Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Nicholas Cicchetti Steven Baderian Michael Hyland John T. Hayes, Jr. Trustees Also Present: William T. Regan, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearing Mayor Treacy stated before continuing the public hearing regarding rescinding the Reclamation Law, we want all members of the public to review the contract and a forum will be held, therefore the Mayor moved to continue this public hearing at the second Board meeting in January 1994, second by Trustee Alter and carried. Approval of Minutes Trustee Hyland moved, second by Trustee Alter to approve the minutes of October 19, 1993 as written, motion carried 6-0. Approval of Warrants Trustee Hyland moved, second by Trustee Jeffers to approve the warrants and authorize the Treasurer to pay the bills, motion carried 6-0. Total of the General Fund is $82,181.37 and the Water Department fund total is $23,795.56. Communications, Petitions & Requests Deputy Clerk read a public hearing notice from the Village of Tarrytown regarding property at 159 Wildey Street for a variance to permit the erection of an 8 ft. fence along the east and north property lines in an area which permits only a 6 ft. fence. Mayor Treacy received a copy of a letter from DOT to Mr. Walbuck regarding the rehabilitation of the pedestrian bridge and making it handicap accessible. They believe that access to Kingsland Point from Palmer Avenue may preclude us from having to make the bridge handicap accessible. Congressman Fish is supporting our efforts in applying for funds for a grant to hire three police officers. We have received acknowledgement that our application submitted to the Bureau of Justice Assistance has been received. The Administrator received correspondence from Gerald Callahan, Secretary of Pocantico Hills Fire District informing us that the Board of Fire Commissioners has concluded that EMS service to 1 �their fire district should be arranged for with our office by directly contacting Supervisor Meehan and the Town of Mt. Pleasant. The Mayor was in receipt of correspondence from Phil Speziale of MEBCO informing us that there will be a minimal increase of 5% in our health insurance premiums in 1994. A letter of praise and thanks for Fire Chief Chulla, Police Chief Brophy and Officer Cappello was received from Mrs. Scarpelletti of Evergreen Way. These three men helped her get into her home when she had locked herself out. Mayor Treacy received correspondence from two residents of Kelbourne Avenue, Scott Engle and Penelope Van Niel requesting that no more parking be made available for the train station and not to widen Riverside Drive. This will be discussed with residents of that area and the Philipse Manor Improvement Association. We have received a check for $10,452.43 from Continental Cable which represents their franchise fee taxes for the quarter ending September 30, 1993. The Mayor received a letter from two exchange students thanking him for his heartful wishes of welcome and the T-shirts they received. Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Hayes to open the public comment section, motion carried. Gus Beirne, GM Plant Manager, addressed the Board stating that General Motors will withdraw its settlement offer made to North Tarrytown unless they rescind the clean-up law tonight; if not General Motors will take the village to court. He then read the list of the original settlement offer which will be withdrawn. Mayor Treacy stated that the Board would not be intimidated by General Motors ultimatum and certainly were not going to rescind the clean-up law tonight; if necessary we would be ready to fight GM in court. He commented that the Board cannot vote until the hearing is closed and there is a legal question of rescinding the local law. We must protect the interest of our community first. , Donal Walsh, Jr., Village Attorney, stated that the SEQRA process must be reviewed and completed as required by the state law before the ordinance can be rescinded. If it is rescinded without the completion of the process, the rescinding is annulled. Trustees Alter commented that it was the consensus of the Board that they were willing to work with GM and nothing has changed; we are just waiting for our legal counsel to review the contract. Trustee Baderian commented that he did not feel GM was being prejudiced and litigation was going to take alot longer than a careful review of the documents. 2 �Trustee Jeffers commented that the contents of GM's letter is not going to help their position and it was counter productive. Tom Wester commented that he felt GM's ultimatum will our position. strengthen Being no further comments, Trustee Alter moved, seconded by Trustee Jeffers to close the public comment section, carried. Mayor's Report Mayor Treacy reported we received good news last week regarding the GM plant staying open until 1996; this will help the merchants and the people who work there. It will also help our water fund revenue since they are our biggest consumer. The Chamber of Commerce will sponsor fireworks on July 3, 1994; they are looking for volunteers to join the committee and there will be a meeting at the Warner Library on November 8th at 7 PM for anyone interested. This past Monday Mayor Treacy and Sergeant Ferguson met with the residents of the Van Tassel in an effort to reduce and prevent crime. The owner of the Van Tassel will be placing surveillance cameras throughout different areas in the Van Tassel, the patrolman's booth in the courtyard will be renovated and our police officers will patrol the courtyard at different times. The Mayor also stated that they will also be meeting with the residents of College Arms and Margotta Courts. Mayor Treacy reported that because of the American Disabilities Act, a survey of the municipal building will be done to see how to make it handicapped accessible; this will be very expensive. Mayor Treacy, Bill Regan and Andres Valdespino attended a meeting regarding the Community Development Block Grant Program. There is a new cycle of grants starting and they will be reviewing different areas of the village for those who would like to apply for monies through the county for improvements to the village. Trustees' Reports Trustee Alter reported this past May County Executive O'Rourke appointed Henry Atterbury to a 4 0 member Urban Youth Council to assess the needs of Westchester's at-risk youth and to develop an initial plan of action for needed programs and services. Because of Henry's input, we are being awarded a $13,000. grant which will help sponsor two dances each month for area high school students and provide homework assistance to 100 youth. Trustee Cicchetti commented that the Police Committee did not have a report. He was unable to attend the CAC meeting last week but a written report will be distributed to the Board members soon. The Clean-Up committee has met but there is no report yet. Trustee Cicchetti reported that the Search Committee has narrowed down their search to eight candidates from 106 and they will be interviewing them starting next week. 3 �Trustee Hyland commented that when Bill Regan was hired, Mayor Martinelli told him "You're getting the best" and he was right, North Tarrytown got the best and now Bronxville will be getting the best. He wished Bill Regan good luck in his new job. Trustee Hayes had no fire report. He commented that the Library is seeking donations and read the letter which they have sent out to all residents. Trustees Jeffers and Baderian had no reports. Mayor Treacy stated that tonight's meeting was Bill Regan's last meeting as he will be leaving to take a job with Bronxville. He read a portion of his resignation letter and presented him with a inscribed plaque in recognition of his administrative effeciency and effectiveness to bolster the Village of North Tarrytown's image and wished him all the best. Administrator's Report Bill Regan thanked the Board for the plaque and commented that the past five years have been a great experience. William Regan reported that: since November 11th is a legal holiday, there will be no recycling on Wednesday and gave the holiday pick-up schedule. He stated our insurance carrier, Gallagher Bassett has reported a significant decrease in losses for the 1992-93 fiscal year. The budget report through September 30th shows a spending of 1% over budget, but the current report through October 3 0th shows we have underspent by 1% or 2%. Resolutions-Attached Old Businesa-None New Business-Nona Publics Comments Trustee Hyland moved, second by Trustee Alter to open the public comment section, motion carried. Mr. Kavicky wanted to know where the franchise money that we received from Continental Cable comes from. He also commented at the corner of Beekman Avenue and Kendall Avenue, the slope of the sidewalk is dangerous. The Mayor responded this is listed on the residents' bills, you pay for the service and Cable pays for the use of our streets. He would have the General Foreman check into the slope of the sidewalk. Mario Belanich commented that he found an old newspaper article of September 1988 which stated that the village passed a resolution whereby the Grand Union would be charged $25. for every shopping cart found on our streets. The Mayor stated that we would check into this since it is not in our code book. A �Mr. Belanich again suggested two public comment sections asked that two meetings not be scheduled for the same night.. Mayor stated that in the past the public comment section got long and took time away from other business. As far as the meetings tonight, the Planning Board held a special meeting Phelps hospital. and The too two for Frank Rizzi commented that he heard the Mayor appointed someone to the Planning Board who is suing the village and wanted to know if he could do this. Mayor Treacy commented that this person is seeking to recoup his medical bills for injuries sustained. Being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section, carried. Trustee Alter commented that Halloween weekend was a great success with the hayride and other activities and thanked all the volunteers. Trustee Hyland moved, second by Trustee Jeffers to adjourn to executive session to discuss litigation, motion carried. Discussion ensued on a litigation matter but no formal action was taken. Being no further business, Trustee Hyland moved, Trustee Alter to adjourn the meeting, motion carried.
