Present: Absent: Mayor Sean Treacy Morris Alter Nicholas Cicchetti Michael Hyland John T. Hayes, Jr. Greg T. Jeffers Steven Baderian Also Present: Trustees Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearings Mayor Treacy read the attached public hearing notice with regard to changing the speed limits on Route 9. Trustee Hyland moved to open the public hearing,second by Trustee Alter and motion carried. Dr. Richard Sweet asked the state's opinion on this change and how the Police Chief felt about enforcing different speed limits along route 9. Trustee Cicchetti commented that the state would not approve too many different speed limits, so we eliminated one. Passing this resolution gives us the authority to apply to the state for the change and the Police Chief has no objections. Being no further comments, Trustee Alter moved, second by Trustee Cicchetti to close the public hearing, motion carried. Mayor Treacy read the attached public hearing notice to consider a proposed local law amending*Chapter 37 "Nuisances". Trustee Hyland moved to open the public hearing,second by Trustee Alter and motion carried. Linda Velano of Grand Union's legal department asked what the Grand Union could do to help with this problem. Mayor Treacy commented that they could hire security to stop people from taking carts off the Grand Union lot, post signs stating that there is a $50. fine for anyone found leaving the carts on our streets and inform the shoppers that folding shopping carts are available for them to purchase. Dr. Sweet asked if the fine was for removal of the carts from the lot or abandonment of carts on the streets. The Mayor commented that our ordinance is for the abandonment of the carts on our streets. 1 �Mario Belanich stated that back in 1988 many suggestions were made to the Grand Union to help solve this problem. Henrietta Brand asked whose responsibility it was for damage to cars by shopping carts left on the streets. She commented that senior citizens need carts to take their groceries home. The Mayor commented if the damage happens on the Grand Union property, they would be responsible, otherwise the person would have to use his own insurance coverage; the seniors can purchase the folding carts to take their groceries home. Frank Rizzi felt anyone caught removing the carts from the lot should be fined. Don Caetano commented that the proposed ordinance was a good one. Mario Belanich commented that since the shopping carts belong to the Grand Union, they should issue summonses to anyone leaving the lot with their carts. Being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section and carried. Approval of Minutes Trustee Hyland moved, second by Trustee Cicchetti to approve the minutes of November 3,1993 with one correction; on page 2, second paragraph from the bottom, the Board did not take a vote, it was the consensus of the Board; with that correction, motion carried 5-0. Approval of Warrants Trustee Hyland moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills, motion carried 5-0. Total amount of the General Fund is $81,109.2 0 and the Water Department total is $5,597.58. Communications, Petitions and Requests Deputy Clerk read a letter from Carol Jones of 253 Hunter Avenue commending the General Foreman and the highway department for the terrific clean-up job they did on Riverside Drive. (Letter placed in personnel file) Deputy Clerk read the Planning Board agenda for November 18th and the Architectural Review Board agenda for November 22nd. Mayor Treacy read correspondence from Barbara Ceconi of the Headless Horseman Monument Committee thanking the village employees who helped make the Haunted Hayride a great success, this helped to raise funds for the monument. The Mayor read correspondence from Friedland Realty, Inc. expressing their interest in the possible purchase of the GM plant and asked for the village's help in arranging a physical inspection of the plant. 2 �Correspondence was read from Joseph Nader, Chairman of the Westchester County Veteran's Advisory Board asking the Board to pass a resolution showing their support for a nursing home for veterans in Westchester County. Mayor Treacy read a letter from Robert Masias requesting the elimination of "No Parking 2PM-5PM Monday through Friday on both sides of Beekman Avenue from Barnhart Avenue to the GM ramp since there are no longer two shifts at General Motors. Public Comments-Agenda Items Trustee Hyland moved to open the public comment section, second by Trustee Alter and motion carried. There being no comments, Trustee Hyland moved, second by Trustee Cicchetti to close the public comment section, motion carried. Mayor's Report Mayor Treacy and Mayor Pi11a met with the Chamber of Commerce and the business people of both towns regarding the parking situation in both villages. Mayor Treacy commented that a local businessman has purchased two houses on Chestnut Street and wants to tear them down for parking spaces. He would lease the lots to the village for permit and metered parking. The Mayor would like to put the site in as part of our application for the Community Development Block grant. Mayor Treacy reported that GM has filed a suit against the village in federal district court. They won't serve us if we revoke the clean-up law by December 8th. We are still working on the contract and will not revoke the law by then. He stated that we are ready to fight GM in court to protect the future of our community. A copy of the contract should be available for the trustees to review next week and then will be made available for the public to comment on. A forum will also be held. The Mayor commented that Donald Stever, environmental attorney who drafted this reclamation law, was able to get his law firm to help us fight GM pro bono. The Mayor commented that the County has a surplus of funds available under the Community Development Block Grant. North Tarrytown is a good client since we always complete our projects. We hope to extend the sidewalk and lighting project from Beekman Avenue down Cortlandt Street to the village line; also down Valley Street from Beekman Avenue. We have applied for the ISTEA grant for the Greenway project and hope the County would come up with a matching grant. We have applied for County funds for the lining of our water lines with concrete. Under the ADA, improvements to sidewalks must be made by dropping curbs so that they are handicap accessible. One problem is that the awards are made in August so we won't be able to start until the Spring of 1995. 3 �The bid for the facade improvements to the Van Tassel eleven storefronts will be awarded by the Chamber of Commerce and the next facade improvement project in January will be five to seven storefronts opposite the Van Tassel. This past Saturday the Mayor attended a very enjoyable family day at the Restoration which was sponsored by the PTA. Trustee's Reports Trustee Alter reported that the Recreation Department will sponsor a dance at the firehouse on Friday, November 2 6th for eighth graders and younger. The Chamber of Commerce has contacted our Recreation Superintendent commenting that they want to be involved in next years hayride and perhaps it could continue for two nights. Trustee Alter reported that he attended a Cable meeting with representatives from Tarrytown and Briarcliff. Continental Cable wants to renew their franchise agreement and presented us with a list of improvements that will take place such as a built in new box, upgrade in service, inter-net communications with all high schools, etc. On Monday, November 29th the Cable committee will meet again. A survey will be mailed to all cable subscribers shortly. Trustee Cicchetti reported that the Search Committee has interviewed eight candidates and have recommended four of them to the Mayor and the Board. A Special meeting was then called for Monday, November 22, 1993 at 7s00 PM for the purpose of interviewing the four candidates. Trustee Hayes commented that he will be unable to attend a Library Board meeting on November 18th but will receive a copy of the minutes and give a report at our next board meeting. As far as the fire department, he would like to discuss their equipment needs at the next work session. The Mayor commented that we are waiting for a third estimate to repair the door at Rescue Hose which was damaged by a fire truck and we are also awaiting estimates to repair the truck. Resolutions- Attached Old Business-None New Business Mayor Treacy appointed Sean McCarthy to the Bureau of Fire Prevention to fill a vacancy on that Board. Trustee Hyland moved to approve this appointment, second by Trustee Alter and carried. Mayor Treacy commented that there was a serious incident at La Terrazza bar on Cortlandt street this past weekend which resulted in the death of a man. There have been many serious crimes at that bar in the past two years and he would like the ABC Board to take their license away and have the bar closed down. 4 �^ Public Comments Trustee Cicchetti moved, second by Trustee Alter to open the public comment section, motion carried. Being no comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section, motion carried. Trustee Hyland moved, second by Trustee Alter to adjourn to executive session, motion carried. Trustee Cicchetti moved, second by Trustee Alter that they did not need to go into executive session therefore they moved that the meeting be adjourned, motion carried. MOVED: Trustee Hyland SECONDED: Trustee Cicchetti VOTE: 5-0 �Meeting Date: 11/16/93 Resolution ##: 11/140/93 WHEREAS, this nation owes a great deal of debt to the men and women who served in the armed forces during times of conflict and war, and WHEREAS, there are more than 1.9 million of these aging veterans in New York State in need of a facility to provide nursing care, and WHEREAS, the Westchester County Veterans' Advisory Board recently collected 11,000 signatures throughout the Mid-Hudson Valley region urging the state delegation to approve the construction of a Veterans' Nursing Home in Montrose, New York, and WHEREAS, Mid-Hudson area is the only section of New York State that is lacking such a facility, and WHEREAS, the V.A. Hospital Montrose, as a site for a State Veterans Home, is geographically in the center of our medical district, is easily accessible to New York City and Long Island, and is a short distance from other medical facilities which could provide major medical and other supportive care, and WHEREAS, more than eleven acres bordered by Route 9 and the Hudson River are currently available for development, and, WHEREAS, the cost of such a facility would be minimal, considering the Federal government would fund 65% of the construction and land acquisition costs, with the State absorbing the remaining 35%, and the Federal government paying a per diem per veteran cost for services through pension and social security allocations. NOW, THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of North Tarrytown supports the efforts of the Westchester County Veterans Advisory Board and urges the State delegation to approve the construction of a Veterans Nursing Home in Montrose, New York. BE IT FURTHER RESOLVED, that the Deputy Village Clerk send a certified copy of this resolution to the State delegation indicating the Village of North Tarrytown's Board of Trustees support for this endeavor.
