Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Nicholas Cicchetti Steven Baderian (Arrived late) Michael Hyland John T. Hayes, Jr. Trustees Also Present: Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Since today is the anniversary of the bombing of Pearl Harbor, he asked that everyone remain standing for a moment of silence for all those who died. Before starting the regular order of business, Mayor Treacy presented Officers Checchi and Hrotko with Certificates of Service for their dramatic rescue last week of six people found unconscious in an apartment due to carbon monoxide fumes. He also presented them with Certificates of Appreciation from the Westchester County Board of Legislators. Certificates of Appreciation are also to be given to Officers Lombardi and Bizzarro for their quick response to an emergency call. Public Hearings Mayor Treacy read the attached public hearing notice regarding amending Chapter 59, Section 59-12 "Water". Trustee Hyland moved, second by Trustee Alter to open the public hearing, motion carried. Mario Belanich asked for an explanation of the cross connection. Mayor Treacy explained that it is a plumbing connection that will prevent any sort of hazardous material from backflowing into your water system. This hearing is to amend our local law by adding penalties for non-conformance. Being no further comments, Trustee Hyland moved, second by Trustee Hayes to close the public hearing, motion carried. Mayor Treacy read the attached public hearing notice regarding the consideration of the adoption of legislation requiring the installation of window guards in buildings with four or more rental units. He commented that an owner of a building must install these window guards if requested by a tenant. When a tenant signs a lease, the landlord must inform them that they can request window guards if they wish. Trustee Hyland moved, second by Trustee Alter to open the public hearing, motion carried. There being no public comments, Trustee Hyland moved, second by Trustee Alter to close the public hearing, motion carried. 1 �Approval of Minutes Trustee Hyland moved, second by Trustee Cicchetti to approve the minutes of November 16, 1993 as written, motion carried 5-0 with Trustee Jeffers abstaining. Trustee Hyland moved, second by Trustee Alter to approve the minutes of the November 23rd work session, motion carried 6-0. Approval of Warrants Trustee Hyland moved, second by Trustee Cicchetti to approve the warrants and authorize the Treasurer to pay the bills, motion carried 6-0. Total of the General Fund is $105,634.44 and the Water Department Fund total $16,200.57. Communications, Petitions and Requests Deputy Clerk read attached correspondence from the Fire Council regarding the action that took place at their November 9th meeting. Trustee Hyland moved, second by Trustee Jeffers to approve these actions and motion carried 6-0. Deputy Clerk read the agenda for the Bureau of Fire Prevention to be held on December 13, 1993 at 8 PM. Mayor Treacy read memorandum from David Stolman, Executive Vice President of Frederick P. Clark Associates, Inc. providing us with a status report regarding the moratorium, planning and zoning amendments and environmental assessment regarding the C-l highway commercial district. He read the resolution on the agenda with regard to extending the moratorium for thirty days. Mayor Treacy was in receipt of a letter from Patrick Munroe of the Neighborhood Association of Webber Park requesting permission for the association to use one or two of the fire-company meeting rooms on the second floor for their Christmas party on Sunday, December 12, 1993 from 4 PM-7 PM and the Mayor and Board were invited. The consensus of the Board was to grant them permission. The Mayor was in receipt of a copy of a memo to Chief' Brophy from Sgt. Caixeiro commending Officer Corona for his outstanding work during a recent drug investigation.(Memo placed in his file) Mayor Treacy read a letter addressed to Chief Brophy from Daniel Matra thanking Officers Lombard! and Bizzarro for their quick response to his call when he found his uncle dead in his room. They helped them get through a very stressful time.( Letters placed in their files) The Mayor read a copy of a letter to the Editor of the Daily News from Katherine Camillieri expressing her sincere gratitude to the Volunteer Ambulance Corp. and the Police Department for their quick response to an emergency at her home and felt they should be recognized for a job well done. Mayor Treacy was in receipt of a letter from Larry Rodrigues requesting permission to light the village trees in front of the Sleepy Hollow Plaza on Valley Street with his lights from 2 �^J?5jJ December 15 to January 15, 1994. The Mayor commented that there is no extra cost to the village for power and asked that the Board consider allowing him to do so. Mayor Treacy has written a letter to Governor Cuomo opposing any and all efforts by the State to store the state's radioactive waste at Indian Point. Public Comments- Agenda Items Trustee Hyland moved to open the public comment section, second by Trustee Cicchetti and motion carried. Mario Belanich commented that with regard to the letter the Mayor wrote to Governor Cuomo, he felt that the whole Board should have written this letter. There being no further comments from the public, Trustee Hyland moved, second by Trustee Alter to close the public comment section, motion carried. Mayor's Report Mayor Treacy reported that with regard to the UDC grant, the storefronts at the Van Tassel should be completed by Christmas and hopefully in January storefronts across the street should be starting. The Mayor commented that with regard to General Motors, they should be filing suit against the village tomorrow since we did not rescind the reclamation law. The draft of the GM contract needs to be refined and should be ready in a couple of weeks. The Mayor commented that in our search for a new Administrator, it has been narrowed down to two candidates. Hopefully by our next board meeting, we will have made our choice. Mayor Treacy showed the audience the new recycling bins which are being distributed to different parts of the village. By using these bins for your recyclables, the village saves on tipping fees because of less garbage. We have created a CAT program (Combat Auto Theft) whereby a CAT sticker is affixed to the left rear window of your car. You can be stopped by a police officer to check your registration, therefore anyone trying to steal your car would hesitate if they saw this sticker on your car. This program has been very successful in New York City. Anyone interested should contact Detective Jim Reddy for further information. The Mayor warned all residents to beware of flim flam con artists who seem to around during this time of the year. The Mayor commented that he met with DOT representatives and the contractor with regard to the work done on route 448. There have been numerous complaints from residents of that area regarding the height of the sidewalks and other complaints. DOT will make sure that the contractor levels the sidewalks. 3 �Trustee Hayes asked if they will be remarking the lane making it clear that it is a drive lane; the Mayor responded yes. The Mayor commented that perhaps by the first meeting in January the public hearing on the proposed changes for the C-l commercial district will continue. The new playgrounds at Devries park and Douglas park are ready, finishing touches such as landscaping will take place in the Spring. Trustee Reports Trustees Jeffers, Baderian, Hyland and Hayes had no reports. Trustee Alter reported that the Recreation department will start receiving the youth grant money of $13,000. starting in January at $2000. a month. This money will be used for after school activities such as dances, etc. He read a list of ski trips and other trips that will be taking place in the next few months. For further information anyone can call the recreation department. Trustee Alter attended a cable meeting last week regarding the franchise agreement renewal issues. On January 5th he will meet with the NYS Commission regarding the franchise agreement renewal. A questionnaire was mailed to 350 cable subscribers and we have received about a 20% return so far. Trustee Cicchetti commented that our monthly police report shows the numerous calls that our officers respond to during a month. Not only do they protect our citizens but they provide a great service to the citizens of this village as shown by the letters read tonight. He commented that we appreciate the wide role they play in this village. Resolutions-Attached Old Business Trustee Alter commented that since the scenic district will be costing more than originally thought, he would like to seek private aid. (Will be discussed at work session) Mayor Treacy commented that it will not be necessary to hold a public hearing scheduled for December 21st for the removal of no parking signs at the lower end of Beekman Avenue since after checking the code book, an ordinance was never adopted. New Business The Mayor commented that it will be necessary to go into executive session to discuss personnel, litigation and the status of a paper street on Bedford Road. Public Comments Mr. Belanich asked about the ordinance recently adopted regarding public telephones. The Mayor stated that the Board enacted legislation that would prevent telephones on posts from being erected; those attached to buildings is a little more difficult 4 �-?JT* I to do. The real concern is the drug activity associated with these phones. He stated that we cannot remove all of them, but the telephone company has stopped incoming calls to public telephones. Mr. Belanich wanted to know if the rumor that Dobbs Ferry Hospital was carting their garbage to Phelps was true and about the incinerator at College Arms. The Mayor responded that Keith Saf ian stated that it was not true and the College Arms building is waiting for HUD funding to replace the incinerator at College Arms with a compactor. He asked if the fine for leaving shopping carts on the street had been passed; the Mayor responded yes. I He asked if a notice could be published in the newspaper regarding the suspension of alternate side parking when there is a holiday. Mr. Belanich objected to the Mayor's comment in the newspaper regarding GM commenting that they were the deadbeat of America instead of the heartbeat; he felt it was not fair. The Mayor stated that he felt his comment was true. Being no further comments, Trustee Hyland moved, second by Trustee Hayes to close the public comment section;motion carried. Executive Session Trustee Alter moved, second by Trustee Cicchetti to move into executive session to discuss personnel and litigation. Discussion ensued regarding the possible sale of the paper street on Bedford Road to two homeowners in that area. Discussion ensued insurance plan. regarding four employees and our health Discussion ensued on the proposed contract with GM where they reviewed the contract, but no formal action was taken.
