Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Nicholas Cicchetti Michael Hyland John T. Hayes, Jr. Trustees Absent: Trustee Steven Baderian Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag and wished everyone a Happy New Year. Public Hearing Mayor Treacy stated that the public hearing on the agenda regarding the route 9 commercial district will be adjourned to the February 1, 1994 meeting so that we can add additional amendments to the proposal and notify the public adequately with these additional amendments so they can ask specific questions. Trustee Trustee adjourn Trustee Cicchetti moved to open the public hearing, second by Hayes and motion carried. Trustee Cicchetti then moved to the public hearing until February 1, 1994, second by Alter and motion carried. Dr. Richard Sweet asked if he could make some suggestions to the existing documents by formalizing them in writing. The Mayor commented that Dr. Sweet could present these to the Board at the next work session and he would read his suggestions into the record at the public hearing. Trustee Cicchetti moved, second by Trustee Hyland to close the public hearing, motion carried. Approval of Minutes Trustee Hyland moved, second by Trustee Alter to approve the minutes of the December 21, 1993 meeting, motion carried 5-0. Approval of Warrants Trustee Hyland moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills, motion carried 5-0. The total of the General fund is $231,254.23 and the Water Department fund total is $2586.84. Communications, Petitions and Requests Mayor Treacy was in receipt of a copy of a letter addressed to Chief Brophy from Sgt. Hayward commending Police Officer Frank Hrotko for saving the life of an infant who was choking by calming the mother and instructing her on the telephone on what to do. (Copy of letter placed in his personnel file) 1 �tf Mayor Treacy read a letter from Berger, Lehman Associates, Consulting Engineers to the construction corporation on the 44 8 project concerning specific safety items of concern that must be addressed immediately. Our Village Attorney has sent: a letter to Continental Cable informing them that they must remove the cable pole as soon as possible since it presents a hazard. Mayor Treacy was in receipt of a copy of a letter addressed to Chief Brophy from the Division of Criminal Justice Services expressing their appreciation for the assistance the police department provided to the agency while they were conducting the DARE Instructor Seminar from November 29-December 10, 1993. He also commended Sergeant Ferguson for his exceptional performance. (Letter placed in Sergeant Ferguson's file) The Mayor read correspondence addressed to Chief Brophy from the Office of the District Attorney thanking the police department for their assistance in the case of the People v. Ann Franklin by supplying them with needed equipment. (Letter placed in Chief Brophy's file) Mayor Treacy read correspondence from Thomas Constantine, Superintendent, NYS Police thanking the Mayor for his kind letter which commended the efforts of the Community Narcotics Enforcement Team, Hudson Valley for the assistance provided in the Village of North Tarrytown. The Mayor and Board of Trustees received a letter from Erin Gathrid of Hunter Avenue thanking the General Foreman and his crew for their quick response to his request to have speed bumps installed to block the rain run-off into his driveway.(Letter placed in Joe DeFeo's file) Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Alter to open the public comment section, motion carried. There being no public comments, Trustee Hyland moved, second by Trustee Jeffers to close the public comment section, motion carried. Mayor's Report The Mayor reported that as a result of a public hearing that was held regarding the speed limit on route 9, the Board passed a resolution to change the speed limit on route 9. We have been in touch with DOT and have met with Senator Oppenheimer's Head of Staff to discuss this change. Senator Oppenheimer will contact DOT on our behalf stating the danger that the current speed limit poses. Our Administrator, Linda David, suggested that arrows be painted for turns into the Manors. With regard to the Urban Development Corporation, the Van Tassel storefront facade improvement is now completed at no cost to the Village. We are hoping that five more stores on the south side of Beekman Avenue will be done next month. The property owner pays less than 40% of the cost and the rest is from the state grant. The Mayor stated there is a resolution on the agenda requesting the ABC Board to revoke all liquor licenses held by La Terraza bar for the purpose of closing it permanently due to the incident 2 �-?7£ that occurred recently when a man died. There have been numerous complaints about this bar. Resolution # 01-06-94 was unanimously passed. Trustee Reports Trustee Jeffers commented that it is not only the bars where these types of incidents happen but other places also. He referred to an incident that occurred on Christmas Eve at the Grand Union parking lot when two men were beaten up by a group of youths. He hoped that our detectives will work closely with the detectives in Tarrytown to find out who is responsible. Mayor Treacy commented that our detectives do work closely on all matters with the detectives from Tarrytown. Trustee Alter reported that we have received about a 22% response to our cable questionnaire. He will be reviewing the responses and make a report shortly. There will be a Cable Commission meeting Wednesday night at 7 PM in Briarcliff. Trustee Alter commented that he has received information from Bob Toole regarding the scenic road on route 9 and would like to discuss this at the next work session. Mayor Treacy commented that he would like to discuss the cable rate regulation at the next work session. Trustee Cicchetti reported there will be a CAC meeting on Wednesday at 8 PM. They will review the report from Frederick P. Clark Associates on the commercial district planning and zoning study which goes back several years. The CAC is in the process of studying a recommendation put together by Jeff Beach which deals mostly with the General Motors property. Trustees Hyland had no report but wanted to discuss at the next work session, legislation regarding banning adult entertainment. Mayor Treacy stated that this will definitely be on the agenda. Trustee Hayes had no report. Administrator's Report Mayor Treacy welcomed our new Administrator, Linda David. Linda David reported that she and Joe DeFeo, General Foreman are working together on OSHA grant for new safety equipment and safety procedures. This is due by January 7th. Linda David read the agenda for the Zoning Board to be held on January 19th, the Planning Board agenda for January 20th and the Bureau of Fire Prevention Board agenda for February 7th. The ARB will be held on January 26th but there was no agenda as yet. Resolutions-Attached OLd Business-Nona Mew Business-None 3 �Public Comments Trustee Hayes moved to open the public comment section, second by Trustee Alter and motion carried. Dr. Richard Sweet wanted to know the status of the GM contract and whether it was available to the public yet. Mayor Treacy commented that the proposed contract is now a legal document and he must discuss his request with the attorney, Stephen Kass. The contract has been given to GM and if the Judge orders that we accept it, we will be bound by it. Dr. Sweet wanted to know if there were any provisions or protections in the contract, should GM renege on the contract. The Mayor responded there are a number of legal protections for the village in the contract. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section, carried. Executive Session Trustee Alter moved, second by Trustee Cicchetti to go into executive session to discuss personnel, motion carried. Discussion ensued on the abuse of sick time by certain employees in the Department of Public Works. The consensus of the Board was to start disciplinary proceedings on a public works employee who has continually abused his sick time. Discussion ensued on the abuse of sick time in the Police Department and possible ways to correct this, but no formal action was taken. There being no further business, Trustee Hayes moved to go back to regular session, second by Trustee Jeffers and carried. Trustee Cicchetti moved, second by Trustee Alter to adjourn the meeting, motion carried. No portion of the property used for a gasoline service station shall lie within four hundred (400) feet in a straight line from any lot or parcel that is used for a public or private school, a public library, a museum, a civic center, a hospital, a church or other place of worship, a public park or playground, a fire station or another gasoline service station." "Section 62-20.A Location. No portion of the property used for the sale of new or used automobiles shall lie within four hundred (400) feet in a straight line from any lot or parcel that is used for a public or private school, a public library, a museum, a civic center, a hospital, a church or other place of worship, a public park or playground, a fire station or another establishment for the sale of new or used automobiles." �A new section 62-20.2 would be added and would read as follows: "Section 62-20.2 Auto-body repair shops. Location. No portion of the property used for an autobody repair shop shall lie within four hundred (400) feet in a straight line from any lot or parcel that is used for a public or private school, a public library, a museum, a civic center, a hospital, a church or other place of worship, a public park or playground, a fire station or another auto-body repair shop." a. A new section 62-20.3 would be added and would read as follows: "Section 62-20.3 Mixed use (commercial and residential) developments. Dwelling units may be permitted on the upper (non-first story) levels of building in accordance with the following conditions: A. Mixed use developments shall only be permitted in buildings which conform to the New York State Uniform Fire Prevention and Building Code for the proposed mixed use. B. The non-residential use of a mixed use building must be a permitted principal use in the zoning district in which it is located. C. The non-residential use of a mixed use building shall be limited to the first story level. D. The residential and non-residential uses of the mixed use building shall have separate means of access (that is, the entrance/exit for the residential use of the building and vice versa), except that the Planning Board may, at its discretion, approve the use of a common lobby or plaza. E. All utility, storage, service and parking areas on the site of the mixed use building shall be screened by means of landscaping and/or fencing to the extent deemed necessary and practical by the planning board to minimize the impact of these areas upon the residential use of the building. F. "Mixed use developments shall not be permitted where the non-residential use of the building includes manufacturing or whnre the non-residential use is automotive in nature." �• b. The following new definition would be added in its proper alphabetical order to Section 62-4, Definitions: "MIXED USE (COMMERCIAL AND RESIDENTIAL) DEVELOPMENT - A building which has non-residential use of the first story level and residential use of the floor or floors above.M a. The Use column pertaining to the C-l District under the heading Maximum Lot Coverage in the Schedule of Regulations, Part II pertaining to Section 62-8.B would be amended to read as follows: "Commercial use or mixed use (commercial and residential) development on a single lot Planned development group" b.
