Mr. DaSilva stated that he does have a two family home. The town
records show that it is assessed at 162,000.
The home was
purchased in November of 1992 for $100,000. Mr. DaSilva also
stated that he had an appraisal completed in August of 1992, the
value was 116,000.
Mayor Treacy advised Mr. DaSilva to attached all the information
to the grievance form and the Assessor will review
all
materials.
IN THE MATTER OP JOSE AND VICTORIA UNGLO, 22 AMOS STREET, NORTH
TARRYTOWN. NEW YORK (Section 17 Block 7 Lot 10.B)
Mrs. Unglo stated that the land value is $57,000. and the total
value is $165,000. Mrs. Unglo stated that the land area is small
only.14 acres. The neighboring areas are assessed much lower.
Both the land and the house was purchased at $290,000.
Mayor Treacy stated that the assessor will review her grievance
and contact her when a decision has been made.

A Regular meeting of the Board of Trustees of the Village of
North Tarrytown was held on Tuesday, February 15, 1994 at 8 PM.

Mayor Treacy called the meeting to order with a pledge to the
flag.
Before starting the regular order of business, Mayor Treacy
stated that he received a letter of resignation from Trustee
Baderian due to a job commitment in California.
The Mayor
accepted his resignation with regrets and appointed David Maloy
as Trustee to fill the unexpired term of Steven Baderian.
Linda David, Village Administrator/Clerk administered the oath of
office to Trustee Maloy.
Public Hearings-None
Approval of Minutes
Trustee Hyland moved, second by Trustee Cicchetti to approve the
minutes of February 1, 1994 as written, motion carried 4-0 with
Trustee Maloy abstaining.
Approval of warrants
Trustee Hyland moved, second by Trustee Hayes to approve the
warrants and authorize the Treasurer to pay the bills; motion
carried 4-0 with Trustee Maloy abstaining. Total of the General
Fund is $48,793.97 and the Water Fund total is $8,681.72.
Communications, Petitions and Requests
Mayor Treacy received a request from the Reverend of the Korean
Church that M No Parking" signs be posted at both sides of the
stairways in front of their church on Broadway. The Board will
discuss this at the next work session and also discuss it with
the Police Chief and General Foreman.
The Mayor received correspondence from the National American
Jewish Committee, Archdiose of New York, Conference of Christians
and Jews inviting the Mayor and Board to a ceremony on February
19th. Trustee Alter will attend.

An invitation was received from WFAS AM/FM to join them in the
First Annual Choral Competition and Concert on March 9th at the
Westchester County Community Center. Mayor Treacy will attend.
Correspondence from the Victim's Assistance Services was received
informing us that they are applying for Community Development
Block Grant funds and that they are available to make a
presentation to the Board outlining what their services entail.
The Mayor has given this information to the Police Chief.
The Mayor received correspondence from the Sleepy Hollow Chamber
of Commerce regarding the fireworks display to be held on July 3,
1994.
They are requesting each village reserve $2000. in their
budget this year for this occasion and that each village issue a
proclamation making the week of May 1st. Independence Day
Fireworks Fund Raising Week.
The New Hope Institute Baptist} Church has invited the Mayor and
Board to a Black History Program on February 2 0th at 4 PM at the
Community Opportunity Center.
The Attorney General has invited the Mayor and Board to the grand
opening of his new office at 19 Court Street in White Plains on
February 22, 1994 from 8:30 AM to 10 AM. The Mayor will attend.
Public Comments-Agenda Items
Trustee Hyland moved, second by Trustee Alter to open the public
comments section, motion carried.
Dr. Richard Sweet of N. Washington Street read a memo he wrote to
the Board regarding the proposed zoning changes. He stated that
he is aware of the need for changes but felt certain zoning
changes are not fair to those businesses already in existence and
he requested that certain things not be added. (Memo attached)
There being no further comments, Trustee Hyland moved, second by
Trustee Hayes to close the public comment section, carried.
Mayor's Report
Mayor Treacy commented that LaTerazza's license has been
suspended. This bar has been a constant source of major problems.
A hearing will be held on February 22nd.
The Mayor reported progress on the greenway application;
ISTEA representative was impressed with our aggressiveness.

Mayor Treacy reported that we are working together with
surrounding villages to create a regional tourist consortium to
attract tourists and promote the area. The tentative name is
"Historic River Towns of Westchester". We are also working very
closely with Historic Hudson Valley representatives.
The Mayor thanked the Public Works department for the great job
they did during the recent snowstorms.

Trustee Reports
Trustee Alter commented that he attended a cable meeting on
February 14th with Tarrytown and Briarcliff regarding the
franchise agreement. Possibly by May or June, we should be ready
to go to agreement with the Cable Company.
Trustee Cicchetti reported that our January expenditure report
showed that we are right on target.
Trustee Hyland had no report.
Trustee Hayes reported that there will be a George Washington
Birthday dinner at the Reformed Church on the 2 3rd of February.
This is the 91st year. There will be a speaker and reservations
can be made by calling the church office at 631-4497.
He commented that he will be attending the Library meeting on
Thursday.
Administrator's Report
Linda David reported that due to all the snow we have had, we
will need to make more budget transfers for personnel and
supplies at the next board meeting.
She reported that the highway department crews are in the process
of moving piles of snow and she commended Joe DeFeo and the
public works department for a job well done.
The Planning Board meeting for February 17th has been canceled
and she read the Zoning Board agenda for February 16th.
Resolutions-Attached
Mayor Treacy read a proclamation declaring March Black History
Month.
Trustee Hyland moved, second by Trustee Alter approve
this proclamation, motion carried 5-0.
Old Business
Mayor Treacy appointed Al Passariello to the North Tarrytown
Housing Authority to fill the unexpired term of Reverend Ronald
Grant who has moved from North Tarrytown.
New Business
Mayor Treacy commented that a work session will be held on
Wednesday, March 9th instead of March 8th due to the fact that
the candidates will hold a debate on that date.
The regular Board meeting will be held on Wednesday March 16th
instead of Tuesday, March 15th which is Election Day.
Trustee Hyland moved, second by Trustee Cicchetti to call for
three public hearings on March 16th; one for a proposed change in
the alarm ordinance, proposal of an adult entertainment ordinance
and the proposed adoption of an anti-graffiti ordinance.

Trustee Hyland moved, second by Trustee Alter to open the public
comment section, motion carried.
Martin Kavicky of Howard Street asked if there was a "No Parking"
ordinance when it snows.
Mayor Treacy commented that certain streets are designated as
snow emergency streets when a snow emergency is declared.
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the public comment section, carried.
There being no further business, Trustee Hyland moved, second by
Trustee Alter to adjourn the meeting, motion carried.

�MEMO. VILLAGE BOARD MEETING
FEB. 15*94
RESOLUTION FOR ZONING CHANGE ON ROUTE 9 CORRIDOR IN NORTH TARRYTOWN.
There has long been a need to improve and enhance the zoning within the Village of North
Tarrytown. As a member of the Zoning Change Committee in the past and as present chair of
the Conservation Advisory Council whose present efforts are to put into place a Local
Waterfront Revitalization Program and as a member of the Tree Commission overseeing certain
aspects of residental development operations within the village I am well aware of the need to
upgrade ans improve the appearance of the village and its environs. The Broadway or Route 9
corridor is an important feature of our village and hopefully in the future will become an attraction
to visitors and residents alike. I believe that with time the nature and character of the area will
change. However, I do not believe that the zoning changes as written are necessary and fair to
existing businesses and that there is a distinct possibility that the language as presented is
excessively limiting and slanted.
The seven day limitation and the five unit restriction may well prove a hardship on customer and
provider alike. Indeed the need to invoke a restrictive time and quantity limitation is
unnecessary and may well prove to be restrictive of business practices. To put it another way, it
may not "enhance the business in the community" as set forth in your Resolution #: 02-25-94.
Furthermore to term "outdoor storage" is ambiguous and seemingly confusing. Does this mean
from areas as viewed from Route 9 or in the total land area of a particular business operation?
This could well be considered as confiscatory action (particularity if GM can so construe certain
aspects of the Village's Industrial Abandonment Law)
I urge you and respectfully plead that you, Mr Mayor and the Board of Trustees, remove the
quantity and time limitations as presented in the proposed resolution or else liberalize them
beyond thier present limits.

the outdoor storage of more than five (5) partially
dismantled or significantly damaged vehicles at any one
time or the outdoor storage of any partially dismantled
or significantly damaged vehicle for more than seven (7)
days."
"GASOLINE SERVICE STATION — Any area of land, including
structures therepn, that is used for the sale of gasoline
or any other motor vehicle fuel and oil and other
lubricating substances, including any sale of motor
vehicle accessories, and which may or may not include

�accessory facilities for lubricating, washing or
otherwise servicing motor vehicles, but not including the
painting thereof by any means. Gasoline service station
shall not include drive-through or automated car washing
and shall not include hand washing or detailing where
such is a principal use of the premises. This use shall
also not include auto wrecking or auto recovery services
and shall not involve the outdoor storage of more than
five (5) partially dismantled or significantly damaged
vehicles at any one time or the outdoor storage of any
partially dismantled or significantly damaged vehicle for
more than seven (7) days."
"MOTOR VEHICLE REPAIR SHOP — A building, or portion of
a building, arranged, intended or designed to be used for
making repairs to motor vehicles. Motor vehicle repair
shop shall not include hand washing or detailing where
such is a principal use of the premises. This use shall
also not include auto wrecking or auto recovery services
and shall not involve the outdoor storage of more than
five (5) partially dismantled or significantly damaged
vehicles at any one time or the outdoor'storage of any
partially dismantled or significantly damaged vehicle for
more than seven (7) days."
The Permitted Accessory Uses column pertaining to the C-l
District in the Schedule of Regulations. Part II
pertaining to Section 62-8.B shall be amended to read as
follows:

Sections 62-19.A and 62-20.A shall be amended to read as
follows:

a museum, a civic center, a hospital, a church or other

sale of new or used automobiles shall lie within four
hundred (400) feet in a straight line from any lot or
parcel that is used for a public or private school, a

A new Section 62-20.2 shall be added and shall read as
follows:
"§ 62-20.2 Motor vehicle repair shop.
Location. No portion of the property used for a motor
vehicle repair shop shall lie within four hundred (400)
feet in a straight line from any lot or parcel that is
used for a public or private school, a public library, a
museum, a civic center, a hospital, a church or other
place of worship, a public park or playground, a fire
station or another motor vehicle repair shop."
A new Section 62-20.3 shall be added and shall read as
follows:
"§ 62-20.3

Mixed use (commercial and residential)
developments.
Dwelling units may be permitted on the upper (non-first
story) levels of buildings in accordance with the
following conditions:
A.

Mixed use developments shall only be permitted in
buildings which' conform to the New York State
Uniform Fire Prevention and Building Code for the
proposed mixed use.

B.

The non-residential use of a mixed use building
must be a permitted principal use in the zoning
district in which it is located.

C.

The non-residential use of a mixed use building
shall be limited to the first story level.

D.

The residential and non-residential uses of the
mixed use building shall have separate means of
access (that is, the entrance/exit for the
residential use shall not be through the nonresidential use of the building and vice versa),
except that the Planning Board may, at its
discretion, approve the use of a common lobby or
- plaza.

E.

All utility, storage, service and parking areas on
the site of the mixed use building shall be
screened by means of landscaping and/or fencing to
the extent deemed necessary and practical by the

�Planning Board to minimize the impact ^ of these
areas upon the residential use of the building.
F.

9.

Mixed use developments shall not be permitted where
the non-residential use of the building includes
manuifacturing or where the non-residential use is
automotive in nature."

The following new definition shall be added in its proper
alphabetical order to Section 62-4, Definitions:
"MIXED USE (COMMERCIAL AND RESIDENTIAL) DEVELOPMENT — A
building which has non-residential use of the first story
level and residential use of the floor or floors above."

New York for the exclusive privilege of twoing all vehicles whose
need for towing has been dispatched by the Village of North
Tarrytown Police Department.
