Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter David J. Maloy Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Absent: Trustee Nicholas Cicchetti Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearings-None Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of the February 15, 1994 meeting as written, motion carried 5-0. Trustee Alter moved, second by Trustee Hayes to approve the February 15, 1994 Grievance Day minutes as written, motion carried 5-0. Approval of Warrants Trustee Hyland moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills, motion carried 6-0. Total of the General Fund is $138,314.36 and the Water Department fund total is $14,301.74. Communications,Petitions & Requests Deputy Clerk read attached correspondence from the Fire Wardens regarding action taken at their February 8th meeting; Trustee Hyland moved to approve this action, second by Trustee Alter and motion carried 5-0. Deputy Clerk read correspondence from Sushi Raku informing the Village of their intent to renew their liquor license. The Mayor commented that there is no problem with them renewing their liquor license since they have not had any problems with them. Mayor Treacy received correspondence from Carol Jones thanking the Board for having the owner of a building remove the graffiti from the outside of his building. The Mayor read a letter from the Westchester Land Trust asking if the Village would be interested in establishing community gardens in the Village by joining our new garden program. The Mayor read correspondence from the Hudson River Improvement Fund regarding engineering and environmental studies for the waterfront park. 1 �A letter was received from the Friends of the Old Dutch Burying Ground requesting that the Village replace the trees along route 9 on the road next to the Old Dutch Burying Ground. Mayor Treacy met with engineers of DOT last week and there are a series of plans for tree planting on Bedford Road. Approximately twenty trees will be left over and we will plant some for the Church. The Mayor has received correspondence from Gallagher Bassett regarding a safety visit of February 3rd and they thanked Joe DeFeo and commended the Village for their participation. Correspondence was received from the Sleepy Hollow Manor Association commending the efforts of all those involved in the snow removal in our Village during the worst winter in a long time and they sent their heartfelt thanks and appreciation. Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Alter to open the public comment section, motion carried. Mario Belanich questioned the hours for voting in resolution #03-26-94. The Mayor responded that the polls must be open at least from noon to 9 AM, but in North Tarrytown they are open from 7 AM-9PM. There being no further comments, Trustee Hyland moved, second by Trustee Jeffers to close the public comment section, carried. Mayor's Report Mayor Treacy reported that he has filed a protest with City Cable Commission regarding our cable rates on behalf cable subscribers hoping this will help to have our reduced. The Mayor attended a very enjoyable Black History celebration this past weekend at the Community Opportunity where they listened to very interesting speakers. the NY of all rates Month Center On February 22nd LaTerraza bar was scheduled for a hearing to enter a plea; they did not do so, therefore they have ten more days to do so or their license will be revoked. Mayor Treacy commented he met with Mayors and representatives of surrounding communities to create a regional tourist consortium to promote tourism in our villages. The tentative name for the group is "Historic River Towns of Westchester", The opening of Kykuit will help bring in tourism. The Mayor commented that on March 16, 1994 there will be three public hearings; one to stiffen the alarm ordinance, create a new graffiti ordinance and an adult entertainment ordinance to protect our village in light of many of the surrounding bars that are starting to bring in topless dancers, etc. With GM soon closing, our local bars may want to do the same. 2 �Trustee Reports Trustees Jeffers and Maloy had no reports. Trustee Alter reported that as of March 1, 1994, stereo hookup to cable ends, another cable meeting will be held in about one or two weeks and hopefully we will have an agreement signed by May or June. Trustee Alter would like to meet with the consultant scenic road at our next work session. on the Trustee Hyland reported on the infrastructure in the village and listed all the improvements that need to be made such as sewer, water, lighting, etc. Trustee Hayes reported that the Library Board met on February 17th regarding their 1993-94 budget. There is a shortfall of $40,000. and they are asking the two villages to make up the shortfall. Trustee Hayes would like to discuss the possible purchase of a new fire truck at the next work session. Administrator's Report Linda David reported that we have received a huge delivery of salt with the help of Assemblyman Brodsky; this will help greatly with the upcoming snow. We have overspent our budget in materials, supplies and overtime so we must transfer more money. The Planning Board will meet on March 17th, Zoning Board and Architectural Review Board will meet on March 2 3rd, but there are no agendas as yet. Resolutions-Attached Old Business Mayor Treacy commented that the situation with GM is still ongoing and that the first preliminary hearing was held today before the US District Judge Vincent Broderick. Assemblyman Brodsky is willing to help us in any way he can with this lawsuit. Mayor Treacy asked that a motion be made to call for a public hearing on April 5th regarding the Korean Church's request for no parking in front of their church during the hours of church services and for the removal of two handicap parking spaces in front of the church; Trustee Hyland moved, second by Trustee Alter and motion carried. New Business-None Public Comments Mr. John Gaydos of 25 Bedford Road addressed the Board with a request for a handicap parking space in front of his home because of his many handicaps. The Mayor commented that they will discuss this request at the work session. 3 �Mario Belanich suggested that when the tree planting takes place, they try not to plant trees where the Con Ed wires are. He suggested that when it comes time for committee appointments, the Mayor evenly distribute the appointments. The Mayor commented that he has done so in the past. He also asked if people must be notified everytime it snows with regard to the removal of snow in front of their homes. The Mayor responded that we only notify them once a year. Frank Occhipinti asked how much money the Village spent on the Hyland lawsuit. The Mayor responded we are currently paying $110. per hour to our previous attorney. Don Caetano asked that a financial report be given on all the departments. The Mayor commented that the Board is given a monthly expenditure report by the Treasurer. Joseph Plick of Amos Street commended the highway department on an excellent job during all the snow storms and felt that they deserved recognition for this. Don Caetano commented that summonses were issued recently at the Eagles and wanted to know for what types of machines. Mayor Treacy devices. commented that they were unlicensed amusement Trustee Hyland commented that these were video machines that kids use and it is the vendors responsibility to take out a permit. Mr. Plick, a member of the Eagles, commented that these were four video game machines and not gambling machines. There being no further comments, Trustee Jeffers moved, second by Trustee Maloy to close the public comment section, carried. Executive Session Trustee Alter moved, second by Trustee executive session , motion carried. Discussion ensued on Maloy to adjourn to training programs for all departments. Back in regular session, attached resolution #03-28-94 was then passed. There being no further business, Trustee Maloy moved, second by Trustee Jeffers to adjourn the meeting, motion carried.
