Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Nicholas Cicchetti David Maloy Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Mayor Treacy stated that the first order of business was for the Board to certify the results of the annual village election which was held on March 15, 1994. Trustee Cicchetti moved, second by Trustee Alter to accept the results, motion carried 6-0. (Part of official minutes). Public Hearings Mayor Treacy read the attached public hearing notice and the proposed local law entitled "Graffiti". Trustee Hyland moved, second by Trustee Hayes to open the public hearing, motion carried. Mario Belanich asked if prohibiting the sale of certain markers was only limited to our village since anyone could go to another town to purchase them. He suggested we ask Tarrytown to adopt a similar ordinance. Mayor Treacy commented that this ordinance bans sales only in our village but Tarrytown usually follows us in adopting laws of this nature. Urs Broderick Furrer asked if there were any alternatives to the stiff fines such as community service,since these fines would present a hardship to the young people. Mayor Treacy stated that the penalty imposed is up to the Judge. Trustee Hayes asked how it would be determined whether the tip on the marker was 1/2" and 1". Donal Walsh, Jr. stated that the size is usually printed on the markers. There being no further comments, Trustee Hyland moved to close the hearing, second by Trustee Alter and carried. Attached Resolution #03-37-94 was then passed. 1 �Mayor Treacy read the attached public hearing notice and certain portions of a proposed local law entitled "Adult Entertainment Use Businesses". He commented that many of these types of businesses are starting up in other places, and with the upcoming closing of the GM plant, many bars and taverns may be looking to do the same. Trustee Hyland moved, second by Trustee Cicchetti to open the public hearing, motion carried. There were no comments from the public, therefore Trustee Alter moved, second by Trustee Hayes to close the hearing, carried. Attached Resolution #03-36-94 was then passed. Mayor Treacy read the attached public hearing notice to consider amendments to the Alarm ordinance. He commented that there have been many false alarms and the wording in that section of our ordinance needs to be clarified, also the penalty section needs revision. Trustee Hyland moved, second by Trustee Hayes to open the public hearing, motion carried. Mario Belanich questioned whether the fines for the number of false alarms was on a yearly basis. The Mayor stated yes. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the hearing, motion carried. Attached resolution #03-38-94 was then passed. Approval of Minutes Trustee Hyland moved, second by Trustee Jeffers to approve the minutes of the March 1, 1994 as written, motion carried 6-0. Approval of Warrants Trustee Hyland moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills, motion carried 6-0. Total of the General fund is $109,611.91 and the Water Department fund total is $ 4387.68. Communications, Petitions & Requests Deputy Clerk read correspondence from Restaurant Latino informing the Village that they have made application with the NYS Liquor Authority for the renewal of their liquor license. (Referred to Police Chief) Deputy Clerk read correspondence from Leonard Galante, President of the Central Veterans Committee, requesting permission to hold its annual Memorial Day parade and services at Sleepy Hollow Cemetery following the parade and inviting the Mayor and Trustees to attend. Trustee Hyland moved, second by Trustee Cicchetti to approve this request and motion carried. Attached correspondence from the Fire Council was read regarding action which took place at their council meeting held on March 8, 1994. Trustee Hyland moved, second by Trustee Alter to approve this action and motion carried. 2 �*3*f£ Mayor Treacy read a letter from Ron Greene and Marion Jansen of Pine Street addressed to Joe DeFeo thanking him and his crew for a job well done during the many snowstorms we have had this winter. (Placed in his file) Mayor Treacy read correspondence from John Morabito, 1st Assistant Chief Engineer inviting him to the installation of the Fire Department Chiefs and Officers on April 7th at 8PM. The Mayor read a letter addressed to the Police Chief from Linda Chen thanking Officer Benetiz for his help when her car wheel was stolen. (Letter placed in his file) The Mayor read a letter addressed to the Police Chief from Edna and Mario Belanich commending the exceptional police performance of five members of the police department, Officers Pellegrino, Bizzarro, Ojito, Cappello and Sgt. Ferguson on March 11th when they informed the police of vandalism in the area.(Placed in their files) Sculptor Richard Aslowsky wrote a letter to the Mayor commenting that it was a pleasure to meet him on Sleepy Hollow Day when he had an on the street display of his model of the Headless Horseman and he enclosed a catalog of his work. He hoped that the life like model of the Headless Horseman will become a reality for North Tarrytown someday. Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Alter to open the public comment section, motion carried. Frank Rey of Holland Avenue asked for an explanation of the resolution regarding the removal of the handicap spaces on Broadway in front of the Korean church and he felt that there were too many signs already and yellow lines should be painted instead. The Mayor responded that there is no longer a need for these spaces, therefore two parking spaces will be gained; there are signs already in the area and parking in the yellow line area can be challenged in court. There being no further comments, Trustee Alter moved, second by Trustee Cicchetti to close the public comment section, carried. Mayor's Report Mayor Treacy reported that a press conference was held with North Tarrytown, Tarrytown and the Tarrytown schools regarding a study that will be conducted by Pace University regarding a cooperative effort to save money by sharing services. Areas they will explore are recreation and senior citizen projects, purchasing, water filtration plant, computer services, water distribution system, etc. The Mayor reported that the proposed 1994-95 budget will be presented to the Board Friday afternoon for their review. 3 �The Mayor attended a ceremony at Sleepy Hollow High School where students in grades 9-12 were honored for their very high scholastic averages. He would like the Village to also honor them at some time in the future. A meeting of the GM Task Force was held last week. On March 8th our Attorney presented depositions at the hearing, the next step is for our Attorney to request discovery documents from GM. A special public hearing will be held on March 29th regarding the proposed changes to the Reclamation law. Mayor Treacy commented that he will be attending the seniors St. Patricks day luncheon on March 17th. Trustee Reports Trustee Jeffers commended Mayor Treacy and thanked the highway department for having Highland Way plowed even though it is not a village street but the Town of Mt. Pleasant had not plowed it. Trustee Alter reported that regarding the designation of route 9 as a scenic road, he met with Bob 0fToole. Trustee Alter thanked Cable for sending a technician and production man with a camera. He rode with them while they panned north and south along route 9. A draft of the franchise renewal has been submitted to Continental Cable for their review. At the next work session a consultant will present an update on the scenic road designation. The Mayor commented that senior residents at Stony Point receive a 10% discount on their cable bills. Trustee Alter stated that this was discussed but Continental Cable would not take up on it. Trustee Cicchetti commented that our application with the State to lower the speed limit on route 9 is still pending. Figures received from the Chief of Police on accidents since October show that there have been 3 5 accidents since then. The Administrator has written a letter to the State regarding our study. Trustee Maloy had no report. Trustee Hyland commented that at the last meeting, he had asked the Village Attorney for an analysis of the Prosecutor's report. And he asked if the Village Attorney had looked into it, in particular the problem that occurred regarding gaining access into a home on 2 0 Hudson Street. Donal Walsh stated that he would have the report by the next meeting but needed to know exactly what we were looking for. Trustee Hyland commented that there is possibly an illegal apartment in the basement which was done without a building permit. Frank Rizzi identified himself as the person who made the complaint. 4 �Trustee Hayes reported that the library budget has a shortfall and have requested an extra $880. from us and an extra $1320. from Tarrytown. We do not have the money for the increase in the new contract and we will not renegotiate the contract for the coming year. The new platform fire truck was tested today and will fit into the bay. Mayor Treacy stated that he was in ladder truck. support of this new hook and Administrator's Report Linda David read agenda for the Planning Board which will meet on March 17th at 8 PM, and the agenda for the Zoning Board which will meet on March 23 at 8 PM. Resolutions-Attached Old Business-None New Business Mayor Treacy commented the new local group that was created called the Historic River Towns of Westchester has requested a draft of the Inter Municipal Agreement. Mr. & Mrs. Theodore Hutchinson, our Village Historians, have created a list of the many historic attractions in North Tarrytown. Public Comments Trustee Hayes moved, second by Trustee Maloy to open the public comment section, motion carried. Mario Belanich asked why the Village is passing the resolution regarding ARCH since it's not a village project. Mayor Treacy commented that the Village helped ARCH apply for a grant from the County. The County will be paying for the project and the Village is not spending any money. Linda David commented that the County assists affordable housing projects throughout the County. in building Mayor Treacy commented that there is a lottery for those wishing to purchase a unit, first pick is for a village resident and then the Town of Mt. Pleasant resident. Henrietta Brand asked why the Mayor and his friends were giving out hot dogs and soda two days before the election at College Arms and she felt the timing was inappropriate. Mayor Treacy responded that they gave them to the kids and residents of College Arms because they have been very supportive of the Democratic party and he hoped to do it again, not only for residents of that building but throughout the village as well. He said everyone had a great time that day. George Samaras asked if the Mayor agreed to give hot dogs and soda to the people who vote for the Democratic party. 5 �The Mayor commented that one wouldn't think so by the results of the election. Eli Samaras wanted to know why the owner of 185 Valley Street was going before the Planning Board. The Administrator commented that she did not have all the particulars, but he could check with her in the morning and she will give them to him. Frank Rizzi asked results. if we were going to accept the election Mayor Treacy stated it was done at the beginning of the meeting. Frank Rizzi commented that he was concerned why the tenant of 20 Hudson Street was told by the owner not let the Building Inspector, Code Enforcement Officer and Assessor into the building. Donal Walsh commented that he was checking into this further. Mr. Rizzi commented that if improvements were made to a building, these people should be let in and when any improvement over $100. is made, the Assessor should be let in to reassess the building so that the owner will pay his fair share of taxes. Mayor Treacy stated that Mr. Rizzi had filed a FOIL request for information regarding this building a month or so ago and the information was given to him. Ugo Checchi commented that he was the plumber at 2 0 Hudson Street originally, then the owner went before the Zoning Board for the addition of an apartment in the basement and was denied. Mr. Checchi was asked by the owner to put in a boiler, hot water heater and coin operated washer for the tenant. He claimed that partitions were put up without permits, plumbing permit was taken out illegally and faulted the Building Inspector for not pursuing the matter of being allowed to go into the building because when he was Building Inspector he demanded to be let into a building. He also wanted to know if a complaint must be in writing before the Building Inspector can enter a building. The Village Attorney commented that he was not aware of an ordinance on the books, but felt common sense should prevail in matters such as these. Mayor Treacy commented that the Village does not want to expose itself to a suit by entering a home without permission. Henrietta Brand asked if there were any legal matters between the Board and a resident such as back taxes due, would a certified letter be required to be sent. Mayor Treacy commented that certified letters were not necessarily required, it depended on the matter or complaint. Village Attorney stated that notices are sent to residents regarding late taxes, but they do not. have to be certified. 6 �Eli Samaras asked why there were alot of allegations made against Trustee Hyland during the campaign. The Mayor commented that there were alot of lies in the republican campaign flyers that were sent out such as the Mayor wanting to bring back Halpern, cut the recreation budget by 10% by eliminating day camp, softball, etc. Frank Rey commented that the Republicans ran an honest campaign and the Mayor could bring all the allegations, such as the incinerator issue up before the Fair Campaign Practice Committee and the Republicans will be happy to address them. Mayor Treacy commented with regard to the incinerator issue, Phelps had filed an application with the State for a new incinerator and by the Village declaring ourselves lead agency, he has prevented the hospital from building this. Mr. Rey commented that a hospital spokesman told him that they did not apply for a new incinerator. Mayor Treacy said that he knows for a fact that they did and stated that Phelps is being fined for the incinerator that is there now and shortly that will be shut down because they are in the process of signing a contract to cart all medical waste away from the hospital. All the untruths in the Republican campaign literature will go before an impartial Board. George Samaras commented that he has a project coming up before the Planning Board and feels that a person who is suing the Village for a million dollars should not be on that Board. Ugo Checchi wanted to know if a person who has a lawsuit against the Village can be on the Planning Board. Village Attorney stated that any volunteer can serve on a Board. Eli Samaras wanted to know why the Mayor only asked Mr. Hyland questions at the debate and not the other candidates. The Mayor commented that he felt Mr. Hyland has done a terrible job as a trustee. Mr. Samaras stated the Mayor had never been seen in the south end of the Village before the day the hot dogs were given out. The Mayor stated that was not true and in fact many people in that area are good friends of his.
