An Organization Meeting and a Regular Meeting of the Board of
Trustees of the Village of North Tarrytown was held on Tuesday,
April 5, 1994 at 8:00 PM.

Pledge
Mayor Treacy called the meeting to order with a pledge to the
flag.
Mayor Treacy congratulated and welcomed the newly
Trustees, Jose Blanco, Scott Horecky and Michael Hyland.

Trustees Jose Blanco, Scott P. Horecky and Michael Hyland were
sworn into office by Linda David, Village Administrator/Village
Clerk.
Mayor Treacy presented a Certificate of Appreciation to former
Trustee Nicholas Cicchetti for all his years of service as a
Trustee. He commented that he also had certificates for David
Maloy and Steven Baderian who were not present tonight.
Mayor Treacy stated that there was alot to accomplish at
tonight's meeting and in an effort to save time, he made a motion
to dispense with some of the regular part of the agenda such as
Communications, Public Comments-Agenda Items, Mayor's Report,
Trustee Reports, Administrator's Report, Old Business, and New
Business, motion was seconded by Trustee Alter.
Trustee Hyland commented
that he, Trustees Blanco and Horecky
had resolutions to call for public hearings on May 17th to amend
sections of our village code. One
was to amend the code to make
Howard Street
street a one-way street from Kendall Avenue
extension
eastbound to Pocantico Street, another to amend the
code to require all garbage receptacles to be enclosed and out of
sight or view from the street, another to amend the code for no
parking on the south side of Howard Street from Kendall Avenue
extension, to Pocantico Street on the east.
The Mayor stated that discussion usually takes place at work
sessions before public hearings are called so that the Board can
consult with department heads
such as the Police Chief and the
General Foreman before calling for a public hearing. He asked
that these proposals be, put on the next work session agenda so
the Board could consider these with information on hand.

�Trustee Jeffers wanted to pass a resolution whereby the Board of
Trustees creates the office of Village Prosecutor whereby the
Board will seek a qualified attorney for the position, effective
immediately. Trustee Hyland moved that the Board vote on this
resolution and those to call for the public hearings.
The Mayor commented that we have not reached the resolution
portion of the agenda yet and we have not dispensed with that
portion of the agenda. Trustee Hyland commented that they
presented them, but will wait for the resolution portion to vote
on them.
On the motion to dispense with certain portions of the meeting,
motion was carried.
Committee Appointments
Mayor Treacy commented that there are different methods of
appointments; some are strictly the Mayors, others are the Mayors
with Board approval and others are just the Board's appointments.
Trustee Jeffers commented that if there are any problems with any
appointments, we should agree that these be placed in the hands
of the Attorney General.
Mayor Treacy stated that he had no problems with any appointments
the Board of Trustees may make and any appointment he makes that
needs Board's approval. All the sections of the local ordinance
or state code that these appointments pertain to is written down
and he stated he will follow these laws to the letter. He
suggested that Trustee Jeffers take any of the appointments that
the Mayor will make tonight to any attorney to check.
Mayor Treacy then
reappointed Andres J. Valdespino as Acting
Village Justice which is a Mayoral appointment.
Trustee Jeffers commented that he thought the Board voted on this j
appointment last year and wanted to know why they couldn't vote
this year.

The Mayor commented that it is a Mayoral appointment and he does
not need the Board's approval.
Trustees Hyland and Jeffers wanted to vote on each appointment
and if they find out the Mayor was correct, the appointment will
stand.
The Mayor stated that he would not entertain an illegal vote;
there is no reason to vote on this appointment.
He commented
that they could voice their protest against what he is doing and
they have the power to sue the Mayor if they think what he is
doing is not correct.
The Mayor commented that these appointments are written in black
and white and he is just following the law. If the law states
appointment by the Board of Trustees, then the Mayor would have
nothing to say about it.

�Trustees Jeffers commented that he is trying to retain and/or
gain trustee powers, just as the' Mayor is trying to retain
Mayoral powers. Trustee Jeffers commented that they should move
to table the appointments. The Mayor stated that Trustee Jeffers
did not have that power. More discussion ensued between the Mayor
and Trustees Jeffers and Hyland regarding which law should be
used, village or state, for example appointments to the Zoning
Board. The Mayor commented that the state law is used if the
village has not adopted a local law. The Mayor commented that in
1988 the village adopted a local law whereby each appointment to
the Zoning Board is made by the Mayor and any vacancy to the
Board is also made by the Mayor.
Mayor Treacy commented that
the Board has the power to hire an attorney if they feel that the
Mayor is doing something illegal.
Trustee Hyland commented that in the past, it was customary to
sit down with new trustees and bring them up to date on village
business.
Mayor Treacy commented that he met with Trustee Horecky and tried
to meet with Trustee Blanco but for some reason they could not
get together.
More discussion ensued but no agreements on the issues could be
reached. Trustee Hyland made a motion to go onto the next order
of business.
The Mayor did not recognize the motion and
continued with his appointments.
Trustee Jeffers moved, second
by Trustee Hyland to adjourn the meeting; the Mayor did not
recognize the motion. Trustees Jeffers, Hyland, Blanco and
Horecky then left the meeting.
George Samaras, a resident of North Tarrytown started shouting
from the audience and was asked to leave by the Mayor if he did
not quiet down.
At a future date the Mayor stated that he
will bring up the
Mayoral appointments that need the Board's approval and hope the
Trustees will have their appointments ready.
Since there was not a quorum present to approve minutes, warrants
and resolutions, the Mayor entertained a motion to adjourn the
meeting, Trustee Alter so moved, second by Trustee Hayes and
meeting was adjourned.
