Present: Mayor Sean Treacy Greg T. Jeffers (Arrived Late) Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearings Mayor Treacy read the attached public hearing notice regarding the removal of two handicap parking spaces in front of the Korean Church and read their request letter. Trustee Hyland moved, second by Trustee Blanco to open the public hearing, motion carried. Sam Gittens asked if these spaces would be replaced if needed; the Mayor responded that one is remaining there. Being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public hearing, motion carried. Mayor Treacy read the attached public hearing notice regarding amending Article III, Section 57-63, 57-64, 57-65 and 57-66 and the letter of request from BOCES. Trustee Alter moved, second by Trustee Hayes to open the public hearing, motion carried. There were no comments from the public, Trustee Hayes moved, second by Trustee Blanco to close the public hearing, motion carried. Mayor Treacy read the attached public hearing notice with regard to increasing certain fees. Trustee Alter moved, second by Trustee Horecky to open the public hearing, motion carried. Dr. Sweet and Mario Belanich asked for an explanation of a peddlers license and who needs one; Mayor Treacy explained. Miguel Jimenez commented that the peddling law should be enforced. Mayor Treacy commented that if anyone has a complaint, the police should be contacted. Armando Galella asked about the veteran's exemption. The Administrator stated if they have a professional business license as a veteran, they are not required to pay the fee. Dr. Sweet asked about the alarm permit fee. The Mayor commented that this is for anyone who has a burglar or fire alarm. The alarm company calls the police department when it goes off. 1 �No further comments, Trustee Blanco moved, second by Trustee Alter to close the public hearing, carried. Approval of Minutes Trustee Alter moved to approve the minutes of April 13, 1994 as written, second by Trustee Hayes and motion carried 5-0. Trustee Horecky moved to approve the minutes of April 19, 1994 as written,second by Trustee Hayes and motion carried 5-0. Approval of Warrants Trustee Alter moved, second by Trustee Horecky to approve the warrants and authorize the Treasurer to pay the bills, motion carried 5-0. Total of the General fund is $149,472.28 and the Water Department total is $24,227.15. Communications, Petitions & Requests Deputy Clerk read several correspondence from the Fire Council which are attached. With regard to the action that took place at their meeting of April 19th, Trustee Hyland moved, second by Trustee Horecky to approve their action, motion carried. I Mayor Treacy read correspondence from the Board of Fire Wardens advising the Board that they are in agreement with the proposed changes on Howard Street. Mayor Treacy read correspondence from Wilson Moore Director of NYS DOT Local Programs Section advising us that since the NYS budget has not been passed yet, they were not be able to meet the scheduled CHIPS O&M payment due on April 25th, but will process the payment as soon as they can. Correspondence from Cesare Manfredi of NYS DEC was received requesting that any documents received by the Village from GM regarding releases of pollutants during the 1960's be sent to them to help in the cleanup of the GM site. Correspondence from Governor Cuomo's office was received thanking the Village for sharing our concern over the storage of low level radioactive waste at the NY Power Authority's Indian Point 3 facility. I The Mayor stated that we have received a check for $9748.66 which represents Continental Cablevision's franchise fee taxes for the period ending March 31, 1994. A request from the Portuguese American Cultural Center to hold their annual candlelight procession on May 8, 1994 at 8:00 PM starting in Tarrytown and continuing through Cortlandt Street to St. Teresa's church was read. This request has been forwarded to the Police Department. Mayor Treacy read a letter from Andrew O'Rourke regarding a conference on May 10th to explore the impact of the film and video industry on Westchester. Linda David will attend. Mayor Treacy read correspondence from the North Tarrytown Ambulance Corps inviting the Mayor and Board to attend a Public Awareness Day at Central Fire Headquarters on Sunday, May 15th from 11 AM until 4 PM. I �Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Hayes to open the public comment section, motion carried. Mr. Galella questioned resolution #4/50/94 regarding the hiring of the Leahy company to check our compensation bills. Mayor Treacy stated this was on last weeks agenda, but commented this company may be able to save us money or get us a refund. Mr. Belanich commented on resolutions # 4/47/94 and 4/48/94 which were tabled from the previous meeting. The Mayor again explained that these resolutions are needed in the event a special meeting must be called before the regular board meeting takes place. Ugo Checchi and George Samaras asked if people could speak at these special meetings, could a law be changed and could the Board hire or fire someone at these meetings. The Mayor commented no to all these questions. Dr. Sweet recommended that the Board also be allowed to call for a special meeting. Being no further comments Trustee Hyland moved, second by Trustee Alter to close the public comment section. Mayor's Report Mayor Treacy reported that on March 29th the budget was adopted. He gave a brief summary of the adopted budget. The homestead tax rate will increase by 1.21% and the non-homestead will decrease by .47%. The Mayor commented that he has good news regarding the Community Block Grant program. The Village will receive $177,000. towards making Village Hall handicapped accessible, $100,000. for sidewalk improvements on Cortlandt Street, $2 00,000. towards the creation of Sleepy Hollow Landing and there will be $5000. worth of improvements at Sykes Park, $2500. in a grant was awarded to Tarrytown and the two villages will each contribute $1250. North Tarrytown has received a total of $477,500. in community development grants. We have received a Certificate of Appreciation from the Westchester County Executive for services rendered to Westchester County Community Development Block Grant in recognition of contributions to Westchester Urban County. This past Friday a meeting of the Historic River Towns of Westchester was held with representatives from surrounding villages. They discussed the draft of the inter-municipal agreement to promote tourism. Each municipality will be contributing $1000. for marketing consultants. We have scheduled future meetings with NYS Economic Development, Westchester County and NYS Greenway. The Mayor met with Katherine Sullivan, Regional Director of the NYS Department of Economic Development and discussed the proposed riverfront park. She will be working with the Village to try and obtain a UDC grant that is available. There will be many tourists coming into our Village with the opening of Kykuit and visitors to the Restoration. T �Trustee Reports Trustee Jeffers commented that someone asked him what the Village was doing to encourage development. He stated the community must be encouraged not to inhibit development. We must allow new development in this community if we are to increase our tax revenue. Trustee Alter reported that the recreation brochure has been mailed out, tot camp registration will take place this Saturday, day camp will start on July 5th and men's softball has been reinstated. Devries Park is now open at no charge to residents, non-residents must apply for a permit and will be charged a fee. Trustee Alter commented that he will attend two cable meetings on May 5th to discuss the cable franchise agreement. The Police Committee will try to meet on Friday with the PBA President to discuss the upcoming contract. The Mayor commented this meeting should take place outside of the work schedule of the PBA President. Trustee Blanco reported that he will be meeting with the merchants shortly to share ideas on how to bring new merchants into the Village. If anyone has any ideas, please write to him. Trustee Horecky reported that the police walking patrol will start this weekend, Thursday through Sunday from 4PM-12 midnight. Trustee Horecky moved to approve the attached resolution #05-70-94, second by Trustee Hyland and motion carried 7-0. Trustee Hyland gave an update on the parking lots owned by the Village regarding the condition of them, clean-up, lighting and repairs. He commented that these are some reasons the lots are not full. He suggested a light be placed in Barnhart Park facing the Andrews Lane lot. Trustee Hyland commented that with regard to the budget, he and Trustees Blanco and Horecky felt that the Village needs two more police officers and therefore did not vote for the budget without them. He commented that we need new equipment in Barnhart Park. Mayor Treacy commented that the reason they did not put them in the budget was because a study showed that there was no proof that more police officers reduce crime and increase productivity. More discussion ensued. Trustee Hyland commented that he had asked several times for the balance in the water department fund and finally received his answer tonight; there is a $19,000. balance from last year. Trustee Hayes reported that at the monthly meeting of the Library Board, there was a concern regarding the $20,000. that had been raised being applied to capital needs rather that to their operating budget. The Library Board would like to meet with members of our Board on May 25th at 5PM. 4 �He reported and for the the budget has money for a new hook and ladder truck emergency vehicle but not for the Fire Chief's car. Administrator's Report Linda David read the agenda for the Zoning Board to be held on May 18th and the agenda for the Planning Board to be held on May 19th. Resolutions-Attached Old Business Trustee Blanco read a memo he wrote regarding the establishment of the Conservation Advisory Council citing several sections of legislation and proceeded to appoint members to the Council. Donal Walsh, Village Attorney, commented that he has made a thorough search of the minutes going back to the 1950s and has not found any official enacted legislation with regard to the CAC. There is no legal authority the CAC was established. More discussion ensued. Trustee Hyland moved to abolish the Environmental Council that presently exists in the Village, motion seconded by Trustee Blanco. The Village Attorney stated that the Trustees could not abolish this Council since this is an advisory council to the Mayor. More discussion ensued. The Mayor stated that on advise of Counsel, this is not a legal resolution and he will not take part in it. Trustee Hyland stated that this question should also be sent to the Attorney General for his opinion. On roll call: Trustees Jeffers, Blanco, Hyland and Horecky voted YES and Trustees Alter and Hayes voted NO. Trustee Hyland moved, second by Trustee Blanco to establish the Conservation Advisory Council as provided for in the General Municipal Law. Trustees Jeffers, Blanco, Hyland and Horecky voted YES, Trustees Alter and Hayes voted NO. Trustee Hyland moved, second by Trustee Jeffers to appoint the following members to the Conservation Advisory Council: Donald Stever, Walter Ceconi, Dr. Richard Sweet were reappointed and Nick Cicchetti and James Donovan appointed as replacements for Mr. Stoeklein and Ms. Tornello. Trustees Jeffers, Blanco, Hyland and Horecky voted YES and Trustees Alter and Hayes voted NO. New Business Mayor Treacy commented that on May 2 0th 2 PM at Devries Park, the Village will hold an Appreciation Picnic for all the highway workers for the great job that they did this past winter with all the snow we had. We have asked the merchants to help in any way that they can. Trustee Hyland asked Donal Walsh if the Zoning Board can make any decisions right now in light of the fact that we have asked for the Attorney General's opinion and what happens if the decision were to be reversed. Village Counsel stated that according to the memo he sent to the Board, it is his opinion the Zoning Board can make decisions right now. The Attorney General would decide what happens if the decision were to be reversed. * �Public Comments Trustee Hyland moved, second by Trustee Horecky to open the public comment section, motion carried. Lydia Michalides presented attached petition from the residents of Howard Street regarding the proposed changes. George Samaras asked the Mayor to send a letter to the Zoning Board with regard to the request of Mr. Rodrigues for a variance to open a deli, urging them to enforce the law regarding no delis within 200 ft. of each other. Armando Galella asked if the Board could consider moving the public comment section sooner on the agenda, the garbage receptacles are in bad shape and we need better lighting in the Village, especially on Depeyster Street. He also commented that some lawsuits have been resolved and asked if the public should be notified of the settlement amounts. The Mayor commented as far as the lawsuits, payments for most of them are listed on the warrants but some cannot be made public. The village pays the first $40,000. and the insurance picks up the rest. Henrietta Brand commented that although she was glad to see the foot patrol coming back, she felt that two new officers should have been hired also. Miguel Jimenez commented that the lights are out at the corner of Beekman Avenue and Cortlandt Street. Goldie Seglio of Pocantico Street commented that this proposed change on Howard Street will affect Pocantico Street, Washington Street and the Van Tassel also. A resident of Continental Street commented that she and other residents are very concerned about the parking at the Upper Mills lot on Continental Street and the traffic. Mayor Treacy commented that before any changes take place on Howard Street many conditions must be met and a public hearing will be held on June 7th. As far as the parking lot, this is only to be used for special events but if this is an everyday occurrence, he will contact them. He suggested a meeting be held with residents and Historic Hudson Valley so that they can express their concerns. Mrs. Michalides wanted to know why residents within two hundred feet did not receive any notices when the Restoration went before the Planning Board. Our Village Attorney commented that this is only a requirement to go before the Zoning Board. Mrs. Michalides suggested that perhaps this could be changed. James Galgano asked why the Village declared itself as lead agency at the March 29th meeting instead of the Mayor and Board of Trustees. He felt it was a conflict of interest since the village is sponsoring the project. He felt environmental impact statements should go before the Planning Board. 6 �The Mayor commented that it is just procedural language that is always used and if needed an environmental impact statement will be done and may go before Planning Board. Mr. Galgano asked who is paying for the survey for the promenade at the new park, where the salt and sand will be put and where will the dumpsters be put. Mayor Treacy commented that we are looking for grant monies for the promenade, we are researching places for the salt and sand but the dumpsters will remain on River Street. Mr. Kavicky suggested that perhaps residents of Continental Street could park in that lot at night. Eli Samaras suggested that a letter be sent to the Zoning Board regarding the request for a variance for a deli on Valley Street. George Samaras, representing deli owners, presented the Board with a petition opposing the proposed new deli and commented that they will sue the village if the Zoning Board grants this variance,the petition will be presented to the Zoning Board also. Mr. Galella commented that the sidewalk in front of the building on Valley Street is completely blocked off and since the owner is not doing any overhead work, it shouldn't be that way. The Mayor will send the Building Inspector there. Mr. Jimenez asked about the continuation of the storefront revitalization program and that there are several violations in the building where he rents his store. The Mayor commented that we will be moving forward with the project in the next few months; he will talk to the Building Inspector about the violations. George Samaras commented that the Valley Bakery is selling soda, hot dogs, etc. and wants the Building Inspector to check this. The Mayor commented that he has not see any of these items being sold, but he will send the Building Inspector there. Mario Belanich and Henrietta Brand commented that they wish the Board would reconsider hiring two police officers. Chief •&* �NORTH TARRYTOWN RECREATION COMMISSION March 25, 1994 To: Honorable Mayor & Trustees At a recent recreation commission meeting, we were directed by the Village Administrator to come up with two budgets - one cutting expenses by 10% and the other budget was to remain at the same figures. We have pared back oyer the years until the proposed budget of $158,468 almost equals the budget of ten years ago which was $156,930 in 1984-85. Our first option is to keep the budget as is. The 10% decrease would severely impede the existing programs of our village. This is a decrease of $18,052 from the previous year's budget of $176,520. An amount of money of that magnitude not only eliminates programs for the children but the adults as well. We have always supported the programs associated with our children in the past and want to continue to do so in the future. We hope you will give this serious consideration when creating next year's budget. I believe we all have the continued well being of the village in mind.
