Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Jose Blanco Scott Horecky Michael Hyland John T- Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. He commented that the meetings will be held in different places throughout the year so that different people can express their opinions. Public Hearings Mayor Treacy read the attached public hearing notice with regard to increasing, certain fees and gaye a brief explanation. This will allow us in the future to avoid having to put public notices in the newspaper, therefore saving the Village money. Trustee Alter moved to open the public hearing, second by Trustee Hayes and carried. There were no comments from the public; Trustee Alter moved to close the public hearing, second by Trustee Hayes and carried. Trustee Hyland commented that he was under the impression by the discussion at the work session that this hearing was to be adjourned tonight until further discussion. The Mayor commented that there are certain portions of this code that should also be changed, such as the requirement for a sprinkler system to be put into an attached garage, which is a hardship on the home owner, also we have checked into several questions that were asked at the work session such as liability insurance for dumpsters on the street. Linda David commented that most of our dumpster companies carry one million dollars or more. Trustee Horecky commented that three Trustees have asked for more information and it was agreed this would be discussed further at the next work session. Trustee Jeffers felt that one million dollars for insurance for a dumpster is too high. After more discussion, Trustee Alter moved to adjourn this hearing until the next meeting on August 16, 1994, second by Trustee Horecky and carried. 1 �Mayor Treacy read the attached public hearing notice with regard to amending Chapter 57-5 regarding a stop sign at Barnhart and Francis Street. Trustee Blanco moved, second by Trustee Horecky to open the public hearing, carried. Trustee Horecky commented that he was approached by several residents in that area regarding the danger to children with drivers not coming to a full stop. Miguel Jimenez commented that this was a good idea. He also suggested that the police department check this area frequently and to check the speeding on Pocantico Street, also. Trustee Horecky commented that this problem has been brought to the Chief's attention and the police department will be doing radar speed checks on Pocantico Street. There being no further comments, Trustee Alter moved, second by Trustee Hayes to close the hearing, carried. Attached Resolution #101 was unanimously passed. Mayor Treacy read the attached public hearing notice with regard to parking spaces in front of the fire house on Cortlandt Street. Trustee Alter moved, second by Trustee Horecky to open the public hearing, motion carried. Mayor Treacy commented that there has been a great deal concern about the safety of the churchgoers in that area. of Trustee Blanco stated that a committee is trying to come up with a solution to the parking problems that will help everyone. Henrietta Brand of College Arms commented that the management at her building is willing to speak to the Boar(d regarding parking for the people attending church. Spaces are available in the lower lot. John Cappello asked if there were specific hours that the firemen could park there and that their main concern is the safety of the people when the trucks pull out, not just the parking. Trustee Blanco commented parking for fireman will be only during emergencies. Mayor Treacy commented that this is not the complete answer, it is just a step in the right direction. John Cellante, President of Union Hose, commented that the safety issue is their main concern; the burden of safety is on the firemen's shoulders. Mayor Treacy commented that the Board understands your concerns and the police will be there during services, Miguel Jimenez, a member of the Church, thanked the Board for their help in working towards a solution, but that this hearing is for parking spaces for the fire department, not the Church. 2 �I i I Frank Rey commented that the direction of the Board is admirable; but the concern for parking is not just on Sundays; there is going to be a day care center and night meetings. He suggested that the Board review this further. John Cappello commented that the discussions should continue with the sub-committee before any decisions are made. Mayor Treacy commented that Trustee Blanco will be continuing discussions with the committee. Henrietta Brand suggested a controlled traffic light. The Mayor stated the prices of traffic lights were sought and found to be too high. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the hearing, carried. Approval of Minutes Trustee Horecky commented that there were several amendments he would like to make to the June 7, 1994 minutes before approving them. On page 2, third para from the bottom;--" The Mayor states that he is not aware of warrants not being paid for three months to certain individuals"; page 4, para 7 from the top, "the Mayor states the residents on Barnhart like the ramp"/ page 4, paragraph 9, "The Mayor states there is no traffic on the ramp and that he doubts the Trustee saying he's seen cars in the park",page 5, para 6, "Trustee Jeffers stated there was a village appointee who was using profanity outbursts and threats of violence during the Board meeting and he assured us it was not one of his appointees", page 5, para 14, "The Mayor stated to Trustee Horecky that he does not have the time to make him privy to every issue that comes before this village",page 5, on the bottom,"Trustee Horecky commented, for two weeks he called the Administrator and it took two weeks to find out who ordered the paving at Barnhart park," page 6 para 2,--- "The Mayor commented that he would return the favor to Trustee Horecky for introducing the resolution, Trustee Horecky asked "is that Barnhart Park?" page 6, para 2,«—-- Trustee Hyland commented " if the Village Administrator cannot administer the "No Parking" bags on the meters and the cleaning of the Avenue, next year the parade should be rerouted. Trustee Hyland commented that the police were not given orders to put the bags on the meters by the Village Administrator; page 6 para 7, Trustee Hyland commented that a letter was sent to the Attorney General on appointments and deliberately left out was the question on whether the Mayor can make appointments without a quorum. With those changes, Trustee Horecky moved, second by Trustee Blanco to approve these minutes, motion carried 6-1 with Mayor Treacy voting No. Trustee Alter moved, second by Trustee Hayes to approve the minutes of June 21, 1994. Trustee Blanco commented that he would like to review the tape of the meeting before approving the minutes. Trustee Horecky commented that he was on vacation and did not have time to read the minutes. The Mayor polled the Board; Trustees Jeffers, Blanco, Horecky and Hyland voted No and Mayor Treacy and Trustees Hayes and Alter voted Yes. Motion failed 3-4. 3 �Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued on several bills. Trustee Hyland questioned the engineering fees; the Treasurer commented we have received the money to pay these bills. Trustees Hyland, Blanco and Horecky questioned the White Front bill again and wanted to know whose line item it was to be paid from. Mayor Treacy commented part from the Mayor's line and part from the Administrator's line since it was near the end of the fiscal year and there wasn't enough left in the Mayor's line. More discussion ensued over this bill. Al Passariello asked if he could speak out of turn because he did not want to wait until later in the evening; Mayor Treacy moved, second by Trustee Alter to allow him to speak, carried. Mr. Passariello was very upset with the way the Board was acting and commented that he voted for everyone on this Board except the Mayor, but he supported him because he was duly elected by the people and he felt that the Board should do the same and get on with the job at hand. Trustee Hyland questioned the Village Attorney's bill. Donal Walsh commented that he attended the last work session to discuss his bills; the bills are per contract. He does not bill the Village until his work is done. Trustee Hyland commented that he would not vote yes on approving the bills until legal questions are answered. He had asked the Attorney whether the Trustees could set the agenda and was told yes, except for the public hearings. Donal Walsh commented that he is here only to give opinions, not to set the agenda, only to advise the Board. legal Trustee Hyland stated that they had discussed at the work session to move executive session to the beginning of the meeting. Trustee Jeffers commented that he had asked that the agenda be changed so that the meeting could be shortened. Mayor Treacy commented that if the executive session were to be first on the agenda, people at home would be watching a blank screen until the regular meeting started. He has asked for copies of agendas from other municipalities to review before we vote to change the agenda. At the next work session, the trustees will be given a copy of the survey from the other municipalities. The Village Attorney stated that he had concerns that need to be addressed; his normal contractual bill must be paid. More discussion ensued. Mayor Treacy asked that a vote be taken on paying the entire warrant. Trustee Alter moved, second by Trustee Hayes to approve the entire warrant and authorize the Treasurer to pay the bills. On roll call vote, Trustees Jeffers, Alter, Hayes and Mayor Treacy voted YES and Trustees Blanco, 4 �Horecky and Hyland voted NO, motion carried 4-3. Total of the General fund is $ 161,34.88 and the Water Department fund is $10,285.16. Communications, Petitions and Requests Correspondence from Luberger Distributors, Inc was read informing the Village of their intent to renew their beer license. (Referred to Police Chief) Deputy Clerk read attached correspondence from the Board of Fire Wardens regarding action that was taken at their meeting in June. Trustee Blanco moved to approve their actions, second by Trustee Horecky and action was approved. Deputy Clerk read attached correspondence from the Board of Fire Wardens requesting permission to take fire apparatus and Fire Chief's vehicles to a parade in Verplank on July 23, 1994; Trustee Alter moved to approve this request, second by Trustee Horecky and motion carried. Mayor Treacy read correspondence from residents of #138, #140, #144 and #146 Webber Avenue asking for the village's assistance in trying to find a solution to the constant flow of water, pebbles and erosion of soil coming from the properties above them at #8 and #9 Amos Street, during a heavy downpour. The Mayor commented that we will schedule a meeting with the property owners and the Building Inspector. A letter from Klaus Schmidt of Philipse Manor was read regarding the noise created by leaf and grass blowers. Will discuss at the next work session. A letter was received from Margaret Kantowitz of Cedar Street regarding the terrible litter in that area and the noise from boon boxes. She also spoke about this matter. This was referred to the Police Chief and Trustee Horecky. Mayor Treacy read correspondence from United Way thanking him for his participation in the dunk tank and sent him a certificate of Appreciation; donations went to fund the Headless Horseman statue. A letter addressed to Henry Atterbury from the Sleepy Hollow Family Festival Group was read thanking the Mayor and Board for providing the portosans. Correspondence from Joan and Richard Rose of Fremont Road was received thanking Officers Cotarello, Lombardi and Nevelus and the fire department for their quick and efficient response to an electrical fire at their home recently. (Placed in their personnel files) A letter from the New York Mets was received , thanking Officer Nevelus and Sergeant Ferguson for their participation in D.A.R.E day and taking the children to the game.(placed in personnel files) 5 �Correspondence from the Division of Criminal Justice addressed to Chief Brophy was received thanking Sergeant Ferguson for his assistance during the D.A.R.E seminar.(placed in personnel file) A letter from Ms. Alston thanking Officer Lombardi for the kindness and consideration he showed during a recent family problem, (placed in personnel file) A letter from the principal of WI school was received praising Officer Nevelus and the D.A.R.E program and commenting how much the kids love him. A letter from Gelsea Shafer and Pat Naley was read regarding the progress of the Hudson River waterfront park. A letter from Joseph Diaz of 19 Andrews Lane was received thanking the village for the tree planted in front of his home. An invitation was received inviting the Mayor and the Board to the Senior Citizen picnic on Wednesday. Mr. & Mrs. Pierce thanked the village for the planting of a dogwood tree in front of their home. A letter was received from a former alumni of North Tarrytown, Janis Harris McLean, commending the village on the positive improvements on Beekman Avenue. A letter was received from Leahy Company informing the village that our insurance rating has been revised and we will be receiving a credit exceeding $35,000. in compensation premiums. Mayor Treacy read a letter from Phil Spaziale of MEBCO in which a check for for $23,400. was enclosed representing 5% return of deposits that were made by us in 1993. A letter from Assemblyman Brodsky was received supporting Public Television on the Hudson. Mayor Treacy read correspondence from the Westchester Arts Council informing the Village that they have been awarded a CDBG grant t.o implement artist residencies in North Tarrytown as well as other areas in the County. The NYS DOT will be awarding us CHIPS money of approximately $16,000. which will be used for the local highway improvement program for curb and street repairs. The State Comptroller has informed us we will be receiving more revenue sharing for the Village on September 15th in the amount of $46,791. The second annual Fire Department parade will be held on Saturday July 30, 1994 at 2 PM. Public Comments In an effort to save time, the Mayor suggested that all public comments be heard now if the Board didn't object. Trustee Alter moved, second by Trustee Horecky to open the public comment section, carried. 6 �I Sunny McLean of Cable gave a brief presentation about what public television has been doing for our community and the surrounding communities. Two residents, Mr. Jimenez and Ms. Brand spoke about having merchants keep their storefronts clean of debris. Ms. Brand also commented that pigeon droppings are a big problem on Cortlandt Street and wished that signs reading "Don't Feed the Pigeons" could be erected. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the public comment section, carried. Mayor»s Report The Mayor reported that paving on Gory Brook Road, Ridge Street, Spruce Street and Kelbourne Avenue has been completed, also curbing on Kelbourne Avenue. Sidewalks and handicap ramps on Beekman Avenue have been completed, lights have been installed at Barnhart Park as has the playground equipment. Valley Street, Clinton Street, Pine Street will be paved. Sidewalks on Valley Street will be rebuilt, curbs on Van Tassel and Holland Avenue will be rebuilt and ten trees will be planted on Cortlandt Street by July 2 9th. Margotta Courts playground will be getting two spring horses and the play area will be repainted. North Tarrytown and Tarrytown have received grant money to improve Sykes park lighting , new picnic tables, and three spring horses. The fence between the parking lot and the park will be taken down since it is always damaged by those trying to go through the lot to the park. The 52 College Avenue building has been purchased by Larry Regan who will convert it into market value apartments. We have a police walking patrol on Thursday through Sunday night. We will receive a grant for $100,000. in 1996 to rebuild the sidewalks on Cortlandt Street and have applied for a UDC Facade Improvement Grant for the storefronts on Cortlandt Street. The Mayor commented that we have a proposal to build a park by the water called Sleepy Hollow Landing. There will be a dock for ferrys and fishing and a beach. The Mayor stated that since we enacted a local law regarding window guards, anyone in an apartment who has a small child and wants a window guard should request this from their landlord. Mayor Treacy commented that LaTerrazza bar is closed and the Board passed legislation to prevent any adult entertainment business from opening at that building. There has been an incinerator problem at College Arms and the Mayor met with Barbara Fratiani and College Arms has been cited for a faulty incinerator. There is a County hotline number to call if you see the incinerator burning at night; 593-5100. Village Hall now has an answering machine if anyone has a problem that is not an emergency when Village Hall is closed, call 631-0533. 7 �I Mayor Treacy, Linda David and Janet Trebor met regarding the new riverfront park. The Army Core of Engineers will be helping us with the dredging which will save us money. Congressman Fish and Senator Moynihan are both in full support of this park. North Tarrytown is one of the villages in the group, Historic River Towns of Westchester; they are in the process of hiring a consultant to help promote this area and bring in tourists. Westchester County has received federal funding to institute grants to local municipalities to work in youth related areas. Tarrytown and North Tarrytown have entered into an agreement and have been awarded a grant to fund the council. We are working with the COC, schools, churches, etc. to have trips for local children. Henry Atterbury is the Liaison to the Advisory Council, and Mayor Treacy appointed Jose Blanco as Liaison to the Youth Council. Mayor Treacy commented that there had been a problem at day camp where an asbestos firm was hired to remove the asbestos. Thanks to the quick work on the part of our Administrator, Linda David, the work has been held off until camp is over. Trustee Reports Trustee Alter reported that installation of the Barnhart park equipment will be completed tomorrow, the North Tarrytown Seniors picnic will begin Wednesday at 10:30 AM at Kingsland Point Park. Recreation programs are running smoothly. Trustee Alter commented that with regard to the Rte. 9 Scenic Road designation, there is a prerequisite. He then resolution #07/92/94 which was unanimously passed. The final document should be ready before the end of July. Trustee Blanco reported that the Planning Board will meet on July 21st and urged residents to attend. He commented that the men and women of the Fire Department do an incredible job and their main concern is for the safety of the people and nothing else. Trustee Horecky thanked Henry Atterbury and Billy Lund for the excellent job they did for the concert at Morse park on the July 4th weekend but commented that the Avenue was not cleaned. He commented that the new garbage pails look much better than the old ones and the signs on each pail that read "No Household Waste" should stop residents from putting their garbage in these receptacles. Trustee Horecky commented that we have been experiencing a problem with paint fumes that we suspect are coming from GM and urged residents to call Village Hall if they smell this. Trustee Horecky stated that we are waiting for garbage pails to be put back in Barnhart Park; the Administrator commented that the pails are on order and will be put there as soon as they arrive. 8 �Trustee Horecky stated with regard to the quality of life in the Village, that we are trying to catch those people who are not picking up after their dogs and have asked the Police Department to try and enforce the ordinance more, also the parks are in a horrible condition with containers of beer, etc. and he has asked the police to patrol the parks more, crack down on offenders and to make sure no one is in the parks after 9 PM. New lighting has been installed in Barnhart Park and the ramp will be removed. Trustee Horecky stated that amending the agenda is not a political move, but it is one person unable to work with the Board. Trustee Horecky commented that he is not a political person, but that he ran for office to do good for the Village and the people. Trustee Hyland reported that the play equipment has finally been installed at Barnhart Park and is practically tamper proof. The ramp will be taken out soon although it has not been done yet. Trustee Hayes had no fire report. The Library Board met on July 14th to discuss the revised budget of the Interior Design group who will be redesigning the reading room. There will be more details at another meeting on September 22, 1994. Trustee Hayesi read attached resolutions #07/93/94 and 07/99/94 with regard to purchase of fire department vehicles. The Mayor thanked Trustee Hayes for his work in helping to acquire these vehicles. Administrator's Report Linda David read the Prosecutor's report. She also read the agenda for the Zoning Board meeting which will be held on July 20th at 8 PM and the Planning Board meeting which will be held on July 21st at 8 PM. Resolutions-Attached Old Business Mayor Treacy made the following appointments: Police Surgeon-Dr. Elio Ippolito Parking Authority-Reappointed Sal Donzella for three years Bureau of Fire Prevention- John Morabito Zoning Board of Appeals-Gary McLean, to fill the unexpired term of John Sherwood. Mayor Treacy reappointed Filomena Fallacaro as Village Registrar for a term of two years, second by Trustee Horecky and carried 6-0 Mayor Treacy reappointed Emil Imhof as Senior Citizen Commissioner, second by Trustee Horecky and carried 6-0. Mayor Treacy reappointed Kay Brown Grala to the North Tarrytown Housing Authority for a term of five years, second by Trustee Hayes and carried 6-0. Mayor Treacy designated the Westchester Gannett newspaper as our Official Newspaper, second by Trustee Alter and carried 3-2 with Trustees Hyland and Horecky voting No and Trustee Blanco abstaining. 9 �Mayor Treacy designated Roberts Rules of Order as the Official Parliamentary Procedures, second by Trustee Horecky and carried 6-0. Mayor Treacy reappointed Angela Everett as Deputy Village Clerk for a term of two years, second by Trustee Horecky and carried 6-0. Mayor Treacy reappointed Linda David as Village Clerk for a term of two years, second by Trustee Alter and carried 6-0. Mayor Treacy reappointed Mr. & Mrs. Theodore Hutchinson as Village Historians, second by Trustee Horecky and carried 6-0. Trustee Hyland moved, second by Trustee Blanco to approve the following appointments: Robert Balog reappointed as Village Assessor for a term of one year, Joseph A. DeMilia, Jr. reappointed as Village Auditor for a term of one year, Emil Imhof reappointed to the Fire Board of Appeals for a term of five years, Eugene Cialini reappointed to the Electrical Board of Fire Underwriters and Anthony Soares reappointed to the Electrical Board for a term of three years; motion carried 6-0. Mayor Treacy reappointed Adrian Kringas and Ronald Simcoe to the Handicap Committee for a term of two years each, and reappointed Trustee Hayes as Liaison to the Library Board and Jose Blanco as Liaison to the Youth Council. Mayor Treacy appointed Jim Combs to the Ethics Committee and reappointed Samuel Gittens, second by Trustee Alter and carried 6-0. New Business-None Executive Session ' Trustee Alter moved, second by Trustee Blanco to adjourn to executive session to discuss a litigation matter. Discussion ensued on the LaManna matter and it was the consensus of the Board that there should be a cap on the amount our attorney should offer the plaintiff. RESPECTFULLY, > LEONARD A RUTIGLIANO SECOND ASST CHIEF/SECY I �Meeting Dates Resolution #; 07-19-94 07-92-94 WHEREAS, the New York State Department of Environmental Conservation (NYSDEC), pursuant to Article 49 of the Environmental Conservation Law, is empowered to designate scenic highways in the state; and WHEREAS, the public highway known as Broadway (U.S. Route 9) within the Village of North Tarrytown (1.7 miles) exhibits exceptional historic and scenic quality and passes through an area of significant regional importance; and WHEREAS, a study has been undertaken by a committee of the Village Board of Trustees, working with a consultant landscape architect, that assessed the scenic quality of the nominated road and documented^ the cultural, historic vegetative and geomorphic features of said highway corridor; and WHEREAS, it is intended to forward to NYSDEC the assessment as the basis for nominating the named road corridor as a scenic road; and WHEREAS, the Village of North Tarrytown has made a recommendation to support the nomination of Broadway (U.S. Route 9) as a New York State Scenic Road, NOW THEREFORE, BE IT RESOLVED, that the Village Board of Trustees hereby requests and encourages the NYSDEC to quickly designate that portion of Broadway (U.S. Route 9) within the Village of North Tarrytown as a scenic road.
