Present: Mayor Sean Treacy John T. Hayes, Jr. Michael Hyland Scott P. Horecky Jose Blanco Morris Alter Greg T. Jeffers Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearings-None Approval of Minutes Trustee Alter moved, second by Trustee Hayes to approve the minutes of the September 7, 1994 as written, motion carried 5-0 with Trustee Horecky abstaining. Approval of Warrants Trustee Hayes moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills. Total of the General Fund is $163,462.22 and the Water fund total is $34,537.37. Discussion ensued. Trustee Hyland commented that he would be voting no because the,Village Attorney did not attend the work session to answer questions on the revision of the zoning code. Trustee Horecky questioned the payment to Neighborhood House, John Lewis and Municipal Management Association. Village Treasurer commented Neighborhood House is a contractual payment, John Lev/is is an attorney hired to collect delinquent Planning Board fees and the last one is dues. Motion carried 6-1 with Trustee Hyland voting no. Public Comments-Agenda Items Only Trustee Hayes moved, second by Trustee Horecky to open the public comment section, motion carried. Dr. Sweet asked with regard to the hospital agreement, what were 12 dumpsters. Mayor Treacy commented that they are not dumpsters, but bins. There being no further comments, Trustee Alter moved, second by Trustee Blanco to close the public comment section, carried. Resolutions-Attached Discussion ensued on the Phelps Hospital agreement with regard to the composting site. Trustee Hyland commented that he is looking into the possibility of using Peabody Field. They met with the School Board and we should know within two weeks. The Mayor stated that permits will be needed and wetland applications need to be made before we oan start using the site. 1 �Trustee Blanco commented that we are only talking about waiting two weeks. The Mayor commented that the highway department will start picking up the leaves by the end of this month and we need a place to bring them. Old Business-None New Business Mayor Treacy commented that the village election will be held on Tuesday, March 21, 1995. Mayor's Report Mayor Treacy gave the Public Works report; sidewalk project on Valley Street is continuing, 50/50 sidewalk program is still in progress, dead end of Millard Avenue has been paved, tree work is continuing, leaf pick-up equipment is ready with pick-up to start the end of September, new concrete apron has been completed at the Ambulance, building, drainage at Devries field will be completed this week, water pressure in Sleepy Hollow Manor will be tested this week to make sure there is no problem with the hospital during the winter months, our first shipment of 600 tons of salt and 200 tons of sand will be ordered October 1st, curbs will be replaced in Webber Park and snow removal equipment is being serviced. The Mayor met with Henry Atterbury and Bill Graham of Sleepy Hollow Cemetery to discuss the creation of a Greenway trail in the village, one section will go through the cemetery. There was a meeting with Janet Langsam of the Westchester Arts Council to discuss bringing an after school arts program to the village. The Mayor, Don Kusel, Robert Plunkett, Robert Balog, Don Walsh, Linda David, and Robert Meehan met to discuss the impending reassessment of the General Motors plant. At the last work session there was a presentation on the Local Waterfront Redevelopment Plan. It will take approximately six months before this plan can be presented to the public. Trustee Horecky commented that Dr. Sweet should be given a round of applause for all the work he has done on this. The Mayor commented that Don Stever, Nick Cicchetti and others should also be applauded. Mayor Treacy received good news from the Leahy Corp.; we had a lower experience rate on worker's compensation which represents a 20% reduction in our insurance rate of approximately $15,000. and we will receive a 10% credit for this years premiums. Trustee Reports Trustee Jeffers reported that the Sleepy Hollow football team had their first defeat last Saturday and urged everyone to support this team at their upcoming games. 2 .^^.^x:.••v•^ , .l;:>.^^^•^•, �Trustee Alter reported that the Street Festival held last Saturday was a great success with approximately seventy vendors; there were approximately 12 0 runners signed up for the five mile run; winners were Kay Grala and Douglas Morton; there was also a two mile fun run. He thanked Henry Atterbury,Christine Yurkovic, the highway department and the Recreation Commission for all their help in putting this together. The Haunted Hayride Committee will meet on September 29th at 5:30 at Village hall. The Mayor success. also thanked everyone who helped make this day a Trustee Blanco welcomed more new businesses to the Village; an ice cream shop and dental office on Beekman Avenue and Barstow Architect has opened on Pocantico Street. He commented that the request from several residents to have a tree trimmed on Cortlandt and Depeyster Streets will be done shortly. Trustee Horecky thanked the Walking Patrol and the Police Department for a great job that was done over the Labor Day weekend. Many summonses were issued for open containers. He thanked Officers Lombardi and Cotarello for capturing a bandit on Elm Street. He reported that he and Linda David met with the Noise and Litter Committee to discuss the shopping cart problem, the telephones have been removed near M&S market. The Mayor commented that they were moved around the corner. Trustee Horecky commented that the Building Inspector will issue an order to the owner to remove them from that area. Trustee Horecky thanked Henry and providing the music on Labor Day. Andre for their work in A "No Outlet" sign has been erected on Howard Street as well as "Children at Play" sign on Andrews Lane. There are a few other places he would like a "Children at Play" sign put and will discuss this with the General Foreman. Trustee Horecky met with Judge Frascati regarding the Noise and Litter Committee's recommendation to implement community service in addition to existing penalties in quality of life offenses and he wanted to know if we needed a public hearing to do this. Village Attorney will check into it. Trustee Horecky would like the Parking Authority to be present at the next work session. The Mayor commented they are scheduled. 3 �Trustee Horecky commented that there is a need to increase fines for crimes and that Chapter 40, "Peace and Order" and Chapter 19, "Ethics" need to be revised and wanted a public hearing on October 18, 1994 for these revisions. Village Attorney will get the specifics for these hearings from Trustee Horecky. Trustee Horecky reported that many people have told him there are many illegal apartments in the village and he urged anyone that knows of any of these apartments to contact him or the Building Inspector with their complaints. Trustee Horecky moved that he be made Chairman of the Police Committee, second by Trustee Hyland and carried. Mayor Treacy commented that although the Walking Patrol did a good job over Labor Day weekend, this past weekend's report showed no activity. Discussion ensued on the merits of Walking Patrol. I Trustee Hyland reported that the paving program is saving the village money. The updated equipment in the highway department helps cut down on compensation cases because the newer equipment is safer. He commented that we need to hire a person to clean village hall and the fire departments because they are a mess; hiring a part time person a few hours a week will help. Trustee Hyland commented two years ago many illegal apartments were found and the owners brought to court; this brought in alot of revenue- This has not been the case in the past fourteen months. Mayor Treacy commented that the Code Enforcement Officer is the one who sites the buildings first, then the Prosecutor acts on it. The Mayor read the Prosecutors report. Trustee Hayes commented that the Library Board will meet this Thursday and he will give a report at the next meeting. There was no fire report. I Administrator's Report Linda David added her thanks to all those who helped to make the Street Festival a success.• She read the Zoning Board agenda for September 21st at 8 PM, the Planning Board agenda for September 2 2nd at 8PM, the ARB agenda for September 28th at 8 PM, the Recreation Commission will meet on October 12th at 7PM and the Noise and Litter Committee will meet on September 2 2nd at 7:30 PM in Columbia Hose, the School Board will meet on September 22nd. Communications,Petitions and Requests Deputy Clerk read correspondence from Uncle Jerry's Deli informing us of their intent to renew their beer-wine cooler product license.(Referred to Police Chief) ' ,' ' V I �> : : i :;::&';:k:i4 Mayor Treacy read a letter from Union Hose regarding safety conditions of North Tarrytown and the proposed possibility of moving Union Hose to new headquarters. If the members agree to this option, they will accept the Board's offer but not to move in with another company. They asked that the Board advise them of any other plans they may have for Union Hose. The Mayor was in receipt of a petition signed by about 35 residents at the lower end of Beekman Avenue regarding the problems being caused by Rocs Bar. (Referred to Police Chief) Correspondence from the US Department of Justice informing us that grant applications to hire more police officers that were not considered last year will be considered this year. The Mayor commented that we are allowing a NYU senior to make a film outside Village Hall on October 8th. Public Comments Trustee Jeffers moved, second by Trustee Horecky to open the public comment section, carried. Chief John Morabito commented that there will be a house inspection on September 3 0th, firemen and apparatus inspection will take place on October 1st with a parade to follow and then a dinner. He asked that the parade route be closed off for the duration of the parade, Trustee Hyland moved to approve this request, second by Trustee Horecky and carried. Chief Morabito commented that he will have Fire Prevention week information available at the next meeting. Henrietta Brand of Cortlandt Street commented that she felt the Walking Patrol has done a great job over the summer. She commented that there is nothing wrong with Cortlandt Street, most problems are created by people who don't live there. Ms. Brand suggested that the GM plant be turned into a gambling casino. Mayor Treacy commented gambling is illegal in New York. Sam Gittens of College Arms requested garbage cans outside of College Arms and asked when the rest of the trees on Cortlandt Street will be planted and when will the sidewalks be done. He commented that some of the trees will not survive the winter. Mayor Treacy commented that ten more trees are coming and the sidewalks won't be done for three more years. There are certain times of the year to plant trees. Mario Garzia and Starkey who are part of a group willing to do community service asked when they will be meeting to discuss this. The Mayor commented there was a meeting scheduled today but no one came. A meeting was then set for Monday at 1 PM. Bobby Levine asked about the repaving on Rte. 9. 5 �I V Mayor Treacy commented that the entire length of Rte. 9 is being repaved and he thanked Linda David for contacting DOT to have North Tarrytown's portion included in the repaving. Linda David commented that our General Foreman will be meeting with the DOT regarding the manhole covers and the repaving work should be completed by the end of October. Don Caetano asked Trustee Horecky what he intended to do with illegal apartments. Trustee Horecky commented that the request goes to the Building Inspector to make sure it's followed through. He asked that people write in with their complaints and he will make sure that it is followed through. Mr. Kavicky asked what route the trailway would follow. The Mayor commented that the trail would extend from Kingsland Point across the ol$ pedestrian bridge into Devries field, along the south side of the Pocantico River, up into the Restoration, cross route 9 at the corner opposite Sleepy Hollow Cemetery through the big gates. People will walk along the roadway that is next to the Pocantico River. Frank Rey asked if it is true that GM is leaving in 1997 and asked for the status of the expenses of the GM lawsuit. Mayor Treacy stated that they were told by Plant Manager ,Gus Beirne, that GM was closing in 1997. One hundred fifty thousand dollars ($150,000.) has been budgeted for this lawsuit. Donal Walsh commented that Berle, Kass & Case, our attorneys have received $30,000. up until this summer. Mayor Treacy commented that he believed the whole total from the previous fiscal year to now is in the realm of $80,000. to $90,000. There being no further comments, Trustee Horecky moved, second by Trustee Blanco to close the public comment section, carried. It is the public policy of this state that each child of this state should have access to quality health care and adequate protection against the extraordinarily high costs of health care services which are determined to be catastrophic and severely impact a child and his/her family. The Mayor and Board of Trustees of North Tarrytown by this resolution do endorse and vigorously support this bill to help the families of those children with catastrophic illness to help cover the extraordinarily high cost of health care services.
