Present: Mayor Sean Treacy Absent: Greg T. Jeffers (Arrived Late) Morris Alter Jose Blanco Scott Horecky Michael Hyland Trustees Trustee John T. Hayes, Jr. Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Alter meeting. moved, second by Trustee Blanco to open the Mayor Treacy presented Chuck DePaolo, outgoing Fire Chief, the Chief's Award Certificate for his past year of service to the village. Lenny Rutligan and John Cellante presented Chuck DePaolo with the Chief's pin and Mayor Treacy presented him with a key to the Village. Chuck DePaolo thanked the Mayor, their support during his term. Board and Administrator for Chief John Morabito presented John Cellante, First Lieutenant of Ambulance Corp. with the EMS Citation of the Unit of the Ambulance Corp of the Village of North Tarrytown. Chief Morabito read a list of activities for Fire Prevention week. Mayor Treacy urged everyone to support our fire department who are a group of very dedicated men and women. Executive Session Trustee Hyland moved, second by Trustee Horecky to go into Executive Session, motion carried 3-2. The Mayor had preferred it to be held at the end of the meeting rather than keep residents waiting. Discussion ensued on a litigation matter regarding the Murphy claim. Trustee Horecky moved, second by Trustee Blanco to authorize the attorney to settle this case with a cap of $2 0,000. to $25,000. Motion carried 5-1. 1 �Our attorney, Donal M. Walsh, Jr., wanted it noted for the record that although he and his colleagues were on this case originally, he has had no consideration in this case since he became Village Attorney and it was turned over to another attorney. Discussion ensued on the police contract negotiations. Trustee Blanco moved, second by Trustee Horecky that the Board offer the police.. department 5% on the salary portion for a one year contract, motion carried 4-2. Discussion ensued on a personnel matter, but no formal action was taken. Public Hearings Mayor Treacy read the attached public hearing notice regarding amending Chapter 62-37. Trustee Blanco moved, second by Trustee Alter to open the public hearing, motion carried. Dr. Richard Sweet commented that since one member of the Planning Board should be on the Tree Commission, would that be affected by the adoption of this amendment. Mayor Treacy commented that it would not, it only affects the Zoning Board. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the hearing, motion carried. Trustee Alter moved, second by Trustee Blanco to adopt these amendments to the Zoning code. Discussion ensued. Trustee Hyland wanted further clarification and wanted it discussed at the work session with the attorney present. Motion failed 2-3 with Trustees Horecky, Blanco and Hyland voting No, Mayor Treacy and Trustee Alter voting Yes and Trustee Jeffers abstaining. Donal Walsh commented that he will not be available for the next work session, but could send someone in his place. Approval of Minutes Trustee Alter moved, second by Trustee Horecky to approve the minutes of September 20, 1994 as written, motion carried. Approval of Warrants Trustee Blanco moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills with the addition of the bill for the Fire Inspection dinner. Discussion ensued. Trustee Hyland commented that he would not vote on #1473 and Trustee Horecky questioned payment to Quarterdeck and wanted an update on the bill from Berle, Kass and Case. Trustee Blanco then moved to approve the warrants with the exception of the bill from Quarterdeck, motion carried. Total of the General fund is $108,687.10 and the Water Department total is $ 4246.61. Public Comments-Agenda Items Trustee Alter moved, second by Trustee Blanco to open the public comment section, motion carried. �Frank Rey asked what expenses we have incurred in legal fees to date with regard to the GM lawsuit. Mayor Treacy commented that he did not have the figures on hand but would have them by the next meeting. Dr. Sweet asked for an explanation of resolution #121 and #124. Mayor Treacy commented make improvements to assessment going up, silicate for the water that this amendment would help homeowners their homes up to $50,000. without their #124 pertains to a contract for sodium department. Frank Rey asked if the exemption would apply to businesses also, the Mayor responded no only for residential dwellings. Trustee Alter moved, second by Trustee Horecky, to close the public comment section, motion carried. Resolutions-Attached Following discussion on resolution #123, Trustee Jeffers moved to reconsider the resolution, second by Trustee Alter and motion carried 4-2 with Mayor Treacy, Trustees Blanco, Jeffers and Alter voting yes and Trustees Hyland and Horecky voting no. Old Business- None New Business Mayor Treacy gave the public works report: sidewalk project on Valley Street is continuing, our 50/50 sidewalk is still in progress, tree work is continuing, leaf equipment is ready to go with the leaf pick-up program starting October 10th, first shipment of salt and sand was ordered October 1st, curbs will be replaced in parts of Webber Park, snow removal equipment is being serviced, village owned parking lots have been cleaned up and the village is looking into putting a roof on the old storage tanks for salt storage. Mayor's Report Mayor Treacy commented that he attended the Fire Department events over this past weekend; house inspections, dedications, etc. He attended a legislative breakfast regarding tourism. County Board of Legislators attended as well as Ellen Hanig of Historic Hudson. We will be seeking out additional grant money and hope to open the Horseman Trail next spring; a volunteer group will blaze the trail starting tomorrow, we have received a $1000. grant from the Greenway Conservancy to build the gate between Sleepy Hollow Cemetery and Douglas Park. N. Tarrytowjn is starting to become a tourism town. The Mayor met with Tarrytown officials regarding proposals for tourism for both villages. The Mayor stated that we have been forced to close the recycling center except for Wednesdays when the men are there due to the fact that people are dumping other than recycling items there. 3 �•v." f-r.-uJtWHr** There has been no signed agreement for the compost facility. Mt. Pleasant will allow us to bring our leaves to their site in the meantime and we have had no answer from the school district with regard to using Peabody field. The Mayor read a memo from Joe DeFeo, General Foreman, recommending that the village secure a site within the village to compost leaves in order to cut down on costs, travel time, and dumping fees, stating that the cost incurred by the village in the past were high when the leaves had to be carted away. The Mayor warned residents and visitors that the police are giving out tickets in great numbers for parking violations especially double parking. He read a letter that he sent to all store owners regarding the double parking situation. Trustee Reports Trustee Jeffers had no report. Trustee Alter reported that Route 9 in North Tarrytown has been granted the scenic designation. He thanked all the groups who supported this. The Recreation Commission will meet on October 12th at 7 PM in Columbia Hose. On October 28th there will be a costume parade for all ages, pie eating contest and a magic show. On October 29th there will be a Haunted Hayride starting a 7PM and the last ride will be at 11:3 0PM. The cost is one dollar. There will also be a reading of the Legend of Sleepy Hollow at the Old Dutch Church on October 28th and 29th from 8-9 PM. Anyone interested in participating in a touch football league, please contact the Recreation Department. Trustee Blanco thanked the Fire Chiefs for the invitation to the Fire Inspection affair and dinner that took place this past weekend, it was very enjoyable. Trustee Blanco asked pedestrians only. the Mayor if the trail is open to The Mayor commented that Rockefeller State Park will not allow bikers, but the Aqueduct trail does allow bikers; this will be something that will have to be worked out by the Village if they assume the additional liability. Trustee Horecky thanked the Fire Chiefs for their invitation to the Inspection ceremony and dinner which he enjoyed. Trustee Horecky met with the Village Attorney regarding the Peace and Good Order ordinance and amending the Noise ordinance 36-4. He thanked the Noise and Litter Committee for the progress that they are making. 4 Ml �I The Walking Patrol was very successful this weekend; summonses were issued. many He commented that Judge Frascati and Joe DeFeo met to discuss community service hours. Trustee Horecky was disappointed to read about the meeting at Historic Hudson Valley that many of our local legislators do not expect any new implementation of programs or monies coming from the State for the Hudson Valley area. Mayor Treacy commented that the newspaper was not clear on that, there will be additional aid. Trustee Horecky felt that board meetings should be held in Village hall and not elsewhere. " Trustee Horecky then moved that Board meetings not be moved to other areas especially during campaign season, motion second by Trustee Hyland. Discussion ensued. Mayor Treacy commented that there was no objection when the meeting was held at Margotta Courts or the Van Tassel. He also stated that public hearing notices were published listing the Historic Hudson as the place for the hearing. Trustee Horecky commented that there were very few people in attendance at Margotta Courts and he felt that the residents will come to Village Hall if they want to attend a meeting. Trustee Horecky commented that he is working with the Village Attorney on trying to amend the Ethics Code, Chpater 19 especially regarding appointments to different boards and when he wanted to call for a public hearing to do this, the Mayor was against it. The Mayor commented that he was the author of the Ethics Code and he was in favor of adding a section to the code stating that no political officer or no employee of the Village, should serve on any organized party of the Village, including himself. If that is adopted, he will resign as Chairman of the Democratic party and would ask Trustee Hyland.to resign as District Leader. On the motion not to change the meeting until after the election, Trustees Horecky, Blanco, Jeffers and Hyland voted yes and Mayor Treacy and Trustee Alter voted no. Trustee Hyland reported that the new Fire Patrol truck will be put into use on October 5th. He thanked the members of the fire department who pushed for this truck. He commented that he has been made an honorary member of Fire Patrdl and has received a plaque. Trustee Hyland gave an explanation of how the proposed composting site at Peabody field would work. He showed the area on the large map where this site is located and commented that the residents in that area should not be affected by the trucks that will be dumping the leaves because the area is situated far enough away. 5 �Mayor Treacy commented that a permit from the DEC will be needed and it could take two months, that area is a wetlands area and there will probably be fifty truckloads a day. Administrator's Report Linda David reported that the Chamber of Commerce will be placing corn husks on street lights in N. Tarry town and Tarrytown on October 15th. Anyone interested in helping, call Ann Marie at 631-1705, Tarrytown and N. Tarrytown are holding an American Heart Association walk on October 23rd from 9AM-Noon, the school board will meet on October 13, Noise and Litter Committee and Library Board will meet on October 27th Communications, Petitions & Requests Deputy Clerk read attached correspondence from the Board of Fire Wardens regarding the actions approved at their last meeting. Trustee Hyland moved, second by Trustee Alter to approve their actions, motion carried. Correspondence from Leonard Galante, President of Central Veterans Committee was read requesting permission to hold its annual Veteran's Day service at Patriots Park on November 11, 1994 at 10:45 AM and inviting the Mayor and Trustees to attend. They also requested that the fire whistle blow at 11 AM on that day. Trustee Hyland moved, second by Trustee Blanco to approve their request, motion carried. (Letter referred to the Police Chief and Fire Chief) Mayor Treacy read correspondence from the PMIA opposing the Peabody field as a compost site and in favor of staying with the Phelps site. Correspondence from George Hritz, Chairman of the Planning Board, was read regarding the resignation of Steve Salman and he asked that the Board consider appointing Joanne Becker as his replacement. Correspondence from the Sleepy Hollow Garden Club was received commenting that they are in favor of the designation of Route 9 as a scenic highway. Mayor Treacy commented that we would thank all the groups in writing who were supportive of this designation. The President of the PTSA invited Mayor Treacy to attend a welcome party for exchange students to be held on October 18th at 3:15 PM. The Mayor commented that the Duracell property has received a clean bill of health and he is sending out letters with questionnaires to residents north of Beekman Avenue and west of Pocantico Street asking them what type of development they would like to see built on that site. Public Comments Trustee Blanco moved, second by Trustee Alter to open the public comment section, motion carried. �I I Judge Frascati asked what the agreement with the hospital was with regard to using their site for composting. The Mayor commented we would continue picking up garbage (twelve bins) plow a little bit further than we had been in the past, through route 448 and to remove the sand and salt. Carmen Moriano of Cortlandt Street commented that she has been very happy with what is being done on Cortlandt Street but it seems that communications seem to stop after elections are over, there is too much arguing and the people in this area need to be informed more. She asked that parking space lines be painted in the area of Cortlandt Street and Chestnut Street. Trustee Blanco encouraged everybbdy to contact any Trustee on the Board if you have a problem. George Hritz commented that the Board gives a negative impression, they must work together. George Hritz of Sleepy Hollow Manor Association and Elliot Martone of Philipse Manor Improvement Association both objected to the proposal that Peabody field be used as a compost site; they felt that the Board should stay with the hospital site and sign the agreement with Phelps. Trustee Hyland commented that the site will only be a small area, less than half an acre. Mark Callan and Bill Jorling residents of the Manor objected to the Peabody site for composting and commented that there will be too many trucks going through that area in the Manor. They commented expenses will be incurred in the meantime while they wait for permits from the DEC, therefore there will be no savings. Frank Rey commented that the points taken were very valid and he suggested that the Board go back and discuss it with Phelps and that we determine tonnage, not bins. There being no further comments, Trustee Hyland moved, second by Trustee Blanco to close the hearing, motion carried.
