                  <text>A Regular meeting of the Board of Trustees of the Village of
North Tarrytown was held in Village Hall on Tuesday, November 1,
1994 at 8:00 PM.

Mayor Treacy called the meeting to order with a pledge to the
flag.

Executive Session
Mayor Treacy made a motion that the Board consider holding
executive session at the end of the meeting rather than at the
beginning so that the people would not have to wait, motion was
seconded by Trustee Alter. Motion died 3-3.
Discussion ensued on the Teamsters contract.

Discussion ensued on the PBA contract. The Board of Trustees
voted to delete the bilateral review of the PBA rules and
regulations. The Mayor voted against it since he is the Chair of
the Negotiating Team that presented it.
The Board then voted
unanimously, including the Mayor to offer the PBA a revised
contract offer. The only item that was deleted from the revised
contract offer is the review of the Police Rules and Regulations.
Discussion ensued on a litigation matter but no formal action was
taken.
There being no further business, Trustee Hyland moved, second by
Trustee Alter to adjourn the executive session and go back to the
regular session, motion carried.
Public Hearing
Mayor Treacy read the attached Public Hearing notice regarding
the creation of a local option property tax exemption program.
Trustee Hyland moved, second by Trustee Alter to open the public
hearing, motion carried.
Mayor Treacy gave a brief explanation of this proposed law,
commenting that it only applies to one and two family dwellings
and that certain criteria must be met.
Dr. Sweet asked if this would be based on the equalization rate

�and would this apply if a new apartment were added.
Mayor Treacy commented it would be based on the equalization
rate. If the existing dwelling was one family it would apply if
a new apartment were added. Repairs will not be considered, only
renovations that add to the market value of the home.
Dr. Sweet asked if the owner can challenge the decision of the
Assessor on the increased market value.

Dr. Sweet commented that this would put a strain on the
non-homestead properties and asked if this will influence the
assessibles of the Town of Mt. Pleasant. The Mayor said no.
There being no further comments, Trustee Hyland moved, second by

Attached resolution #139 was then passed.
Approval of Minutes
Trustee Alter moved , second by Trustee Hayes to approve the
minutes of the October 4, 1994 meeting as written. Motion failed
with Mayor Treacy and Trustees Alter and Hayes voting yes and
Trustees Blanco, Horecky and Hyland abstaining due to the fact
that they felt they were already approved at the October 18, 1994
meeting.
Much discussion ensued on the validity of that meeting. Mayor
Treacy read several memos from Don Walsh regarding that meeting.
He cited a court case that was similar in nature and was not won.
Trustee Hyland moved to adopt the minutes of the October 18, 1994
meeting, second by Trustee Horecky. More discussion ensued on
whether this was a valid meeting. Motion failed with Trustees
Blanco, Horecky and Hyland voting yes and Mayor Treacy and
Trustee Alter and Hayes abstaining.
Donal Walsh stated that he would get something in writing from
NYCOM and give it to the Board.
Approval of Warrants
Trustee Alter moved, second by Trustee Hayes to approve the
warrants of October 18, 1994 and authorize the Treasurer to pay
the bills. Total of the General fund is $78,100.00 and the Water
Department fund total is $42,113.84. Motion failed with Mayor
Treacy and Trustees Alter and Hayes voting Yes and Trustees
Hyland, Horecky and Blanco abstaining because of the same reason.
More discussion ensued.
Trustee Horecky moved, second by Trustee Hyland to approve the
warrants of November 1, 1994 and authorize the Treasurer to pay
the bills, motion carried 6-0.
Total of the General fund is
$131,207.26 and the Water Department fund total is $20,798.

�Public Comments-Agenda Items
Trustee Hyland moved, second by Trustee Alter to open the public
comment section, motion carried.
Dr. Sweet, asked with regard to resolution #128 Cross Connection
fees, that the Board consider amending the whole ordinance since
he felt the fees charged by plumbers is too high. He asked about
resolution #129 regarding sodium silicate. Linda David commented
that the cross connection law is mandated by New York State and
passed along to the village. The sodium silicate is used at our
pump houses.
Mr. Christian, one of the winners of the lottery of the ARCH
condominiums, urged the Board to please pass the resolutions
pertaining to ARCH so that the closings can take place.
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the public comment section, carried.
Resolutions-Attached
On resolution #130, the attorney representing ARCH urged the
Board to pass this resolution because it is very important that
they close on these condos. After more discussion a different
resolution pertaining to the easement was passed. See resolution
#130A.
Old Business
Mayor Treacy read the attached Public Works report.
New Business
Mayor Treacy appointed the following two people to a new Special
Advisory Group to the Mayor's office on Hispanic Affairs; Jose
Chevere and Carmen Moriano.

We have received a $100,000. grant from Governor Cuomo's office
to do a feasiblility study regarding the GM site.
We have received a letter regarding the possibility of putting a
Hunts Point market at that location; the Mayor commented that is
not a good idea at all and we will not consider it.
The Mayor commented that a special meeting was held on October
31, 1994 to pass the senior citizen tax exemption and urged
senior citizens to make sure they file before the end of December
to find out if they qualify.
He thanked Assemblyman Brodsky for $20,000. grants over a two
year period for play equipment at Devries park and other parks.
On November 16, United Way will be conducting a Cablethon at
Tarrytown village hall and the Mayor will be there to help.
On October 24th a movie with Woody Allen was
on Depeyster street.

�Mayor Treacy reported that with regard to the Community
Development Block grant program, we have received $23,500 towards
the American Disabilities Act, $60,000. towards Sleepy Hollow
Landing. In 1995 we should receive $153,500. for ADA, $100,000,
for the sidewalk project on Cortlandt Street and $40,000. for the
Sleepy Hollow Landing and in 1996 $100,000. toward the riverfront
park.
On November 28th from 9:30AM-3:30 PM the Department of Motor
Vehicles will be visiting village hall to offer their Early Image
Outreach Program for residents where they will take your picture
so that you may renew your driver's license or non-driver ID card
by mail. This service is provided free of charge.
On November 3, 1994 from 7AM-9AM Good Day New York will present
their program live from the Philipsburg Restoration.
Trustee Reports
Trustee Alter reported that the events of the Halloween weekend
were very successful; the haunted hayride, the reading at the Old
Dutch Church, store window paintings, etc.
He commented that there was an article in the Westchester Section
of the NY Times regarding the Headless Horseman statue. It also
made reference that many of us envision the Tarrytowns together
as the Halloween capital of the world. There is alot of interest
in North Tarrytown from outsiders.
Trustee Alter thanked all those who helped to make the weekend
events a success.
He commented that the after school programs and men's basketball
are in full swing and two successful teen dances were held
recently.
Mayor Treacy commented that the costume parade was also great.
Trustee Blanco requested that the discussion of possible loading
zones take place at the next work session as well as the
discussion on the freon removal.
Trustee Blanco commented that he has received complaints
regarding the lot at the corner of Clinton and Beekman Avenue.
Linda David commented that the owner was notified but that she
will notify them once more.
Trustee Horecky invited everyone with young children to go to
Barnhart, Reverend Sykes and Devries parks to see all the new
play equipment that was installed.
The costume parade, magician and hayride were all great.
Trustee Horecky thanked the police department for enforcing
traffic violations on Beekman Avenue and thanked Sgt. Caixiero
for the drug arrests made on lower Beekman Avenue. He also
thanked the police department for the their prompt response to
the complaints of car repairs on Andrews Lane.

�Trustee Horecky commented the police walking patrol has ended and
thanked those officers for a great job.
Trustee Horecky thanked the Friends of the Old Dutch Church for
the tours. He thanked Greg Wilson from Tarrytown ambulance corp,
Judy Pircio, Richard Chulla and all members of our ambulance
corp. for their endurance for putting up with the old ambulance.
Trustee Horecky read attached correspondence from Robert Moon and
David Cappello regarding Fire Patrol's new rescue truck being put
into service on October 26, 1994.
Trustee Hyland commended the Police Department for the great job
they did over the Halloween weekend.
He commented that the new roof that the public works employees
put on the salt shed has saved the village money. Also, an old
garbage truck was converted to a new dump truck which will give
us an extra truck on the road especially for the winter months;
thanks to the expertise of Joe DeFeo, General Foreman and his
men, this has also saved the village money.
Trustee Hayes reported that the Fire Department has started their
fund drive and urged residents to contribute whatever they can to
our volunteer firefighters.
The Library Board's program is underway to renovate their large
reading room; Phase I will cost $50,000 and Phase II which will
consist of the furnishings will cost $40,000. They would like to
replace the chandelier in that room.
Administrator's Report
Linda David reported
the Tarrytown School Board will meet on
Thursday, November 10 at 7:30 PM in their Administration Board
room, the Recreation Commission will meet on November 16, 1994 at
8 PM in Village Hall. She read the Zoning Board agenda for the
meeting of November 16 at 8 PM, the agenda for the Planning Board
to be held on November 17 at 8 PM.
Communications, Petitions &amp; Requests
Mayor Treacy read correspondence from Mr. &amp; Mrs. Lenny Rutigliano
to Chief Brophy commending Officers Nevelus, Cotarello and
Lombardi and Sergeant Morrison for their quick response to their
place of business when an intruder was causing problems. (Copy of
letter placed in their files)
Mayor Treacy read correspondence from Cathy and Richard Chulla
commending Officers Kiggins, Bizzaro, Cappello and Ojito
for
their quick response to their call when they thought their child
was missing recently. (Copy of letter placed in their files)
Correspondence was read from John Dobkin,President of Historic
Hudson Valley thanking the Mayor for attending their first
Legislative breakfast recently.

�A letter was received from Mathew Storms of Beekman Avenue
objecting to the loud fire alarm horn.
He suggested that the
firefighters carry beepers rather than have this horn blow at all
hours of the day and night.
A letter from the owner of the Off Broadway Deli was read
regarding the great number of tickets the police have been
issuing lately for double parking in front of stores and did not
feel this was fair.
Deputy Clerk read correspondence from Board of Fire Wardens
regarding actions that took place at their last meeting/Trustee
Hyland moved, second by Trustee Horecky to approve these actions,
motion carried.
Mayor Treacy commented that there will a reopening of the
Seabreeze on Novmeber 3rd at 6 PM and the Mayor, Board of
Trustees and employees are all invited.
Trustee Horecky commented that there will be a Veterans' Day
ceremony at 11 AM on November 11th at Patriots Park.
Public Comments
Trustee Hyland moved, second by Trustee Horecky to open
public comment section, motion carried.
Fire Chief John Morabito commented that he will be sounding
fire alarm at 11 AM on November 11th for the ceremony. The
rescue truck was put into service on October 26th at
insistence.

Henrietta Brand commended the actions of the police department in
issuing tickets but felt that they are going overboard and should
use their judgment.
Carmen Moriano thanked the Mayor for appointing her to the
Hispanic committee and will do her best to help him.
She
commented that it is embarrassing to sit and watch the trustees
argue at the meeting; they should put their differences aside and
work for the village first.
Jose Chevere also thanked the Mayor for appointing him to the
Hispanic committee and will also do his best. He suggested that
the executive session portion of the meeting be held at the end
of the meeting and thought that the DMV coming to village hall is
a good idea.

Trustee Hayes to close the public comment section, carried.

NOTICE IS HERHBY GIVEN that the Board of Trustees of the Village of North
Tarrytown will hold a public hearing on Tuesday, November 1, 1994 at 8;0G p.m. at 28
Beekman Avenue, North Tarrytown, New York to hear and consider the creation of a
local option property tax exemption program for capital improvements to residential
property pursuant to the Real Property Tax Law, Section 421-f of the State of New York.
The intent of said program is to offer a way to ameliorate any increase in real property
assessment that may result when a property owner undertakes a capital improvement.

WHEREAS/ the Village of North Tarrytown (the "Village"),
located in the County of Westchester, State of New York, desires
to issue its serial bonds to finance public purposes authorized
in various bond resolutions respectively adopted by the Board of
Trustees of the Village on June 7, 1994 and June 21, 1994; and
WHEREAS, each of said bond resolutions adopted by the Board
of Trustees of the Village on said dates delegated certain powers
to the Village Treasurer in connection with the issuance of
serial bonds of the Village pursuant to Sections 30.00, 50.00 and
56.00 through 60.00 of the Local Finance Law; and
WHEREAS, Chapter 201 of the Laws of 1994 amends Sections
21.00, 56.00 and 58.00 of the Local Finance law, among the
provisions, to permit a municipality, such as the Village, to
issue its serial bonds with substantially level or declining debt
service and to further permit the Board so Trustees of the
Village to delegate to the Village Treasurer the power to issue
the Village's serial bonds with substantially level or declining
debt service;
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of
North Tarrytown, as follows:
Section 1.
In addition to all powers delegated to the
Village Treasurer, as chief fiscal officer of the Village,
pursuant to the Local Finance Law in the serial bond resolutions
adopted by the Board of Trustees of the Village on June 7, 1994
and June 21, 1994, all powers given to the Board of Trustees of
the Village as the governing body of the Village in connection
with the issuance, terms, and content of serial bonds to be
issued under the authority of said bond resolutions pursuant to
Chapter 201 of the Laws of 1994, are hereby delegated to the
Village Treasurer, the chief fiscal officer of the Village.
Section 2.

Local Law #13 of 1994
Be it resolved that the North Tarrytown Board of Trustees hereby adopts the
following local law to be entitled, Capital Improvement Exemption Law.
Article 1: Residential buildings reconstructed, altered or improved subsequent to the first
day of January, 1995 for residential purposes shall be exempt from taxation and special ad
valorem levies to the extent provided hereinafter.
Article 2, Paragraph A: Such buildings shall be exempt for a period of one year to the
extent of one hundred per centum of the increase in assessed value thereof attributable to
such reconstruction, alteration or improvement and for an additional period of seven
years. Provided, however, that the extent of such exemption shall be decreased by twelve
and one-half per centum of the initial exemption each year during such additional period.
Provided, further, that such exemption shall be limited to fifty thousand dollars in
increased market value of the property attributable to such reconstruction, alteration or
improvement and any increase in market value greater than such amount shall not be
eligible for the exemption pursuant to this section. For the purposes of this section, the
market value of the reconstruction, alteration or improvement shall be equal to the
increased assessed value attributable to such reconstruction, alteration or improvement
divided by the most recently established state equalization rate except where the state
equalization rate or special equalization rate equals or exceeds ninety-five percent, then
the increase in assessed value attributable to such reconstruction, alteration or
improvement shall equal the market value of such reconstruction, alteration or
improvement.
Paragraph B: No such exemption shall be granted for reconstruction, alterations or
improvements unless:
(1) such reconstruction, alteration or improvement was commenced subsequent to
thefirstday of January, 1995; and
(2) the value of such reconstruction, alteration or improvement exceeds three
thousand dollars; and
(3) the greater portion, as so determined by the square footage, of the building
reconstructed, altered or improved is at least five years old.
Paragraph C: For purposes of this section the terms reconstruction, alteration or
improvement shall not include ordinary maintenance and repairs.

�Article 3: Such exemption shall be granted only upon application by the owner of such
building on a form prescribed by the state board. The original shall be filed with the
assessor of the village on or before January 1 of each year. A copy thereof shall be filed
with the state board by the village assessor.
Article 4: If the assessor is satisfied that the applicant is entitled to an exemption pursuant
to this section, he shall approve the application and such building shall thereafter be
exempt from taxation and special ad valorem levies as herein provided commencing with
the assessment roll prepared after the taxable status date referred to in subdivision three of
this section. The assessed value of any exemption granted pursuant to this section shall be
entered by the assessor on the portion of the assessment roll provided for property exempt
from taxation.
Article 5: For the purposes of this section, a residential building shall mean any building
or structure designed and occupied exclusively for residential purposes by not more than
two families.
Article 6: In the event that a building granted an exemption pursuant to this section ceases
to be used primarily for residential purposes or title thereto is transferred to other than the
heirs or distributees of the owner, the exemption granted pursuant to this section shall
cease.
Article 7: A copy of this local law shall be filed with the state board of equalization and
assessment.

of the Local Finance Law, and that the period of probable usefulness of such item is ten (10)
years, The serial bonds in the aggregate principal amount of up to $85&gt;0O0 authorized herein
shall have a maximum maturity of five (5) years computed from the earlier of (a) the date of
such serial bonds, or (o) the date of the fust bond anticipation notes issued in anticipation of the
issuance of such serial bonds.
Section 5. Subject to the terms and conditions of this Resolution and the Local Finance
Law, and pursuant to the provisions of Sections 21:00, 30.00, 50,00, 56.00 and 60.00,
inclusive, of the Local Finance Law, the power to authorize, bond anticipation notes in
anticipation of the issuance of the serial bonds authorized by this Resolution and the renewal of
such bond anticipation notes zrid the power to prescribe the terms, form and contents of such
serial bonds and such bond anticipation notes authorized by this Resolution, and the power to
issue, sell and deliver such serial bonds and bond anticipation notes are hereby delegated to the
Village Treasurer, as the chief fiscal officer of the Village. The Village Treasurer is hereby
authorized to execute on behalf of the Village all serial bonds issued pursuant (o this Resolution

Project (collectively, the "environmental compliance proceedings"). In the event that any of the
environmental compliance proceedings axe not completed, or require amendment or modification
subsequent to the date of adoption of this bond resolution, the Board of Trustees of the Village
will re-adopt, amend or modify this bond resolution prior to the issuance of obligations
authorized to be issued herein upon the advice of bond counsel. It is hereby determined by the
Board of Trustees of the Village that the Project will not have a significant effect on the
environment.
Section 9. The Village hereby declares its intention to issue the obligations authorized
herein \o finance costs of the Project. The Village covenants for Lhe benefit of the holders of
the obligations authorized herein that it will not make any use of the proceeds of such
obligations, any funds reasonably expected to be used to pay the principal of or interest on such
obligations or any other funds of the Village, and will not make any use of any of the vehicles
financed with the proceeds of such obligations which would cause the interest on such
obligations to become subject to Federal income taxation under the Internal Revenue Code of
1986, as amended (the "Code"), (except for the alternative minimum tax imposed on
corporations by section 55 of the Code and except for the environmental tax imposed on
corporations by section 59A of the Code) or subject the- Village to any penalties under section

bonds or any other provisions hereof until the dale which is sixty (60) days after the final

for such purposes on or after a date which is not more than one year prior to the date of
adoption of this Resolution by the Village.
Section 10. The Village hereby covenants for the benefit of holders of obligations
authorized herein to comply with the proposed amendments to Rule 15c2-12 of the Securities
Exchange Act of 1934 (iht "Rule") to the extent such proposed amendments are finally adopted,
and in particular proposed paragraphs (b)(5)(i)(A) and (b)(5)(i)(B) of the Rule, by providing to
a nationally recognized municipal securities information repository: 0) 3t least annually, current
financial information concerning the Village, including annual audited financial statements and
pertinent operating information, and (ii) notice of any material events as set forth in proposed
paragraph (b)(5)(i)(B), unless an exemption from such paragraphs exists as provided in proposed
paragraph (d)(1) or (d)(2) of the Rule, as required by such proposed amendments as finally
adopted.

Amendments to tne minutes of the November 1. 1994 Board
Trustees Meeting Made by Trustee Horecky

of

Second Paragraph of the Approval of Minutes
Trustee Horecky asked the Mayor if the moving of the October 18
board meeting was voted on by the Board of Trustees.
Mayor
replied, "I do not recall."
Trustee Horecky replied that it ws not and should not be confused
with the meetings that were moved over the summer legally by a
vote of the board.
Trustee Horecky states, "the Mayor took it upon himself to move
the meeting without board approval and the furthermore is was
noticed in the paper before the board was notified."
Trustee
Horecky contends that the meeting held at the restoration was an
illegal meeting lacking board approval and would not attend.
Trustee Horecky conends that the "White case" that is being cited
by the Village Attorney is flawed as a comparison due to the
circumstances being completely different.
Trustee Blanco asked the Village Attorney what disciplinary
actions can be taken if a Board of Trustees majority 4-2 vote is
ignored, what can be done?
Village Attorney replied, " that he could not be fined anything,
other than it being a violation of Roberts Rules of Order".
Trustee Blanco states that a majority votew of the Board was
completely ignored and that is the basic problem here and the
Board would like to correct and prevent this from happening
again.
Under Resolution 11/131/94; Trustee Horecky states "I
projects like ARCH and that I in fact, brought it
attention of the Mayor and the Board months ago that a
project for volunteer firemen should be considered
