Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Executive Session Mayor Treacy moved, second by Trustee Alter to postpone the executive session until the end of the meeting so that the people in the audience and at home do not have to wait. Motion failed 3-4. Trustee Hyland moved to go into executive session to discuss PBA negotiations. Mayor Treacy commented that the PBA negotiations were concluded on the date the memorandum of agreement was signed and the Board could not discuss PBA negotiations in executive session. He commented that the Board could go into executive session just to be brought up to date on the negotiations and we also have the MEU contract to discuss in executive session. Trustee Hyland moved, second by Trustee Jeffers to go into executive session for the purpose of having the Board be brought up to date on the PBA negotiations and MEU contract. The Mayor brought the Board up to date on what took place during the negotiations with the PBA and the signing of the memorandum of agreement. Members of the negotiating team and their new representative, Anthony Solfaro, were present in the audience and wanted to meet with the Board in executive session. The Mayor commented that it could only be an informational meeting and nothing else. He commented that since he was the Chief Executive Officer, he would not be present and turned the Chair over to Deputy Mayor Alter. Discussion ensued on issues that the PBA wanted to discuss with the Board since the signing of the memorandum of agreement. The Board will discuss this further at their next work session. After the PBA members left, Mayor Treacy returned and discussion ensued on the MEU contract. Mayor Treacy moved that they offer the MEU an eighteen month contract with a 4% increase for one year and 2 1/2% for the following six months , also a $50. increase in their welfare fund. 1 �I There being no further business, meeting was adjourned back to the regular session. Mayor Treacy informed the audience that PBA issues and the Municipal Employees Unit contract were discussed in executive session. Public Hearings Mayor Treacy gave an explanation of the purpose of amending Chapter 59 Article II. Trustee Alter moved, second by Trustee Blanco to open the hearing, motion carried. There were no comments from the public; Trustee Hyland moved, second by Trustee Blanco to close the hearing, carried. Mayor Treacy read the attached public hearing notice regarding a proposal to amend Chapter 3 6; Trustee Hyland moved, second by Trustee Horecky to open the public hearing, motion carried. Mayor Treacy read the attached public hearing notice to consider proposals to increase fines; Trustee Hayes moved, second by Trustee Horecky to open the public hearing, motion carried. Don Caetano asked about the fine for garbage cans with no covers; would this mean cans in your own yard. The Mayor responded no. Trustee Horecky commented that the officers will be using their discretion when issuing summonses for this violation. Mario Belanich wanted to know if the garbage can is empty and has no cover, can you get a ticket. He was told, not when the can is empty, only full of garbage. Mario Belanich questioned the snow removal fine and whether warnings will be given. Trustee Horecky commented that we are only changing the amount of the fine, everything else remains the same. Carmen Mariano wanted to know what was meant Gatherings; how many people constitute a gathering. by Public Mayor Treacy read the code and commented that it is very vague. Trustee Horecky commented that it would be up to the discretion of the police officer. Don Caetano commented that the word gatherings must be defined. Trustee Horecky commented that the Village Attorney advised him not to make any changes to the code, only to the fines. Mayor Treacy asked Trustee Horecky how many times in the past year has anyone been issued a fine for public gathering. Trustee Horecky answered there have been no tickets issued since April that he is aware of. 2 �Trustee Hyland commented that we are only voting on the increase in the fines. There being no further comments, Trustee Hyland moved, second by Trustee Blanco to close the public hearing, motion carried. Approval of Minutes Trustee Alter moved to approve the minutes of the Special meeting of October 31, 1994 as written, second by Trustee Horecky and carried 5-0 with Trustees Jeffers and Hyland abstaining. Trustee Hyland moved, second by Trustee Horecky to approve the minutes of the November 1, 1994 meeting with additions and corrections; motion carried 6-0 with Trustee Jeffers abstaining. Mayor Treacy comented on page 3, 3rd paragraph from bottom, the $20,000. grant from Assemblyman Brodsky is over a two year period and is for other parks as well as Devries. (See attached sheet with amendments made by Trustee Horecky) Approval of Warrants Trustee Blanco moved, second by Trustee Horecky to approve the warrants of the October 18, 1994 meeting and authorize the Treasurer to pay the bills, motion carried. The total of the General Fund is $78,160.37 and the total of the Water fund is $42,113.84. (See attached addendum) Trustee Hyland moved, second by Trustee Horecky to approve the warrants of November 15, 1994 and authorize the Treasurer to pay the bills with the exception of four bills, Hitzman, Hoffman and O'Reilly, one for Postmaster and one to the hospital for payment for a portion of the fence. He did not think these bills should be paid out of contingency since the Mayor had told the Board there was no money in the contingency fund awhile ago. Also, he felt the bill for attorney's fees was too high since we are still waiting for an answer from NYCOM with regard to the October 18th meeting. Trustee Blanco asked if we could use the $1000. owed the hospital against the money they owe us? The Mayor commented that we owe the hospital more than they owe us. This must be worked out by both parties. Motion died with a 3-4 vote. Mayor Treacy moved, second by Trustee Alter to approve the November 15th warrants and authorize the Treasurer to pay the bills. Trustee Blanco questioned a bill in the contingency line for Beachler Enterprises. Mayor Treacy commented that these were for keys to the village that he gives out and should come out of the Mayor's line. The Treasurer will move this from contingency to the Mayor's line. Motion carried 4-2 with Trustee Blanco abstaining. The total of the General fund is $79,928.07 plus an additional $7000. to Village Attorney and the Water fund is $30,715.75. Public Comments-Agenda Items Only Trustee Hayes moved to open the public comment section, second by Trustee Alter and motion carried. There were no comments from the public, Trustee Horecky moved, second by Trustee Alter to close the public comment section. 3 �Resolutions-Attached Old Business Mayor Treacy read the attached Public Works report. Mayor Treacy read a letter from the Police Department to parents regarding Operation Safe Smile Program created by the District Attorney's office of Westchester County to help locate missing children. This will be held at John Paulding School on December 3, 1994 from 9:30AM-2:30PM. Children ages 2 to 12 will be fingerprinted and have their photo taken which will be included in a Child's Safety Passport. Anyone wishing more information, contact Sgt. Gordon Ferguson at 631-9393. Trustee Horecky urged all parents to join this program. Linda David commented that any papers, belongings, etc. will be returned. New Business-None Mayor's Report Mayor Treacy reported that on November 6th he attended the installation of the new minister at the Shiloh Baptist Church. She is the first woman pastor. The ceremony was very enlightening and full of energy. On November 3rd the Mayor appeared on Good Day New York which was being filmed at the Philipsburg Manor. He presented Jim Ryan with a proclamation and the keys to the village. The Mayor commented that on November 28th from 9:30AM-3:30 PM the Department of Motor Vehicles will be in village hall to present their Early Bird Program so that residents who have the old style drivers license can renew their drivers license or non-drivers ID card ahead of time. They will take your picture and you will be able to renew your license by mail in the future because your photo will be on file. Woody Allen shot a scene from a movie on Depeyster Street a few weeks ago and his production company, Sweetheart Productions has donated two pieces of playground equipment to North Tarrytown. The equipment for Devries park and Barnhart park are called easy diggers and are worth $500. The Mayor reported that the Teamsters contract has been settled and they have signed an eighteen month contract. They received 4% for one year and 2 1/2% for the next six months. The Mayor met with Nancy Gold of Historic Tours of Westchester who is doing a tourism research survey for North Tarrytown. The Mayor commented that we have received approximately 95 responses to the survey that was sent out to residents regarding the Duracell site. The majority of the residents would like to see it be zoned for townhouses and two family dwellings. He will be creating a rezoning committee to work on this project. 4 �i Hitachi is sponsoring a cablethon for United Way in Tarrytown Village Hall on Wednesday from 7PM-10PM and the Mayor will be there to answer the phones for awhile. Trustee Reports Trustee Jeffers and Trustee Hyland had left the meeting earlier. Trustee Alter commented that on November 21, 1994 route 9 will officially be granted the scenic designation by the NYS DEC. Trustee Alter commented that on November 19th Henry Atterbury, Recreation Superintendent, will be taking the children in grades 4 through 9 rock climbing in New Paltz from 8AM-6PM, the fee is $5. Two weeks ago they went caving. On Wednesday, November 30th the TNT coaches will meet in village hall to elect officers. There will be a Recreation Commission meeting at 7PM on November 16th in village hall. Mayor Treacy thanked Trustee Alter for the work he did in getting route 9 scenic designation. Trustee Blanco commented that at the next work session the Board will be discussing the possibility of establishing loading zones for merchants since there have been many complaints from merchants about tickets given for double parking while deliveries are being made. On Saturday and Sunday, Trustee Blanco will be speaking to merchants in the area with regard to where these zones should be put. He commented if he does not get to speak to every merchant, he asked that they let the Administrator know and she will call him. Trustee Blanco commented about the condition of the lot at the corner of Clinton and Beekman Avenue. Linda David stated that she has been in touch with the owners, but they are away now but it should be taken care of in early December. Trustee Horecky gave the monthly police report; 1000 tickets were issued, 27 arrests including DWI, 8 aided cases, 15 car accidents 29 alarms answered and 45 cases in progress. Trustee Horecky thanked Officers Don Pellegrino, Nick Bizzaro, Greg Camp and Bobby Checchi for an outstanding job in enforcing traffic codes. Trustee Horecky congratulated Governor Elect George Pataki. Trustee Hayes had no fire report. The Library board meeting is this Thursday and he will have a report at our next meeting. The Mayor thanked Trustee Hayes for all his help in getting the new ambulance which has now arrived. Administrator's Report Linda David read the Zoning Board agenda which will be held on November 16, 1994 at 8 PM, the Planning Board agenda which will be held on November 17th at 8 PM. The ARB will meet on November 30th at 8 PM. She commented that there will be a Chamber of Commerce meeting on Thursday morning at 9 AM. 5 �Mayor Treacy commented that there may be a need to amend the ARB code to notify adjacent residents of those who are coming before the ARB. Will be discussed at the next work session. Communications, Petitions & Requests Mayor Treacy read correspondence from President Clinton thanking the Village for a copy of a resolution regarding unfunded federal mandates that was adopted by the Board of Trustees. The Mayor was in receipt of a petition signed by twenty residents of North Washington street regarding the lack of lighting in that area. The Mayor commented that we will have the trees trimmed that are blocking some of the lighting and will see if more lights could be put in that area. The Mayor received correspondence from DOT regarding our request for the elimination of the left turn from route 9 into the Manors heading northward. The DOT will be doing a formal study and investigations but stated it will take time. The Mayor commented that he will send this to Senator Oppenheimer to try to move it along more quickly if possible. Mayor Treacy received a letter from Carol Jones regarding a hole by a water main at the train station and would like this area filled in as well as the walkway adjacent to it. A letter was received from the Senior Citizens thanking Fire Chief Morabito, Richard Gross and Jay Brennan for their demonstrations during fire prevention week. Public Comments Trustee Alter moved, second by Trustee Horecky to open the public comment section, motion carried. Fire Chief John Morabito commented that he appreciated the letter of thanks from the seniors; many of them purchased fire extinguishers and smoke detectors which he purchased for them at a discount. He thanked the Mayor, Board and the Administrator for their help in purchasing the ambulance; it is at Union Hose now waiting for the alarms to be installed. Chief Morabito commented that his brother owns a sports store and donates prizes in other village for fishing contests. He suggested that the village do the same. The Mayor commented that he will suggest this to the Recreation Superintendent. Chief Morabito asked if a non driver can apply for a first time non-drivers license on November 28th. The Mayor responded yes. There being no further comments, Trustee Horecky moved, second by Trustee Hayes to close the public comment section, carried. Mayor Treacy voted No. He objected to the increase in the fines for garbage cans left uncovered and for the increase in the fine for riding bicycles on village sidewalks. MOVED:Mayor Treacy SECONDED:Trustee Alter VOTE: Mayor Treacy commented that we need a place to bring our leaves since November 18th is the last day we can bring them to the Phelps site. To carry leaves out of town costs the village money and we have already spent money on the canvas covers for the trucks. Discussion ensued. Trustee Blanco asked that the wording be amended to read tonnage instead of bins. He would like to wait until the Board can discuss how much we owe the hospital as compared to how much they owe us. He wanted to know what position this is going to put us in with regard to the money owed. Trustee Hyland wanted to wait and discuss it further at the work session. He felt we are giving the hospital too many services in return for using the compost site. He felt we could dump the leaves at Devries field in the meantime. After the discussion the resolution was adopted 4-3. �PUBLIC WORKS REPORT BOARD MEETING 11/15/94 Our 50/50 sidewalk program has ended until the Spring. Tree work is continuing. Leaf pick-up program is in still progress residents leaving the leaves loose. and we appreciate The curbs in Webber Park have been completed. Snow removal equipment has been serviced and ready to go. The light installed. pole that was knocked down on Route 9 has been New street lights will be installed in Sleepy Hollow Manor next week. Two handicapped crossing spaces have been installed on Teresa and Elm Street. Pot holes have been repaired on Riverside Drive. There will be no recycling next week due to the Thanksgiving holiday. �Amendments to the minutes of the November 1, 1994 Board of Trustees Meeting Made by Trustee Horecky Second Paragraph of the Approval of Minutes Trustee Horecky asked the Mayor if the moving of the October 18 board meeting was voted on by the Board of Trustees. Mayor replied, "I do not recall." Trustee Horecky replied that it ws not and should not be confused with the meetings that were moved over the summer legally by a vote of the board. Trustee Horecky states, "the Mayor took it upon himself to move the meeting without board approval and the furthermore is was noticed in the paper before the board was notified." Trustee Horecky contends that the meeting held at the restoration was an illegal meeting lacking board approval and would not attend. Trustee Horecky conends that the "White case" that is being cited by the Village Attorney is flawed as a comparison due to the circumstances being completely different. Trustee Blanco asked the Village Attorney what disciplinary actions can be taken if a Board of Trustees majority 4-2 vote is ignored, what can be done? Village Attorney replied, " that he could not be fined anything, other than it being a violation of Roberts Rules of Order". Trustee Blanco states that a majority votew of the Board was completely ignored and that is the basic problem here and the Board would like to correct and prevent this from happening again. Trustee Horecky states, "the Mayor took it upon himself to move the meeting without board approval and the furthermore is was noticed in the paper before the board was notified." Trustee Horecky contends that the meeting held at the restoration was an illegal meeting lacking board approval and would not attend. Trustee Horecky conends that the "White case" that is being cited by the Village Attorney is flawed as a comparison due to the circumstances being completely different. Trustee Blanco asked the Village Attorney what disciplinary actions can be taken if a Board of Trustees majority 4-2 vote is ignored, what can be done? Village Attorney replied, " that he could not be fined anything, other than it being a violation of Roberts Rules of Order". Trustee Blanco states that a majority votew of the Board was completely ignored and that is the basic problem here and the Board would like to correct and prevent this from happening again.
