Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Executive Session Mayor Treacy requested that the Board not hold executive in the beginning of the meeting, but have it at the end the public does not have to wait. He then made a motion executive session at the end of the meeting, second by Alter and motion failed 3-4. session so that to hold Trustee Trustee Hyland moved, second by Trustee Horecky to go into executive session to discuss possible future litigation and negotiations with PBA, motion carried 4-3. Discussion ensued on the possibility of a litigation case as a result of an incident which occurred on November 30, 1994. The consensus of the Board was that the Police Committee would meet with the principals involved in this incident to gather some facts and report back to the Board. Discussion ensued on PBA negotiations. The consensus of the Board was to have the PBA present a ratified contract proposal in writing to the Village that has been voted on and approved by the PBA membership and that the Village Board will find reasonable to include a long term cost savings for the Village. There being no further discussion, the Board went back into the regular session of the meeting. Public Hearing Mayor Treacy read the attached public hearing notice and gave a brief explanation. Trustee Hyland moved, second by Trustee Hayes to open the public hearing, motion carried. Don Caetano commented that the reduced speed limits should also apply to village highway employees. The Mayor stated that the General Foreman will inform his men of the new speed limits. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the hearing, motion carried. 1 �I Approval of Minutes Trustee Alter moved, second by Trustee Hayes to approve the minutes of November 15, 1994 as written, motion carried 6-0. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued. Trustee Blanco questioned payment to Carmen Mariano and Nutrasystems. The Treasurer explained that Ms. Mariano takes minutes at the Zoning and Planning Boards and Nutrasystems is for a warmer to keep the meals for "Meals on Wheels" warm during delivery. Trustee Hyland commented that he is still looking for the $7000. bill for tarps and that he is voting against paying the warrants because of the bill to the Attorney since we still haven't received an answer about the October 18 meeting. Donal Walsh commented that he cannot control how quickly we receive a response once he has sent the letters. After the discussion, motion carried 5-1. Total of the General fund is $346,526.97 and the Water Department fund total is $28,660.49. Public Comments-Agenda Items Mr. Kavicky commented that executive session should be held much earlier or at the end of the meeting. The Mayor commented that he has asked the Board to have it at the end of the meeting. Trustee Hyland commented that the former Mayor always executive session prior to the start of the meeting. held Trustee Jeffers commented that earlier is not good for him since he gets home late from work. Trustee Horecky commented that important matters should be discussed earlier in the evening while everyone is still fresh and sharp. Don Caetano asked with regard to resolution #12/153 whether the Planning Board has anything to do with this. The Mayor replied that this resolution will be circulated to the other boards. This is just the first step towards adopting the Local Waterfront Revitalization Program. There being no further comments, Trustee Hayes moved, second by Trustee Alter to close this section, motion carried. Resolutions-Attached Old Business Mayor Treacy read the attached public works report. The Mayor announced that parking meters have been covered for shopping for the holidays. 2 �New Business Mayor Treacy appointed Monica Timmings to the Ethics Committee to fill the unexpired term of Frank Occhipinti. The Mayor appointed Peter Gasperini to the Plumbing Board to fill the unexpired term of Daniel Visconti who is very ill. Mayor's Report The Mayor commented that there was a company who was interested in using the GM plant to recycle trash into toilet tissue. The Mayor did not think this was a very good idea and asked the Board's opinion before he went ahead and contacted them. There was no interest on the part of the Board. Mayor Treacy reported that the DMV Early Bird program that was held last week was a great success. Over 150 people took advantage of this program. Maybe at a future date, we can have this again and have evening hours also. There was a problem at College Arms during a fire where the fire trucks could not get close enough to the apartment due to parked cars. The Police Department has been directed to have a tow truck respond to that area in the future to remove cars if needed. Mayor Treacy commented that with regard to the composting issue, the hospital has closed the site due to a health problem being created by compost. Therefore, effective December 15th, the Village will no longer pick up their garbage. Mayor Treacy reported that we had hired a company called Allen Roto Consultants to review our phone bills. We are entitled to a refund of $9981. from NYNEX, of which the consultant company will receive 50%. On December 8th there will be a meeting of the Historic River Towns of Westchester to discuss the municipal tourism committees, also meetings with Metro North and Westchester DOT. We are very interested in working with Westchester DOT to create a trolley system to bring tourists to the area and moving them around. They will also be meeting with ferry companies to discuss ferry traffic tourism in the area and will discuss the Greenway project. We will be receiving a marketing report from Nancy Gold and she will be outlining fund raising project. The Mayor commented that there seems to be a problem with residents not being notified when their neighbors are going before the Architectural Review Board and he would like to discuss possible changes to the code to require all applicants before the ARB to notify three neighbors on the opposite of the street and two adjacent neighbors when they want to change the facade of their building. 3 �Senator Oppenheimer has informed us that there is a new grant fund for parks, recreation and hist6ric preservation. It is an Environmental Protection fund. Applicants may seek up to $200,000. for this grant. We will be seeking money for Sleepy Hollow Landing. The Mayor welcomed O'Briens Gift Shop and Sleepy Hollow Cleaners on Beekman Avenue. The Mayor reported that the next meeting on December 20th will be a short meeting, since this is our Christmas party meeting where we will serve refreshments. All residents are invited to attend. Trustee Reports Trustee Jeffers had no report. Trustee Alter reported that about two weeks ago, route 9 was officially designated as a scenic road and he read the plaque that we received from them. He showed the audience the signs that will be posted on route 9 which read "Scenic Road". About fourteen six graders of the Youth Council of the Tarrytowns have organized a food collection drive for the needy. Food can be dropped off at the COC or the Salvation Army. They will also be going to Tarry Hall on December 23rd to sing Christmas carols. Trustee Blanco commented again on the condition of the lot on Beekman and Clinton. Linda David commented that the owners are appearing in court this evening and she will get the information from the Building Inspector or the Judge as to the outcome of his court appearance. Trustee Blanco welcomed the two businesses on Beekman Avenue. Trustee Horecky read the attached November Fire Chief's report. Trustee Horecky reported that repairs to curbing are needed in several areas throughout the village such as College, Cortland and Chestnut Street. He has requested that letters be sent to College Arms to repair their fence which has been completely destroyed. Residents and merchants on Valley, Clinton, College and Chestnut Streets must keep their sidewalks clean of debris. He noted several zoning violations. He will be meeting with the Building Inspector to do a walking tour to see if enforcement is adequate. The Coca Cola signs on the Avenue will be taken down shortly. Several yellow curb lines need to be painted throughout the village. Trustee Horecky commented that he is working on a program to help senior citizens who need help in shoveling their sidewalks this winter and he is looking for volunteers. He and Bill Arduino have already volunteered their services. Anyone wishing to speak to Trustee Horecky can call him at, home at 332-5250 or call village hall and leave a message. 4 �One of residents, Nancy Andrews is a sculptor and her work can be seen at the Chappaqua library. for further information call 238-4779. Trustee Horecky thanked the highway department for their quick response in servicing the street lights especially on Teresa Street. Trustee Horecky read the attached statement in newspaper article regarding Phelps and contracts. response to Trustee Hyland commented that he is glad the Phelps agreement issue is now over and we will not be picking up their garbage any longer and this will save the village money. There is an alternate site for composting that we should look into for next season. Trustee Hyland asked about an incident that happened at the teen dance last Friday. Linda David commented that one of the youths left the water running in a bathroom and the water did some minor damage to the fire department room below. The incident was handled very quickly and efficiently and they do know who was responsible and Sgt. Ferguson is taking care of it. Trustee Hyland felt that Trustee Hayes should read the Fire Wardens report since he is the Chair of the fire committee. Mayor Treacy commented that the Deputy Clerk has been reading these reports whenever they are received. The one from their last meeting was just received today, therefore there was no correspondence to be read at our previous meeting. Trustee Hayes had no Fire report. The Library Board met on November 17th and the next meeting will be on December 15th. A letter has gone out to residents of Tarrytown and North Tarrytown from the Library requesting donations to help keep the library services where they are. Any amount will be greatly appreciated. Some companies will match what their employees donate. Administrator's Report Linda David read the agenda for the Zoning Board to be held on December 21st at 8 PM, the Planning Board agenda for December 2 2nd at 8 PM. The Tarrytown school board will meet on December 15th, the Noise and Litter Committee will have no meeting in December. There will be an Elderlaw seminar on December 8th at Warner Library. Linda David commented that the parking meters have been bagged through January 3rd for the holiday season. She read the Prosecutors report for November. 5 �Ms. David commented that we have been working with the Office of the Aging of Westchester County to help seniors. Seniors can call us regarding services and meetings. Communications, Petitions & Requests Deputy Clerk read attached correspondence from Fire Council regarding action taken at their recent meeting. Trustee Hyland moved, second by Trustee Alter to approve their actions, motion carried. Public Comments Trustee Hyland moved, second by Trustee Horecky to open the public comment section, motion carried. Don Caetano commented that Trustee Horecky should discuss forming committees with other trustees instead of on his own. He also commented that Trustee Hyland was on one of the first people to suggest the Phelps site for composting many years ago. Albert Martins of 273 N. Washington Street asked why the residents in this part of the village must bag their leaves and cannot put them in the road like the people in the Manors do and if we have to bag them, the village should provide them. He also wanted to know who owns Washington Lane. There is alot of traffic on that road and he wants to know if he and the other homeowners are liable for any injuries that might occur. He asked that the village please look into this and let him know as soon as possible. Mayor Treacy commented that we cannot allow residents to blow their leaves into the street in the inner village because of the number of cars parked on the streets over the leaves which causes fires. As far as Washington Lane is concerned, it is not a dedicated street. We would need to have an abstract done which would cost us money, but we will look into it. Frank Rey asked what were the legal fees incurred to date for the GM lawsuit. The Mayor responded $100,000. Don Caetano asked who chaperoned the teen dance last Friday. The Mayor and the Administrator responded that they were village employees and parents. Bob Levine suggested executive session be held at the end of the meeting. Frank Rey wanted to know the disposition status of the Halpern case. Donal Walsh commented that Halpern had discharged their law firm and hired a new one, therefore the scheduling of the depositions has been put off. He will let him know as soon as he finds out. Don Caetano commented that there will be a Christmas party, for children on December 11th at Veteran's Hall in Tarrytown. 6 �i Trustee Blanco suggested that it might be worth it to the Village to spend $400-$600 to have an abstract done on the homes on Washington Lane. The Mayor suggested that the owners give the Lane to the Village and we would make it a dedicated street. He asked that the Administrator get a quote on an abstract on Washington Lane and we will bring this up to the Board, then we will send a letter to the property owners. Linda David commented that First Fidelity Bank is sponsoring the Elderlaw seminar on December 8th and it is free of charge. There being no further comments, Trustee Horecky moved, second by Trustee Blanco to close the public comment section, carried. Leaf pick-up program should be completed by Christmas. Snow removal equipment has been serviced and ready to go. Sand barrels have been placed throughout the village. Christmas tree lights have been put up. New street lights have been installed in Sleepy Hollow Manor. Two new lights have been installed on North Washington Street near the Sleepy Hollow bank. We are waiting for Con Edison to turn the power on. Repaired an 8" water main break on Sleepy Hollow Road last week. �REVISED Meeting Date: Resolution #: 12-06-94 12-152-94 Be It Resolved, that the Mayor and Board of Trustees, hereby amend Chapter 57-4 6, Paragraph (A) for a trial period of one year to read as follows: Route US 9 (4 0) miles per hour from Pierson Avenue to the northerly Village boundary line, and to delete paragraph (B). SECONDED: T r u s t e e Hayes VOTE: ^~® �I Statement by Trustee Scott Horeckv- December 6. 1994 The Mayor's offer to the teamsters union has never been accepted in the Mayor's six months of negotiations. The Trustees worked long and hard during work session and settled the contract as well as the M.E.U. contract in one meeting. The Mayor brought the PBA talks to an impasse which were headed into arbitration which costs taxpayers $31,000. in legal fees three years ago. The Trustees entered into the process to keep negotiations running which saved the taxpayers extensive legal fees. Finally, in dealing with Phelps hospital, the Mayor virtually gave away services that Trustee Hyland and myself opposed,that you the residents must pay for. This contract that took five months of negotiations, ended as an embarrassing failure just as Trustee Hyland predicted.
