Present: Mayor Sean Treacy Absent: Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Trustee Greg Jeffers Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Mayor Treacy commented that tonight is our yearly Christmas meeting so we will have a short meeting and refreshments will be served afterward. He asked that the Board make a motion to hold over PBA discussions for executive session until our January 3rd meeting. Trustee Horecky moved, second by Trustee Alter, carried. Approval of Minutes Trustee Horecky moved, second by Trustee Hayes to approve the minutes of December 6, 1994 with attached additions/corrections made by Trustee Horecky, motion carried 6-0. Approval of Warrants Trustee Hayes moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills, motion carried 4-2. Total of the General fund is $116,326.68 and the Water fund total is $4 677.49. Resolutions-Attached On resolution #12/155/94, Village Attorney explained that when the reassessment was done an error was made with regard to these lots; they are not buildable lots and the error was discovered after the work session was held. The correction must be done before January 1st. On resolutions #12/156 and #12/157 Mayor Treacy commented that this project will not cost the village any money. The Writers' Center will indemnify the village for any and all costs associated with the project including the overage mentioned in the resolution. Donald Stever, the attorney representing Hudson Valley's Writers' Center gave a brief explanation of the agreement commenting that there will be a series of fail-safe mechanisms in place to insure that the village never has to spend any money. The Center will put money into an account with the village and any money spent will only come out of this account. 1 �i There being no further business, Trustee Hayes moved, second by Trustee Alter to adjourn the meeting, motion carried. Two meetings in a row you were told this and it is not true. North Tarrytown still has no place to compost. We don't have to go to the Town of Mt. Pleasant, we have a place right here in the village." 3 �I Meeting Date: Resolution #: 12/20/94 12/156/94 RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF NORTH TARRYTOWN APPROVING A FEDERAL AID STP ENHANCEMENT PROJECT AND AUTHORIZING THE VILLAGE OF NORTH TARRYTOWN TO PARTICIPATE TO THE EXTENT OF UP TO 100% OF THE NON-FEDERAL SHARE OF COSTS FOR SUCH PROJECT. WHEREAS, a Project for the Philipse Manor Railroad Station Restoration, identified as PIN 8775.71 funded under the Federal Aid Highway Program as provided for the costs of such projects to be borne at the ratio of 80% Federal Funds and 20% non-Federal funds; and WHEREAS, the Village of North Tarrytown desires to advance the above project by contributing up to 100% of the non-Federal share of the cost of such project. NOW, THEREFORE, the Board of Trustees of the Village of North Tarrytown, duly convened does hereby RESOLVE, that the Village of North Tarrytown hereby approves of the above project; and it is hereby further RESOLVED, that the Board of Trustees of the Village of North Tarrytown hereby authorizes the Village of North Tarrytown to contribute up to 100% of the non-Federal share of the costs of the above project; and it is further RESOLVED, that the. sum of $76,675.00 is hereby appropriated to provide for up to 100% of the non-Federal share of the cost of the above project and to cover the cost of participation by the Village of North Tarrytown in the above project; and it is further RESOLVED, that the Village shall appropriate sufficient funds to complete the Project in the event such funds are necessary. RESOLVED, that in the event that the non-Federal Share of costs exceeds the amount appropriated above, the Village of North Tarrytown shal be liable for all costs in excess of the above amount, and that the Board of Trustees of the Village of North Tarrytown shall convene as soon as possible to appropriate such excess amount immediately upon notification by the Department of Transportation that such excess costs have been identified; and it is further �I RESOLVED, that the Mayor of the Village of North Tarrytown be and is hereby authorized to execute all necessary Agreements on behalf of Village of North Tarrytown with the State of New York, approving the above project by the Village of North Tarrytown, and providing for the contribution by the Village of North Tarrytown of the nonFederal share of the costs of said project; and it is further RESOLVED, that a certified copy of this Resolution be filed with the Commissioner of Transportation by attaching it to any and all Agreements that may be executed between the Village of North Tarrytown and the State of New York in connection with the above project.
