Present: Mayor Sean Treacy Greg T. Jeffers (Arrived late) Morris Alter Jose Blanco Scott Horecky Michael Hyland John T. Hayes, Jr. Also Present: Donal M. Walsh, Jr., Village Attorney Linda E. David, Village Administrator Trustee Alter moved, second by Trustee Hayes to open the meeting of February 7, 1995, motion carried. Mayor Treacy called the meeting to order with a pledge to the flag. Executive Session Mayor Treacy moved that the executive session be held at the end of the meeting instead of the beginning, motion seconded by Trustee Alter; motion died 3-3. Discussion ensued on the Belanich lawsuit but no formal action was taken. Discussion ensued on a personnel matter. Mayor Treacy moved, second by Trustee Alter that the Police Committee discuss the matter further, motion carried 6-1 with Trustee Hyland voting No. There being no further business, Trustee Blanco moved, second by Trustee Hayes to move back into regular session, carried. Public Hearing-None Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of January 17, 1995 as written, motion carried 5-0. Approval of Warrants Trustee Hayes moved, second by Trustee Alter to. approve the warrants and authorize the Treasurer to pay the bills, motion carried 4-1 with Trustee Hyland voting No. Total of the General fund is $602,960.36 and the Water Department fund total is $22,456.77. Public Comments-Agenda Items Only Trustee Hayes moved, second by Trustee Blanco to open the public comment section, motion carried. Chief John Morabito commented that with regard to resolution #02/15 he was opposed to the removal of any more parking spaces on Cortlandt Street. He also commented that he was opposed to 1 �I the new hook and ladder truck that was ordered because the 90 foot ladder is too short and felt that the Board should look into canceling the contract. Mayor Treacy commented that this was all discussed with the apparatus committee previous to Morabito's term but the Board will discuss it again at the next work session and invited the Chief to attend. Sam Gittens asked if the Chief was aware that the truck was ordered and commented that he lives at College Arms and if a ladder can't reach the tenth floor of the building, there is no sense in having this truck. Mayor Treacy commented that the previous Chief was aware of the purchase of the truck. The Mayor also was not in favor of removing parking spaces in front of College Arms. Mr. Caetano asked if this contract could be revised to change the height of the ladder. The Mayor responded that he felt sure there would be serious penalties if this was done. Frank Rey asked what the purchase price of the truck was. The Mayor commented that he did not know the exact amount but would find out. There being no further comments, Trustee Alter moved, second by Trustee Blanco to close the public comment section, carried. Resolutions-Attached Old Business- None New Business Mayor Treacy commented that Acting Village Justice, Andres J. Valdespino has resigned to take a position on the school board. He commented that last Friday, he appointed John Lewis as Acting Village Justice to fill the unexpired term of Andres Valdespino. Mayor Treacy presented Burrell Abrams, the youth who put out the fire in the trash bin at Sleepy Hollow high school, with a Certificate of Appreciation and a key to the Village. Mayor's Report Mayor Treacy reported that Woody Allen was filming another movie in our village this week and has given the village $1000. towards the Horseman trail. The UDC grant project will be starting up again shortly with improvements to O'Briens laundromat and the deli, both on the other side of Beekman Avenue. He thanked Wally Tuscanini for all his help in getting the grant for this project. The budget report for December shows we still have 34% of funds available, but the Police Department is overspent in their 2 �overtime line. He therefore had to lay off a Parking Enforcement Officer and stated that the Police Officers can start issuing tickets that the Parking Enforcement Officer issued. The Mayor reported that the crime rate in North Tarrytown is down 66% from last year. Mayor Treacy commented that he has been issuing pens to merchants that can detect counterfeit money. The Mayor commented that the loading zone issue was discussed at a previous work session but they are still waiting for responses to the questionnaire from more merchants. There have been complaints about the enforcement of the one hour parking on Beekman Avenue since there are meters with three hour parking there. The Mayor brought this up to the Board and the majority of the Board decided to remove the three hour meters and enforce the one hour parking. This will not help the restaurants in this area since people like to spend more than an hour while they are dining. There will be a meeting of Westchester on February 9th. the Historic River Towns of The Mayor commented that the Handicapped Committee met to discuss ADA requirements, improvements to Village hall and other areas such as the aligning of curbs for the handicapped. Governor Pataki's representative attended the GM Task Force meeting to discuss GM issues such as the closing of the plant, reassessment of the plant and feasibility studies. Governor Pataki has informed us that our grant for a feasibility study for the GM site was spared from being cut. General Motors and North Tarrytown have not agreed on an Assessor yet. We would like Governor Pataki to step in. Mayor Treacy read the Public Works report and commended the public works department for a job well done during last weekend's snow storm. Mayor Treacy commented that there has been a vacancy on the Planning Board since the resignation of Steve Salman; he moved to appoint Joanne Becker to fill his unexpired term,, second by Trustee Alter, motion carried 4-3. Trustee Reports Trustee Jeffers had no report. Trustee Alter gave a recreation report. Since TNT baseball registration was canceled last weekend, it will be held February 8th in village hall from 7-9 PM and on February 11th from 10AM-1PM in the Tarrytown Recreation Department. Registration is $50. for the first child and $25. for each additional child, if registered before March 1st. Kick-off will take place on April 7th at 5:45 PM. Tiny Tot baseball will begin April 29-June 10th, 3 �, • I > • Girls softball will start on April 7th. Trustee Alter commented that there is a one bedroom condo still available through the ARCH program for $50,000. Anyone who is interested can call 332-5229 or call the Administrator here at village hall 631-0533. Trustee Blanco reported that we are making some headway with regard to the Washington Lane problem. Linda David has been in contact with the Tarrytown Board of Education. The Board of Trustees would like to make it an official street in the village. Trustee Horecky gave the police report for January 1995 (part of official minutes). Trustee Horecky read a letter from a visitor from California who commended Officer Pellegrino for his help when his car became disabled. (Placed in personnel file) Trustee Horecky read the attached fire department correspondence regarding repairs to the firehouses. Linda David commented that we have acted on several of the items already. Trustee Horecky commented that the election posters put up by the Democratic party are illegal because they are too large and was surprised by the fact some of these signs were nailed to a tree. Trustee Horecky moved, second by Trustee Hyland to bring ethics charges against the Mayor for the illegal firing of Mark Broadway and call for an ethics hearing before the Ethics Board, motion carried 3-2. Village Attorney, Donal Walsh, stated that there must be a written complaint first before a hearing can be held. The Ethics Board is required to hold all such matters in confidence and to only meet in executive session for such purposes. Trustee Horecky commented writing. that he will put his complaint in Mayor Treacy commented that he will be filing ethics charges against Trustee Horecky for having one of our secretaries type a college report on a village computer using village stationery. Trustee Horecky commented that he paid this person to do this after working hours and did not feel he did anything wrong. Trustee Hyland commented that he did not believe the Mayor layed off the Parking Enforcement Officer because of budgetary reasons. He showed a long printout sheet for 1994 showing approximately $50,000. worth of tickets given out by this officer. By letting him go, we will be losing this amount of money. Trustee Hyland also commented that he felt the Police Department is doing a good job considering that they are understaffed. He commented that the one hour parking on Beekman Avenue has been a law for many years now and needed to be enforced; there are signs 4 �stating one hour parking and by the majority vote they made all the meters consistent. Trustee Hayes commented that he was unable to attend the Library Board meeting on January 19th because he attended the Planning Board meeting. Administrator's Report Linda David read the Zoning Board agenda for February 15, 1995 at 8:00 PM, the Planning Board agenda for February 16, 1995 at 8 PM. The Tarrytown School Board will meet on February 9th, Recreation Commission will meet on February 15th, the Noise and Litter Committee will meet on February 23rd at 7:30 PM and there will be no ARB meeting in February, they will meet on March 1st. Communications, Petitions & Requests The Deputy Clerk read a letter from the VFW notifying the Village of their intent to renew their liquor license. (Referred to Police Chief) The Deputy Clerk read attached correspondence from the Board of Fire Wardens regarding a five year exempt certificate for Robert Moon. (Will be issued this week) Mayor Treacy read correspondence from the Ambulance Corp inviting the Board to their dinner on March 4th. The Mayor read a letter to a realty company concerning a party that is interested in purchasing the GM property. A while ago a request for a four way stop sign at County House road and route 4 48 was sent to DOT, but they refused at that time. Linda David is writing to Mr. McGovern of DOT again asking him to have this sign installed due to an increase in the volume of traffic on that road. Ruffles, a company that sells plastic bags would like to give the first Sanitation Worker of the Year award of $10,000. to the most outstanding worker of a village. The village would also receive an award of $2000. We will check with DPW to see if we have any candidates that might qualify to be entered in this contest. Trustee Horecky read a letter from James Margotta to the Democratic party informing tham that their political signs do not conform and must be taken down. Mayor Treacy commented that they will be going before the ARB to obtain approval for these signs. Public Comments Trustee Hayes moved, second by Trustee Horecky to open the public comment section, carried. A new resident in the audience asked Trustee Hyland why he withdrew from the Mayoral race. Trustee Hyland commented that it went to court and he felt it best to withdraw his petition rather than involve any more 5 �people. Mr. Caetano commented that the police department tickets as well as Parking Enforcement Officers. can issue Sam Gittens commented that since he is a member of the Ethics Board he should be given the written statements. The Mayor commented that since Mr. Gittens Trustee, he didn't feel this was a good idea. is running for Mr. Gittens commented that his running would have nothing to do with his decision, he will always do his job as far as the Ethics committee is concerned. George Samaras asked about a Zoning board member holding two positions. The Mayor commented that the Board amended the code so that someone can sit on two boards except that they cannot hold a position on the Planning and Zoning boards at the same time. Frank Rey asked the Mayor if he had the amount of the bill for the attorney, the Mayor responded $2300. Mr. Rey suggested that the $1000. the village received from Woody Allen be put towards the Headless Horseman monument fund instead of the trail; the Mayor commented that there is a state law which states it is illegal for the village to give gifts to any project. Mr. Caetano suggested that the fees for recreation programs come out of the recreation fees that are paid when someone goes before the Planning Board. Frank Rey commented that the Mayor does not have the power to terminate a position without a hearing before the board and that the budget is not overspent. Mayor Treacy commented he does have the power and that the police department is overspent in their overtime budget line by 23%. Jim Tierney commented that he felt Mark Broadway was doing an excellent job. There being no further comments from the public, Trustee Hayes moved, second by Trustee Alter to close the public comment section and to adjourn the meeting, motion carried.
