Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Jose Blanco Scott Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Linda David requested that the Board approve the warrants before starting the meeting, since the Treasurer was not feeling well. Approval of Warrants Trustee Hayes moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued. Trustee Horecky questioned the Village Attorney's bills since that line was overspent. Donal Walsh commented that he spent alot of time on the Belanich lawsuit and other items that were not anticipated. Trustee Horecky moved, second by Trustee Hyland to remove the Attorney's bill from the warrant. Trustees Hayes, Alter, Jeffers and Mayor Treacy voted no, Trustees Hyland, Horecky and Blanco voted yes. Motion failed 3-4. Trustee Alter moved, second by Trustee Hayes to approve the warrants and pay all the bills. Discussion ensued. Trustee Blanco asked if there was any problem with buying supplies from Valley Plumbing since he is on the Plumbing Board. The Mayor commented no; we try to spread things around to all plumbers and try to keep our purchases to local merchants. Trustee Hyland questioned the bill from Sleepy Hollow Plumbing and felt it was too high. Linda David gave an explanation of what needed to be done in one of the fire departments with an ongoing problem. He also questioned why the bill for Compu Training is coming out of contingency. The Mayor explained because there wasn't any money in other lines. Motion carried 5-2. Total of the General Fund is $108,701.04 and the Water fund total is $287.93. Executive Session Mayor Treacy moved that the Board hold off executive session until the end of the meeting, second by Trustee Alter and motion failed 3-4. Trustee Hyland moved, second by Trustee Horecky to adjourn to executive session to discuss personnel and litigation, motion carried 4-3. Discussion ensued on the Belliveau lawsuit but no formal action was taken. Public Hearings Mayor Treacy read the first attached public hearing notice. Trustee Hayes moved, second by Trustee Blanco to open the public hearing, motion carried. Frank Rey suggested that fees collected for filming be put towards the Headless Horseman monument fund and asked that the Board see if this would violate any law regarding gift giving. Mayor Treacy commented that they would put this on the work session agenda. There being no further comments, Trustee Alter moved, second by Trustee Horecky to close the hearing, carried. Mayor Treacy read the last attached public hearing notice. Trustee Alter moved, second by Trustee Horecky to open the public hearing, carried. Don Caetano asked if this amendment to the Ethics code covers the school; the Mayor responded no. It applies to any employee of the Village who receives a paycheck. Trustee Jeffers commented that the Mayor has more power than a Trustee and that a District Leader is. not the same as the Chair of a party. Frank Rizzi stated that the Village Prosecutor should be included in this. The Mayor commented that she will be. Trustee Blanco commented that there are only three people on the Board that are involved in politics. Don Caetano asked if a wife of a trustee can be a district leader. Mayor commented this just pertains to an employee of the village. There being no further comments, Trustee Hayes moved, second by Trustee Alter to close the public hearing, carried. Approval of Minutes Trustee Horecky moved, second by Trustee Hyland to postpone approving the minutes of February 7, 1995 until they review the tape for additions/ and or corrections, carried. Public Comments-Agenda Items Trustee Blanco moved to open the Public Comment section, second ftllli''" �by Trustee Horecky, motion carried. There were no comments, Trustee Blanco moved, second by Trustee Hayes to close the section, carried. Mayor Treacy asked that everyone remain standing for a moment of silence for all the deceased Marines and Armed Forces veterans of the invasion of the island of Iwo Jima fifty years ago on February 19. Resolutions-Attached Old Business-None New Business Mayor Treacy read the attached public works report. Mayor Treacy commented that there has been alot of concern about antennas being installed in different communities and he would like to call for a public hearing. Mayor Treacy moved to call for a public hearing in Village Hall on March 7, 1995 to add a new chapter to the code of the Village of North Tarrytown to be entitled Temporary Moratorium on Installation of Antennas, second by Trustee Alter, carried. Trustee Blanco asked about TV antennas. The Mayor commented that all these questions will be looked into at the public hearing before any law was adopted. Mayor's Report Mayor Treacy met with our new Congresswoman Sue Kelly last Friday. She is very interested in the GM situation. We want to start negotiating with GM again. She is interested in the new Riverfront part and she will act as liaison with the Army Corp of Engineers and the Village. The Gannett newspaper will soon be getting competition from the Gazette newspaper which serves upper New York. This past Sunday, Mayor Treacy and Trustee Hayes attended a ceremony at the New Hope Baptist church regarding Black History Month. He has read the book entitled "Black 100" which tells about very interesting black people. The Mayor commented that the GM Task Force will meet on March 6th and he has asked Governor Pataki to step in choosing an Assessor for the reassessment of the GM plant. As far as the UDC grant, the contract improvement of Frank O'Brien's building. was signed for the The Mayor reported that we have received a $75,000. over a three year period from the Department of Justice towards the hiring of new police officers. Mayor Treacy commented that the polling places for village elections had requested the village increase the amount they pay from $75. to $100. Mayor Treacy moved that the payment made to the polling places be increased to $100,, second by Trustee Alter 3 �I and motion carried. Trustee Horecky recused himself. Trustee Reports Trustee Hayes reported that he attended the February 16th meeting of the Library board and that the Library board would like to make a presentation to the Board during their budget time to present their concerns. They will be put on the work session agenda. Trustee Hayes read a letter from Sutphen Co. addressed to Chuck DePaolo regarding the lengthing of the fire truck ladder which would cost approximately $20,000. to do so. The Fire Department would like to discuss this modification. There are concerns of the Union Hose members regarding double parking of cars blocking the trucks and the Mayor wrote to the Police Chief to see if he could rectify this situation. He read a letter from John Cellante regarding the increasing problems on Cortlandt Street due to cars and trucks blocking their trucks. The Police Department must enforce parking problems. The Mayor received a letter from the PBA of the dismissal of Mark Broadway and then read the letter into record that Broadway. He commented that the police is 22% overspent . expressing their outrage want him reinstated. He he had written to Mark department overtime line Trustee Hyland commented that we can thank the Police Chief for getting this grant for more police officers, since he wrote it. The reason there is more overtime in the police department is due to the fact that there are not enough police officers. Trustee Hyland commented that the other Parking Enforcement Officers are being given overtime since Mark Broadway was dismissed. He commented that recyclables must be put out before 7 AM not the day before. He commented that a court of law must take care of these tickets, not the Mayor. Mayor Treacy commented that tickets were issued village wide and the tickets were voided by the Judge not the Mayor. Trustee Horecky commented that the Police Chief needs to be congratulated for getting the grant; there was a high level of response to this grant. Trustee Horecky commented that the overtime problem in the police department is due to the officers who were never replaced. Trustee Horecky commented that it was ill-timed that the Mayor stated the best interest of the village cannot be served while an individual is the Chair of a political party and wants to change it now when his term is up. He commented that the Mayor's pick-up truck was illegally parked at the corner of Elm Street and Beekman Avenue while he was out 4 �campaigning last week. Trustee Horecky read letter from John Cellante regarding their problems at Union Hose which have not been addressed yet. He would like to invite him to the next work session to discuss these problems. Will be put on work session agenda. Mayor Treacy commented that there will be an emergency meeting with the fire committee on Thursday, February 23 at 7 PM to discuss the hook and ladder truck. Trustee Blanco asked if there was a .penalty for canceling the truck and will the $20,000. come out of contingency or will we take out a bond? Linda David commented that Steve Hopkins will be attending the work session to answer our questions and we would take out a bond for $20,000. Trustee Blanco wanted to know if width would also be added along with the length. Trustee Hayes commented that approximately 32" will be added to the width. Trustees Alter and Jeffers had no report. Administrator's Report Linda David read the ARB agenda for March 1, 1995; the School Board will meet on Thursday at 8 PM; the Library Board will meet on February 23 as will the Noise and Litter Committee, the Board will hold a work session on February 28th and March 14th; the Zoning Board will meet on March 15 at 8 PM, the Planning Board will meet on March 16 at 8 PM, the Recreation Commission will meet on March 15 and our next regular Board meeting will be held on March 7. Communications,Petitions and Requests Deputy Clerk read correspondence from Sushi Raku informing the village of their intent to renew their liquor license. Referred to the Police Chief. The Mayor sent a letter to the Fire Chiefs and Fire Captains asking them to compile a list of OSHA violations relating to the firehouses, equipment, uniforms, etc. The Administrator has sent a memo to all department heads regarding the 95-96 budget asking them to show a 5% decrease and one with no increase. The Mayor commented that we cannot cut any more fat from the budget; we may have to increase taxes if services are to stay the same or cut services if we have no increase in taxes. The Mayor issued a press release today stating that he is lending his support in property tax relief as called for by the New York Conference of Mayors at the recent budget hearing in Albany. We have received a letter from DOT in response to our request for 5 �I a four-way stop sign at the intersection of 448 and County House Road. They have started a formal investigation and they will review our request as soon as possible. The Mayor commented that with regard to the grant we received from the Department of Justice, he did alot of lobbying to get this grant; there were 7000 other communities who applied. Public Comments Trustee Hayes moved, second by Trustee Alter to open the public comment section, carried. Frank Rey commented that the firing of Mark Broadway did not save any money since the other PEOs are being given more hours and that he did not fire anyone when he was Mayor; two people retired and the other one did not pass the civil service test. Don Caetano commented that Mr. Rey tried to force two men out of the Detective department when he was Mayor and he succeeded. Chick Galella asked that the public comment section be moved to an earlier spot on the agenda. Mayor Treacy made a motion to move the public comment section to #7 on the agenda, second by Trustee Alter and carried. Carmen Mariano commented that she is happy they are moving public comments and suggested that executive session also be moved. Mayor Treacy made a motion to move executive session to #13, second by Trustee Alter, motion died 3-3. Ms. Mariano commented that the Board should respect each other; the public cannot respect the Board is they don't respect each other. Edna Belanich commented that someone from the Rock of Salvation church should also attend the work session with John Cellante. Detective Manny Caixiero commented that the Board did offer the PBA 5% increase but there were other issues involved with this offer but should not be discussed now. Jim Tierney commented that if tickets are given out on Beekman Avenue, they should enforce no parking in the Manors. Chick Galella commented that if the Board passed a resolution to award the police their contract, how could the Mayor deny it. Mayor commented that he is Chief contract negotiator and there were a number of issues to be considered in the contract, the Board only voted on the 5% increase not the other issues. Trustee Hyland commented that the Administrator is the one who should negotiate all contracts and that is not being done and that the offer of 5% never went to the police department. Don Caetano wanted to know if there was a Chair of the police 6 •w : *mjHtim^->. • •••• �committee; the Mayor responded yes. Manny Caixiero commented that we are the lowest paid police department. The committee brought down the offer to the PBA members and we rejected it; only the committee had accepted the Board's proposal not the whole PBA. Frank Rey commented that improper practice charges should have been filed if something was done improperly. The Mayor commented that the Republican trustees did not want to file charges, therefore there was no majority of the Board. Ugo Checchi commented why not bring it up in executive session. The Mayor commented that unfair labor practices must be filed within 90 days; could not get the trustees all together at an executive session. There being no further comments, Trustee Alter moved, second by Trustee Horecky to close the public comment section.
