Present: Mayor Sean Treacy Trustee Trustee Trustee Trustee Trustee Also Present: Absent: Alter Blanco Horecky Hyland Hayes, Jr. Linda David, Village Administrator Donal M. Walsh, Jr., Village Attorney Trustee Jeffers Trustee Alter moved, second by Trustee Blanco to open the meeting of March 7, 1995. Motion carried unanimously. Mayor Treacy called the meeting to order with a pledge to the flag. The Mayor stated that he would like to clear the air as too the issues concerning the Pocantico Hook and Ladder. Mr. Apollonio stated that he was the spokesperson for Pocantico Hook and Ladder. The Mayor stated that the company needs a new apparatus. Mr. Apollonio stated that the truck the Fire Department wanted was proposed to the Board, a 90 ft. tower ladder, which is what was ordered. The previous suggested ladder could reach the top of 100 College Avenue (130ft.) but it could not fit into the bay area in the fire house. There has never been an aerial that would reach the top of 100 College Ave. Mayor Treacy stated that a ladder that large could not fit through the streets of North Tarrytown. Mayor Treacy stated that the fire fighters have greater expertise in knowing what it needed. Mr. Apollonio thanked the Mayor and Board of Trustees for ordering the truck. Mayor Treacy requested that the Board not hold Executive Session in the beginning of the meeting, but have it at the end so that the public does not have to wait. The Mayor made a motion to hold executive session at the end of the meeting, second by Trustee Alter and motion failed 4-2. �Executive Session Discussion ensued on Police Department's overtimeand sick time. Trustee Horecky stated that he would make an appointment with the Chief of Police. Discussion ensued on water usage which has gone up in the past months. Discussion ensued on the Bond Resolution for the replacement of a water pump for the Sleepy Hollow Pump Station. Donal Walsh, Village Counsel discussed the towing contract, the tax certiorari case against the Village by Anchor Motor Freight, and discussion was also ensued concerning Belanich litigation. No formal action was taken in Executive Session. There being no further discussion, the Board went back into the regular session of the meeting. Public Hearing Mayor Treacy read the attached public hearing notice and gave a brief explanation. Trustee Alter moved, second by Trustee Hayes. Motion not carried. A poll of the board was taken. Trustee Alter - Yes Trustee Hayes - Yes Trustee Blanco - Nay Trustee Horecky - Nay Trustee Hyland - Nay Trustee Treacy stated that the reason this has been brought forth is because of the double parked cars on Cortlandt Street. The Mayor has proposed to double the fines on double parked cars and not penalize everyone in the neighborhood. Mayor Treacy made a motion to open public comments regarding the parking ideas, seconded by Trustee Alter. Motion carried unanimously. Mr. Volpacchio of 11 Cedar Street stated that he has resided in North Tarrytown for 29 years, three spaces are gone and now he sees all cars parked there one on Cortlandt Street one on College Avenue and one on Cedar Street, not all in one spot. Mr. Caetano stated that he attended the work session and saw Trustee Hyland voting on this hearing, he feels people should do the right thing now. �II Trustee Hyland stated that the point is that the spaces are being taken away one by one. What has the Mayor done to give residents parking or otherwise. Now it is the time for residents to come to the meetings and say parking is needed. We have to have parking somewhere. (Please see Trustee Blanco stated that the only reason is because of the Fire Department situation. It is not intentional to take away residential parking. Mayor Treacy stated that there is another resolution which will raise the fine on double parking. He believes that once someone gets a $75. ticket on Cortlandt Street they may not double park again. Ms. Henrietta Brand stated that she saw the flyer in the store. It was late in the evening when the flyers were given out. She was told by Trustee Hyland to attend the meeting. At this point during the meeting Mrs. Mariano translated in Spanish to the public where this issue stands. Mr. Caetano suggested in the future to make announcements in the Spanish paper so they also would be notified. The people should not be forced to come to a meeting. Mayor Treacy read the attached public hearing and gave a brief explanation regarding cellular antennas. This public hearing has come to the Mayors attention because a cellular phone yower may be erected in North Tarrytown. There is a great deal of concern because they are very large and they may reduce the values of properties and also the health effects of these towers have not been properly analyzed and North Tarrytown needs a time period to get as much information as possible on these cellular phone towers so that the Board of Trustees could make a decision whether or not these towers should be allowed or should be outlawed. Trustee Alter moved, second by Trustee Horecky to open the public hearing. Motion carried unanimously. Dr. Sweet of 3 09 North Washington Street asked the Mayor if this would be a transmitting and or a receiving antenna. Mayor Treacy stated both. According to the legislative intent this law would be for commercial communication only. �Dr. Sweet asked if the wording would be put in to exclude television dishes because being an increase is the usage this might be necessary. Mayor Treacy stated that its states for commercial communication. Mr. Belanich stated that there is a 30 day time period and wanted to know why the board couldn't ask for more time. Mr. Walsh stated that there would be a draft law circulated so that the Board would review it within a 30 day period. This time is based upon several court decisions. Trustee Alter, moved, second by Trustee Horecky to close the public hearings. Motion carried unanimously. Trustee Blanco stated that he would like to add Dr. Sweets suggestion to the local law. Mayor Treacy stated that the word "commercial" would be added to Section 2. Scope of Control to read "of commercial antennas" instead of "any antenna" Trustee Alter moved to approve the above, seconded by Trustee Blanco. Motion carried unanimously. Approval of Minutes Trustee Blanco moved, second by Trustee Alter to approve the minutes of February 7, 1995 as written. Motion carried unanimously. Trustee Alter moved, second by Trustee Hayes to approve the minutes of February 21, 1995 (Grievance Day) as written. Motion carried unanimously. Approval of Warrants Trustee Blanco moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills. Motion carried 4-1 with Trustee Hyland and Horecky voting No. Total of the General Fund is $113,195.16 and the Water Department fund total is $1,337.17. Discussion ensued concerning the Village Attorney line. Public Comments: Agenda Items Only. Trustee Alter moved, second by Trustee Hayes to open the public comment section. Motion carried unanimously. Mr. Caetano asked if the restaurant and bars would be affected by the cellular antennas moratorium. Mayor Treacy responded that the contract that restaurants and bars have with the cable contracts would be considered not to be commercial and it will not affect the local clubs only future commercial constructions. .HV/A'"\v.^?Uy-'#$-' ••'•.'."••,•••'- V:V.<••':• . �Mrs. Belanich asked the Mayor if the Towing Resolution was being researched by the Village Attorney. Mayor Treacy responded "yes". The Village Attorney will speak resolution section of the agenda. on this issue during the Dr. Sweet was inquiring about resolution 03-26-95. New York State has informed us that veterans are entitled to an additional property tax exemption. North Tarrytown has 29 veterans who would be affected in this change of exemptions. Ms. Mariano stated that for some reason the people on Cortlandt Street feel that they were being striked back for the church situation. We are not all responsible for the church. The fire house has been there and she has not seen any problems with the fires truck coming in and out of the fire house. If the church is going to have problems with parking it has nothing to do with the rest of the people who use the parking. The people on Cortlandt Street need every space they can have. Trustee Blanco stated that this has nothing to do with the church the fire house does have problems with coining out of the fire house. Whether the church is there or not the problems will have to be resolved somehow. Trustee Horecky moved, second by Trustee Alter to close the public hearing on agenda items only. Motion carried unanimously. Resolutions: Attached Donal Walsh stated that the police committee should look at the research committee as to a new towing policy so it would not go against federal legislation. Mayor Treacy stated that this is a bonding resolution. The main pump at the Sleepy Hollow pump station has broken down and it is in need of repair. The levels of repairs that are needed will cost $34,000. There are two sets of pumps a main pump and a back up pump which supply water to the distribution area. Public Comments: Trustee Hayes moved, second by Trustee Horecky to open the public comment section. Motion carried unanimously. Ms. Hennrietta Brand stated that she spoke to Mable Boyd who has worked in the polling district for several years. What was the reason for her dismissal or are her services are being needed? �I The Mayor responded that the County Board of Elections pointed out that there have been many problems in the polling districts. Mabel Boyd has been serving the Village for many years and has been doing a capable job. Mistake are being made in the district and he was forced in a situation to replace Mabel Boyd. Dr. Sweet asked if the pump house is adjacent to the Tarrytown pump house The Mayor responded that there is quite some distance between the two. Mr. Caetano mentioned that by moving the public comment section further up the public does not know why this was done and the public does not get the information on all the reports. Mr. Arduino stated that last month a Parking Enforcement Officer was terminated to correct the overtime situation he asked if this has had a positive effect in the last month. Village Attorney, Donal Walsh stated that this issue is before the Ethics Board. Mayor Treacy stated that the police overtime has increased over the last month, 27% over budgeted. Trustee Horecky will speak to the Chief of Police. Henrietta Brand does last year there might have been a problem but very few people double park when the police are around. She feels that the fine is too high. Trustee Blanco moved, second by Trustee Hayes to close the public comment section. Motion carried unanimously. Old Business: The Mayor read the public works report. (Please see attached.) New Business: None Mayor's Report The Mayor stated that he, Trustee Horecky, Trustee Hayes and Administrator David attended the ambulance dinner. There were two years of awards given out. The Mayor stated that he was impressed and he thanks everyone. Everyone deserves wings because they are life saving angels. A round of applause was given by the Board and the audience at this time, they are lifesavers. The Mayor stated that the Pocantico Hook and Ladder truck was discussed earlier and the Village will continue the order. �The Mayor stated that he would be attending an Historic River Towns meeting held at the Axe Castle. Members of the Greenway Council, Lynn Oliva, and the president of the Westchester County Vistors Bureau would be attending. The purpose of these meetings is to create a commercial need for local economy that is in tourism. There will be a summer pilot program which will include rubber wheeled trollies stopping at historic sites and cruise boats that could be seen in Ossining and Verplack. Paddlewheel boating will also be used as a Ferry Service. The successful pilot program with Metro North in regards to tourims will defer the costs. The Mayor and the Administrator attended a General Motors Task Force meeting and the RFP has been completed and will be sent to various consultants througout the Country. The contract will be awarded in June, 1995. This is not costing the Village any monies.$100,000 from New York State has been issued. General Motors agrees to pay for a reassessment and the assessor chosen to complete this project. The next General Motors Task Force meeting will be held on March 23, 1995 at 10:00 AM. The Mayor announced that a park grant with the help of Henry Atterbury and Linda David has been completed for the Sleepy Hollow Landing Park the grant is for $200,000. Discussion ensued about the grant process. The Mayor stated that he looked forward to the Public Hearing on Veteran's Exemptions they deserve another exemption for putting themselves at risk. Trustee Reports: Trustee Hayes stated that he also attended the ambulance dinner at the training center. Also he would be attending the Library Board meeting later in the month. Trustee Hyland asked where would the people park once Sleepy Hollow Landing is completed and where will the Highway Department go. The Mayor responded that there will be diagonal parking on river street and that there is room in back of the Highway Department building for equipment. Trustee Hyland stated that he would like to see the walking patrol full time because the Village needs it* Trustee Horecky for two Police Trustee thanked would be placed read a letter of gratitude from Vittorio Castelli Officer Pelligrino and Police Officer Bizzaro. the officers and the Mayor stated that the letter in their personnel files. �Trustee Horecky also thanked the Police Department for their success regarding under age drinking. Trustee Village parking Horecky Horecky asked the Mayor to obey the sign since the sign code has been violated. on Beekman Avenue has become a problem will ask the Chief of Police to have the law laws in the Also double and Trustee enforced. "Trustee Horecky stated that Mr. Cellante, President of Union Hose would like a draft letter stating that the Village will assume all liability. The Mayor stated that it was decided at the work session that a letter is to be written. Trustee Horecky moved, second by Trustee Blanco to have a letter written to Mr. Cellante stating that the Village will assume liabilites towards the Fire Department. Motion carried unanimously. Trustee Horecky stated that he spoke with Congresswomen Sue Kelly regarding the General Motors site and that she is doing her best to help. Trustee Horecky mentioned a book he was reading called "It Can Happen Here" and feels that things are happening in North Tarrytown. The Mayor read a quote from a great politician named Stevenson, "Those who corrupt the public mind are just as evil as those who steal from the public purse." Trustee Blanco state that he would like to welcome car tronics to our business community and everyon should take advantage of the Village business. Also on April 19th there wil be a workshop that deals with onwership, which will be held at the Community Opportunity Center. Trustee Blanco stated that would encourage everyone to vote on March 21, 1995. Trustee Alter stated that the Recreation Dept. has introduced Line Dancing. The course is completely sold out and there is a waiting list. Henry Atterbury is trying to arrange a second class. Also, T.N.T. baseball is still accepting applicaitons, if anyone is interested please call Charles DePaolo at 631-7174. Also, Saturday March 18th there will be a ski trip, weather permitting. Past trips have been very successful. Trustee Alter would also like to bring the Mayor and Board up to date on what is heppening with the cable contract renewal, before a public hearing takes place. Mayor Treacy stated that the issued would be placed on the next workshop session. �i Administrator's Report Linda David read the Zoning Board agenda for March 15, 1995 at 8:00 PM. The Tarrytown School Board will meet on March 9, 1995, Recration Commission will meet on March 15, 1995 at 8:00 PM, the Noise and Litter Committee will meet on March 23, 1995 at 7:30 PM the Architecutral Review Board will meet on March 1, 1995. There will be no Planning Board meeting this month. Also, Election Day will be held on Tuesday, March 21, 1995 between 7:00AM and 9:00 PM. Communications, Petitions & Requests The Administrator also read attached correspondence from the Board of Fire Wardens, please see attached. Trustee Horecky moved, second by Trustee Blanco to accept James Hayes as an active member of Rescue Hose and to approve John Jiminez and Tom Gronowski as drivers for Union Hose. Motion carried unanimously. Mayor Treacy stated that he also met with Congresswomen Sue Kelly in the past week to discuss many issues. The Mayor had received a letter thanking him for his outlooks on General Motors. The Mayor had also received a letter from Bill Thorp of Phelps Memorial Hospital thanking Betty Anzovino and Mike Anzovino for their great concern and professionalism, they are two exceptional volunteers. Mayor Treacy mentioned that the Senior Outreach Program will be held on Thursday, March 9, 1995 from 12 to 2PM. Free blooding pressure testing will be given. Mayor Treacy also mentioned the the SPCA walk a thon is underway. The Mayor has received a letter from Richard Gross requesting the use of Devries field for the Fire Departments Parade/Fair. LEGISLATIVE FINDINGS OF FACT AND INTENT BACKGROUND The Village cf North Tarrytown is concerned about the possible erection of transmitting and receiving antennae within the Village, particularly these used for commercial communications purposes, due to the fact that antennae are highly visible structures the appearance cf which are frequently unaesthetic and the use of which involuntarily exposes residents to unwanted nonionizing electromagnetic radio frequency radiation. Based upon similar concerns, other municipalities in Westchester County have enacted legislation imposing temporary moratoria on the approval and/or erection of antennas pending review and/or amendment of their respective zoning codes to address the health, safety and welfare concerns brought on by the increase and proliferation of new technology. At present the Zoning Code of the Village of North Tarrytown dees net contain provisions that address these concerns. 3. LEGISLATIVE FINDINGS CF FACT The Eoard of Trustees is aware that the Federal Communications Commission has primary jurisdiction over regulation of communications facilities and devices. However, state and local governments remain free to issue reasonable regulations in those areas in which the Federal Communications Commission has not exercised its jurisdiction. Local governments in New York State are specifically empowered to exercise their police powers granted by Article IX, Section 2 of the New York State Constitution to enact laws for the protection of the safety, health and 'well-being of persons and property. The Federal Communications Commission to date has not exercised its jurisdiction to preempt state or local regulation of aesthetics of, or health and safety issues related to, non-ionizing electromagnetic radiation from communications antennae. The Eoard of Trustees of the Village of North Tarrytown is concerned that even if exposure to limited electromagnetic radio frequency radiation poses an "acceptable" health risk, the cumulative effect of involuntary exposure to multiple sources of electromagnetic radio frequency radiation is unknown and merits further review of the lecal Zoning Cede before any new antennae receive zoning approval. There have been no long-term health studies regarding exposure to �::cn-ionizing elec~rc".-.c:::~-i j r.-.dic frequency emissions . Therefore, until .=. g~::era 1 consensus is achieved within the scientific community that there are no adverse health effects to long tern exposure to ncn-icnizining electrcrr.agnetic radio frequency radiaticn cr amendments to the Village of North Tarrytown Zoning Cede are drafted ensuring that the location, density, and/or intensity of ::cn-ionizing electromagnetic frequency radiation sources can be regulated so as to limit involuntary exposure to levels deemed generally "acceptable" insofar as short-tern exposure is concerned, the Village is obligated to exercise its police powers and declare this moratorium on the approval of any antenna (e) installation in the Village of North Tarrytcwn. c. LEGISLATIVE INTENT Pursuant to the authority duly vested in it, it is the intention of the Board of Trustees of the Village of North Tarrytown to protect the health, safety ar.d welfare of the citizens of the Village of North Tarrytown and to preserve the intended objectives of the Zoning Cede, and, therefore, the Board of Trustees dees hereby adept a temporary moratorium on the approval of any antennae installations within the confines of the Village of North Tarrytown. SECTION 2. SCOPE 0? CONTROLS During the effective pericd of this lav; as provided herein, the Planning Eoard, Zoning Beard of Appeals, Architectural Review board, and Building Inspector shall not accept, or continue to review, or grant any subdivision plat, site plan, Certificate of Appropriateness, architectural approval, variance, ox- building permit which would have as a result of the erection of any commercial antennae, or any tower upon which antenna (e) are intended to be installed, within the Village of North Tarrytown. SECTION 3. PENALTIES Any person, firm, entity or corporation that shall violate any of the provisions of this local law shall be subject to penalties as otherwise provided by law or ordinance of the Village of North Tarrytown for violation of the provisions of a local law and shall be subject to injunctive relief to remove any construction which may have taken place in violation of this local law. SECTION 4. APPLICATION This law shall apply to all property within the Village of North Tarrytown. SECTION 5. WHEREAS, the Board of Trustees of the Village of North Tarrytown (the "Village"), located in Westchester County, in the State of New York (the "State"), hereby determines that it is in the public interest of the Village to authorize the financing of the costs of acquiring various equipment for the Village at a total cost not to exceed $34,0)00, all in accordance with the Local Finance Law; NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Village of North Tarrytown, as follows: Section 1. There is hereby authorized to be issued serial bonds of the Village in the aggregate principal amount of up to $34,000, pursuant to the Local Finance Law, in order to finance the costs of the specific object or purpose hereinafter described. Section 2. The specific object or purpose to be financed by the issuance of such serial bonds is payment of the costs of the replacement of a waterpump diesel drive engine for the Water Department and applicable incidental costs in connection therewith (the "Project"). Section 3, The Board of Trustees of the Village has ascertained and hereby states that (a) the estimated maximum cost of the Project Is not to exceed $34,000; (b) no money has heretofore been authorized to be applied to the payment of the costs of the Project; (c) the Board of Trustees of the Village plans to finance costs of the Project from the $34>000 proceeds of the serial bonds or bond anticipation notes authorized herein; and (d) the maturity of the obligations authorized herein will be in excess of five (5) years. �Section 4. It is hereby determined that thejproject referred to in Section 2 hereof is a specific object or purpose described in subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law, and that the period of probable usefulness of such Project is fifteen (15) years. The serial bonds in the principal amount of up to $34,000 authorized herein shall have a maximum maturity offifteen(15) years computed from the earlier of (a) the date of such serial bonds, or (b) the date of the first bond anticipation notes issued in anticipation of the issuance of such serial bonds. Section 5. Subject to the terms and conditions of this Resolution and the Local Finance Law, and pursuant to the provisions of Sections 21.00, 30.00, 50.00, 56.00 and 60.00, inclusive, of the Local Finance Law, the power to authorize bond anticipation notes in anticipation of the issuance of the serial bonds authorized by this Resolution and the renewal of such bond anticipation notes and the power to prescribe the terms, form and contents of such serial bonds and such bond anticipation notes authorized by this Resolution, and the power to issue, sell and deliver such serial bonds and bond anticipation notes are hereby delegated to the Village Treasurer, as the chief fiscal officer of the Village. The Village Treasurer is hereby authorized to execute on behalf of the Village all serial bonds issued pursuant to this Resolution and all bond anticipation notes issued in anticipation of the issuance of such serial bonds, and the Cleric of the Village is hereby authorized to affix the seal of the Village to all such serial bonds and all such bond anticipation notes and to attest such seal. Each interest coupon, if any, representing interest payable on such serial bonds shall be authenticated by the original or facsimile signature of the Village Treasurer. 2 �I I Section 6, The faith and credit of the Village is hereby and shall be irrevocably pledged for the punctual payment of the principal of and interest on all obligations authorized and issued pursuant to this Resolution as the same shall become due. Section 7. When this Resolution takes effect, the Clerk of the Village shall cause tlie same to be published together with a notice in substantially the form prescribed by Section 81,00 of the Local Finance Law in Daily News a newspaper having a general circulation in the Village. The validity of the serial bonds authorized by this Resolution and of bond anticipation notes issued in anticipation of the sale of such serial bonds may be contested only if such obligations are authorized for an object or purpose for which the Village is not authorized to expend money, or the provisions of law which should be complied with as of the date of the publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, or if such obligations are authorized in violation of the provisions of the Constitution of the State. Section 8. Prior to the issuance of obb'gations authorized to be issued by this bond resolution, the Board of Trustees of the Village shall comply with all applicable provisions prescribed in Article 8 of the Environmental Conservation Law, all regulations promulgated thereunder by the New York State Department of Environmental Conservation, and all applicable Federal laws and regulations in connection with environmental quality review relating to the Project (collectively, the "environmental compliance proceedings"). In the event that any of the environmental compliance proceedings are not completed, or require amendment or modification subsequent io the date of adoption of this bond resolution, the Board of Trustees of the Village 3 �I will re-adopt, amend or modify this bond resolution prior to the issuance of obligations authorized to be issued herein upon the advice of bond counsel, It is hereby determined by the Board of Trustees of the Village that the Project will not have a significant effect on the environment. Section 9. The Village hereby declares its intention to issue the obligations authorized herein to finance the costs of the Project. The Village covenants for the benefit of the holders of the obligations authorized herein that it will not make any use of the proceeds of such obligations, any funds reasonably expected to be used to pay the principal of or interest on such obligations or any other funds of the Village, and will not make any use- of the various equipment financed with the proceeds of such obligations which would cause the interest on such obligations to become subject to Federal income taxation under the Internal Revenue Code of 1986, as amended (the "Code"), (except for the alternative minimum tax imposed on corporations by section 55 of the Code and except for the environmental tax imposed on corporations by section 59A of the Code) or subject the Village to any penalties under section 148 of the Code, and that it will not take any action or omit to take any action with respect to such obligations, the proceeds thereof or the various equipment financed thereby if such action or omission would cause the interest on such obb'gations to become subject to Federal income taxation under the Code (except for the alternative minimum tax imposed on corporations by section 55 of the Code and except for the environmental tax imposed on corporations by section 59A of the Code.) or subject the Village to any penalties under section 148 of the Code. The foregoing covenants shall remain in full force and effect notwithstanding the defeasance of the bonds or any other provisions hereof until the date which is 60 days after the final maturity date �or earlier prior redemption da;e thereof. The proceeds of any obligations authorized herein may be applied to reimburse expenditures or commitments of the Village made for such purpose on or after a date which is not more than one year prior to the date of adoption of this Resolution by the Village, Section 10. The Village hereby covenants for the benefit of holders of obligations authorized herein to comply with Rule 15c2-12 of the Securities Exchange Act of 1934, as amended (the "Rule"), and in particular paragraphs (b)(5)(i)(A), (b)(5)(i)(B) and (b)(5)(i)(C) of the Rule, by providing to a nationally recognized municipal securities information repository: (i) at least annually, current financial information concerning the Village, including annual audited financial statements and pertinent operating information, and (ii) notice of any material events as set forth in paragraph (b)(5)(i)(C), unless an exemption from such paragraphs exists as provided in paragraph (a) of the Rule. Section 11. This Resolution is subject to a permissive referendum and will take effect upon the expiration of the period prescribed in the Village Law during which petitions for a permissive referendum may be submitted and filed with the Clerk of the Village.
