Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Jose Blanco Scott Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Hayes moved, second by Trustee Horecky to open the public meeting, carried. Executive Session- None Public Hearing Trustee Horecky moved, second by Trustee Hayes to open the public hearing, motion carried. Mayor Treacy read the attached public hearing notice. Armando Galella commented that he was glad that something is being done for the veterans and asked if widows were eligible and was told they would have to apply. Mr. Galella and Dr. Sweet commented that they are veterans but did not receive a letter from the village with regard to this. Linda David gave a brief explanation of the veteran's exemption, and would check to see why they did not receive a letter. There being no further comments, Trustee Hayes moved, second by Trustee Horecky to close the public hearing, motion carried. Attached resolution #03/32/95 was then passed. Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of February 21, 1995 as written, motion carried 6-0 with Trustee Jeffers abstaining. Trustee Alter moved, second by Trustee Horecky to approve the minutes of March 7, 1995 as written, motion carried 6-0 with Trustee Jeffers abstaining. Approval of Warrants Trustee Hayes moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills, motion carried 5-2. The total of the General fund is $123,598.48 and 1 �the total of the Water and Sewer fund is $3242.07. Trustee Blanco asked that the Village Attorney attend the next work session at no charge to the Village. Donal Walsh commented that he would attend. Public comments-Agenda Items Trustee Horecky moved, second by Trustee Hyland to open the public comment section, carried. There were no comments, Trustee Hayes moved, second by Trustee Horecky to close the public comment section, carried. Resolutions-Attached Public Comments Trustee Hyland moved, second by Trustee Horecky to open the public comment section, carried. Mr. Kavicky suggested that we share the ferry dock that Tarrytown has and wanted the police to enforce the full stop sign at the corner of Kendall and Howard Street especially when GM is coming out of work. He also mentioned a few places where metal was missed. The Mayor commented that we would like people to come into North Tarrytown to shop so we should have our own dock. We will have the police enforce the full stop and he will check with the General Foreman regarding the missed metal. Dr. Richard Sweet wanted more information regarding resolution #03/34/95. He wanted to know if work on the Riverfront park would start before we have all the money and if there should be an increase in the amount, will the village have to bare the extra expense. Mayor Treacy commented that we will be going out to bid before we start any work on the park. Mr. Galella asked if the overrun can be controlled by putting a cap on the bids; the Mayor responded yes. John Cellante expressed his concerns over the parking problems on Cortlandt Street and wanted to know when this was going to be addressed. He wanted to know why there wasn't a public hearing tonight. Mayor Treacy commented that the Administrator wrote Mr. Cellante a letter asking exactly what he wanted from the Board to ally your fears that the Village does assume responsibility for the volunteer fire department and the risks associated with driving trucks, etc. The public hearing was cancelled due to the fact that the resolution to call for one did not pass. The Board has done alot to help the situation such as spending money on a traffic study and increasing fines for double parking. Trustee Horecky commented to the public that the budget was drafted by the Mayor without any input from the trustees and when he asked the Administrator why the Board of Trustees had not been contacted on the budget, she commented that this is the Mayor's budget. Mayor Treacy explained the budget process. Trustee Hyland commented that the Mayor increased the budget last year, not the Board and that the Board always had input in the proposed budget in the past. George Samaras asked if this budget was official; the Mayor responded no. Mr. Galella commented that years ago the Board of Trustees would sit down with the Treasurer on the proposed budget. Trustee Horecky stated that it was outrageous that the Mayor would not let the Board have any input on the proposed budget and commented that the budget was not available to the public that day because the doors were locked. Discussion ensued among the trustees and the Mayor regarding the budget process. Mayor Treacy commented that the budget process has always been the same and the NYCOM handbook states that the Board reviews the tentative budget to make any necessary changes. Trustee Horecky asked the Mayor if this is the handbook that the Mayor says has no jurisdiction over this Board anytime a law is constituted in there. The Mayor commented it is not. Trustee Alter commented that the new mandate is that the budget must be released by March 20th. Don Caetano commented that the trustees will have their say in the budget. Trustee Blanco commented that everything must be made clear to the public on how the budget process works. The Mayor explained the budget process and commented that the Board then reviews the tentative budget. Henrietta Brand commented that she sympathizes with the parking problem on Cortlandt Street but there has been a great influx of people moving into that area and parking is at a premium. Mr. Galella commented that there is alot of garbage piled up at the corner of Beekman Avenue and Washington Street and that the Administrator should ride around the village and see the garbage that is around. Linda David commented that the garbage truck broke down this week which could account for this. 3 �There being no further comments from the public, Trustee Horecky moved, second by Trustee Alter to close the public comment section, carried. Old Business-None New Business Mayor Treacy read the attached Public Works report. Mayor's Report Mayor Treacy congratulated the newly elected candidates and commented there was a heavy voter turnout this year. The Mayor commented that the proposed budget was released on March 20th; homestead rate shows a 4.79% increase and non-homestead rate shows a 3.42% increase. He commented that this is a very lean budget of $5,960,436. There are no cuts in services. The increase in the budget is due mainly to labor contract costs. The Mayor commented that he is concerned that the Administrator is being targeted for something and felt that she is doing a capable job. The Mayor attended a meeting of the Historic River Towns last week. Trustee's Report Trustee Hayes reported that the Library Board will meet Thursday, March 2 3rd. There was no fire report. Trustee Hyland had no report. Trustee Horecky read attached correspondence from the Board of Fire Wardens. He commented that he shares the concerns of Mr. Cellante that Cortlandt Street has a high density population and he felt that the Planning and Zoning Boards failed to address this problem initially. Trustee Horecky commended the Police Department on their quick response to calls he made to them as far as disturbances throughout the village. Trustee Blanco reported that First Fidelity Bank will be holding a seminar on April 19th at the COC from 6:30PM-8PM for first time homeowners. Trustee Blanco made a formal request for a list of all village employees who are not under union contracts, salary, benefits, qualifications, etc. to see about the possible reduction in personnel since the budget is so tight. This will be discussed at the work session. Trustee Alter stated that he would like to resume the discussion on the Cable franchise agreement at the next work session. He reported that TNT baseball applications have been closed. If anyone wishes to get on a waiting list, they can call 631-7174. �I I N. A new session of Kiddy Corner I will be starting soon at the Warner Library, anyone interested can call Diane Walpuck at 631-5560. April 7th is kick off nite for TNT and girls softball meeting will be on March 27th. Line dancing has been such a success that there are now two classes on Monday nights. A softball clinic will be held at Losee park. Trustee Jeffers had no report. Discussion ensued regarding the proposed public hearing on the Cortlandt Street parking issue. Trustee Hyland commented that the Mayor and Trustee Alter had promised the Union Hose firemen at the last work session that they would call for a public hearing, but then at the regular meeting the Mayor and Trustees Alter and Hayes voted against the public hearing. More discussion ensued between Trustee Hyland and Trustee Alter. Trustee Alter commented that he was told by several residents in that area that they were against the removal of parking spaces. Administrator's Report Linda David read the ARB agenda for March 2 9th at 8 PM, the School Board and the Noise & Litter Committee will meet this Thursday, a work session will be held on March 28th and the next regular meeting will be held on April 4th. By the Order of the Board of Trustees Linda David, Village Clerk Dated: March 7, 1995 interest are �Meeting Date: Resolution #: 03-22-95 03-32-95 Be It Resolved that the Mayor and Board of Trustees does hereby amend the Local Law entitled veterans exemption to match the re-evaluation proposed by the Village, and Whereas, notwithstanding the limitation on the amount of exemption prescribed in the Village Code under Chapter 50A, if the total assessed value of the real property for which such exemption has been granted increases or decreases a s a result of a re-evaluation or update of assessments, and a material change in level of assessment, the assessor shall increase or decrease there amount of such exemption by multiplying the amount of such exemption by such change in level of assessment. If the assessor receives a certification after the completion, verification and filing of the final assessment role, the assessor shall certify the amount of exemption as recomputed pursuant to this paragraph to the local officers having custody and control of the role and such local officers are hereby directed and authorized to enter the recomputed exemptions certified by the assessor on the role and, Whereas, owners of property who previously received an exemption pursuant to Chapter 50A of the Village code, but who opted instead to receive exemption pursuant to Section 458-a of the Real Property Tax Law, may again receive an exemption pursuant to this Section upon application by the owner within one (1) year of the adoption of this law. The assessor shall then recompute all exemptions granted pursuant to this Section by multiplying the amount of each such exemption by the accumulative change in level of assessment certified by the State Board measured from the assessment role immediately proceeding the assessment role on which exemptions were first granted, provided however, that if an exemption pursuant to this Section was initially granted to a parcel on a later assessment role, the accumulative change in level factor to be used in recomputing that exemption shall be measured from the assessment role immediately preceding the assessment role on which that exemption was initially granted. No refunds or retroactive entitlements shall be granted, and Whereas, terms used in this Section shall be subject to the definition of Section 102 of the Real Property Tax Law. '..' . • iw • , . 03-22-95 03-34-95 Be It Resolved, of the Board of Trustees of the Village of North Tarrytown approving a federal aid STP Enhancement Project and authorizing the Village of North Tarrytown to participate to the extent of up to 100% of the non-federal share of costs for such project. Whereas, a Project for the North Tarrytown Riverfront Park and Promenade, identified as PIN 8755.68, funded under the Federal Aid Highway Program as provided for in the applicable sections of Title 23, U.S. Code 23, as amended, calls for the costs of such projects to be borne at the ratio of 80% Federal funds and 20% non-Federal funds; and Whereas, the Village of North Tarrytown desires to advance the above project by contributing up to 100% of the non-Federal share of the cost of such project. Now, Therefore, the Board of Trustees of the Village of North Tarrytown, duly convened, does hereby Resolved, that the Village of North Tarrytown hereby approves of the above project; and it is hereby further Resolved, that the Board of Trustees of the Village of North Tarrytown hereby authorizes Village of North Tarrytown to contribute up to 100% of the non-Federal share of the costs of the above project; and it is further Resolved, that the sum of $1,034,887.00 is hereby available to provide for up to 100% of the non-Federal share of the cost of the above project and to cover the cost of participation by the Village of North Tarrytown the above project; and it is further Resolved, that in the event that the non-Federal share of costs exceeds the amount appropriated above, the Village of North Tarrytown shall be liable for all cost in excess of the above amount, and that the Board of Trustees of the Village of North Tarrytown shall convene as soon as possible to appropriate such excess amount immediately upon notification by the Department of Transportation that such excess cost have been identified; and it is further Resolved, that the Mayor of the Village of North Tarrytown be and is hereby authorized to execute all necessary Agreements on behalf of the Village of North Tarrytown with the State of New York, approving the above project by the Village of North Tarrytown, and providing for the contribution by the Village of North Tarrytown of the non-Federal share of the costs of said project; and it is further �Resolved, that the certified copy of this Resolution be filed with the Commissioner of Transporation by attaching it to any and all Agreements that may be executed between the Village of North Tarrytown and the State of New York in connection with the above project.
