Present: Absent: Mayor Sean Treacy John T. Hayes, Jr. Scott P. Horecky Jose Blanco Morris Alter Trustees Trustee Michael Hyland Trustee Greg Jeffers (Arrived during regular meeting) Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Michael Miranda, Attorney Discussion ensued on the Halpern lawsuit but no formal action was taken. The regular meeting of the Board of Trustees took place at 8PM. Mayor Treacy called the meeting to order with a pledge to the flag. Before starting the meeting, Mayor Treacy presented outgoing Fire Chief John Morabito with a plaque in appreciation for his service to the village this past year and thanked him for a job well done and also presented him with a key to the village. John Morabito thanked the Mayor and Board of Trustees for their support and help this past year and also thanked the village employees for all their help. Trustee Hayes moved, second by Trustee Alter to open the regular portion of the meeting, motion carried. Executive Session Mayor Treacy moved that the executive session be held off until the end of the meeting, second by Trustee Alter and carried. Public Hearing-None Approval of Minutes Trustee Alter moved, second by Trustee Hayes to approve minutes of April 4, 1995 as written, motion carried 5-0. the Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills, motion carried 5-0. Amount of the General fund is $41,230.91 and the Water Department fund total is $3950.24. Public Comments-Agenda Items Trustee Hayes moved, second by Trustee Alter to open the public comment section, motion carried. John Morabito asked that wording "upgrade the room" be added to 1 �4° resolution #04/47/95. There being no further comments, Trustee Alter moved, second by Trustee Hayes to close this section, carried. Resolutions-Attached Public Comments Trustee Alter moved, second by Trustee Horecky to open the public comment section, motion carried. Mr. Kavicky asked why the water rates were going up. The Mayor responded that the charges we pay for water to New York are very high so we must pass it on to the consumer, but the largest consumers will be paying the higher rates. There being no further comments, Trustee Hayes moved, second by Trustee Alter to close the public comment section, motion carried. Old Business-None New Business Mayor Treacy read the attached Public Works report. Mayor's Report Mayor Treacy commented that he met with our attorney Stephen Kass who brought us up to date on the GM litigation. A new Judge has been assigned to this case. GM is now ready to negotiate again. Mayor Treacy commented that he met with the Fire Chiefs and Town Supervisor Robert Meehan regarding ambulance services outside of North Tarrytown. It was a very fruitful meeting and North Tarrytown will be receiving $2000. for previous years of ambulance service and will receive $3000. for this year. This extra money will be added to the Fire Department budget. The Historic River Towns of Westchester met last Thursday. Tarrytown and North Tarrytown has been chosen to be the site for pilot trolleys which will take tourists through the villages, making regular stops through the shopping districts. Hospitality training was held today at the Hilton Inn. A calendar of events sites, etc. is being put together and we hope that the local merchants will pick up the expense of the calendar. A resident of Kendall Avenue suggested that the "No Parking" signs near the parking lot that belongs to Luberger Distributors be removed to make spaces for on street parking for three cars, since the company is no longer in existence. We have removed the signs. We will also research the possibility of leasing the lot from the owner to create more parking in the village. An emergency meeting of the ETPA for tenants is being held on Saturday April 22, 1995 at 3 PM at St. Teresas. Governor Pataki is considering having the number of apartments under ETPA to be increased to twenty-five families. Tenants can express their concerns over this proposal. Assemblymen and Senators have been 2 �...... ^.:-^M».. .••••. .'v t V " . invited. The SPCA is sponsoring a Walkathon on April 30, 1995 from 10:3 0AM to 2 PM at Rockwood Hall. Mayor Treacy read the final report from outgoing Fire Chief John Morabito. (Part of official minutes) Mayor Treacy commented that the 1995-96 budget was adopted last Wednesday. There is a $88,567. increase in appropriations for a total budget of $5,960,436. Homestead rate will be $10.76 per $1000. of assessed value and the non-homestead rate will be $20.79 per $1000. which is a tax increase of 5.19% for homestead and 2.8% for non-homestead. Trustee Reports Trustee Hayes read correspondence from the Fire Wardens.(Part of official minutes) He congratulated John Morabito on a job well done and extended good wishes to new Chief Richard Chulla. The Library Board will meet on Thursday, April 2 0th. Florence Kane would like to see Diane Boersma reappointed to the Library Board and Ms. Boersma would like to come and speak to our Board. Trustee Horecky commented that he attended the kick-off parade for TNT baseball for the summer. It was a great success. Trustees Alter and Hayes also attended as well as some officials from Tarrytown. He thanked Henry Atterbury, Recreation Superintendent and his assistants for the wonderful easter egg hunt that was held last Saturday at Douglas Park. Pictures were taken and anyone wishing a copy can contact the Recreation Department. Trustee Horecky attended the swearing in ceremony for the Fire Department and he wished Chief Chulla, Lenny Rutligan and Robert Moon success and congratulated John Morabito for his past year's service. There was a great dinner after the ceremony and during the dinner the fire alarm blew and the firemen all responded to the alarm. This shows the dedication of our volunteers which is very gratifying. Trustee Horecky attended th DARE ceremony. Chief Brophy, Sgt. Ferguson, Officer Nevelus and all officers in the DARE program deserve special recognition. The teachers are a very important part of this DARE program. Trustee Horecky stated with regard to the budget; on behalf of himself and others, he offered an apology to residents on the manner in which the budget was adopted. He opposed this and it was dead wrong and unprecedented that the Mayor would not inform members of the Board or the public that the budget was about to be adopted. It was outrageous that the Mayor contacted certain members of the Board that this was going to happen, this was unconscionable and an abrupt slap in the face to Dr. Sweet. The Mayor contends that this was legal but Trustee Horecky felt it was dead wrong and detrimental to our community. It was wrong to 3 �I change the budget process that has existed in the Village for many years, it is wrong not to work with newly elected trustees. Trustee Blanco commented that at the April 12th budget hearing it was very unusual to adopt the budget at that time. In the past there was always further discussion after the hearing was held. One trustee cast the deciding vote even though he was not present at most of the work, sessions when the budget was being discussed. It was not surprising that the Mayor did this nor that Trustees Alter and Hayes went along with it, but he felt that Trustee Jeffers had a lapse in judgment by voting in favor of the budget that night. He felt that Dr. Sweet, the newly elected Trustee, who attended all the work sessions on the budget, should have been able to have a say in the budget. A few items remain undiscussed such as the pagers for the fire department, contract services for the heating and plumbing, Prosecutor and Village Attorney legal expenses and capital expense of $50,000. for the sand/salt shed that is needed because of the proposed Riverfront Park. He also felt that Dr. Sweet's valuable ideas will never be considered. Trustee Alter commented that the Recreation brochures will be mailed out next week. Some of the programs that are being offered are: tiny tot baseball for 5 and 6 year olds from 9AM-10AM starting April 29 through June 10, summer day camp from 9AM-1PM starting July 10-August 18 for ages 5-12. Tot camp starts July 10 for ages 3-4. Anyone interested in these programs can contact the Recreation Department before they receive the brochure. Trustee Jeffers commented that he is responding to Trustees Horecky and Blanco's comments. Trustee Jeffers stated that he voted for the budget as a taxpayer first and does not want his taxes to go up any higher. He agreed with the Mayor because he is interested in keeping taxes down. The whole County is in a state of decline and a survey showed that 42% of the County would move if they could. Everyone knows that he and the Mayor don't usually agree on most things but in this case he did agree with adopting this budget. Trustee Horecky responded that his grandmother and other relatives are senior citizens on a fixed income and does not like the insinuation that he is not thinking of the homeowner when it comes to taxes. He hopes to buy a home in the village one day also. Mayor Treacy commented that if they did not adopt the budget that night, the budget would go up $237,000. instead of $88,567. Trustee Jeffers commented that he felt his party made a mistake when they recruited people from the other party to run with them. We now have division within our own party. In order to hold a majority on the Board, we must sweep the next election and hope the people and district leaders of the Republican party will keep this in mind when the next election rolls around. Communications, Petitions & Requests Deputy Clerk read the Chief's report for the month of March. (Part of official minutes) Mayor Treacy read correspondence from New York Guard Headquarters inviting the Mayor to speak at their services at the Sleepy Hollow Cemetery on May 7, 1995 at noon. He received correspondence from Ed Stocklein thanking him and Linda David for having a computer print out error in the court corrected. The Mayor received correspondence from Andrew O'Rourke acknowledging receipt of our application for funding for youth services. A new resident to the Village asked if there was anything the Mayor could do with regard to people hitting golf balls in Peabody field because it is a dangerous situation. The Mayor is trying to work something out with school officials. Senator Suzi Oppenheimer sent congratulations to the Mayor on his recent re-election and is looking forward to working with him. Mr. Lamoscola thanked all the trustees who voted for the budget. He commented that our bond rating is not good and interest rate on bonds was a little high. Dr. Sweet commented that this Wednesday, 7:30 PM at the Town of Mt. Pleasant Town Hall, town officials will explain the town tax bills. He will attend this meeting. Mr. Kavicky commented the homestead rate for one-family homes should be changed to residence since one-family homes don't have tenants to charge for tax increases. The Mayor commented that this is a process of the state law. Trustee Jeffers explained with regard to the rating issue, it was discussed in the past but considering our low rate of borrowing, it wasn't worth our time to convince the rating agencies to increase our rating. The Mayor commented that depending on how we handle the reassessment of General Motors, we may see our bond rating upgraded. There being no further comments, Trustee Hayes moved, second by Trustee Horecky to adjourn to executive session to discuss litigation, motion carried. Executive Session Discussion ensued on the assessment of Chestnut Ridge. 5 �A Discussion ensued on the Dutan litigation case. The insurance carrier has recommended payment of $10,000. to settle the case. Trustee Alter moved, second by Trustee Hayes to approve this settlement, motion carried 4-1 with Trustee Horecky voting no and Trustee Blanco abstaining. Discussion ensued on the Buscetto claim. The insurance carrier has recommended settling this claim for $1202.for damages due to sewer back up. Trustee Horecky moved, second by Trustee Hayes to approve this settlement, motion carried 6-0. Discussion ensued on the Caetano litigation case. The insurance company has recommended payment of $31,012.48 to settle this case. Trustee Horecky moved, second by Trustee Jeffers not to settle this claim in this amount, motion carried 5-0. Mayor Treacy recused himself. Page 2 of 3 There were also many other drills and training sessions during the 94/95 firematic year, working jointly as a team with other companies within the village and also with Tarrytown, Archville, Pocantico Hills, Ossining Etc. The General Motors fire which occured on Friday the 13th of May took many men and great cooperation by the North Tarrytown Fire Department plus the mutual aid from nearby villages. After much research by General Motors and testing by the County Labratories, it was determined that there was "NO" hazardous material at thiss fire. The sticky substance which clung to boots, tools and fire Gear proved to be nothing more than a wax substance. The new Rescue - 12 apparatus was put into service in October of 1994. A new tower Ladder for Pocantico Hook and Ladder will be delivered approximently mid 1995 (June). Myself and two (2) assistances had no involment with the specifications of these two (2) apparatuses (See attached). The new ambulance (Amb. - 13) was put into service in Dec.95, fully equiped and ready to respond. The old ambulance is now known as Amb. - 18 and is used as a backup. There was one (1) suspension during the year. The North Tarrytown Fire Dept. won Seven (7) Trophys during the 1994 parade season. Cortlandt Verplank Montrose 2nd Best appearing regulation uniform. Co. parade over 40 Co's in line) I enjoyed my term as Chief Engineer, I am happy I served and I am also happy its over. Myself and my two assistants Chulla and Rutigliano worked excellent together for the good of the Department and the village. We also had many fun times together socially. I know that I have faithfully fullfilled my duties as Chief Engineer of the North Tarrytown Fire Department. I have filled most requests for gear and equipment when and where I thought it was of the upermost importance for the good of the department and the taxpayers. �i-'age I received great cooperation from 99% of the members of the NTFD. The oter 1% did not make a drip in the ocean and did not effect the overall performance of the NTFD at fires or social functions. RE: New Apparatuses Rescue-12 Ladder-38 Dear Mayor and Board: The undersigned Chiefs hereby state that we have not had any envolment with the drawing up of the specifications of the above named Two (2) vehicles. One (1) of which has already been put into service (Rescue-12), and the other which is under contract to be assembled and delivered some time in early or mid 1995 (Ladder-38)/ We wish to state the following: 1. Rescue-12 cannot be used as a back up ambulance as it does not meet EMS requirements to be used as such. 2. Ladder-38 The new ladder and bucket can only reach a height of ninty (90) feet at a 75 degree angle, (see page 31 of the specifications) -- Copy attached. 3. There is to.ibe NO scotchlite stripe per NFPA and the village will need to sign a waiver of liability, (see copy attached). Horizontal reach to be not less than 80 feet. Overall length of vehicle to be 46 feet, 4 inches. Overall height of vehicle to be not more than 9 feet, 10 inches. GENERAL An elevated platform of the telescopic design consisting of a minimum-of four (4) sections shall be provided. The overall length of the boom with all four (4) sections and platform fully retracted at 0 degree elevation shall not exceed 34 feet. These particular shorter lengths shall be important for allowing the platform to be positioned in tight or confined spaces associated with lower degrees of elevation, All sections shall be of the open lattice, non-crossing enclosed box design of truss type construction to obtain light weight and stability atfull horizontal reach. The telescoping sections will be constructed from heat treated 6061-T6 aluminum alloy material fastened by Aircraft-type bolts and there shall be no welding on .the boom so as not to lower the yield strength of the material and cause torsional fracture, grain distortions and unequal conductivity. There shall be a minimum of 500 Aircraft-type bolts per section of boom. The base section of the boom shall have a section modulus of 240 psi and a resisting bending moment of 8,000,000 in. lb. The base section shall also consist of two (2) heavy duty steel side plates, one (1) mounted each side of the boom. The steel side plates shall be aircraft bolted into place and shall function to tie the boom, turntable, and lift cylinders together. There shall be trailing beams attached to the side plates t h a t shall function to position and anchor lift cylinders into place and to distribute shock loads imposed by water hammer and hose breakage. The 4000FM lightbar is to have lens colors as follows: red/clear/red/clear/red. The 4200TB lightbars are to be red/clear. 33. Wire the work light in the 4200 TB's to come on with the rear door of the cab. ¥ 34. There is to be no scotchlite stripe per NFPA and the department will need to sign a waiver of liability. 35.
