Present: Mayor Sean Treacy John T. Hayes, Jr. Michael Hyland Scott P. Horecky Jose Blanco Morris Alter Richard C. Sweet Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. The Mayor asked that everyone remain standing for a moment of silence for the victims of the Oklahoma City bombing. Trustee Hayes moved, second by Trustee Alter to open the meeting, motion carried. The newly elected trustees Morris Alter, Richard Sweet and John Hayes, Jr. were sworn into office by Linda E. David, Village Administrator/Village Clerk. Mayor Treacy had been sworn in previously. Mayor Treacy stated that he will make committee tonight: appointments Mayor Treacy reappointed John Lewis as Acting Village Justice for a term of one year, second by Trustee Alter, motion failed 3-4 with Trustees 'Blanco, Hyland, Horecky and Sweet voting no, and Mayor Treacy and Trustees Hayes and Alter voting yes. Mayor Treacy reappointed Marion Reilly to the Architectural Review Board for a term of four years, second by Trustee Hayes and motion carried. He appointed Robert Barstow for a term of four years, second by Trustee Alter and motion carried. Trustee Hyland moved to appoint Richard Chulla, Fire Chief, to the Bureau of Fire Prevention for a term of one year, second by Trustee Horecky and carried. Mayor Treacy reappointed Chris Rezza and James Marx to the Economic Development Advisory Council for a term of three years and appointed Hugh Casey, Tom Staudter, Jose Chevere and Alcides Mariano to the Council for a term of three years. Trustee Hyland moved to reappoint Eugene Cialini to the Electrical Board of Fire Underwriters for a term of one year, second by Trustee Horecky and carried. Mayor Treacy reappointed Catherine Wolfe and Mario DiFelice to the Environmental Council for a term of two years and appointed Ralph Gunderman to the Council for a term of two years. 1 �(A Trustee Alter moved, second by Trustee Hayes to reappoint Frederick Mauhs to the Ethics Board for a term of two years. Motion carried 4-3 with Mayor Treacy and Trustees Hayes, Alter and Sweet voting yes and Trustees Hyland, Blanco and Horecky voting no. Trustee Hayes moved to reappoint Marie Nicol to the Ethics Board for a term of two years, second by Trustee Alter and motion carried 5-1-1 with Trustee Horecky voting no and Trustee Hyland abstaining. Mayor Treacy reappointed Monica Timmings to the Ethics Board for a term of two years, second by Trustee Alter and carried 4-1-2 with Mayor Treacy and Trustees Alter, Hayes and Sweet voting yes and Trustee Horecky voting no. Trustee Blanco and Hyland abstained. Trustee Hyland moved, second by Trustee Alter to reappoint Carmen Capossela to the Fire Board of Appeals for a term of five years, motion carried 6-0. Mayor Treacy reappointed John Venuti and Rita Pulsoni to the Handicapped Committee for a term of two years and appointed John Maltby for a term of two years. Mayor Treacy reappointed Trustee Hayes as liaison to the Library Board. Trustee Hayes moved, second by Trustee Alter to reappoint Diane Boersma to the Library Board for a term of five years, motion carried 6-0. Mayor Treacy reappointed William Palmer to the North Tarrytown Housing Authority for a term of five years. Mayor Treacy commented that the Sleepy Hollow National Bank will continue as our official depository of funds. Mayor Treacy commented that we will hold off designating the official newspaper since there is going to be a local newspaper in town shortly. Trustee Blanco moved, second by Trustee Alter to designate Roberts Rules of Order as the Official Parliamentary Procedure, motion carried. Mayor Treacy moved to appoint Miguel Jimenez to the Parking Authority, second by Trustee Alter; Trustee Hyland asked who he was replacing. The Mayor commented to replace Josephine Galgano; motion failed 3-4. Trustee Alter moved, second by Trustee Hayes to appoint Miguel Jimenez to the Parking Authority for a term of one year to fill in a vacancy, motion carried,. Josephine Galgano will continue as a holdover. Mayor Treacy reappointed Dr. Elio Ippolito as Police Surgeon, second by Trustee Horecky, motion carried. Mayor Treacy reappointed Frank Gallagher to the Recreation Commission and appointed Marion Palmer both for a term of seven years. Trustee Alter moved, second by Trustee Hayes to appoint Daniel Michaud to the Tree Commission, motion carried 6-0. Mayor Treacy stated that our General Foreman, Joe DeFeo, must serve on the Tree Commission by code. Trustee Sweet commented that we need a member from the Planning Board and the CAC to be on the Tree Commission and will ask for volunteers. Mayor Treacy reappointed Robert Balog as Village Assessor for a term of one year, second by Trustee Alter and carried. Trustee Hyland moved, second by Trustee Horecky to reappoint Joseph DeMilia, Jr. as Village Auditor for a term of one year, motion carried. Trustee Hyland moved, second by Trustee Hayes to reappoint Mr. & Mrs. Theodore Hutchinson as Village Historians for a term of one year, motion carried. Mayor Treacy appointed Angelo LaMoscola and William Taylor to the Zoning Board for a term of three years. Mayor Treacy commented that Donal Walsh, Jr., Village Attorney, continues as a holdover. Mayor Treacy appointed the trustees to different committees. (See attached sheet) Trustee Hyland commented that he would like to discuss trustee committee appointments at the next work session. Executive Session Mayor Treacy moved that executive session be held at the end of the meeting, second by Trustee Alter, motion failed 3-4. Trustee Sweet commented that he would like to have the agenda amended to have executive session at 7 PM if needed, Trustee Horecky so moved, second by Trustee Blanco and carried. Trustee Hyland moved, second by Trustee Blanco to go into executive session to discuss legal matters and personnel,carried. Discussion ensued on the meter that was removed on Bedford Road. Trustee Blanco stated that he wanted a letter from each member of the Board of Trustees that the investigation was done without their knowledge. He also wanted a letter stating the amount of the water bill and wants to know why it wasn't sent out. He wanted to know why an investigation was done by the Prosecutor into allegations regarding his brother. Mayor Treacy stated that he started the investigation on his own and told the Board that he was moving forward on it. Trustee Horecky entered memos, letters, etc. regarding the water meter incident into the official minutes. As per the Village Attorney, the confidential police investigation report of 10/3/91 shall remain stored in the Village Clerk's files. Trustee Blanco stated that he will be introducing a resolution to 3 �appoint an independent counsel to look into these allegations. Mayor Treacy moved, second by Trustee Alter to request that the District Attorney look into all allegations involving the Police Department, motion failed 3-1-3 with Mayor Treacy and Trustees Alter and Hayes voting yes, Trustee Hyland voting no and Trustees Blanco, Sweet and Horecky abstaining. Trustee Blanco moved, second by Trustee Alter to have the executive portion of board meetings taped in the future, motion carried 6-0. Back in regular session, Mayor Treacy told the audience what was voted on in executive session. Public Hearing Mayor Treacy read the attached public hearing notice with regard to the cable franchise renewal. Trustee Alter moved, second by Trustee Hayes to open the public hearing, motion carried. Trustee Alter gave some highlights of the cable franchise renewal agreement. He entered a letter from Public Access into the official minutes. Mr. Sanders and Mr. Guthrie were there to answer any questions. Mr. Guthrie commented that this is a non-exclusive agreement. Mayor Treacy asked if it were possible for seniors to get an exemption. Mr. Sanders said this was not possible because they cannot lower rates for any one party. He commented that the village does not lose anything by signing a ten year franchise agreement. Trustee Alter asked about the eighteen month window. Mr. Sanders commented that we need approval from the state. Mr. Kavicky commented that the federal government said the rates were to come down, why did they go up and wanted to know if Continental Cable could have a payment center to pay their bills. Mr. Sanders commented that although most of the rates did not go down, the vast majority of items did come down as did a few rates. Having a place to pay the bills would cost too much money. Mr. Martone and Mr. Jimenez were concerned about signing a ten year agreement in light of the rapid changes in technology. Sunny McLean of Public Access channel presented her views and discussion ensued between her and the representatives of Continental. Mr. Guthrie commented that the cable company is testing the technology that would allow the people to interface with the different computer programs that are out there. There being no further comments, Trustee Alter moved, second by Trustee Hayes to close the public hearing, motion carried. Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of April 12, 1995 with minor additions/corrections. Discussion ensued. Trustee Hyland asked the Village Attorney if business can be conducted at a public hearing such as the adoption of the budget. Donal Walsh stated yes because a public hearing is a board meeting. On page 4, final para, Mayor Treacy wanted to add that the budget was adopted 4-3, 3rd para from bottom that Trustee Hyland walked out of the meeting after he made his comments. Trustee Hyland commented, for the record, that part of the meeting was illegal. Trustee Horecky commented that Mayor Treacy stated on page 3, para 6 that village fines allow us one way to reach into the renters pockets. Mayor Treacy commented that he never said that. Trustee Hyland commented that the budget has never been adopted at a public hearing before as the Mayor had previously stated. Dr. Sweet commented that although he could not vote on the approval of the minutes, he felt there should be a change in the wording on page 1, para 3 and 4. The tax rate for homestead will show an increase from last years increase and the non-homestead will show a decrease from last years change. Homestead property taxes will increase ;to $10.76 per thousand, not by. and the non-homestead taxes will increase to $20.79 not by. Trustee Horecky moved to approve the minutes of April 12 with his addition, second by Trustee Hyland, motion failed 2-3-2. Trustees Hyland and Horecky voted yes, Mayor Treacy and Trustees Hayes and Alter voted no and Trustees Blanco and Sweet abstained. Trustee Hayes moved, second by Trustee Alter to approve the minutes of April 12 with the other changes, motion carried 5-0-2 with Trustees Sweet and Blanco abstaining. Trustee Alter moved, second by Trustee Hayes to approve the minutes of April 18, 1995 as written, motion carried 5-0-1 with Trustee Hyland abstaining. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued. Trustee Blanco commented that he would like to pull the Village Attorney's bill until his contract can be discussed. Village Attorney explained what these bills were for and that under the contract, it is not really necessary for them to appear on a warrant. Trustee Blanco commented that he would like the Board to discuss renegotiating the Village Attorney's contract and restructuring at the next work session. Don Walsh 5 �1\ commented that he could not attend the next work session due to a prior commitment but could be at the May 2 3rd work session. After further discussion motion carried 6-0. Total of the General fund is $111,249.47 and the Water Department fund total is $20,493.10. Public Comments-Agenda Items Trustee Alter moved, second by Trustee Hayes to open the public comment section, motion carried. Miguel Jimenez asked why the issue of the water meter came before the Board when the electrical issue awhile ago did not. Trustee Blanco commented that he wanted his family name cleared of serious allegations. Discussion ensued. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the public comment section, carried. Resolutions-Attached Mayor Treacy read the results of the canvass of the election held on March 21, 1995. Trustee Hayes moved, second by Trustee Alter to accept the results, motion carried 6-0 'with Trustee Hyland abstaining. (Part of official minutes) Since it was so late, Mayor Treacy moved that they dispense with the rest of the agenda after public comments, seconded by Trustee Alter and carried. Mr. Kavicky asked if anything could be done about the visitors' parking at the Westchester Medical Center especially for senior citizens. Visitors for prisoners don't have to pay but other visitors do as do people who have to go to the clinic. Mayor Treacy commented that we can speak to Legislator Swanson who is the Chair of the medical issues at the County. Mr. Kavicky commented couldn't help. that he already spoke to her and she Trustee Blanco commented that he thought this was being run by a private company. The Mayor commented that he would call and see if there are any senior citizen discounts available. Mayor Treacy commented that since the Boar,d has received the correspondence from the Fire Wardens, the Board will just approve the action taken at that meeting, Trustee Hayes so moved, second by Trustee Alter and carried. I will be unable to make our meeting on May 1 because I am taking the day off for personal reasons. 2. Section 5711-Q, sec. 8 of the Unconsolidated Laws and Article 1, sec. 77-1 (B) of the Rules and Regulations provide that the Board of Trustees, not you, have statutory authority with the Police Department. 3. On April 21, 1995 I provided Trustee Scott Horecky with a copy of Det. sgt. Caixeiro's report concerning the water meter incident per Article I, sec. 77-1 (A) of the Rules and Regulations. 4. The reason that Rob Ryser was provided with a copy of the report was because YOU called him and brought the matter to his attention. Article IV, sec. 77-32 (B) gives me the authority to do this and does not compel me to force Mr. Ryser to invoke the Freedom of Information Act. 5. I requested this information from you on April 20, 1995. You have to date failed to provide said file. I would also like to see any Freedom of Information request from the Gannett Newspaper regarding the file and I would demand that you explain to me in writing why the newspaper has been provided police files before the Mayor of the Village of North Tarrytown. Sgt. Caixeiro to me. As you can see, the matter was turned over to Mr. Rob Ryser of Gannett Westchester before it ever got into the hands of the District Attorney's Office. The part that is extremely disturbing to me is the fact that Janet Gandolfo personally searched the court f iles for the summonses issued to Henry Blanco without reque sting assistance from the Court Clerk and without informing th e Clerk what she was looking for. If Ms. Gandolfo had simply requested assistance from the Clerk she would have found the summonses the way Det. Sgt. Caixeiro did. I believe that if Ms. Gandolfo had located the summonses she would have left the courtroom with them and disposed of them in an attempt to frame me for fixing the case. September, 1994 - Henry Blanco is arrested for violation of Vehicle and Traffic Law, Section 511, Arrest Number - . 2. A few days later an article regarding the arrest appeared in the West. Gannett Newspapers under Police File. 3. To this date, Henry Blanco has never appeared in North Tarrytown Court. 4. Procedures of N. Tarrytown Police Department after arrest: 1. Arrest is logged into arrest book. (If you look at book you will sec the arrest record). 2. At appearance in Court, defendant pleads guilty or not guilty. 3. If defendant pleads guilty, he pays a fine and his name and judgment sheet are entered into the Simplified Format Motor Vehicle Docket (see copies of attached). 4. If defendant pleads not guilty, his ticket is kept in box in courtroom until appearance. There is no ticket for this individual in the appropriate box in the courtroom. In any event, he has never appeared in court to plead not guilty. 5. After thefinaldisposition of the case, ht*9 arrest card is filed in headquarters. Thereis no file for Henry Blanco. / §> _,, ,. Bureau on Government Integrity District Attorney's Office 111 Grove Street White Plains, New York 10601 Re: Village of North Tarrytown Dear Mr. Hughes, There is a situation in North Tarrytown which has reached intolerable levels and I must seek the help of the District Attorney's office. At this point in time, I do not appear to have any alternative but to seek your help. The Police Chief, along with the help of the detective division, has been involved in a conspiracy to systematically help Republican politicians in the Village and to hurt all Democratic politicians or their helpers. This is not paranoia on my part but can be backed up with facts, as follows: 1. At the end of the 19K0's the Democratic Deputy Mayor was arrested for Driving While Intoxicated under James Brophy's direction. Mr. Fudali had been a long time outspoken critic of the manner in which Mr. Brophy conducted himself. The charges against Mr. Fudali were later dismissed and Mr. Fudali sued the Village and received a judgment in the amount of S85.0O0 for false arrest, inter alia. (Documentation can be provided to support these facts). 2. In 1993, a well-known democratic supporter, Laurentino Rodrigues, was arrested for theft of services on the complaint of Chief Brophy's Republican supporter, Trustee Michael Hyland. Trustee Hyland and Mr. Rodrigues have been political enemies for quite some time. The charge stemmed from Mr.Rodrigues' use of electricity from a village light pole for which he had permission from the Foreman of Public Works. Within a matter of twenty �JEftUNs. t i'-» "-— A 1 Page 2 - District Attorney's Ofnee minutes, without even investigating the matter to ascertain whether Mr. Rodrigues had permission, the Chief had him arrested. The charges were immediately withdrawn by the District Attorney's office at the first court appearance. (Documentation can be provided to support these facts). 3. In 1994, a well-known democratic supporter and party worker, Frank Occhipinti, was arrested by Detective Manny Caixero on the complaint of the Chairman of the Village Republican Party. Mr. Occhipinti was accused of assaulting this Chairman. The complaint was not made against Mr. Occhipinti until two weeks after the alleged incident and there was absolutely no proof against him other than the contradictory statements of the three current Republican trustees and the Chairman but Detective Manny Caixero still arrested Mr. Occhipinti. These charges were later dismissed by the Court 4. Recently, during a routine inspection of all the water meters in the Village, it came to the attention of our Village Water Department that the family of Republican Trustee, Jose Blanco, had disconnected its water meter and run a bypass connection (see enclosed copy of photo). Our Water Department records show that the meter had been disconnected since February, 1994 (see enclosed copy of computer print-out of Blanco file). I brought* this matter to the attention of the Board of Trustees (Republican majority) who agreed with me that an immediate investigation should follow. However, the next day it was discovered by them that the premises were owned by the Blanco family and they insisted that all investigations be stopped. As Chief Executive Officer, I directed the Police Department to look into the matter. I knew this would be a waste of time but T. had no other recourse. As soon as we spoke to the Police Department we were advised that "there is nothing there" and Detective Caixero made a finding of "no intent." The Republicans had spoken to Detective Caixero and the Chief prior to the Police Department starting the investigation (the Detective and the Chief both admit to the fact that they spoke to Trustee Blanco prior to starting their investigation). I would point out to you that the circumstances here were similar to that of the Rodrigues matter mentioned above, with the exception that the Blancos did not have the Village's permission to use its water free of charge. The Blanco family also admits to disconnecting the meter and running a bypass. If this were anyone else the Police Department would have preferred charges for theft of sen-ices. This is a perfect example of the favoritism shown by the Police Department to the Republican trustees. I. am requesting that the District Attorney look into the Village's complaint of theft of sen-ices regarding this water meter incident". 5. Finally, on or about September 17, 1994, the brother of Republican Trustee Jose Blanco, Henry Bianco, was arrested for a violation of Section 511 of the Vehicle and Traffic Law. We know this to be true because an article appeared in the local newspaper regarding the arrest. After a careful examination of the court files, we have determined that the matter �i JEANNE E METTLER PA Page 3 - District Attorney's Office has "disappeared." Mr. Blanco has never appeared in court to enter a plea to the charges. It does not appear that the charges ever made it to the court and we believe that the Police Chief, and/or a member of his Department, has buried the matter. I am requesting that the District Attorney look into this matter as well. I have enclosed copies of our Village Vehicle and Traffic Docket which would indicate if he ever paid the ticket. The dockets date from October, 1994 to the present time. Procedurally, in North Tarrytown, when a case isfinished,an index card showing the disposition is filed with the Police Department. There is no such record in the Police Department. Not only should the Chief be investigated regarding this situation, the matter of the arrest of Henry Blanco should be placed on the court calendar and proceed according to normal custom. I think that you will agree with me that when a community is held hostage by a renegade Police Chief it can only lead to chaos. We simply cannot have a Police Department that will arrest and charge democratic politicians and/or their supporters without any basis and then cover-up or refuse to act on the complaints against Republican office holders and/or their families. We are living in a community where if one is on the wrong side of the Police Department one is subject getting harassed and arrested for no reason. HE SHOWED ME A COPY OF A LETTER APPARENTLY PREPARED BY OR FOR MAYOR TREACY. THE LETTER WAS ADDRESSED TO MICHAEL HUGHES, ESQ OF THE WEST. COUNTY D.A. OFFICE, BUREAU OF GOVERNMENT INTEGRITY, AND IT IS DATED MAY 1, 1995. THIS LETTER LISTED A SERIES OF EVENTS WHICH, ACCORDING TO MAYOR TREACY, ARE EVIDENCE THAT "THE CHIEF OF POLICE, ALONG WITH THE DETECTIVE DIVISION, HAS BEEN INVOLVED IN A CONSPIRACY TO SYSTEMATICALLY HELP REPUBLICANS IN THE VILLAGE AND TO HURT ALL DEMOCRATIC POLITICIANS OR THEIR HELPERS." THIS LETTER IS A REQUEST BY MAYOR TREACY TO HAVE THE D.A.'S BUREAU OF GOVERNMENT INTEGRITY UNIT INVESTIGATE THE ACTIONS OF YOURSELF, AND THE DETECTIVE DIVISION, REGARDING THE FIVE EVENTS LISTED (COPY OF THE LETTER IS ATTACHED). I FIND IT INTERESTING TO NOTE THAT THIS LETTER WAS A FACSIMILE, SENT FROM THE OFFICE OF JEANNE E. METTLER, WHERE I BELIEVE JANET GANDOLFO'S OFFICE IS ALSO SITUATED. IT WAS SENT AT 1017AM ON MAY 1ST, 1995, AND WAS SHOWN TO MYSELF BY ROB RYSER, THE REPORTER FOR THE LOCAL GANNETT PAPER, AT APPROXIMATELY 10:30AM, MAY 1ST, 1995. THE LETTER HAD NOT YET BEEN SIGNED BY THE MAYOR, INDICATING THAT WHEN ROB RECEIVED IT, "IT WAS HOT OFF THE PRESS." THE MOTIVE, THEREFORE, WAS CLEARLY TO SLANDER YOURSELF AND THE DETECTIVE DIVISION BY HAVING ROB PRINT THIS STORY BEFORE THE D.A.'S OFFICE EVER HAD AN OPPORTUNITY TO CONDUCT ITS INVESTIGATION. IF THE INTENT ON THE PART OF THE MAYOR AND JANET GANDOLFO WAS TO ASCERTAIN THE TRUTH, THEY WOULD NOT HAVE ATTEMPTED TO DISCLOSE THE LETTER, UNTIL THE INVESTIGATION WAS CONCLUDED. ROB RYSER SHOWED ME THE LETTER, AND APPEARED TO BE PARTICULARLY CONCERNED WITH ITEM NUMBER FIVE, IN WHICH IT IS ALLEGED THAT COURT FILES PURSUANT TO THE ARREST OF HENRY BLANCO (BROTHER OF TRUSTEE JOSE BLANCO) ON SEPT. 17, 1994 FOR VIOLATION OF SEC 511 OF THE VEHICLE AND TRAFFIC LAW. IT IS INDICATED IN THIS PARAGRAPH THAT "AFTER CAREFUL EXAMINATION OF THE COURT �nfao ,v'ILES, WE HAVE DETERMINED THAT THE MATTER HAS DISAPPEARED" IT v IS FURTHER STATED THAT THE "CHIEF BE INVESTIGATED REGARDING THIS SITUATION,." WHEN I INFORMED HIM THAT THIS OFFICE WOULD NOT HAVE BEEN INVOLVED WITH THIS MATTER SINCE THE V & T INFRACTIONS WERE NOT FINGERPRINTABLE OFFENSES HE WAS NOT SATISFIED WITH MY RESPONSE. I THEN CALLED THE D.A.'S OFFICE TO CONFIRM THAT OUR POLICY WAS CORRECT AND ONLY AFTER THIS DID HE MOVE ON. I EXPLAINED TO HIM THAT EVEN THOUGH THIS OFFICE WOULD NOT HAVE BEEN INVOLVED IN THIS MATTER, I DOUBTED VERY SERIOUSLY THAT ANYONE IN THIS DEPARTMENT WOULD HAVE, IN ANY WAY, INTERFERED WITH THE PROSECUTION OF THIS CASE. I WENT WITH HIM TO THE COURT TO ATTEMPT TO LOCATE THIS CASE, BUT THE COURT CLERK WAS UNABLE TO LOCATE IT. I THEN INFORMED HIM THAT I WOULD PERSONALLY GO BACK INTO THE COURT AND GO THROUGH THE CASES WITH ELSIE MOTEN UNTIL SUCH TIME AS I LOCATED THIS CASE. I INDICATED TO HIM THAT I WOULD CALL HIM AS SOON AS IT WAS LOCATED, AND HE LEFT. I THEN CONTACTED OFFICER GREG CAMP, WHO ISSUED THE TWO SUMMONSES TO HENRY BLANCO ON SEPT. 17, 1994, SUBSEQUENT TO HIS INVESTIGATION OF A MOTOR VEHICLE ACCIDENT. OFFICER CAMP TOLD ME THAT HE RECALLED THE INCIDENT AND THAT HE REMEMBERED ISSUING TWO SUMMONSES TO HENRY BLANCO. HE CHARGED HIM WITH VIOLATION OF SECTION 511.1A, AND 512 OF THE VEHICLE AND TRAFFIC LAW. HE RECALLED PLACING THE SUMMONES IN THE COURT BASKET. MYSELF, ELSIE MOTEN (COURT CLERK), AND LINDA FUKUCHI BEGAN TO SEARCH THE COURT FILES FOR THIS CASE. AFTER A SHORT TIME, ELSIE MOTEN LOCATED THE COMPUTER PRINTOUT FROM ALBANY NOTING THAT THE ISSUANCE OF THESE TWO SUMMONSES HAD BEEN REPORTED (LT. HAYES DOES THIS AS PART OF HIS DUTIES). ELSIE THEN CONTINUED TO LOOK THROUGH HER FILES AND FOUND THE CASE FILE IN HER UNPAID FINES FILE. IT IS NOTED ON THE COURT FILE THAT HENRY BLANCO DID APPEAR ON OCT. 11, 1994 AND THAT A FINE OF $125.00 HAD BEEN IMPOSED BY THE COURT, BUT ELSIE INDICATED THAT APPARENTLY HE HAD NEVER PAID THE FINE. I THEN ASSUMED POSSESSION OF THE FILE. I THEN CONTACTED ROB RYSER TO INFORM HIM THAT WE HAD LOCATED THE FILE AND THAT HENRY BLANCO HAD APPEARED IN OUR COURT TO ANSWER THE SUMMONES. I WAS SUBSEQUENTLY INFORMED THAT HIS EDITOR WAS NO LONGER INTERESTED IN RUNNING THE STORY SINCE WE HAD LOCATED THE FILE. I EXPRESSED MY DISPLEASURE NOTING THAT IF WE HAD NOT FOUND IT, THE PAPER WOULD HAVE PRINTED IT. AT ABOUT 3:45PM I RECEIVED A CALL FROM ELSIE MOTEN. SHE INDICATED THAT "JANET HAD CALLED HER AND ALREADY KNOWS THAT WE LOCATED THE FILE" AND THAT SHE NEEDED THE FILE BECAUSE JANET HAD INSTRUCTED HER TO CONTACT THE JUDGE ON THIS MATTER. I THEN BROUGHT HER THE FILE AND SHE DID CONTACT THE JUDGE, SHE THEN CONTACTED JANET TO ADVISE HER THAT THE JUDGE HAD BEEN NOTIFIED. I LEARNED FROM THE COURT CLERK THAT JANET WANTED TO KNOW FROM HER HOW IT WAS THAT I HAD LOCATED THE FILES, WHEN SHE HAD NOT BEEN ABLE TO. ACCORDING TO THE COURT CLERK SHE RESPONDED BE TELLING JANET THAT I HAD SIMPLY ASKED HER FOR THE FILE AND THAT TOGETHER WE LOCATED IT. I LEARNED FROM THE COURT CLERK THAT ON APRIL 28, 1995, JANET GANDOLFO HAD COME INTO HER COURT AND HAD STARTED LOOKING THROUGH THE 1994 COURT DOCKETS. ELSIE EXPRESSED DISPLEASURE WITH JANET JUST WALKING IN AND GOING THROUGH HER COURT RECORDS WITHOUT TELLING HER WHAT SHE WAS LOOKING FOR. ELSIE ALSO INDICATED THAT SHE DOES NOT LIKE ATTORNEYS GOING THROUGH HER COURT RECORDS. �1 ."ELSIE INDICATED THAT JANET WAS THERE FOR QUITE SOME TIME, AND THAT AT ONE POINT SHE (ELSIE) ASKED JANET IF SHE COULD HELP HER, BUT JANET REFUSED ANY ASSISTANCE. I SUSEQUENTLY CONTACTED ADA HUGHES, TO WHOM THE LETTER WAS ADDRESSED, AND HE INFORMED ME THAT HE HAD DISCUSSED SOME OF THESE ISSUES WITH BOTH JANET GANDOLFO AND THE MAYOR. HE TOLD ME THAT HE DID REQUEST A LETTER IN WRITING FROM THEM BUT THAT HE HAD NOT YET RECEIVED IT. HE ALSO EXPRESSED SOME CONCERNS REGARDING THE FACT THAT THEY WOULD HAVE TURNED OVER THE LETTER TO THE NEWSPAPER WITHOUT AT LEAST GIVING HIM THE OPPORTUNITY TO READ IT. BECAUSE HE HAS NOT YET RECEIVED THE LETTER HE HAS ASKED ME TO WAIT A COUPLE OF DAYS BEFORE MEETING WITH US ON THIS MATTER. I HAVE EXPRESSED OUR DESIRE TO COOPERATE WITH HIS INVESTIGATION, AS IT IS MY OPINION THAT YOURSELF, THE DETECTIVE DIVISION, AND THIS POLICE DEPARTMENT HAVE BEEN SLANDERED BY THIS LETTER. IN CONCLUSION, I AM VERY CONCERNED THAT AS VILLAGE PROSECUTOR, JANET GANDOLFO HAS ACCESS TO MUCH CONFIDENTIAL INFORMATION. Chief April 27, 1995 TO: Mayor and Board of Trustees FROM: Fire Council RE: ADOPTED FIRE BUDGET Dear Mayor and Board of Trustees, The Fire Council wishes to convey their displeasure with the adopted Fire Budget. Chief Chulla presented a fair and no frills budget that was needed and necessary for the Fire Department. The Mayor, alone, should not decide what items are not necessary in the Fire Budget. The Mayor and the Board should have sat down with Chief Chulla and let the Chief decide what items to remove. What good is supplying boots and bunker pants, but not helmets? We have 15-20 new members that need to have complete turn out gear to fight fires. Also, Building Maintenance, heating and phone bills should not be in our budget. By placing them in the Administrative Budget and keeping the Fire Budget at the same amount, we will be able to maintain and update our aging equipment. We do not want to sound mightier than thou, but with new State and OSHA requirements, it costs more to outfit and maintain a Fire Department. Look at what other communities spend on th*S> r Fire Budgets. We are appreciative to the Board for purchasing a new Ladder, Rescue Truck and Ambulance for the Department. Each vehic/£" was replaced due to their _ age and failing mechanical condition. The Fire Department is not demanding better pay,better working conditions, more sick or vacation time. Our all Volunteer Fire Department requires a decent budget to supply proper up to date equipment to protect the safety of our personnel. If you had to fund a paid Department, it would cost in the millions each year.
