Present: Mayor Sean Treacy Richard C, Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Donal M. Walsh, Jr. Village Attorney Linda E. David, Village Administrator * Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Hayes moved, second meeting, motion carried. by Trustee Horecky to open the Public Hearing Mayor Treacy read the attached public hearing notice with regard to amending Chapter 3 6 entitled "Noise". Trustee Blanco moved, second by Trustee Alter to open the public hearing, motion carried. Mr. Kavicky commented that he felt that 10:00 AM on Saturdays was too late and suggested 9:00 AM instead. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the hearing, motion carried. Trustee Sweet commented that Saturday hours should be the same as weekdays. Trustees Alter and Blanco agreed with the 9:00 AM starting time on Saturdays. Trustee Sweet commented that he would agree with the 9:00 AM time on Saturdays, also. Trustee Alter moved, second by Trustee Horecky to amend Chapter 36, Section 36-5 (C) to add 9:00 AM to 8:00 PM on Saturdays, motion carried 5-1 with Trustee Hyland voting no. Discussion ensued on the wording of tfre types of equipment that are being used. Trustee Blanco suggested adding the wording leaf blowers and leaf vacuums. Mayor Treacy moved to reconsider the vote, second by Trustee Hayes and carried.' Mayor Treacy moved to add the additional wording, second by Trustee Blanco and carried 5-1 with Trustee Hyland voting no. Trustee Hyland wanted to know how this ordinance would be enforced. " The Mayor commented that anyone can call the police if they feel the ordinance is not being adhered to. Mayor Treacy read the attached public hearing notice with regard to amending Chapter 57. 1 �*v Trustee Sweet moved, second by Trustee Horecky to open the public hearing, motion carried. There being no comments from the public, Trustee Hyland moved, second by Trustee Alter to close the public hearing, carried. Trustee Horecky commented that the Board should consider only one handicapped parking space on Lawrence Avenue instead of two. Trustee Hyland commented that parking on Lawrence Avenue is very tight now and taking^away two spaces would make it worse. Trustee Hyland moved, second by Trustee Horecky to add one handicapped parking space in front of 38 Lawrence Avenue, motion carried. Approval of Minutes Trustee Alter moved, second by Trustee Hayes to approve the minutes of May 16, 1995 with additions/corrections. On page 4, para 2, Mayor Treacy added "with a savings of $10,000 a year due to a reduction in our deductible from $35,000. to $25,000. Trustee Hayes added that on page 6, para 4, "Diana Boersma would like to make a presentation to the Board about the history of the library, current status and future of the library. The meeting will be held on June 1st. Trustee Sweet added on page 3, para 2, after General Motor's "taxes" should read (pilot payment), on page4, para 7, should read "It involved a survey of medical impact which composting involves. A typical recycling center is being operated on the other side of the County." Trustee Horecky moved, second by Trustee Blanco to table the Approval of minutes until they could review the tape, motion carried. Approval of Warrants Trustee Horekcy moved, second by Trustee Blanco to table the approval of warrants until the Trustees had a chance to review the bills since they just received them. Mayor Treacy suggested they hold off until the end of the meeting, motion carried. Public Comments-Agenda Items Trustee Hayes moved, second by Trustee Horecky to open the public comment section, motion carried. There being no comments,' Trustee Hayes- moved, second by Trustee Blanco to close the public comment section, carried. Resolutions-Attached Discussion ensued on the approval of a cost estimate for plumbing work to be done in village hall due to a gas leak that was detected and Con Ed turned off the gas until this is corrected. Trustee Blanco felt that with the estimate being over $6000. we should get more estimates and perhaps go out to a larger company. Trustee Hyland commented that he had suggested during budget time that we budget money for a maintenance program for village hall. After more discussion, it was decided to discuss it further at �the next work session. Mayor Treacy commented that Frank Rey has filed an appeal in the election lawsuit and has named the Village in the appeal although he had said he would not. He then read attached resolution #06/72/95. There was no motion, resolution died. Trustee Horecky commented that after the elections were over, the Mayor had wanted us to put our differences aside and to work together but this is not happening. We had asked that Marc Broadway be rehired since he was a valuable employee, not only bringing in much needed revenue but directing traffic when GM was leaving but it hasn't happened. The political nonsense must stop. Public comments Trustee Horecky moved, second by Trustee Hayes to open the public comment section, motion carried. John Korzelius, volunteer firemen, commented that there has been a problem regarding the handicapped parking space in front of village hall. The Judge parks there every Tuesday and Thursday and therefore anyone who is handicapped and would like to come to the meeting cannot do so. Also, he parks too close to the ramp and the fire trucks have a hard time turning. Mr. Korzelius has spoken to the Judge but to no avail. He urged the Board to try and resolve this matter quickly. Mr. Kavicky wanted to know if the $10,000. for the park would be paid by the Village. The Mayor responded that it is grant money. Mr. LaMascola wanted to know what the standard was for paying attorney's fees on the lawsuit;what the progress on the park was. Village Attorney commented it would be that the suit was totally baseless. Mayor Treacy commented that we are on track with the audit and if there are no serious problems we can move forward to the demolition phase. The money must be spent this year and hopefully the park will be open by next summer. Mr. Galella asked how much the Village Attorney earns an hour and asked if we hired a former employee for $5000. Don Walsh commented that as part of his contract his hourly earnings are $95. an hour. The Mayor commented that we have hired San jay Shah to help us correct computer problems we have been, having in the Water Department. He is very knowledgeable in computers. Mr. Galella asked why the Chairman of the Fire Committee was not involved in the discussion with the ambulance services with the Town of Mt. Pleasant. Mayor Treacy commented that he, Robert Meehan and our Village Administrator were working on this together for some time and the meetings were held during the day and Trustee Hayes was not 3 �I available, but he was involved in it. Don Caetano commented that there are people in Morse park at all hours of the night causing alot of problems. The park is not being policed and people in that area are complaining. Trustee Sweet stated that he would speak to the Police Chief. Trustee Horecky commented that he lives in that area and he has called the police and they have responded very quickly. There being no further comments from the public, Trustee Hyland moved, second by Trustee Alter to close the public comment section, motion carried. Old Business Trustee Hyland asked if the Mayor wrote a letter to Mrs. Napolitano regarding the problem she was having. The Mayor responded yes. Trustee Hyland read the letter that was sent to her by the Administrator and didn't feel that Mrs. Napolitano would have to prove anything if there were any problems directly created by the repairs. The Administrator commented that if anything was done that caused the problem, we would repair it. We have seen some people in the neighborhood perhaps try to create some issues that were non-existence; that was the reason the Attorney suggested that the wording be the way that it is. We admit to changing where the pipe was. Trustee Horecky commented that he received a memo from the Administrator stating that village hall was being closed at 1 PM on the Friday before Memorial Day and although he was not opposed to this, he wanted to know who gave her permission to do so without Board approval. Mayor Treacy commented that he did and that employees have been given half days off before. Trustee Hyland commented that employees were never given half a day off for Memorial Day, only Christmas Eve and New Year's eve. Trustee Horecky read a letter from Congresswoman Sue Kelly regarding the work she has been doing and that she has opened two new district offices and anyone wishing help or information can contact her at these offices. Trustee Horecky commented that anyone could contact him if they could not reach Sue Kelly. Trustee Hayes commented that he gave a deposition on the Halpern lawsuit and has now received the transcript to review. Trustee Sweet commented that he has not as yet been replaced on the Tree Commission and has asked the Planning Board to appoint a member to the Tree Commission but he has not received any response as yet. He understands that there is an opening on the Planning Board. Trustee Sweet made a motion to appoint Nicholas Cicchetti to the Planning Board and the Tree Commission, second by Trustee Horecky. Discussion ensued. the Planning Board Mayor Treacy commented that appointment to is a Mayor's appointment. Trustee Blanco �/£f commented that he recalled it being the Board's appointment. Don Walsh stated that the state law is that it is a Mayor's appointment for Planning Board and the local law is the Zoning Board. The Mayor commented that he is considering Mr. Cicchetti and also Betsy Sawyer Gaylin. New Business-None Mayor's Report Memorial Day parade was successful as was the Sleepy Family Festival at Patriots Park on Sunday. Hollow Mayor Treacy reported that he attended a town meeting for kids on May 2 3rd which was very enjoyable. They are an Earth Force group. He reported that the police walking patrol has begun on weekends. The Mayor reported that N. Tarrytown and Tarrytown applied to the County for a grant and have been awarded $4 0,000. for a grant which will offer an 11 month intergenerational program for compentency building, marshall arts, video production, computer literacy, tailoring, sewing,- etc. for 200 kids from our communities. With regard to the facade improvement program, we are continuing to update Beekman Avenue. The store next to the Off Broadway Deli is the next one for improvement, plus the old Strand Theatre will soon be occupied by the Open Door Clinic and there will be great improvements on that. General Motors is willing to sit down with the village now and discuss issues. A meeting was held on May 22, 1995 where the School Superintendent and Robert Meehan were also in attendance and the meeting was very pleasant. The reappraisal of the property is the most important issue and we are coming close to a selection of an Assessor. We will meet again this month. The Westchester Business Journal had an article stating GM will be donating $200,000. towards the feasibility study which is not true. We have a $100,000. grant from the State and GM will be contributing some money towards the study. At the last work session it was mentioned that Japanese business men wanted to tour GM. A rumor then started that a Lexus plant was going to be built on that sight and this is not true. All the workers had their hopes lifted; the* Mayor will speak to Mr. Martino and inform him that this was just a rumor. The GM Task Force met on May 30th and we are moving along with the feasibility study; we have narrowed it down to four corporations. Trustee Reports Trustee Hayes reported that on June 7, 1995 at 1 PM in the Van Tassel Community room a Managed Care Forum sponsored by the Westchester County Office for the Aging will be held. Representatives from Medicare, Oxford and US Health Care will 5 �answer any questions senior citizens may have and your blood pressure will be taken free of charge. The last meeting of the Senior Committee Coalition will be held on June 16th at the Community Center in Ossining; the next meeting will be in September. The Library Board met on June 1st and the major item for discussion was the renovation of the blue room. They went out to bid and received only one bid which they accepted after discussion with the*sole bidder who lowered his price. Diana Boersma would like to make a presentation to the Board regarding the history of the library, current status and future of the library. She will make this presentation to the Tarrytown and North Tarrytown Board sometime in September. Trustee Hayes read a letter of thanks from Veronica Morrow to the Ambulance Corp. thanking them for their quick response to a 911 call to her home on May 6th. On Wednesday, June 7th, the Fire Chiefs will be meeting with the Administrator and Trustee Hayes regarding the capital budget and pagers. Trustee Hyland read a memo from the former Police Committee who wanted to have the walking patrol everyday instead of just on the weekends. Trustee Hyland would like to discuss at the next work session, having the Planning Board and Zoning Board meetings televised. Trustee Horecky read a memo from Henry Atterbury to Linda David that he had read at the previous meeting regarding the amount of money that has come out of our recreation budget to maintain Sykes Park and we have not been reimbursed by Tarrytown for their share. Since we do need to recoup this money, Trustee Horecky moved the following motion: Whereas the Village of Tarrytown owes North Tarrytown $14,000. as outlined in the contract agreement from July 19, 1985, Be it Resolved that the Board of Trustees requests this Administration to recoup the monies owed to North Tarrytown. Discussion ensued. Mayor Treacy commented that he has the original agreement and other background material and feels the Recreation Commission should meet with Tarrytown first before we just send them a bill. Mayor Treacy stated that Tarrytown has never sent us a bill for maintaining Patriots Park. Mayor Treacy moved to table Trustee Horecky's motion until the Recreation Commission gets to the bottom of this matter, second by Trustee Alter and carried 4-3 on roll call: Mayor Treacy, Trustees Hayes, Alter, and Sweet voting yes and Trustees Hyland, Horecky and Blanco voting no. Trustee Alter commented that he agrees we need to recoup the money, but felt it would be better to sit down and talk first. 6 �s<2d Trustee Sweet commented that Patriots Park is soley in Tarrytown. He also agreed the two villages should discuss the matter first and then collect the money. Trustee Horecky commented that the Metro- North gate at Devries Field has been left open and presents a dangerous situation. Trustee Alter commented that he is aware that this happens periodically and then is closed, but he will check into it again. Trustee Horecky commented that he is not in favor of the basketball league with food and music at Sykes park. There is already a basketball league being held at the COC. Trustee Horecky commented that the firehouses are used alot to hold meetings and felt that some meetings could be Held at the COC since we contribute to the COC. He commended the quick action of the Police Department; Officer Corona and Lt. Hayes for rescuing child in a locked car, Officer Checchi for medical aid, Detectives Reddy and Caixiero for drug arrests. He thanked the Police Department for answering his calls so quickly. The summer walking patrol has 2 6-September 4 from 7-8:30 PM. started on weekends from May He commended the Ambulance Corp for their quick response to a recent call to the Van Tassel apartments. Trustee Horecky commented that he took an informal tour of the public works garage with Joe DeFeo and was very impressed with the productivity, he has saved the village alot of money. He commented that this is the best Public Works department he has seen in Westchester County. He was very impressed with the whole department. He commented that there is an opening in this department and a few part timers have worked for the village for many years and commented that we should fill this vacancy by hiring from within with one of these part timers. As far as building material that is placed at the curb, Joe suggested that a sticker be placed on these materials stating the village does not pick these up, please remove from the curb and if they are not removed the owner should be ticketed. Trustee Horecky commented that when GM^ is being dismissed, there is a bad traffic jam and we need somone to direct traffic and he suggested that the Board reconsider the rehiring of Marc Broadway for this job. ' Trustee Horecky commented that when members of certain Boards or committees are not reappointed, tHey should be sent a thank you note for their past services. He is working with Tarrytown with regard to the parking situation for those people who are attending the Music Hall theatre. 7 �The Health Care forum is being held in the Van Tassel meeting room which is at the corner of Beekman Avenue and Teresa Street. Trustee Horecky commented from residents of Devries at route 9 because there the safety of the children that correspondence has been received Avenue to have this street closed off is too much traffic and they fear for and they have circulated a petition. Trustee Blanco commented that the students from the high school were to paint the empty storefronts for their final project but since it is too late now, he requested that any students who would like to volunteer their services for next year, please contact him. Trustee Blanco commented that the residents of Chestnut Street would like to have a "Children at Play" sign erected. The Administrator stated that these signs are on order. Trustee Blanco commented that with regard to the firemen's budget, he would like the Board to discuss the whole capital budget, pagers, headsets and radios. Trustee Alter commented that the Devries Avenue picnic shelter is open only to North Tarrytown residents. Trustee Alter read a memo from Henry Atterbury to Larry Verdi and Floyd Rhein of the Public Works department thanking them for wiring the picnic shelter, their quality of work was outstanding and they did it quickly and professionaly at a savings to the village. The cost was only $300. (Placed in their personnel file) Day camp registrations starts this Friday at womens' softball starts TNT picnic will be held are still being taken. Mens 1 softball Devries field at 6:45PM and 8:15 PM, Sunday, June 18 at 5 PM and 6:15 PM, the on June 17th at Devries Park. Trustee Alter read the attached Public Works report. Trustee Sweet reported as liaison, he attended the Planning Board meeting where discussion took place on the continuation of Antonio Rodrigue's site plans for the development of Philipse Plaza and since there are several variances which will be required, the Planning Board is awaiting actions by the Zoning Board. Trustee Sweet reported that he attended a meeting on May 22 at Tarrytown's village hall along with Mayor Treacy and Don Stever to hear and discuss aspects of a Draft Environmental Impact Study, DEIS, concerning the proposed Concrete Recycling plant to be located on the waterfront just south of the present County Asphalt Batch plant. He found that no one spoke in favor of the project. A meeting of the Conservation Advisory Council has been rescheduled for Wednesday, June 14th to discuss the final form of the DEIS for the Local Waterfront Revitalization Program. Trustee Sweet attended a work session on May 31st on the SEQR process given by Frederick P. Clark Associates, Inc. �'-3P Trustee Sweet and Linda David met with John Jadus of the Noise and Litter Committee on Thursday, June 1st to discuss directions, goals and what they could do to get better response to some of the concerns of the community. There is a meeting with the Noise and Littter Committee, Quality of Life and Police Committee, tentatively set for June 29th at 7:30 PM. With regard to the County wide re-assessment, the County Board is presently considering a home rule message for the legislature which will enable a county-wide-re-assessment to be performed by the County following which the use of classifications will be used to further improve the assessement practice. He commented that a new list has been assembled and forwarded to GM's Attorney that includes one common designee. A group from the County EMC will be travelling to Albany on Wednesday for the purpose of becoming acquainted with our officials and represenatives, they will be leaving at 8:30 AM. Administrator's Report Linda David commented that repairs have been made to our cable system. Linda David commented that she acted as host to a fourth grade class and talked to them about village government. United Way is sponsoring a special charity evening at Dockside restaurant where she will be a hostess for a few hours. Linda David read the Zoning Board agenda to be held on June 21, the Planning Board agenda to be held on June 22, and the Architectural Review Board agenda to be held on June 28, all to be held at 8 PM. Communications/ Petitions & Requests Deputy Clerk read correspondence from the Immaculate Conception Church requesting permission to close Depeyster Street between Broadway and N. Washington Street for two weekends starting August 11th. Mayor Treacy moved, second by Trustee Sweet to approve their request, motion carried 6-0. The Mayor read a letter from Darlene Hassinger commending Officer Hrotko for returning her daughter's wallet which he had found. Since her license had a Binghamton address on it, it was difficult to find out who it belonged to in the village, but he took the time to locate the owner. (Placed in personnel file) Mayor Treacy read the attached letter from Diane Bruning and petition signed by residents in that area regarding closing off Devries Avenue to traffic due to the dange'r it presents. The Mayor asked the Administrator to make sure the police enforce the speed limit and also that Ltl Hayes did a study recently regarding the speed limit in that area and we have some background information on this. The Mayor commented that he received copies of letters from the PMIA and SHIA addressed to Mayor Pilla, protesting the idea of 9 �I I new concrete recycling plant. The Mayor read a letter addressed to the Administrator with regard to a formal complaint against Landry taxi regarding an automobile accident for which they were at fault but refused to pay any money for the accident. They were taken to court and were told to pay for the damages but have refused to do so. The Mayor commented that in light of all this, Landry taxi will not be issued a license when the old one expires if this matter is not cleared up by then. Letter from Edwin Ja'cobsen was read regarding GM stating that they should still be paying taxes even after the plant closes. Mayor Treacy commented that they must pay taxes after closure, which will be September 13, 1996 but the property must be reassessed. Trustee Sweet commented that the assessed value will be significantly lower when it ceases operation and the equipment is taken out. Trustee Hayes read a letter from Hugh Jones regarding GM. He wrote that back in the late 1980s Fairchild Republic closed it aircraft manufacturing facility in the town of Babylon. After eight years there is a plan and a developer moving the redevelopment ahead. If it would be helpful, Mr. Jones would be glad to set up a one day visit to let the Mayor and Trustees of our village meet with Town Supervisor of Babylon and his staff, tour the site and talk with the developer. Trustee Horecky read correspondence addressed to the Mayor and Board from Ed Bard, 95 Beekman Avenue commenting that he has been watching the meetings for about a year and did not know Trustee Hayes was the chairman of the fire committee and that he can always find Trustee Horecky walking around the village talking to residents about any village problems. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrant and authorize the Treasurer to pay the bills. Trustee Blanco asked that the Village Attorney's bill for $10,930. for work on the election lawsuit be removed until it can be discussed at the next work session. With that bill removed, motion carried 5-2 with Trustees Hyland and Horecky voting no due to the fact that there was not enough time to review all the bills. Total of the General Fund is $328,048.53 and the Water Department fund total is $11,457.15. There being no further business, Trustee Hayes moved, second by Trustee Horecky to adjourn the meeting, motion carried. MOVED: SECONDED: VOTE: There was no motion. ^ �I PUBLIC WORKS REPORT JUNE 6, 1995 Repaved Evergreen Way»„today (Tuesday) June 6th. We will be repaving Fremont Circle within the next week or so. Old light poles and fixtures will be replaced in the village shortly. The 50/50 sidewalk program is in progress and will continue as long as funds are available. Tree work is continuing. We are continuing to clean out catch basins in the inner village, Webber Park and the Manors. LEAVES MUST BE BAGGED AND AND BRUSH TIED UP BEFORE IT WILL BE PICKED UP ON MONDAYS AT THE CURB. WHEN REMOVING SHRUBS, PLEASE REMOVE ALL DIRT FROM THE BOTTOM OF THE SHRUB•!!!I!!!!!!!!!! We have discussed this amongst ourselves and, for the reasons listed below, believe it warrants serious and immediate consideration. We believe such action would make it dramatically safer for those living on our street as well as pedestrians and visitors without any inconvenience to others. 1. The first and foremost reason is the safety of our children and pedestrians. We are located two blocks east of the Devries ballfields, playground and picnic area and we have seen a steady increase in traffic - at frightening driving speeds - as the popularity and use of the Devries Park has grown. This is drive-through traffic that may be as conveniently but more safely routed through the traffic light onto Pierson/Bellwood which is one block immediately south of us. We have sidewalks on only a portion of the block and children and pedestrians are forced to use the street with a growing number of frightening incidents concerning safety. This speeding traffic tends to occur at the time when most children and pedestrians are out. 2. The second reason is the safety or the drivers using Devries Avenue, Devries entrance and exit ways at route 9 are located on a hill, are not wide enough to accommodate two-way traffic, and are blinded by property and foliage. Many of us have witnessed or experienced near accidents in this situation. Again, we are located one block north of the intersection and light at Pierson/Bellwood which in all respects is the safer choice. 3. In relation to emergency access, we would reiterate that for the above reasons, a left turn into Philipse Manor at Pierson is far safer and as fast as a left turn off of a hill on the much-used route 9 onto our street. There are two major access routes and seven other streets into Philipse Manor which would be unaffected by our proposal. We believe you will give this your serious and immediate attention as we offer it in great earnest and with concern. Kindly address any need for further information or attendance at a board meeting or hearing to the residents first listed in this petition. Additionally^ would also request that the same consideration be given to closing the entrance to Merlin from Route 9. While your efforts and success in reducing the speed limit to 40 MPH on Route 9 are greatly appreciated unfortunately we still experience drivers who exit Route 9 entering Merlin at a high rate of speed with absolutely no regard for the welfare of the residents, not to mention small children. As you are aware through the years the residents of Merlin have witnessed several accidents, some resulting in deaths, as a result of motorists either exiting or entering Merlin Avenue at the Route 9 entrance. This coupled with accessability for potential burgalars to enter homes or automobiles has lead to the belief among the residents that the closing of this access would greatly enhance the safety and overall quality of life on our street. ALso there was a transformer and there ma be PCB's present. - The park site may need a phase III environmental evaluation to determine its usability. Westchester County has discovered oil spills at the adjacent oil facility. Mayor "North Tarrytown employees will not be involved in doing the work with the removal of materials." Re: Law not resolution. Trustee Blanco "That it is absurd to vote on this when the case is still in court on appeal, this motion defies logic." Trustee Horecky "Stop the political stunts. The Mayor stated that we should work together on the Villages problems not proceed with cheap political stunts." Trustee Hyland brought up when the residents of the Manor petitioned the Board to work with Mayor for the betterment of the Village. Trustee Hyland put forth the proposition to the hire back Mark Broadway who was an asset and better the Village through $50,000 in revenue. Littering tickets, traffic direction, etc. The Mayor stated that he wont give Broadway his job back. The Mayor obviously construes that this employee hurt him in an area where he is politically strong which was proven by the results of the election distrcts. The pay back has been payed back. John Korzeleous: "The judge parks there every Tuesday and Thursday for four years. The stated to me "I'll park where I want , I' m the Judge this is my parking spot". The handicap spot and it is is his privilege to park there. It is a hypocricy that the Judge parks in a handicap spot for four years. He violated this law and it is immoral for him to park there.
