Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Also Present: Trustees Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney L.W.R.P. Presentation Mayor Treacy called the meeting to order at 7:00 PM. Jeff Beech and Donal Stever made a presentation to the Board on the Local Waterfront Revitalization Program. Regular Meeting Mayor Treacy called the meeting to order with flag at 8:00 PM. a pledge to the Trustee Blanco moved to open the meeting, second by Trustee Alter and carried. Public Hearing Mayor Treacy read resolution #07/82/95 pertaining to the attached public hearing notice regarding the Municipal Home Rule Law. Trustee Hyland moved, second by Trustee Blanco to open the public hearing, motion carried. Trustee Sweet explained the reason for this hearing was to find out what the public feeling and opinion is with regard to restoring the power of appointments to the Planning Board to the Board of Trustees which had been the practice up until 1993 when the State Legislature gave that power of appointment to the Mayor, Several people he has spoken to commented that this power should be returned to the Board of Trustees. Mayor Treacy commented that he has received no correspondence from anyone regarding this change since 1993 when it took place. He felt that this was an insult to those members presently on the Planning Board. Trustee Sweet commented that he had no intention to insult any present member of the Planning Board, he just wanted the power to be returned to the Trustees. Trustee Hayes asked for an explanation of the memo received from our Village Attorney with regard to this. Trustee Alter supersession. asked if any other 1 municipality enacted this �The Village Attorney stated the memo addresses the question he was asked at the last meeting if there was any specific authority for supersession of 7-718; there is none and no other municipality has done so. Trustee Sweet read the section of the Municipal Home Rule Law which authorizes the Village to adopt local laws which are not in consistence with the Constitution or general law. Trustee Horecky commented that the majority of the Board voted for this and it should stand. Trustee Hyland commented that the Mayor received no input from the Board on appointments to the Planning Board except for the appointment of Nicholas Cicchetti. More discussion ensued. Trustee Kyland moved, second by Trustee Alter to open the public hearing, carried. There were no comments from the public, therefore Trustee Blanco moved, second by Trustee Alter to close the public hearing, carried. Mayor Treacy read the attached public hearing notice to hear and consider amending Chapter 57. Trustee Hyland moved, second by Trustee Blanco to open the public hearing, carried. Mayor Treacy read two letters into the minutes, one for and one against closing off the streets. He commented that at a previous meeting, there were two petitions in favor of closing these streets. He also read Fire Chief Chulla's letter into the minutes stating the reasons the Fire Department is not in favor of this. The residents of Devries and Merlin Avenue addressed the Board with regard to the closing of these streets because their main concern was for the safety of the children and pedestrians. One resident of Devries Avenue presented the Board with a sketch of Devries Avenue (attached). Mr. Levy commented that there hasn't been a fire on that street in twenty years and that the increased traffic through that street has been tremendous. Kathy Lustig felt that the street is wide enough for the fire trucks to go through and commented since the visibility is poor, a chain across the entrance will not help. Diane Bruning and Mr. Grosso's concern was for the safety of the children due to the speed of the cars coming off Broadway. The residents would work with the Fire Department on how to block off the streets. 2 �The possibility of movable barriers was discussed but there was concern that trying to remove them when there was a fire or a snowstorm could create a problem. Chief Chulla addressed the Board with his concerns that he had stated in his letter. The Fire Department is concerned about saving lives if there should be a fire on that street, a few years ago there was a fire on Pleasant Street when we lost a home due to the poor access for trucks. Mayor Treacy commented that we need to balance the safety of the children and fires. Joe Trotti commented that the grade at Devries and Merlin causes cars to speed causing many accidents and he felt that the street is wide enough for the fire trucks to go through. Jack Linden thanked the Fire Department for their concern and commented that there are two fire hydrants on that street. There are no sidewalks therefore pedestrians must walk on the streets and the blind curve near route 9 causes accidents. He suggested that the Board consider taking one step at a time, close these two streets first and see how it works out. Dr. Kreisheimer stated that he had a car crash onto his lawn one time and it might have crashed into his house. He respected the Fire Chief's concerns. Snow removal might be a problem unless a cul-de-sac was created. Richard Gross, ex-Fire Chief and member of the Fire Council commented that there was a public hearing in 1989 with regard to this request and the Fire Council objected to it then and still does. A play street is not a good idea. In 1987-88 he commented that he was an Assistant Code Enforcement Officer and he found numerous violations in the Manors for illegal fences and hedges creating poor visibility. Palmer Avenue is the worst street and the only blind street. Richard Gross commented that the Fire Department objected to the comments made about the noise and traffic created by the carnival since they received nothing but compliments about the carnival from the residents in that area. Diane Bruning commented that they do not want to make it a play street, they want to work to solve safety issues, and that the Fire Department was not responsible for the traffic generated due to the carnival. There being no further comments, Trustee Blanco moved, second by Trustee Alter to close the public comment section, motion carried. Trustee Sweet asked if the PMIA had taken any position on this request. The Mayor responded no. Trustee Sweet asked the residents if anyone felt if they closed Devries, if there would only be speeding from Bellwood to Devries Park. 3 �One resident commented that park traffic is not a serious problem. It's speeding to get to the train station and trying to avoid stop signs. Trustee Sweet asked if anyone felt a delayed left turn signal at Pierson and Broadway would help alleviate some of the traffic on Devries. One resident commented it would help some, but is not the answer. Trustee Alter commented that the Administrator is checking with the State with regard to a delayed green light. If you block off these two streets, the other streets will get all the traffic. Dr. Kreisheimer commented that a play street sign may help to slow down the traffic. Trustee Blanco commented that the delayed green light on route 9 onto Pierson will help, but a bigger problem is when you are going south on route 9, the cars will shoot into Devries causing a problem. We have had the request to the State for the delayed green light for quite awhile now. The use of movable barriers would help and seems like the best way to go. Eventually we should consider having all the streets along route 9 closed off. Trustee Horecky commented that the primary concern is for public safety. Residents and the Fire Chief both have concerns and must work together and we must understand there are risks if the streets are closed off. Waiting for the State to make a decision on the delayed green light will take forever. We must also take into consideration the cost factor. Trustee Hyland commented that we should implement no left turns going north and no right turns going south except for Bellwood and Pierson. Whether this can be done depends on the State. Trustee Hayes commented that we can't satisfy both and wondered if any other village has dealt with this sort of a problem. We need an expert to look at this situation and felt closing these streets would create more traffic on the other streets. Mayor Treacy commented that movable barriers seem like the only solution plus the erection of play street signs. A possibility of speed bumps was mentioned. The Mayor commented that it is against the law to put speed bumps on public streets. Trustee Blanco suggested that we try movable barriers for a six month period to see how they work. Trustee Sweet suggested no left hand turn going north and making the streets one-way from Bellwood eastward. 4 �i Mayor Treacy moved that we close off access to Devries and Merlin Avenue by installing movable barriers, second by Trustee Horecky and motion carried 6-0-1 with Trustee Sweet abstaining. Trustee Sweet moved, second by Trustee Hyland that the Board of Trustees enact a law to consider through the supersession authority granted by virtue of the Municipal Home Rule Law to enact a law specifying that members of the Planning Board of the Village of North Tarrytown shall be appointed by majority vote of the Board of Trustees, motion carried 4-3. Discussion ensued. Village Attorney commented sign the certification for this law. that he cannot Trustee Horecky commented that the vote is never against party lines, the three Trustees always vote together. Trustee Alter commented that when he agrees with the Mayor, he votes with him, if he doesn't agree he won't vote with him. Approval of Minutes Trustee Horecky moved, second by Trustee Hyland to table the approval of the minutes of July 18, 1995 until he could review the video tape, carried. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants of August 8, 1995 and authorize the Treasurer to pay the bills. Discussion ensued on the election bill from the Village Attorney and several other bills. These bills were to be held until the September 12th work session. The total of the General Fund is $161,977.40 minus those bills. Trustee Alter moved, second by Trustee Horecky to approve the Water Department warrant for a total of $40,784.41. Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Horecky public comment section, motion carried. Mr. Kavicky Devries and remove. He Laborer who 728, to open the commented that gates should be put up to close off Merlin Avenue, barriers would take too much time to also wanted to know what the salary was for the was being hired. The Administrator commented $31, There being no further comments, Trustee Alter moved, second by Trustee Horecky to close the public comment section, carried. Resolutions-Attached Public Comments Trustee Horecky moved, second by Trustee Blanco to open the public comment section, motion carried. 5 �In Henrietta Brand commented that there is a new owner of 111 Cortlandt Street and wanted to know kind of business this is and commented that there is no building permit posted. The Mayor stated that this is a machine shop and we will check into it. Ms. Brand commented that cars with parking permit stickers are parking on the streets and taking spaces away from others. She stated that they should park in the lot. Also, people going to the train station are parking on Cortlandt Street all day and suggested that alternate side parking be changed to 8AM-9AM so they wouldn't be able to park. She also commented that the apartments at 126 Valley Street are being rented to outsiders and not to local families. She will give the Mayor signed affidavits to this. The Mayor commented that we cannot stop people from parking on the street if they have a parking sticker for a lot. Mayor Treacy commented that we have no control over who rents apartments at 126 Valley Street and as far as parking, some villages do have four hour parking on streets or permits to park on the streets which we could check into. Carmen Mariano commented that she was appointed as Hispanic Advisor to the Mayor and was giving service to the Hispanics for twenty years before that. She receives no payment for this and does if for personal satisfaction. She does not think she has to explain her actions to the Board and did not like hearing things to that effect from certain people. Trustee Horecky commented that most Boards are voluntary and all he did was ask the Administrator if she could tell him what was going on. Mt. Kisco generates a Hispanic report and thought it would be a good idea if our village had one. He is very involved with what is going on in the village and the Hispanic community and he is not picking on them. Trustee Horecky commented that 25 Andrews Lane is a disgrace with garbage, junk cars, etc. Trustee Blanco stated that Trustee Horecky is just trying to help the Hispanic community. Don Caetano felt that the Mt. Kisco article about immigrants was discriminating. Ms. Brand commented that the littering ordinance should be enforced. Store owners should be made to clean in front of their stores. Mr. Caetano commented that littering tickets should be given out by the police also. 6 �There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section, carried. Old Business Mayor Treacy commented that Trustee Hyland is in arrears in payment of $13,423. for the reimbursement of health insurance benefits. Trustee Hyland commented that he will be paying this shortly. New Business Mayor Treacy commented that Bill Herlihy, Plumbing Inspector has had heart surgery and will be unable to perform his duties as Plumbing Inspector for a while. He appointed Gary McLean as Acting Plumbing Inspector until such time that Bill Herlihy is able to return. Discussion ensued. Trustee Blanco commented that Mr. McLean is doing a job for the village now and asked if this was a conflict. The Mayor responded that Adrian Domingues, who is the Plumbing Inspector in Tarrytown, will check this job when it is done. Trustee Hyland felt that Mr. Domingues should take Bill's place while he is out recuperating. Mayor's Report Mayor Treacy commented that he attended the Senior's picnic at Kingsland Point and had a good time. He reported that tourism is growing in North Tarrytown, The trolley service is a great success. Two hundred and fifty thousand brochures will'be distributed throughout the tourism region listing historic sites, restaurants, hotels, etc. Talks with General Motors are moving along well. Met with the Trustees to update them on the status. We are in the process of trading our final draft of RFP(Request for Proposals) that will go out to three appraisal firms. Fortunately General Motors will be paying for this. GM Supervisor will meet with us in September to discuss the lawsuit. In the meantime they will withdraw for six months until discussion takes place. The Mayor reported that the CAC presented the Local Waterfront Revitalization Project to the Board tonight. Jeff Beech and others have been working on this for many years. Trustee Reports Trustee Hayes reported that the Library Board will meet on September 20th. On September 19th Diane Boersma will present her ideas to the Board. He reported that renovations to the blue room in the Library have started and should be completed by August 22nd. The Senior Canteen Coalition will hold their next meeting in the fall. The Sacred Heart Life Center at 34 Beekman Avenue is open to Seniors every Wednesday from 2-3 PM for coffee and conversation. 7 �Trustee Hayes commented that on July 29th a wet down for Fire Patrol's new truck was held. He reported that the Fire Department is opposed to the closing of Devries Avenue and Merlin Avenue. The new ladder truck is back with all problems corrected and should be in service by Labor Day. We are trying to sell the old truck. He gave the alarm report for July. We received two trophies at the Verplank parade. Trustee Hyland commented that he is still trying to get the Zoning and Planning Boards televised. He commented that the opinion from the Attorney General's office was not very clear. Village Attorney stated that the Board cannot direct the Zoning Board to have their meetings televised, only the Planning Board. Trustee Hyland commented that we received wrong information from the cable company when they informed us that no municipalities televise those meetings, this is not true. Trustee Hyland moved, second by Trustee Horecky to have the Planning and Zoning Boards televised, motion carried 6-1. Mayor Treacy read letters from the Chairs of those Boards that they did not want these meetings televised.(part of minutes) Trustee Horecky thanked the police officers for the great job on the walking patrol regarding quality of life, disturbances, groups congregating at different locations, boom boxes are lower; it is a great improvement over last summer. Trustee Horecky commented that the Code Enforcement Officer stated that he needed directive from the Building Inspector to go to certain areas. There should be surveillance on certain streets; Mt. Kisco has this in order to find out about illegal apartments. The report suggests that Hispanics come to a work session. INS should also be contacted because they can be very helpful. Trustee Horecky commented that he has obtained fifteen more signatures on his petition to make the Administrator's position part-time; he has 131 signatures in all. Trustee Horecky moved to put this suggestion on a referendum at the next election. There was no second, motion died. There was a clean-up day at Barnhart Park last week and he thanked everyone who helped. He thanked Erin Kelly and family for initiating this clean-up. This is the oldest park in the village and would like to create a path from the park to the GM lot. He was told it should only cost the village man hours to do this. A new swing set and lights are needed in the park, also. 8 �Trustee Horecky again commented that we must contact Tarrytown to recoup the money they owe us. Trustee Horecky was very surprised that the ARB gave permission for the old Strand theatre to have the beautiful mural scrapped down while doing repairs to the building. He commented about having the work sessions televised. He urged all the residents to attend the Circus at Patriots Park. Trustee Blanco commented that the Village needs a full time Building Inspector. Trustee Blanco met with the Code Enforcement Officer and the Building Inspector and was told the CEO is guided by the Building Inspector and the Administrator. He requested the job descriptions for the Building Inspector's title. The Administrator commented that we have several levels for that title and she had given him one pertaining to our Building Inspector, but she will give him all of them. Trustee Alter reported that tonight at 7 PM the Water Department will be testing the water pressure to the hospital. On August 24th Pocantico Street Valley Street is the next street. is scheduled to be repaved, Trustee Alter checked with Joe DeFeo with regard to caps for fire hydrants, they cost about $80. each. Trustee Alter suggested that we invite Joe DeFeo to our next work session to discuss the infrastructure of the water and sewer system. Trustee Alter commented that the General Foreman would like any garbage that is put out on the streets in plastic bags to be put into containers, especially on Beekman Avenue. Additional wire waste baskets have been ordered for Beekman Avenue. Trustee Alter commented that if the village cannot sell the old hook and ladder fire truck, Joe DeFeo told him that his department could convert it to a recycling vehicle for roughly $15,000. Trustee Alter commented that he called the police regarding the noise ordinance when there were painters on his street scrapping quite early one Saturday. The painters were not aware of the ordinance and did stop until later in the morning. The TNT Tigers won a game at Devries field and will play again this Thursday at 5:30 PM and if they win they will go to the division play-off, women's softball is still in progress, day camp and tot camp will be ending shortly. 9 �I Trustee Alter commented that the Recreation Superintendent, Henry Atterbury has given him a list of improvements that need to be made at Barnhart Park at a minimal cost. Trustee Alter moved, second by Trustee Hayes that we allow Henry to spend up to $3000. on Barnhart park improvements, carried. The National Association of Counties has written to the County Executive and congratulated him on his Urban Youth Initiative Program. Andrew O'Rourke commended Henry Atterbury and advised him that the National Association of Counties has recognized our Urban Youth Initiative with a National Association Counties Achievement Award. The Fire Department thanked Henry for all his help in making the carnival a success. The Association for Retarded Citizens wrote a letter to Henry Atterbury thanking him for his participation in the WARP summer youth employment program. These are learning disabled children who are helping to build our trail. Trustee Sweet reported no activity on the walking patrol for July 14th, Officers Camp and Lombardi issued two summonses for open containers on the walking patrol for July 21 & 22, On July 28 and 29 walking patrol summonses were issued for open containers and loud radios and on August 4 and 5 summonses were issued for open containers. Trustee Sweet commented that he has received the monthly police report. Trustee Sweet reported that the cost for the cellular phone requested by the Police Chief will cost a monthly fee of $30. as a carrying charge. He will talk with the Chief further on this. Trustee Sweet commented that Jeff Beech and Don Stever presented the Local Waterfront Revitalization Program to the Board tonight and commented that it is important that the Board make themselves aware of the contents of the LWRP. Administrators Report Linda David read the agenda for the Zoning Board which will be held on August 16th at 8 PM and the Planning Board agenda for August 17th at 8 PM and the ARB meeting agenda to be held on August 23, the CAC will meet on August 24 and the Public School Board will meet on August 31st. She commented that training workshop for EMTs will be held on September 9 and September IS. Communications, Petitions & Requests Deputy Clerk read correspondence from Joseph Penn representing the May 14 Corp. notifying the village that they are applying for a liquor license.(Referred to Police Chief) 10 �I Mayor Treacy commented that a 5K run is being sponsored by Phelps Memorial on August 13th. Mayor Treacy read a copy of correspondence from Susan Crucy to the Chamber of Commerce regarding the death of Ann McGovern and the Chamber would like to donate a bench or plant a tree in her memory and they are asking for donations. Trustee Horecky moved, second by Trustee Blanco to donate $50. towards this memorial. Trustee Horecky invited the Board and Henry Atterbury to meet at Barnhart Park this Monday at 9:30 AM to meet the residents on the street. There being no further business, Trustee Blanco moved, second by Trustee Alter to move into Executive Session to discuss litigation, carried. Executive Session Discussion ensued on the LaManna litigation case. Trustee Blanco moved, second by Trustee Horecky that the Board not accept the insurance companies recommendation to settle the case for the specified amount, motion carried. There being no further business, Trustee Blanco moved, second by Trustee Alter to adjourn the meeting, motion carried. We are not in favor of this proposal , which would place our home at •the dead end. We feel that the p r o p o s a l , if enacted, would create m o r e p r o b l e m s than it would s o l v e . H a v i n g lived here for more than 33 y e a r s , we know that t u r n s , e s p e c i a l l y left turns, into our street from Broadway are d a n g e r o u s . S e n s i b l e people who live here avoid s u c h turns. Those who lack s e n s e , as well as the children and other p e o p l e in the path of their v e h i c l e s , should be p r o t e c t e d . It would be a very good idea to p r o h i b i t all turns from Broadway into D e V r i e s Avenue, to all but emergency v e h i c l e s , including p o l i c e c a r s and fire trucks. However, t h e r e d o e s n ' t seem to be a real need to eliminate the egress fromD e V r i e s to Broadway. Cars leaving the street must come to a s t o p , and then wait until it is s a f e to e x i t . We are concerned for the safety of the children in our s t r e e t . We b r o u g h t up two children h e r e o u r s e l v e s . However, we had what many oh t h i s street lack--a front s i d e w a l k w h i c h had been installed and paid for by the previous o w n e r s of the house--so they told us when we b o u g h t it. I In a d d i t i o n to the e l i m i n a t i o n of t u r n s into the street from Broadway n o t h i n g could .improve the safety of the children more than the ins t a l l a t i o n of sidewalks in front of t h e houses that do not have them. P a r e n t s should be willing to m a k e t h i s expenditure for their children's s a k e , and to urge n e i g h b o r s to do l i k e w i s e . W h e n driving on D e V r i e s A v e n u e , no m a t t e r how slowly, it is frightening to see small children come t u m b l i n g o u t of a driveway-• into the s t r e e t . The Fire Council feels the F i r e Department needs two entrances into each street for p r o p e r positioning of trucks and access to hydrant locations so the engine companies may lay in their hose. We strongly support the closing of the Broadway entrance to Devries Avenue. The entrance is narrow and up hill, resulting in an almost blind turn when a car enters the street from Broadway. Given the speed with which cars generally travel on Broadway, it is difficult to slow down sufficiently to turn safely when coming from the north. Left turners coming from the south block traffic on Route 9, and then must also turn quickly into the street. We have witnessed many cars ruining on to our street at high speeds, which is extremely hazardous to pedestrians and children on their bicycles or roller blades. Sidewalks exist on only part of the block, forcing pedestrians to use the street. Also, the existence of the park at Devries Field, while definitely an asset to the neighborhood, has drawn an increasing number of cars to the street. These cars could be routed along Bellwood with much greater safety. The only comment negative to the proposed closing which we have heard is that having only one entrance to the street may make it more difficult for fire fighters to maneuver their equipment in the event of a fire. We believe that the Broadway entrance is probably too narrow for modern, large fire engines in any event. However, it would be easy to determine whether a problem exists. Our fire companies routinely run practice drills. A drill could be held on our block and the assumption made that the Broadway entrance was blocked. The crew could then assess any difficulties that this closing might pose. In addition, the street could be closed with a barrier, such as a chain, that could be opened in an emergency. There are many other dead end streets in this community and firefightersmust have a plan for coping with these situations. In closing, as parents of three young children, we feel that the increased safety of a street with no through traffic would greatly override any minor problems associated with the closing.
