Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Hayes moved, second by Trustee Sweet to open the meeting of September 5, 1995, motion carried. Trustee Sweet moved, second by Trustee Alter to hold an executive session at the end of the meeting to discuss personnel, motion carried. Public Hearings-None Approval of Minutes Trustee Horecky moved, second by Trustee Alter to approve the minutes of July 18, 1995, motion carried 6-0. Trustee Alter moved, second by Trustee Hayes to approve the minutes of August 8, 1995. Discussion ensued. Trustee Horecky commented he had additions. The Mayor stated that we will hold off approving the minutes until the next meeting so v/e can have a television and a VCR to review the previous meetings since there are always so many additions to the minutes. Approval of Warrants Trustee Sweet moved, second by Trustee Hayes to approve the warrants of September 5, 1995. Much discussion ensued on the payment to Hitsman, Hoffman and O'Reilly with regard to arbitration. Trustee Hyland wanted an update on the cost of arbitration to date. The Administrator will give it to him tomorrow. The Mayor gave the trustees a copy of the breakdown of those bills. Trustee Hyland wanted to know if any other Mayor was involved in PBA contracts. Mayor Treacy commented that Mayor Schulman and Mayor Zeleski. The Mayor commented that we will have the Administrator do a survey of other villages. Trustee Horecky commented on the Village Attorney's bill. Donal Walsh explained the itemized bill and stated that a portion of this is his regular contract, work on lawsuits, work on certioraris, etc. Mayor Treacy commented that this should be discussed in executive session since this is a personnel item. 1 �Trustee Blanco commented on the Sleepy Hollow Plumbing bill. The Mayor commented that this is the bid award. Trustee Horecky commented that we have not been given an update on the work that is being done. Linda David stated that the work has been completed, but the pipes to the gas stoves are still apart to be completed and new lines will be put in which is more economical. Motion carried 6-1 with Trustee Hyland voting no. Total of the General Fund is $173,617.87, the Capital fund is $19,108.01 and the Water Department fund is $18,892.87. Public Comments-Agenda Items Al Mariano commented that he is on the Tourism Committee and the Economic Advisory Council and wants to help this village as much as he can. He looks forward to working with the trustees. He knows that the Board has a very difficult job to do and he commended them for all the hours they put in for very little pay. He felt that any resident that tries to help this village should not be treated rudely and felt that his mother had been at the last meeting. Trustee Horecky commented he looks forward to working with people like Al Mariano and commented sometimes meetings do get heated. Trustee Blanco apologized to Carmen Mariano and asked Al Mariano to pass this on to his mother. He was sorry that she felt he was rude, that was not his intention. He also looks forward to working with Al Mariano. Mrs. Michalides of Howard Street commented that she has spoken to the Administrator about a problem on that street; there are no alternate side street signs there and the sweeper cannot get through to sweep and the snow plows have a problem in the winter. Cars park there indefinitely sometimes and nothing can get done. She commented that General Motors used to take care of clearing the snow a few years ago and then they stopped. Linda David commented that she has asked the Police Chief to check into this and she will get back to Mrs. Michalides as soon as the Chief responds. The Mayor commented that we should check into the reason GM stopped cleaning the street and we will have the Chief make sure cars are ticketed and towed away when they do not move their cars in a timely fashion. Resolutions-Attached Public Comments-None Old Business Trustee Hyland wanted to know why executive session is being held at the end of the meeting instead of at 7 PM as it should be. The Mayor commented that Trustee Sweet had asked the Board just before the meeting started if an executive session could be held tonight. Trustee Hyland asked a balance of the contingency fund 2 be made �available at the next work session. Trustee Sweet commented that on September 7, 1993 he sent a letter to the Board of Education asking them to have the blacktop removed from the base of the trees in the Morse lot. Nothing has been done. He suggested that we take immediate action to insist that the Schools take care of this before the trees die. Mayor Treacy reminded the residents that work sessions are now being taped and rerun on Thursdays and Saturdays; we are back on regular schedule for meetings, first and third Tuesday for board meetings and second and fourth Tuesdays for work sessions. Trustee Horecky thanked all the residents of Barnhart Avenue for devoting all their time in the clean-up of Barnhart Park. Mayor Treacy thanked Henry coordinating the clean-up. Atterbury and Trustee Alter for New Business Mayor Treacy commented that since the first meeting in October falls on Yum Kipper, we will be moving the October 3rd meeting to Monday, October 2. Mayor Treacy recognized all those people who made contributions to our Street Festival; $300. donations were received from General Motors, Phelps Hospital, Frederick P. Clark Associates and Hitsman, Hoffman and O'Reilly and $75. from Goldies Restaurant. M a y o r s Report The Mayor attended a meeting with General Motors this past Monday. In the near future we hope to announce positive news with regard to the lawsuit. The trolley was a great success. It has stopped running for this year but we hope to expand it next year. Coupons were issued on the trolleys for use at local merchants. The Historic River Towns of Westchester membership has increased to ten now. New color brochures which include maps of the Historic River Towns is being distributed all over the metropolitan area. He thanked Nancy Gold for the great job she is doing. A discounted admissions program called PastPort is being launched by Citibank, Those people who pick up a PastPort at Citibank locations in the metropolitan area become eligible for a grand prize weekend lodging package. Mayor Treacy commented that he will be a guest speaker at Temple Beth Abraham on September 12, 1995 at 7:45 PM, the topic is "Family in the 90's". Mayor Treacy stated that North Tarrytown has been honored with our ninth Pedestrian Safety Award for 1994 and we will receive a certificate on September 21st. 3 �The Hudson Valley Writers Center will be holding readings on September 24th. Mayor Treacy commented that Vicki Simnowski,one of our part- time employees has retired after twelve years. Mayor Treacy commented that with regard to the facade improvement program, work is continuing through September and October. We are seeking to obtain additional monies so that we can continue further. Mayor Treacy commented that he has received requests from several residents that they want to have more input on the GM situation. Therefore he created a Citizens' Advisory Group to help him with the GM situation. He appointed Eliot Martone, George F. Hritz, Patricia Ramsey, Jose Chevere, Bob Anello, John Becker, Bill Jarr, Angelo LaMascolo, David Maloy, Don Stever and Scott Horecky as liaison to this group. Trustee Horecky commented that the Mayor and Board had a special session on the General Motors issue and that he stands by a unified Board when it comes to dealing with the General Motors situation. Mayor Treacy reported that the election lawsuit has been dismissed and the appeal has been dropped; the stipulated agreement was dated September 1, 1995. Trustee Reports Trustee Hayes reported that the next meeting of the Senior Coalition Committee will be held in September. He and Linda David attended the senior luncheon at Rudys on August 2 5th. Trustee Hayes commented that the improvements on the Library blue room are finished and it is now the white room. The Library Board will hold their next meeting on September 28th. On September 19th three members of the Library Board were to make a presentation to our Board but they must change that to the first meeting in October. Trustee Hayes reported that the Fire Committee met tonight with Chief Chulla and Chief Moon. A dinner dance will be held on September 22nd. and the annual inspection and clambake will be held on September 30th. The old hook and ladder truck is being advertised for sale. Trustee Hyland commented that he is happy that the Planning Board meetings are finally being televised and asked the Village Attorney why the Board can't have the Zoning Board meetings televised. Don Walsh stated that the Board of Trustees does not have the power to force the Zoning Board to have their meetings televised. There is no way to do this without their consent. Trustee Hyland asked Trustee Sweet to have the police enforce the 4 �tight container law on Beekman Avenue. The avenue was a mess this holiday weekend with household garbage being put into the litter baskets. He suggested that they be removed, on a trial basis, from the side of the street where the apartments and stores are located. The Mayor commented we will be put this on the work session agenda for discussion. Trustee Horecky applauded Trustee Kyland for having the Planning Board meetings televised. He commented that the New Castle Planning Board is also televised and it is shame that the our Zoning Board meetings cannot be televised. Trustee Horecky commented that he checked the monitoring wells at the proposed Riverfront Park and commented there are three wells that were drilled within forty-five feet of each other and a narrow scope. We are talking about an entire acre of land. You cannot get an accurate assessment if you are drilling in the driveway about twenty feet from each other. Mayor Treacy commented that this is the second phase of the environmental audit because the first audit raised concerns. These audits are being paid through grants received from the County of Westchester. The test wells were established in the areas where there were some suspicions. Linda David commented that other samples were taken in and around the salt shed and the recycling yard area. Trustee Horecky stated that he toured the area and found garbage, old pipes, sludge, salt, etc. The test moorings are in the wrong area, not where contamination exists. Trustee Horecky commented that he walked through Barnhart Park and Devries Park. There is the construction of a path down along Devries along the fence of the GM parking lot into Historic Hudson Valley. A tremendous pathway was cut measuring thirty-five feet at some points. Numerous vegetation and trees were taken out and he was curious if any environmental study was done on this. He commented there is no public access when the gate is closed. There are ancient Indian shell pits on this path which are covered over. The trail is thirty-five feet wide and at one point is twenty-five feet wide which is much too wide. He showed part of the proposed greenway on a map. He suggested that there should be a path from Barnhart Park through GM to Devries Park which would enhance this village. The Mayor commented that the trail is not thirty-five feet wide or twenty-five feet wide. He pointed out the proposed trailway on the large map on the wall. Trustee Horecky commented that some sort of stencil or decal with a fish insignia should be painted on the storm drains with a warning so people do not dump any contaminated liquids down the storm drains. Trustee Horecky commented that he has 132 signatures on a petition to eliminate the Administrator's position and take-home vehicles and asked for a motion to have this put on a referendum 5 �I I in March; there was no motion. He also commented that we lost $2000. every time we gave village employees half a day off before a holiday. If the Parking Enforcement Officer was rehired, we would return up to $50,000. in revenue to the village. Trustee Horecky thanked the Tarrytown officials for inviting the trustees to their parade which he attended and North Tarrytown Fire Department received four awards. Trustee Horecky commented that we need a full-time Building Inspector and we should combine the two part-time positions into this one position. We have been informed by the Code Enforcement Officer that the Mayor, Administrator and Building Inspector are the only ones who can assign him to go into the buildings, not the Board. Trustee Blanco asked if this is written in our code book. The Administrator will check into it. Trustee Blanco commented that he spoke to several people over the weekend who would like to have a flea market at the Morse school lot during the summer months. He would like to discuss this with the school to see if this was feasible and that our Board should also discuss the possibility of this taking place. Trustee Blanco asked for a report on what has been found at the proposed Sleepy Hollow Landing and wanted to know what the status was for the money that was allocated for the salt/sand shed. Linda David commented that the study will be completed at the end of the month and the trustees will receive a report. Mayor Treacy commented that meetings were held with Jim Hahn, our Village Engineer and that we pursued different architectural firms to create the salt shed. It was decided that the best course of business was to create a path behind the old waste treatment silo, level out the area and possibly put in a retaining wall where the salt will be stored in a pile and covered with rubber matting like the ones that are seen on the thruway. Trustee Blanco asked retaining wall, etc. if we had any cost estimates on the Mayor Treacy commented that it will be done in house if we need to build the wall and Joe DeFeo could give him some cost estimates. Discussion ensued on the possible retaining wall. Trustee Hyland commented that the Hudson Street lot is collapsing and the only thing holding it up is the tree and a retaining wall should be put up so it does not collapse. Trustee Sweet commented that there is a partial retaining wall there right now. 6 �I , Mayor Treacy commented that putting up a retaining wall is only a possibility, not definite. Mr. Hahn stated that if you don't disturb the wall, we won't have a problem. We are not digging into the wall. Trustee Blanco asked that New Castle be contacted to see if their Zoning Board volunteered to have their Zoning Board meetings televised. Trustee Alter reported that the Street Festival and 5K run will be held on September 23rd. He congratulated the TNT baseball Westchester League Championship. team for winning the The Haunted Hayride will be held on October 27 and 28th from 6-11 PM. Tickets will be sold one week prior for $1. for residents. Tickets will be $8. the night of the hayride. Arrangements are being made for the Headless Horseman riding a real horse on both nights of the hayride. to be Men's softball is still in progress. The fall recreation brochures will be mailed out shortly. Trustee Alter read the attached public works report. Trustee Sweet asked for a motion to call for a public hearing on Tuesday, September 19th at 8:00 PM to hear and discuss a proposed amendment to the Code of the Village of North Tarrytown by adding a new section regarding the manner of appointment of members of the Planning Board. Discussion ensued. Trustee Horecky moved, second by Trustee Blanco and motion carried 4-3. Trustee Sweet reported that on the August 21st walking patrol several summonses were issued for loud radios, open containers, unlicensed vehicle and a towed vehicle, no activity on August 11th Walking Patrol, August 8th, Officers Camp and Ojito issued a summons for an open container. Trustee Sweet reported that the next Household Chemical Clean-up Day will be held on Saturday, November 4th at Rye Playland from 9AM-3PM. The Watershed Planning Award Program is looking for candidates. The Environmental Management Council will meet on Thursday, September 21st on Court Street regarding pesticides regulations and use. Trustee Hyland asked for an update from the possibility of a village parking lot Mayor commented that there has been some Walsh's office and he will give a copy to Trustee Sweet asked the Village Attorney on on Clinton Street. The Mayor commented that this is Administrator's Report Linda David thanked and congratulated our Fire Department for the fantastic job they did in putting out the brush fires that occurred recently along the Metro North tracks. She read the Architectural Review Board agenda for September 18 at 8PM, the Zoning Board agenda for September 20th at 8PM and the Planning Board agenda for September 21st at 8PM. Linda David asked that the Trustees respond as to their attendance at the next Municipal Officials dinner on September 14th. Mayor Treacy commented that he felt an apology should be given to Linda David due to the fact that she was called a liar at a previous meeting by one of the trustees. The information she received was what she relayed on to the trustees and that she does not lie to the trustees. Discussion ensued. Trustee Hyland commented that he did not call her a liar, he just stated that the information she was given was a lie. Communications, Petitions & Requests Mayor Treacy read correspondence from Pubic Access TV Center informing the Board that their main camera is old and broken and they are in need of a new one. (Discuss at work session) Mayor Treacy read a letter from Elizabeth Gareis regarding the Local Waterfront Revitalization Program. Will be made part of the official minutes of September 19th hearing. A thank-you note was received from Bill Herlihy, Plumbing Inspector thanking the Board for the basket of fruit he received while he was recuperating and that he is recovering quite well and has resumed his duties as Plumbing Inspector. A letter from Anthony Appolonio and Chuck DePaolo of Pocantico Hook and Ladder was read expressing their sincere appreciation to the Board for their help in buying the new truck. Tarrytown Eagle Boy Scouts will be holding a ceremony on September 10 at 2 PM to honor Eagle Scout Gregory Clark and they asked the Mayor to attend. A letter of thanks addressed to the Board from James and Maureen Occurosso was read thanking them for their decision to close off Merlin Avenue at Route 9. A letter from Union Hose was received informing the Board that the parking problem on Cortlandt Street is getting worse because of double parking. They were delayed in responding to a call recently due to this problem. 8 �I Mayor Treacy read a letter from Regan Development Corporation thanking the village for all their help in the renovations of 52 College Avenue building. He also thanked Jim Margotta. Deputy Clerk read correspondence from the ABC Board with regard to the May 14 Corporation applying for a liquor license. Mayor Treacy commented that he has written to the ABC Board informing them that this building is within two hundred feet of a church. Deputy Clerk read correspondence from Sleepy Hollow Market informing the village of their intent to obtain a liquor license to sell beer. (Referred to Police Chief) Deputy Clerk read a letter from Edna and Mario Belanich to Joe DeFeo commending him for his quick response to a parking problem they were having in front of their home on Washington St. and commended Mike Timm for a great job he did in painting the lines. (Placed in personnel files) Executive Session Trustee Alter moved, second by Trustee Horecky to move executive session to discuss personnel, motion carried. into Discussion ensued on what disciplinary action, if any, should be taken with regard to an incident involving a recreation employee. After much discussion, the consensus of the Board was to have the Recreation Superintendent inform the Board of Trustees of the direction he wanted them to go. There being no further business, meeting was adjourned. Planning �PUBLIC WORKS REPORT SEPTEMBER 5, 19 9 5 Continuing to paint crosswalks and parking spaces. New drainage has been installed on Tappan Avenue. Curbs on New Broadway have been replaced (where needed) and paving will take place around the second week in September. Pocantico Street was paved on August 24th. The sidewalk program is still in effect. Tree work is continuing. There will be a delay in the paving of Beekman Avenue due to Con Edison installing a new gas main. We will start installing new street lights throughout the Village around the third week in September. IMPORTANT REMINDER!
