Present: Mayor Sean Treacy John T. Hayes, Jr. Michael Hyland Scott P. Horecky Jose Blanco Morris Alter Richard C. Sweet Trustees Also Present: Linda £. David, Village Administrator James Simmons, Village Attorney Donal M.Walsh, Village Attorney (Arrived Late) Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Alter moved, second by Trustee Hayes to open the public meeting. Public Hearing-None Approval of Minutes Trustee Horecky moved, second by Trustee Hayes to approve the minutes of September 19/ 1995. Trustee Sweet and Mayor Treacy had a few addendums/corrections which are attached. Motion carried 4-2-1 with Mayor Treacy and Trustees Sweet, Hayes and Alter voting yes, Trustees Hyland and Horecky voting no and Trustee Blanco abstaining. Before approving the warrants, Mayor Treacy commented that we had two representatives of the Warner Library here tonight to make a presentation to the Board. Diane Boersma gave a short report on the financial state of the library. Mr. Campbell distributed copies of the library budget to the Board and gave a brief explanation. He commented that this was alot to digest tonight and if anyone had any questions, they could call him and he would be happy to answer their questions. Diane Boersma reported on how the ^library is used by residents and what is available to them. Fund raising is very important in helping with the expenses of the ^library and its future. Mayor Treacy thanked M s . Boersma and Mr. Campbell for their presentations to the Board. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued on several bills such as the Attorney's bill, payment to Sleepy Hollow Plumbing and others. After discussion, motion carried 6-1 with Trustee Hyland voting no. Total of the General fund is $84,046.89, the Water Department total is $3346.90 and the Capital fund total is $23,118.48. 1 �Public Comments-Agenda Items Trustee Hyland moved, second by Trustee Alter to open the public comment section, carried. There were no comments from the public; Trustee Alter moved, second by Trustee Sweet to close the public comment section, carried. Resolutions-Attached On resolution #10-99-95 Trustee Hyland asked Don Stever if it is legal to award this bid to Sound Build,Inc. even though they were not the lowest bidder. Donal stever commentedvthat it is a negotiated contract, not a bid contract. For this type of work, criteria and qualifications are what needs to be met, not the price. Public Comments-None Old Business Trustee Blanco made a motion to rescind the vote taken on resolution #09-98-95 which was made at the September 19, 1995 meeting, motion seconded by Trustee Hyland. Discussion ensued. Mayor Treacy commented that there is a problem with doing this. The Village Attorney's memo states that a motion to rescind was not in order. Trustee Blanco read portions of Roberts Rules of Order commenting that it can be done. After discussion, motion carried 4-3 with Trustees Blanco, Horecky, Sweet and Hyland voting yes, and Mayor Treacy and Trustees Hayes and Alter voting no. Attached resolutions #10-105-95 and #10-106-95 were then read. Discussion ensued. Trustee Sweet commented that this is not political, they just want to return the power back to the trustees and the cost of a referendum will be minimal. Trustee Blanco commented that we need an active Board instead of a reactive one. Mayor Treacy read a letter addressed to Trustee Sweet from George Hritz, Chairman of the Planning Board with regard to this supersession. (Part of official minutes) The Mayor also commented that this was never brought up during any work session. Trustee Sweet commented that Sean Dugan, Edmund Stocklein, George O'Hanlon and Patricia Tornello have worked on the LWRP in previous years. Trustee Hyland commented that since we tabled resolution #09-19-95 at the last meeting, he would like to reintroduce it tonight. Discussion ensued on whether the Code Enforcement Officer could indiscriminately go into homes and check them. Village Attorney commented that the resolution should be reworded. Attached resolution #10-107-95 was then passed. Trustee Hyland commented that he would like to have a committee formed to discuss the feasibility of the village using the Clinton Street lot to be used for off-street parking. This will be discussed at the work session. New Business-None 2 �Mayor's Report Mayor Treacy reported that the Fall Festival and Five- Mile Run held on September 23rd were very successful. Last Friday night the inspection of the firehouses took place and we hope to continue with improvements; the second floor of the ambulance building needs repairs. He attended the Fire Chief's affair on Saturday which was very enjoyable. He presented former Chief Morabito with a Certificate of Appreciation for his year as Fire Chief. Mayor Treacy commented that we will be housing the old fire truck in the old warehouse on Kendall Avenue at no cost to the village until we can sell it. He thanked the Luberger family for their generous offer. The Mayor attended the Family Fun Day at Sleepy Hollow High School and had a grand time. He thanked Officers Ojito and Cotarello for volunteering for the EMT courses. Mayor Treacy commented that the resolution on tonight's agenda with regard to the ISTEA agreement is very important so we can move forward on the reconstruction of the Philipse Manor train station for the Hudson Valley Writers' Association. On October 12th he will meet with Sandy Galef, Fire Chief and Police Chief at Phelps Memorial Hospital to discuss services for the community. Mayor Treacy commented that negotiations continued with General Motors today and there is some good news which will be discussed at the work session. Very positive comments were made by General Motors with regard to the LWRP. On October 31st, the dedication ceremony for the opening of the Horseman's Trail will take place and we are hoping to have Andrew O'Rourke there to cut the ribbon. This weekend the village of Tarrytown will be celebrating 125th anniversary with a parade, carnival, etc. its Mayor Treacy stated that the second, phase of the environmental audit of the Riverfront park showed no major environmental problems, hopefully we will be able to start soon. Mayor Treacy commented that there will be two items for executive session tonight, litigation and personnel. Mayor Treacy asked Trustee Sweet to check with Chief Brophy with regard to making sure his officers check for double parking on cortlandt street and ticketing here in the village since only thirty nine tickets were issued by twenty-three police officers. Trustee Reports Trustee Hayes commented Dinner on October 12th. that there is a Municipal 0 Officials �Trustee Hayes reported that he was unable to attend the Library Board meeting on September 2 8th but he will give a report when he gets the minutes of that meeting. The book sale at the library will take place on Saturday and Sunday October 7th and 8th from 10AM-5PM. A newsletter with all the Fall events has been sent out. Trustee Hayes reported that he attended the fire houses inspection and annual inspection of equipment last weekend, he attended the clambake and a good time was had by all. By the end of this evening the old truck will be out of commission and the new one will be in. Sutphen will be coming in to check it out. Trustee Hyland commented that the old truck is still on the avenue and is glad it will be housed in the Luberger warehouse. Trustee Hyland wanted to know why the executive session is being held at the end of the meeting tonight. Our Attorney stated that Ponzini's office asked for this executive session to discuss litigation they are handling and we cannot hold an executive session at 7PM when the meeting was noticed for 8 FM and there was not enough time to renotice. Trustee Hyland commented on where we proposed to put all the highway equipment when the Sleepy Hollow Landing is built. The storage area, parking and recycling area are all going to be combined; the planning of this park was not thought out very well. Trustee Hyland commented that Union Hose parking survey has been implemented on Cortlandt Street. Trustee Hyland commented that the issuance of tickets are down because we have no Parking Enforcement Officer. He also commented that the Zoning Board should be televised. Trustee Horecky thanked the Police Department for answering all the calls he made to them regarding problems in his neighborhood. Trustee Horecky commented that he would like to discuss at the next work session, recouping the money Tarrytown owes us for Sykes Park. Trustee Horecky commented that he would like to have Barnhart Park cleaned out and wants to discuss this at the work session. Trustee Horecky commented that October 16th he will meet with the members of the General Motors committee. He commented that during the inspection of the fire housos, they found major disrepair in Columbia Hose. Columbia Hose is being used for meetings and is left in a mess. He felt that anyone who abuses their privilege of using this room, should not be allowed to use it anymore. Trustee Horecky asked if the trolley will run next year and if it does he would like to see it stop more than once in our business 4 �I districts. This year the trolley only stopped at one place. The Mayor commented that this decision will be made by Historic River Towns; funding is always a problem. the Trustee Horecky commented that he would like to see a Recycling Committee created to work with multi-family dwellings. Discuss at the work session. Trustee Blanco commented that there was vandalism across the street over the weekend outside the liquor store when someone knocked down the bricks around the store. He urged residents to let the police know if they see something like this occur. Trustee Blanco commented that he attended a Westchester Hispanic Chamber of Commerce dinner that was held to honor certain Hispanics. There is a large group of Hispanics who are quite successful in business. He congratulated them all. Trustee Blanco thanked the Fire Department for the good time he had on Friday and Saturday and for the ride in the bucket truck. Trustee Blanco commented that he would like to form a Cultural Council consisting of five members to present any cultural events, etc. Discuss at work session. Trustee Alter reported that the Fall Festival and S-K Run were quite successful. The Haunted Hayride will take place on October 27th and 28th, tickets are $1. if purchased now and $8. the night of the hayride. There will be a pie eating contest on Thursday, October 26th at 3:30 PM and a reading will be held at the Old Dutch Church on October 27th and 28th. For further information call the church at 631-1123. Trustee Alter reported that equipment for Barnhart park has been ordered and should arrive by the end of the week. He reported that line dancing will be held at the GM Training Center from 7-8 PM on Tuesday evenings starting October 10th. The cost is $25. for eight sessions. The Pass, Punt and Kick winners were announced at the festival last week. Trustee Alter read the attached public works report. Trustee Sweet reported he has received the August police report. (Part of official minutes.) Trustee Sweet commented that he will meet with chief Brophy to see that tickets are issued for double parking and speeding in the Manors. He has a fear of problems arising. He will speak to the Chief regarding the four-way stop signs not being obeyed at Howard and Pocantico and Howard and Washington Streets. Trustee Sweet attended a seminar last Thursday given by Susan Portman and David Stolman of Frederick P. Clark, Associates. It was very informative and helpful. The members of the Planning Board were also in attendance. <s �Trustee Sweet commented that the Land Use Law Reporter of Pace University School of Law has asked municipalities to pass a resolution resolving to reform New York's land use system. (Copy of resolution is attached.) Administrator's Report Linda David reported that the next work session will be held on October 10, 1995 at 8 PM, the regular meeting on October 17th with an informal discussion on the LWRP at 7 PM before the meeting begins, she read the agenda for the Zoning Board for October 18 at 8 PM, the Planning Board agenda for October 25th at 8 PM and the ARB on October 25th at 8 PM. There will be an election workshop for election inspectors to be held on October 18th at the Town of Mt. Pleasant at 7 PM. . , ».-•» Trustee Sweet commented that the new Town Assessor Adams. is Barbara Communications, Petitions & Requests Mayor Treacy read the Prosecutors report. Mayor Treacy read correspondence from Senator Moynihan regarding the Community Development Block Grant program. Deputy Clerk read correspondence from Leonard Galante requesting permission for the Central Veterans Committee of the Tarrytowns to hold its annual Veterans' Day services on November 11, 1995 at 10:45AM at Patriots Park. Trustee Hyland moved, second by Trustee Sweet to approve this request, motion carried. Executive Session Trustee Alter moved, second by Trustee Hayes to adjourn to executive session to discuss litigation and personnel, motion carried. Discussion ensued on the Caetano lawsuit. Trustee Hyland moved, second by Trustee Horecky to continue with the case and not settle the case for the recommended amount, motion carried 6-0. Mayor Treacy recused himself. Discussion ensued on the appointment of a provisional Recreation Leader. Mayor Treacy moved, second by Trustee Alter to appoint Mary Ellen suleski as Provisional Recreation Leader; said appointment is contingent upon Ms. Suleski passing the civil service exam for this position. After a brief discussion, motion carried 7-0. There being no further business, Trustee Alter moved, second by Trustee Hayes to move back to the regular meeting, carried. Trustee Horecky moved, second by Trustee Hyland to adjourn the meeting, motion carried. Chapter j>_2 shall be amended as follows: Section .28.1 Planning Board Appointments. A. Legislative Findings of Pact. Effective July 1, 1993, the New York State Legislature amended Village Law §7-718, providing in subsection (1) thereof that the power to make appointments of members to a village's planning board is vested in the mayor of the village. This amendment changed the lav/ concerning the power and manner in which planning board appointments were made, since prior to that time the lav/ had stated that planning board appointments were to be made by a village's village's board of trustees. In fact, prior to the effective date of that amendment, planning board appointments in the Village of North Tarrytown had been made by the Board of Trustees. Although the state law concerning planning board appointments has been changed, pursuant to the authority of Municipal Home Rule Law §10(1) (ii) (e) (3), a village may by local law amend or supersede any provision of the Village Lav/, as long as the state legislature shall not have expressly prohibited the adoption of such a local law. The Board of Trustees of the Village of North Tarrytown considers it important that the various working boards and groups of the Village be as representative and responsive as possible to the needs, desires and demands of the community, and recognizes that by virtue of its size and varied composition the Board of Trustees represents six-fold the elected delineation of the voters. The Board of Trustees therefore believes that a more democratic selection process v/ill result if Planning Board appointments are made by the Beard of Trustees. New street lights are being installed throughout the village. We are continuing to paint crosswalks and parking spaces. A small strip of Bellwood Avenue towards Devries Avenue will be paved shortly. We have patched a large area at the lower end of Beekman Avenue. Sidewalk program is still in effect. Tree work is continuing. REMINDERS 1 !!!!!! ! Personally, I have not yet formed an opinion on the merits of your proposal that North Tarrvtown should seek to avoid the 1993 statewide changes in village law that now prescribe the method for the making of appointments to planning boards all over New York. Your proposal is entirely new to me, but I will seek to educate myself as to the pros and cons. ^j?he purpose of this letter, however, is to be sure you and your fellow Trustees are operating on correct factual information as to the appointments that have been made to our Village Planning Board since the new state law, a situation with which I am quite familiar. In practice, since July 1993 I have not seen any sign of "cronyism"jor the "good ole boy" syndrome you fear. To start with yours truly, I think I have reported publicly to the Board of Trustees that X had never voted for Mayor Treacy and indeed had voted against him prior to his nominating me t'6 the Board. Not only was I not his political ally, I barely knew him. As for the Mayor's appointments since I joined the board, 4,there have been three. The first was Jo Anne Becker, who was and is a Republican. She had met the Mayor only once when he appointed her; in addition, she was and is a superbly well~qualified candidate with a professional background in municipal finance. The Mayor's second appointment was David Perlijmtter, who — as anyone who has seen him advocate his own positions will tell you —> is not only . a-highly—qual-if led lawyer and a first-olass thinker, he is"also nobody's stooge. If you do, I am sure you will conclude that in fact the Mayor has assembled a Planning Board of able citizen-volunteers to join their able fellow neighbors who preceded them. I believe this Board has worked well and in a nonpartisan manner and I hope will continue to do so, however our members are selected. Since then, as population has increased and more complex needs have arisen, this original system has been augmented in a piecemeal fashion. Over the years, new regulations and additional levels of authority have been created to respond to emerging challenges. All of these changes were well intended and effective for a time; WHEREAS, the cumulative result of this process is an uncoordinated and complex web of regulations, processes and financial incentives, administered by numerous agencies at various levels of government, that is neither simple, efficient nor effective. Rather than constituting a coordinated framework of compatible processes pursuing common objectives, it has become a complicated tangle of influences that frequently do not achieve economic competitiveness, sound community planning or effective environmental conservation; • I WHEREAS, there are three basic principles on which the improvement of this legal system should be based; • First, local governments should be provided incentives and information to encourage them to develop cost effective land use patterns; • Second, municipalities should be encouraged to work closely with their neighbors to create competitive economic market areas and protect natural resources that overlap local boundaries; and • Third, these inteiwunicipal land use plans should define efficient patterns of conservation and development, indicating where development is to be encouraged and where land and resource consetyation is to be supported; WHEREAS, through these intermimicipal plans, great, efficiency in the. use of tax revenues and natural resources can be achieved. The capital budgets of local, count}', state and federal agencies can be coordinated with these intemunicipal plans for cost efficient development. From this cost-effective beginning, economically competitive patterns of development can emerge. Land investors and developers will know where to invest and, in those areas, streamlining of the development process will be possible. By encouraging land development where it is appropriate, natural resources and environmental quality will be preserved in consetyation areas. Funds available for acquiring land or easements to protect open space and achieve natural resource conservation can be directed to areas designatedfor consayation purposes without suffering expensive competition with development pressures and costly legal battles. Local officials can expect assistance from all relevant state and federal agencies in implementing their plans, reducing intergovernmental tension and competition; and WHEREAS, New York State has already given I ocaj., governments broad and flexible power to adopt and implement land use plans and to cooperate with one another, and their counties, in doing so. In adopting a variety of individual laws, the legislature has articulated an impressive list of state-wide land use objectives. To achieve these objectives, the legislature'and governor have established a number of administrative agencies, many with regional offices and expert staffs. NOW, THEREFORE, BE IT RESOLVED THAT: 1. The land use system needs to be restructured so that strategic planning and regulation are centered at the local level, incentives are relied on rather than mandates and regulations, and processes are integrated to become responsive and flexible rather than rigid and bureaucratic; �2. Patterns of land development and resource conservation must emerge from the local level with active public participation so that the unique qualities and contributions of each community can strengthen the economic regions and ecosystems of the state; and 3. The proper role for county, state and federal agencies is to encourage intermunicipal land use activities and to coordinate the expenditure of their resources and the enforcement of their regulations with locally developed, intermunicipal plans for development and conservation. BE IT FURTHER RESOLVED THAT there are several actions that the State of New York can take to aid and encourage local governments to work together to create more cost effective patterns of development. Among these are the following, which we hereby call on the Governor and Legislature to adopt: 1. The State of New York should adopt a fully integrated set of principles and objectives to influence the expenditure of its resources and to guide the conduct of its agencies so that they support cost effective land use patterns and intermunicipal planning that achieves such patterns. Guidance should be taken from New Jersey and the nine other states that have adopted such state-wide land use policies; 2. The Governor's office should require that the activities of all state departments and offices that influence land use be coordinated. It should also integrate the administrative jurisdictions of those agencies so that they can be coordinated at the regional level and become more friendly to, and supportive of, the policies and programs of local officials and agencies; 3. The state should develop a program for delivering to local governments and agencies all available land-linked data gathered by state agencies and for integrating this data on a digitized geographic map of each municipality. With the help of the county governments, this will create an extensive land-linked data base that will enable localities to create efficient land use plans with their neighbors; 4. The state should develop a plan for providing technical and financial assistance to localities to enable them to develop intermunicipal land use plans; and 5. The state legislature and executive department should give communities that have adopted intermunicipal plans designating areas for conservation and development a significant priority in the distribution of state funds for capital projects that support development and in the distribution of state funds appropriated for conservation purposes.
