Present: Mayor Sean Treacy John T. Hayes, Jr. Michael Hyland Scott P. Horecky Jose Blanco Morris Alter Richard C. Sweet Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy commented that before opening the Local Waterfront Revitalization Program informational hearing, the Board would like to recognize certain individuals for all their help the night of the Haunted Hayride. Trustee Alter thanked Greg Thompson of Wolfpack, Robert Moon, Fire Department and Cecilia Vogt, Ladies Auxiliary. Each of these groups will be receiving a share of the money that was raised from the hayride. LWRP Informational Hearing-7 PM Trustee Sweet moved, second by Trustee Alter to open the informational hearing on the Local Waterfront Revitalization. Donal stever, Chair of the Conservation Advisory Council was the only one present. Due to the lack of turnout, no informational hearing was held. It was suggested that the new local newspaper, "TarryNews" place an ad in their paper regarding these hearings. Mayor Treacy commented that perhaps we could contact Diane Rainey of Continental Cablevision and have a call-in show. Public Hearing-None Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Blanco moved, second by Trustee Horecky to open the regular portion of the meeting, carried. Approval of Minutes Trustee Alter moved, second by Trustee Sweet to approve the minutes of October 17, 1995, motion carried 6-0. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued on several bills such as Frederick P. Clarke Associates, Insurance Reserve, village Attorney, and others. Following the discussion, motion carried 5-2 with Trustees Hyland and Horecky voting no. Total of the General Fund is $167,804.95, total of Capital fund is $15,535.17 and the Water Department fund total is $23,392.81. 1 �Public Comments-Agenda Items-None Public Comments Haig Bohigan, President of the Philipse Manor Improvement Association, commented that they strongly opposed the action that the Board of Trustees took at the August 8, 1995 meeting with regard to the closing of Devries and Merlin Avenues.(Copy of Resolution is attached) He submitted a petition from residents asking the Board to reconsider the closing of these streets. (Part of official minutes) He commented that the speed on Route 9 can be controlled in other ways and that the claims in the original petition are not correct. The PMIA has suggested that the State install a left turn light going northbound at Pierson Avenue and Route 9. The PMIA asked that a traffic study be done and the temporary barriers be removed. The PMIA will be invited to the work session on November 14th and the residents of Devries and Merlin will be invited also. Trustee Horecky had concerns over the liability if an accident occurred and we should check with the Sate. Brief discussion ensued. Trustee Horecky moved, second by Trustee Alter that the temporary barriers on Devries and Merlin be removed until we hear from the State in writing, motion carried 6-0. Trustee Alter commented that we have been asking the state for a delayed light on route 9 for quite some time with no results. Resolutions-Attached Old Business-None New Business Trustee Sweet asked that the Board approve naming of members of the Tree Commission. He put forth the names of Ralph Gunderman who is a member of the CAC, James Donovan, Nicholas Cicchetti, Sean Dugan and Joe DeFeo, second by Trustee Horecky and carried. Mayor Treacy commented that he was not consulted on these appointments. Mayor's Report Mayor Treacy commented that they met recently with the GM Task Force regarding the feasibility study. Arthur Anderson was awarded the contract to do this study and will be in contact with as much of our community as they can. They have taken a great deal of interest in our local waterfront redevelopment plan. The Mayor plans on setting up a meeting with members of the CAC and the other Environmental Advisory Group,members of the Board of Trustees, Planning and Zoning Boards and neighborhood association presidents. We will meet with representatives of Arthur Anderson next week. The Mayor commented that they met with the PBA regarding contractual issues. 2 �The Mayor congratulated all the volunteers who worked on the hayride which was very successful with a total of $1500. raised which will be distributed equally to the Fire Department, Ladies Auxiliary and Wolfpack. Halloween weekend was very successful with all the events that took place. Mayor Treacy commented that the official opening of the Headless Horsemans' Trail toook place on Halloween. This trail connects Devries and Douglas Parks with Philipsburg Restoration, the Old Dutch Church, Burying Ground at Sleepy Hollow Cemetery into the Rockefeller State Park and the old Aqueduct trail system. He will be meeting Mr. DeSantis, Commissioner of Westchester County Parks to discuss the possibility of refurbishing the bridge that stretches from Devries Park to Philipsburg Manor. The Mayor commented that the Historic River Town group has been very successful with the trolley ride this summer. We received a $10,000. grant from Citi-Bank and $30,000. grant from Westchester County which will help with tourism. The Mayor stated that he has been receiving numerous complaints regarding a homeless man who has been hanging around the village in front of doorways, etc. He would like to see if there is anything that can be done as far as getting some help from Social Services, etc. Trustee Sweet will check with the Police Chief. Trustee Reports Trustee Hayes reported that the Senior Outreach program was held on October 24th in the Van Tassel. Blood pressure testing took place and Ruth Jacobs from the Arthritis Foundation spoke to the Seniors. Trustee Hayes attended the Halloween luncheon held at Rudys where they honored a couple who were celebrating their 62nd wedding anniversary. At the October 23rd Library Board meeting, they thanked the Board of Trustees for allowing them to make their presentation at the last meeting of the Board of Trustees. The next Library Board meeting will be held on November 16th. They received a letter of resignation from Mrs. Quinn from the Library Board and Mayor Pilla appointed Margaret O'Connor. Approximately $5000. was raised from the book sale and fund raising letters will be mailed out shortly. On October 22nd a dedication of the tower ladder truck took place. Trustee Hayes accepted a plaque on behalf of the Board of Trustees from Pocantico Hook and Ladder in appreciation for all their help. Trustee Hayes read the attached letters from the Fire Council. Trustee Hayes moved, second by Trustee Blanco to approve the Council's appointments and carried. The Mayor commented that he received a letter with a petition from the residents of Howard Street objecting to the variance that the Zoning Board granted to Mr. Viera for 65 Howard Street 3 �I asking the Board to overturn this decision since some of the residents were not duly notified.. The Mayor commented that the Board of Trustees does not have the power to overturn the Zoning Board's decision but he will direct the Village Attorney to hold off on any sort of a variance that was issued so that another hearing can be held, one that is properly notified to all the neighbors. Trustee Hyland commented this is one reason why the Zoning Board meetings should be televised. Trustee Hyland commented now that General Motors has dropped their lawsuit against the village, we can take that money out of contingency fund and put it into next year's budget. Trustee Alter read the attached Public Works report. Trustee Alter thanked all the volunteers who worked the night of the hayride. He commented that the Recreation Department is sponsoring a caving trip on this Saturday, November 11th at 8:30 AM. Ski trips will take place on January 12 and 27th. Open gym is held on Monday, Wednesday and Thursday for 15yr. olds and up Tuesday and Thursdays for 3rd.4th and 5th graders at Morse gym. The Mayor commented that this Saturday November 11th is Veterans' Day and a ceremony will be held at 10 AM in Patriots Park to honor all veterans. Trustee Horecky thanked the Mayor and Board for approving and working on the idea of having the land cleared by Barnhart Park. He spoke to Joe DeFeo and they will be clearing this land. This will open a vast field to have a beautiful outlook of the north river improving the aesthetics of that area of the village. Trustee Horecky commented that he spoke to the Administrator regarding several improvements that were needed such as potholes, and sidewalk repairs. Trustee Horecky thanked Officer Checchi and Chief Chulla for their quick response to a call from his grandmother when water was coming from her ceiling. He commented that there was a dumpster on Elm Street where the owner did not take out a permit. Trustee Horecky commented that there are many illegal apartments in North Tarrytown and he is aware of two, one on 21 Anderson Avenue and 165 Valley Street. Anyone wanting to add an apartment must go before the Zoning Board to get a variance. Trustee Horecky commented that he has appreciated working with the Board for almost two years and stated that he will not be seeking re-election in March. Anything he does, he does for the good of the village and it is not political. Trustee Blanco welcomed our new local newspaper run by Marc 4 �Arduino who was in the audience. Mr. Arduino told the Board that anyone wishing to subscribe to the newspaper can come into their office at 95 Beekman Avenue. The cost is $30./yr. and $26. /yr. for seniors. Trustee Blanco asked for an update on the elevator. discussed at the work session. Will be Trustee Blanco stated that a Cultural Council was created at the last meeting. He appointed Trisha Meade and Lisa Dente, Trustee Horecky appointed Laura and Michael Phillippo. Trustee Blanco moved to accept these appointments, second by Trustee Horecky and carried. Trustee Sweet commented that the police report shows that as a result of an undercover narcotics investigation, several people were charged with possession or sale of a criminal substance and a number of other arrests were also made. He commended Detectives Caixiero and Reddy, and Officers Corona and Benetiz. He hoped that this whole operation represents a positive position of the Village and Police Department and hopefully there will be less drug use in the Village. Trustee Sweet read a letter from Ms. Glenn, Business Education teacher at Sleepy Hollow, commending Sergeant Ferguson for the great presentation he gave to her legal problem class. (Placed in personnel file) Administrator's Report Linda David congratulated Henry Atterbury, the Recreation staff and volunteers for the great job done for the hayride and other Halloween events. There will be a joint LWRP meeting with the Board of Trustees, Zoning Board and Planning Board on November 14th. Ms.David commented that Judy Acosta will be training Ambulance Corp. personnel on what to do while a patient is in the ambulance on their way to the hospital. She read the Planning Board agenda for November 16th and the ARB agenda for November 20th. There is no Zoning Board meeting in November and the Library Board will meet on November 16th. Communications, Petitions, S Requests Deputy Clerk read legal notice from the Village of Tarrytown regarding an application of Richard Arkin to go before their Planning Board on November 27,1995. Mayor Treacy read correspondence from Matthew Horaan, Campaign Director of the Fund for Public Interest Research informing the Village that they will be conducting a joint campaign with the Sierra Club to achieve support for the Federal Clean Water Act. Mayor Treacy read communication from Senator Suzi Oppenheimer to Secretary of State showing her support of the Local Waterfront Revitalization Program. 5 �I Correspondence from Mr. Harney of 4 Highland Avenue was read regarding the deterioration of a section of the street in front of their home. Mayor Treacy commented that with regard to Mr. Kavicky's request recently about discounted parking fees.at the Westchester Medical Center, Suzanne Swanson has checked into it and commented that the fees are set in a lease. They may be able to lower fees only for long term parking. A letter from Mr. & Mrs. Tubal of 427 N. Broadway was read which states that they were never approached with the petition to close off Devries and Merlin Avenue. We have received a check for $9614. for franchise fees from Continental Cablevision. The Mayor read a letter from Tom Thacter of Irvington with regard to the LWRP; he suggested that a Westchester Children's Museum be created in this area. Trustee Sweet commented that anyone who read the LWRP report in detail would see that museums, etc. are listed in this report. Mayor Treacy reported that there are several violations on the Prosecutor's report for the months of September and October. Linda David commented that Woody Allen's new movie, Mighty Aphrodite, which was partially filmed in North Tarrytown is now out. North Tarrytown did receive credit at the end of the movie. There being no further business, Trustee Kyland moved, second by Trustee Alter to adjourn the meeting. Our block of Devries, between Bellwood and Monroe, has long had speeding problems, both because it is a shortcut to Monroe with houses on only one side of the street and because of the ball field. We have never been successful in getting the police department to enforce safety despite calls to complain of speeding (we gave up calling after we lived here for a couple of years). We had no knowledge of the street closings on Rte 9 - not a letter or phone calL We are adamantly opposed to this. We don't understand how this can be done without notification or without any traffic studies which would demonstrate the impact of this diversion on our block. We have no sidewalks to act as a buffer to keep our children out of the road. The block of Devries offRte 9 at least has that advantage. They also do not have the balifiekl as an extra traffic generator. We cannot understand how, to convience the people on that block, we are being so disadvantaged. / We think it is only fair to have a full study and full disclosure before any permanent action is taken. Tarrytown, NY 10591 Gentlemen: We are experiencing problems with Ambulance 18 responding from it's quarters. In order for Ambulance 18 to respond to a call, Union Hose must be moved. If a Driver for Union Hose cannot be found, the Ambulance cannot get out of it's quarters. The Fire Council would like the Board to expand the Ambulance building further back. This way Ambulance 18 could be stored in the back of the Ambulance building. We understand the Board is looking into adding a second story meeting room to the building. If the Ambulance building were to be extended back, Ambulance 18 could be placed on one side and you could have a meeting room on the other side. The costs for expanding the building back may be cheaper than the cost of adding an additional story. The current building was constructed with volunteer labor from the Fire Department and the Department of Public Works. This might be an alternative to consider as to the feasability of expanding the Ambulance building. The Fire Council hopes that the Board will consider our request.
