Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Executive Session-7:30 PM Discussion ensued on two personnel matters, but no formal action was taken. Regular Meeting Mayor Treacy called the meeting to order with a pledge to the flag at 8:10 PM. Public Hearing-None Approval of Minutes Trustee Alter moved, second by Trustee Horecky to approve the minutes of November 8, 1995 with minor corrections. On page 1, the Mayor commented we could contact Diane Rainey of Cable, not Donal Stever, on page 4 under Trustee Alter's report, open gym is held at Sleepy Hollow High School gym for 15yr. olds and up and 3rd, 4th and 5th graders at Morse gym, motion carried 6-0. Approval of Warrants Discussion ensued on several bills, such as Hahn Engineering, Dr. Panitz, SPCA, etc. Much discussion ensued on payment to Greenthumb Nursery for a tree. Trustee Hyland did not feel the village should pay for a tree for a resident, he felt this was a gift and that the Board was not informed of this purchase. The Mayor explained the situation of the tree dispute between the two neighbors and this was a way a settling this dispute without the village being involved in litigation. The Village Attorney commented that the hearing before the Board was withdrawn and this is not a gift, we are just settling the dispute. The Mayor commented that he would have this payment taken out of his line. More discussion ensued. Trustee Horecky moved, second by Trustee Hyland to approve the warrants and authorize the Treasurer to pay the bills without the payment to Greenthumb Nursery, motion carried 4-3. Mayor Treacy made a motion to pay all the bills and have the bill to Greenthumb Nursery paid from the Mayor's line, motion seconded by Trustee Alter and motion carried 4-2-1 with Mayor Treacy and Trustees Alter, Hayes and Blanco voting yes and Trustees Hyland and Horecky voting no and Trustee Sweet abstaining. Total of the General Fund is $47,488.53, Water Fund total is $5,108.42 and the Capital fund total is $1,700.92. 1 �Public Comments-Agenda Items There were no comments from the public, Trustee Hayes moved, second by Trustee Hayes to close this section. Resolutions-Attached >v Public Comments Trustee Hyland moved, second by Trustee Horecky to open the public comment section, carried. Martin Kavicky suggested that there be two public comment sections. Don Caetano asked why there was such a rush to have Barnhart Park cleared. Trustee Horecky commented that this was a good time so that the park will be ready for the Spring and Joe DeFeo told him this was the best time to clear it. James Reddy, President of the PBA, commented on the expenditure of the tree to avoid the expense of litigation, yet the Village is spending money on arbitration with the police department. He then read a letter pertaining to certain issues with regard to the settling of the PBA contract. (Part of official minutes) Mayor Treacy commented to Mr. Reddy that he violated the trust of not going before the public and the press. Discussion ensued. Trustee Horecky thanked attention of the Board; negotiations.. Jim Reddy for bringing this to the they have not been kept apprised of Don Caetano commented that you cannot compare the price of a tree with the salary of the Police Department. Detective Caixiero commented that there is one important issue to be discussed and that is the Mayor's authority. The PBA felt that the Mayor should waive some of his authority. More discussion ensued. There being no further comments, Trustee Horecky moved, second by Trustee Alter to close the public comment section, carried. Old Business Trustee Horecky asked for a quote on the fence for Barnhart Park. The Mayor commented that it will cost $6000. for the fence and the installation. He will see that Trustee Horecky gets a copy of the quote. Trustee Hyland commented on the bids for the fence at the garage which was not discussed at a work session and asked why we chose the higher bid. The Mayor commented that all the information regarding the bids was given to Trustee Hyland a few weeks ago as he requested. Three bids were sought and only two were received and the lowest bid did not meet our security needs, 2 �therefore we went with the other bid. Trustee Sweet reported that the blacktop surrounding the memorial oak trees in front of Morse School is damaging them. He contacted the school and received a letter from Mrs.Barbelet, President of School Board, stating that they do not intend to remove this blacktop. The cost for our highway department to remove the blacktop and replace it with a material such as item 4, would cost approximately $800.-$1000. according to Joe DeFeo's estimate. The Conservation Advisory Council has opted to undertake an examination of our tree law. Trustee Sweet made a motion that the CAC or the Tree Commission be authorized to go before the School Board or the Superintendent of Schools, so this matter can be resolved, motion was seconded by Trustee Horecky and carried 6-0. New Business-None Mayor's Report Mayor Treacy reported that he met with GM. they are willing to have a contract drafted, hopefully within the next week. The Mayor met with Arthur Anderson to discuss the vision for the Village. A feasibility study will be done on the future of the GM site and we will meet with the GM Advisory group on November 30th. Mayor Treacy attended the Veterans' Day ceremony at Patriots Park on Veterans' Day. At the last work session many residents of Merlin and Devries Avenue attended to discuss the closing of the streets. Much discussion took place at this meeting. The barriers have been removed and the State informed the village that a gate is not acceptable, the street must be closed completely. A partial traffic study will cost approximately $3000. and a full study will cost around $7000.-$8000. We need more information regarding the traffic study. The Mayor commented that the village has a three-wheel vehicle in which the motor blew and Con Ed is offering us $10,000. towards the purchase of a new one. It would be run by electricity .The cost of the vehicle is $17,000. plus $2000. for a charging unit. The Mayor commented that we have a few pieces of old equipment at the garage which we will discuss selling at the next work session. Mayor Treacy appointed Jim Occhiogrosso to the GM Advisory Council. Mayor Treacy commented that he will appoint two people to the new Cultural Council very soon. Mayor Treacy commented that at the last meeting Trustee Horecky made a statement about an illegal apartment at 21 Anderson Avenue and read a letter from Mrs. Lobato to Trustee Horecky stating that her home is a legal two family home and wanted a public apology from him. 3 �I Trustee Horecky commented he stated at the last meeting that there are many illegal apartments.in the village that need to be looked into. He read a letter that he sent to Mr. & Mrs. Labato in response to their letter. Trustee Blanco asked about taxes that >v were paid from 1987-1995; were they for a one or two family home. Mayor Treacy received a letter from the Assessor which stated that the tax rate was the same for 1,2 or 3 family homes, there was no loss to the village. Mayor Treacy moved, on behalf of the Village of North Tarrytown, the Board of Trustees does hereby apologize to the Labato family for any errors that may have been stated here at the board meeting of November 8, 1995, second by Trustee Alter, carried 4-3. On roll call: Mayor Treacy, Trustees Alter, Hayes and Sweet voted yes, Trustee Hyland, Horecky and Blanco voted no. Mayor Treacy commented that the property at 165 Valley Street is also a legal two-family home. Trustee Horecky commented that the Mayor had sent the Building Inspector to have a 74 year old man kicked out of his apartment because he was the Chair of the Republican party, stating the house was an illegal two-family home. The Mayor commented that this was brought to our attention by a neighbor, Mrs. Tucci. Trustees' Report Trustee Hayes gave the fire report for October. He reported that the Library Board met on November 16th, there was no quorum so there were no votes taken. A fund raising letter will be mailed out shortly and the next meeting will be held on December 21st. He attended the Senior Coalition Thanksgiving luncheon at the Van Tassel today. The next meeting will be held on December 19th. They have been discussing different programs for the coming months and one of them is multi-cultural awareness and they will start with Italy and their culture and foods. Trustee Hayes commented that the Chair of the Library Board works at Hitachi and they are offering the village a home page on the internet. The Administrator commented that she is in the process of getting the village involved in this internet. Linda David commented that Trustee Hyland had asked about the status of the old hook and ladder truck. Trustee Hayes commented that there are two municipalities that were interested in it, but there were no firm bid as yet. Trustee Hyland commented with regard to the police contract, the 25% insurance copayment was not in the list of demands in the 4 �statement given by the PBA. The Mayor commented that it is not out of the picture and there are many things that are not in that list of demands. Trustee Hyland thought we hired an Administrator to negotiate contracts, etc., not the Mayor. The Board of Trustees was brought up to date on negotiations by the PBA not the Mayor. Trustee Horecky commented that the Building Inspector should see that the building permits issued are displayed on the property. The Mayor commented that this is the police's job. Trustee Horecky commented that he was not in favor of spending money on a traffic study for route 9 because it is not needed and that signs reading "No Left Hand Turn" are fine. Trustee Horecky moved, second by Trustee Blanco that we call for a public hearing to discuss the no left hand turns from Devries Avenue to Merlin Avenue and no left turns on the north bound side of route 9 onto Devries and Merlin Avenue, motion carried 6-0. Trustee Horecky commented that there are many violations at 25 Andrews Lane, such as car repairs, etc. and that the reason he brings up certain problems at board meetings is that they can be followed through since they are part of public record. Trustee Horecky thanked the Police Department and Detectives for their excellent work in the recent drug bust. Trustee Blanco commented that in light of the recent tree incident involving two neighbors and a tree on Depeyster and Cortlandt Street that toppled over during the recent storm which had been looked at a few months ago and just trimmed instead of being removed, he wanted the Board to look at the Tree Commission's method of determining whether trees should be removed/trimmed and what criteria they are using, also if there is anything we can do to help streamline this or make it a little more effective. Trustee Blanco commented that building permits should be visible and that they should be returned when the job is completed. The Administrator commented that there were some problems with people removing them from the site while work was going on. Mayor Treacy commented that perhaps the numbers on the permits could be larger and we could keep track of these permits. The Mayor moved, second by Trustee Blanco that we require all building permits to be displayed on windows and a new form be created with larger numbers, carried 5-2 with Trustees Hyland and Horecky voting no. \ Trustee Blanco commented that it seems like the Building Inspector is doing less work and he would like a written sampling of the work that he does. Trustee Alter read a proclamation from the village proclaiming 5 �the week of November 19-25, North Tarrytown Alumni Week and he will be presenting this at the reunion to be held on Saturday night at Rita Hall; approximately 600 people are expected to attend. Trustee Alter commented that the equipment for Barnhart Park v should be installed shortly. The caving trip was very successful. Ski trip schedules can be obtained through the recreation office. Trustee Alter read the attached Public Works report. Trustee Sweet read the sick and overtime Police Report for October. Trustee Sweet reported that he spoke to the Police Chief with regard to the homeless person in the village and the Chief told him that unless an act has been committed, nothing can be done. The Mayor commented that he did not think this was so and that the police should be able to arrest him for trespassing when he hangs out in the doorways of the businesses in the village. Trustee Sweet commented with regard to Trustee Blanco's question pertaining to the survey of trees; the Village tree law does contain a section dealing with the survey of trees within the village and there is a need to perform an inventory of these trees. One person cannot do an inventory of trees and most of the members of the Commission are not available during the day. In the past we have relied on residents informing the Clerk of trees that need attention who in turn notified the Tree Commission and they will inspect the tree and give a recommendation. Lately, there seems to be many trees in the village that have been dying. He commented that Nick Cicchetti who is on the Tree Commission is retired and is the only one available during the day. We do need an inventory of the trees in the village, but cannot be done by one person. With regard to the car repairs on Andrews Lane, Trustee Sweet will check with the Police Department to have them look into this since there is an ordinance prohibiting car repairs on the street. Administrator's Report Linda David reported there will be an informational hearing on the LWRP on November 27th at 7 PM at the Philipsburg Restoration. There will be no work session on November 28th. Linda David and the Mayor met with Sal DeSantis to work on the trail. The Administrator stated that there will be a meeting in Briarcliff next week regarding a drug alcohol program. Linda David reported that the water drought emergency has been lifted. 6 �* She reported that while the renovations to the Philipse Manor train station are taking place, eight parking spaces will be removed for commuters who park there. There will be parking allowed on Palmer Avenue during this time. Communications, Petitions & Requests Deputy Clerk read correspondence from Zora Abelaf of 62 New Broadway thanking the Highway Department for a job well done in the trimming of the trees in front of her home. Deputy Clerk read correspondence addressed to Joe DeFeo from Richard Weiss of 2 Terrace Close thanking him and his crew for the prompt removal of the tree that came down in front of his home during the last storm. (Placed in personnel file) Mayor Treacy read correspondence from the US Department of the Interior regarding the review of the draft of the LWRP; they had no comment. Correspondence from Janet Gandolfo was received advising the village that the Strobl litigation case has been discontinued. There being no further business, Trustee Blanco moved, second by Trustee Hayes to adjourn the meeting, carried. Mayor Treacy recently made a contract offer to the PBA which encompasses the following; 1) 4% salary increase retroactive to June 1, 1994 2) 5% salary increase retroactive to June 1, 1995 3) $2 00 per member added to the welfare fund effective June 1, 1995 4) A proceedure for line of duty injury ( section 207c of the General Municipal Law) to be negotiated by the village and the PBA. THIS ITEM IS A NON ECONOMIC ISSUE Based upon Mayor Treacy's offer the village cancelled, with the approval of the PBA, the interest arbitration session that was scheduled for November 15 in order to reach an amicable and agreed upon "207c proceedure" concerning line of duty injury. At this juncture the PBA has agreed to accept items 1,2, and 3 as listed above. We have agreed to roughly ninety percent of a 207c proceedure, with some modifications, with the exception of this issue. 1) It is the position of the Mayor that a hearing officer is appointed by the Mayor and village board, ideally the PBA would like arbitration. �" 2) The Mayor wants the PBA to pay for half of the cost of the Hearing officer, which the PBA would have no role in the appointment of. 3) The Mayor refuses to allow a stenographic record of the hearing with the village and the PBA splitting the cost. 4) The Mayor wants to be able to make the final and binding determination regarding the hearing officers recommendation - therefore being able to overturn the hearing officers recommendation if he decides to. The mayor refuses to budge on the four minor issues which have no real economic impact on the village - probably less than a thousand dollars if a hearing was ever held - and gives him the sole authority to appoint a hearing officer, deny a legal and proper recording of the proceedings, then have the power to overturn the hearing officer's recommendation. I ask you now to consider what the mayor offered, what we have accepted and what the mayor is refusing to budge on. Is this enough to delay a settlement of the contract, continue with arbitration, which is scheduled for December 1 and to delay that decision until after a January 11, 1996 hearing in Albany where the village has to defend it's position on admissability of this proceedure into the ongoing arbitration? I believe it is in the best interest for the village to act on this now. This issue is not of economics but of ego. Sincerely yours, James E.
