Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Executive Session- 7:00 PM Discussion took place on litigation matters but no formal action was taken. Trustee Hayes moved, second by Trustee Alter to adjourn the executive session and move into the regular portion of the meeting, motion carried. Regular Meeting Mayor Treacy called the meeting to order with the pledge to the flag. Public Hearing-None Approval of Minutes Trustee Hayes moved, second by Trustee Sweet to approve the minutes of November 21, 1995 as written, motion carried 6-0. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants of December 5, 1995 and authorize the Treasurer to pay the bills. Discussion ensued on several bills such as Balog & Ferrier, Donal Walsh, Bert's Auto Body, Ideal Electric, Hitzman, Hoffman and O'Reilly, Maroney Ponzini & Spencer, etc. Mayor Treacy commented that we leave out the bill to Main Street Pizza. After discussion, motion carried 4-2 with Trustees Hyland and Horecky voting no. Total of the General Fund is $308,235.87, Water Fund is $18,728.71 and Capital Fund total is $6,248.67. Trustee Horecky commented that Andrews Lane needs more lighting. Public Comments-Agenda Items Trustee Hayes moved, second by Trustee Sweet to open the public comment section, motion carried. There were no comments from the public, Trustee Alter moved, second by Trustee Hayes to close the public comment section, motion carried. Resolutions-Attached Public comments Trustee Alter moved, second by Trustee Hayes to open the public comment section, carried. Miguel Jimenez asked about the status of the homeless person. He commented as a merchant, business is being hurt. i �I I Mayor Treacy commented that he agreed with Mr. Jimenez and that he found it hard to believe that the police cannot arrest this person for loitering, public lewdness, harassment, alcohol consumption on the street, etc. The Mayor made a motion to hold a public hearing as soon as it is possible, on the establishment of a local loitering ordinance, second by Trustee Alter. Much discussion ensued. Trustee Sweet commented that the Chief informed him that Mr. White has been arrested many times but has to be released; nobody will press charges and he can't be kept in jail indefinitely. Marc Arduino, editor of our new local newspaper TarryNews, commented that something should be done to try and help Mr. White rather than arrest him. John Jadus, member of the Task Force on Noise and Litter, commented that the Police Chief should attend the next work session and discuss with the Board on what can be done. Don Caetano commented that he has asked Mr. White to go away to get help and cleaned up but he does not want help. After discussion motion carried on calling for public hearing. This matter will be discussed at the next work session and the Board will invite the Police Chief to attend. There being no further comments, Trustee Sweet moved, second by Trustee Hayes to close the public comment section, carried. Old Business-None New Business Trustee Sweet commented that there will be a public hearing on December 6 at the County Center from 4:30PM-9:3 0PM to discuss a proposal to reconstruct portions of 1-287 for high-occupancy vehicle lanes (HOV). The Environmental Management Group and the Federated Conservationists are against this and are urging the citizens of the County to come out and voice their opposition. Trustee Sweet commented that the NY State Land Use Reform Act has reached its termination. The question is now before the government in Albany. Trustee Sweet read a letter from the NYS Department of Parks and Historic Preservation which states they are very supportive of the Local Waterfront Revitalization Project. The final Environmental Impact statement regarding the Hudson Recycling will be ready for review on January 29th in Tarrytown Village Hall. Trustee Horecky wanted to know why our Village Attorney was not present; the Mayor replied that he went home because he was ill. Mayor's Report Mayor Treacy reported that the PBA contract has been settled. The Police Chief receives the dollar amount that the next highest paid officer gets. He then read the contents of the PBA award 2 �and explained benefits. the 207-C clause which pertains to disability The Mayor stated that the Teamsters negotiations will start next week and the Municipal Employees Union will be meeting in the near future. Mayor Treacy reported that the attorney for GM has informed us that the RFF (Request for Proposals) is completed, we can move forward on selecting an appraiser for the reassessment of the plant. We are moving forward on the feasibility study of future uses of the site, we will be meeting with members of the Task Force to discuss this. Arthur Anderson Co. has met with various committees to discuss the future uses for the GM site. The Mayor reported that there was a hearing on the LWRP last week held at Philipsburg Manor, but the turnout was poor. He suggested that perhaps we could have a call-in show on cable. Mayor Treacy commented that there was an oil spill at Phelps Memorial Hospital last week and the DEC did not notify us. The DEC told us that they do not notify municipalities of oil spills. The Mayor felt that this is not helpful and there should be more notification on the local levels. We will be holding an auction on December 18th to sell certain vehicles and equipment that are no longer needed. Anyone interested can inspect the vehicles at the village garage everyday from 7AM-3PM. The Administrator commented that the highest bidder will get the vehicle. The Mayor commented that there was an interesting regarding tourism in the New York Times recently. article Mayor Treacy commented that we will be interviewing candidates for the position of police officer. We received a grant for the purpose of hiring a police officer. Mayor Treacy commented that notification on the local level is very important. The County has informed us that they may be eliminating bus service in certain areas and our village may lose service on the Bee-line. He wrote letters to County Executive, Andrew O'Rourke and County Legislator Suzanne Swanson asking for their help. Many people in the village do not drive and this is the only way they can get to their jobs in White Plains. The Mayor commented that Andrew O'Rourke will be a speaker at our Village Official's meeting next week. Trustee Reports Trustee Hayes had no new items to report on the Senior Coalition and had no Fire Chief's report. He read the attached Fire Council letter regarding appointments, Trustee Hayes moved, second by Trustee Horecky to approve these appointments, carried. Trustee Hayes commented that we 3 are making progress on the �I internet with Hitachi. Trustee Hayes read a letter from the Warner Library that was mailed to all residents requesting donations. Trustee Hyland questioned the status of the old hook and ladder truck and asked if we were paying for housing it in the garage. The Administrator commented that we are in discussions right now with one perspective buyer. The Luberger family is not charging us for keeping the truck there. Trustee Hyland asked Trustee Sweet what was being done about the village tree that was cut down by a resident. Trustee Sweet commented that it is being looked into right now. Trustee Hyland commented that an arbitrator was hired to look at the police contract but this could have been settled last year and we would have saved the village money in attorney fees. Trustee Hyland commented that the purpose of the contingency fund was for the GM defense and but now it is being depleted with other expenses. He commented that we are spending alot of money on plumbing repairs for our buildings. During budget time he had suggested that we have a plumbing maintenance program for our buildings but nothing was done about it. Trustee Hyland asked the Village Administrator how many littering tickets have been issued since April and asked if our income, other than taxes, is up or down. Linda David commented that she will check into it and give him a report on both questions. Trustee Hyland commented that in a recent editorial in the Gannett newspaper, they suggested that our village attorney step down until he is cleared of all allegations. Trustee Hyland felt that he should. Trustee Horecky displayed and read several newspaper articles written regarding the allegations against Donal Walsh. He then read resolution #12/125/95 from the previous meeting which did not pass asking Donal Walsh to step down. Mayor Treacy stated that since Trustee Horecky is the one who previously put forth the motion, he cannot do it now, a Trustee who voted no or abstained must do this. There was no motion from the floor. Trustee Horecky commented with regard to the settlement of the PBA contract, the Board settled this almost a year ago; the police were offered the same percentage then as they were awarded now. We have spent $25,000. since then in attorney fees. This money could have been saved had we settled last year. Trustee Horecky commented that he has asked the Administrator to take care of several items such as a pot hole, abuse of handicap parking space in front of village hall, the removal of a village tree in front of 17 Irving Place, etc. 4 �Trustee Horecky asked if the police have access to the GM parking lot. There has been vandalism near the new trail and the police should check down there. The Mayor commented that they do have access. Trustee Horecky asked about the $5000. that the Mayor proposed we put aside to investigate the tax equalization rate regarding school taxes. The Mayor commented that we did a review and he will release a report to Trustee Horecky. Trustee Horecky urged everyone to support newspaper, the TarryNews. our new local Trustee Horecky commented that the plane of the Horseman Trail is in a way where it will be flooding and unpassable. The Mayor was in a hurry to open this trail by October 31th and now the trail is a mess. Trustee Blanco commented that there are two new storefront renovations in progress on Beekman Avenue; J&G Deli and the Tarry Inn. There are several new businesses on Valley Street and Chestnut Street and urged people to support them. Trustee Blanco reminded the Mayor about his appointments to the Cultural Council. Trustee Blanco commented that the reason he abstained on the vote at the last meeting regarding the village counsel stepping down was because he needed time to think about it. A person is innocent until proven guilty and his vote would be no if it were voted on tonight. Until such time that this is resolved, he will support our attorney to a certain extent. Trustee Alter reported on several recreation activities, recreation youth discussion group for ages 10-18 will meet on December 7 from 7-8:3 0PM; this will be an open views meeting. There are several upcoming ski trips, Downhill skiing at Vernon Valley on December 16th for ages 40 and over, January 12th at Vernon Valley and January 27th at Mohawk Mountain. There is an interest in starting a men's softball team. interested can contact the recreation department. Anyone Equipment at Barnhart Park will be installed shortly. There will be a Mambo Salsa workshop held at Flex Fitness every Saturday from 1-4 PM for a fee of $2 0. Trustee Alter read a thank you note to Henry Atterbury from Lenny Rutligan thanking him for his thoughtfulness and for the donation to the Fire Department from1the proceeds of the hayride. Trustee Alter commented that the Sleepy Hollow Society will hold a meeting on December 7th at the Philipsburg Restoration; musical entertainment will take place. R �T/histee Alter read the attached public works report. •Jprustee Sweet was in receipt, of, the monthly police report and Jfvertime report. Trustee Sweet gave the results of a speed survey done recently in the Manors which showed that very few people travel over 3 0 miles per hour, but commented that this speed in a residential area is quite fast. Trustee Sweet received notice of the police activity which shows that there were many illegal liquor sales to minors in bars and delis in the village and several arrests were made.(Part of Official Minutes) He commented that the CAC is reviewing our Tree Conservation Law for the purpose of amending it. They are also reviewing tree laws from surrounding villages. Administrator's Report Linda David read the Zoning Board agenda for December 2 0th, Planning Board for December 21st, Architectural Review Board for December 27th and the Fire Prevention Board for January 8, 1996. She reported that construction is proceeding at the Philipse Manor train station and parking is limited. Linda David alerted village residents to the fact the Cable Company will be doing wiring throughout the Village for the next two to three weeks. Linda David commented that the village will no longer be licensing plumbers, the County will be taking over. She will be attending a meeting at the County which will give us more information. Dr. Kusel, Superintendent of Public Schools, asked the Administrator to thank the Water Department, Public Works Department and the Fire Department for all their help last week during a water emergency. She commented that a public hearing on changes to the Vehicle and Traffic ordinance on Devries and Merlin will be held on January 2, 1996. She reported that filling in the pothole on Francis Street is in the work assignment for the Public Works Department and they have begun clearing Barnhart Park and have done a great job. Linda David commented that a seminar will be held with the County on January 28th at 4 PM in Village Hall regarding multi-family recycling. Jim Hogan and Maryann Gallagher of the County will be in attendance. We have notified the owners of the multi-family dwellings, also. Communications, Petitions & Requests Mayor Treacy read correspondence from Martha Jiminez, owner of the Embassy Bar, informing the village that they are moving from 134 Cortlandt Street to 176 Beekman Avenue and that they intend to renew their liquor license, (Copy to Police Chief) The Mayor read correspondence from Mr. & Mrs. Washburn of Washington Street requesting that the village do something about the very bright lite that was installed in the parking lot at the new condos on Depeyster Street which shines into their home. Linda David commented that the village engineer has been in contact with the contractor and it should be taken care of by tomorrow. The Mayor received another letter of response from a bill which we had written our opposition to. This bill would no longer allow our emergency services to charge insurance companies for responding to an ambulance call. The Mayor was in receipt of a copy of a letter to the State from Lynn Oliva, Commissioner of Planning, regarding the LWRP commending the village and listing some recommendations. Trustee Hyland asked if the Mayor was finished reading communications. Discussion ensued on following the order of the agenda. Trustee Blanco commented that the agenda should be followed and under communications, other items should not be brought up. The Mayor commented that the Chair can bring things up out of the order of the agenda. More discussion ensued on points of order, etc. Trustee Horecky commented there was correspondence which the Mayor neglected to read. He read a letter from Kevin Connolly, a former resident, who was visiting his family two weeks ago and watched the last board meeting. He was appalled at the behavior of the Mayor during that meeting. The Mayor commented that the letter was personally insulting to his family. Discussion ensued. This past Thursday night and Friday morning the department undertook an operation against illegal sales of alcoholic beverages to persons under the age of 21 by bars and delicat essens in the village. Undercover personnel under 21 years of age were used pursuant to the New York State Liquor Authorities Underage Agent Program. Employees who sold liquor illegally were charged with Unlawfully Dealing with a Child and the owners were charged with Unlawful Sale of Alcohol to a Person Under the Age of 21, a violation of the Alcoholic Beverage Control Law. The operation began at 9:30 PM on Thursday and ended at 2:00 AM on Friday. The establishments in violation are: Rocks Bar, 176 Beekman Ave. Taveras Grocery, 160 Depeyster St. Opescador Restaurant, 180 Valley St. Family Mini Mart, 196 Cortlandt St. Hidalgo's Grocery, 111 Cortlandt St. Max's Deli, 17 3 Beekman Ave. Sophia's Bar, 49 Chestnut St. Vina Del Mar Deli, 90 Beekman Ave. 2. Rafael Martinez, no home address, was arrested for Attempted Burglary in the second degree and Criminal Use of a Firearm as a result of a complaint Sunday morning. Martinez is accused of accosting a couple as they were about to enter their third floor apartment at 25 Andrews Lane. Martinez displayed what was later discovered to be a -.water pistol wrapped in aluminium foil. A struggle developed as he pushed the husband into the �apartment and a foot pursuit ensued. A witness identified Martinez in a photo array and he was picked up a short time later by PO Frank Corona. David Ragoonath, 7 Barnhardt Ave..was arrested by Det. Sgt.
