Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Donal M. Walsh, Jr. Village Attorney Executive Session-7 PH Discussion ensued on the Municipal Employees Unit contract. Regular Meeting Mayor Treacy called the meeting to order with a pledge to the flag at 8:00 PM. Trustee Alter moved,second by Trustee Blanco to open the public meeting, carried. Public Hearing Mayor Treacy read the attached public hearing notice. Trustee Sweet moved, second by Trustee Blanco to open the public hearing, carried. Mayor Treacy read attached letter from Diane Bruning. Jim Carlin of Palmer Avenue commented that he presented a petition with regard to no left hand turn into Palmer Avenue also. Will be discussed at next work session. Mayor Treacy commented that the Board will discuss their request at the next work session. Dr. Kreilsheimer asked who had the final say on the no left hand turn from Broadway and can the Board vote on each street separately. The Mayor commented that the DOT has the final say. After the Board passes the resolution, it would be sent to the DOT. The Board can vote on each street separately. Jim Occhigrosso of Merlin Avenue commented that the no left turns was an acceptable alternative to closing off the street. Eliot Martone, President of PMIA, stated that he hoped the Board will go forward with this compromise. Roger Bilharz of Munroe Avenue commented that there is speeding on all streets; if you do this for one street, it should be done for all. Frank Rey commented that the Board should make sure that the 1 �State grants approval before they pass a resolution and that the fire and emergency vehicles are exempt from this ordinance. There being no further comments, Trustee Alter moved,second by Trustee Sweet to close the public hearing, motion carried. Mayor Treacy commented that the State gave us a report for a five year study on route 9. It showed that there were 48 accidents, with thirty-one injuries, twelve were left turn related. Dr. Kreilsheimer commented about the the traffic light at Devries Avenue. left hand turn signal at Linda David commented that we have been asking the State for this for quite some time now and they tell us they cannot do it yet due to budget constraints. Trustee Hayes moved, second by Trustee Blanco: Resolved, no left hand turns from Devries Avenue onto Route 9. Discussion ensued. Trustee Hyland commented that before we go forward, he felt that the Board should wait on this and approach the DOT to look into the fact that maybe we should do this on all the streets from Pierson Avenue up to Bellwood Avenue for a no left hand or right hand turn. More discussion ensued. Trustee Hyland moved, second by Trustee Horecky to table this resolution until the Board can discuss it further and we receive a letter from DOT, motion carried 4-3 with Trustees Hyland, Horecky, Blanco and Sweet voting yes and Mayor Treacy and Trustees Hayes and Alter voting no. Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of December 19, 1995, motion carried 6-0. Approval of Warrants Trustee Alter moved, second by Trustee Blanco to approve the warrants and authorize the Treasurer to pay the bills. Brief discussion ensued on a few bills such as Montibello and Sanjay Shah. Motion carried 5-1 with Trustee Hyland voting no. Total of General Fund is $84,456.85, total of Water fund is $10,910.58 and the Capital fund total is $11,007.79. Public Comments-Agenda Items Only Trustee Blanco moved, second by Trustee Alter to open the public comment section, motion carried. Frank Rey commented that the resolution with regard to the pay increase for the MEU was too high. Resolutions-Attached Public Comments Trustee Blanco moved, second by Trustee Alter to open the public comment section, motion carried. Haig Bohigan of Hunter Avenue asked the Mayor what was the purpose of the no left turn and what was expected to be accomplished. He felt this should be studied more carefully 2 �I because it will only produce more traffic on other streets. He wanted proof that there is a safety issue involved and would like a copy of the study that the State did. The Mayor commented that this was at the request of the residents of that area because of speeding and the safety factor. Joe Trotti of Merlin Avenue commented that we are trying to resolve a safety issue and we are not accomplishing anything by going round and round on issues. He wanted a copy of the study. Frank Rey commented that this issue should be analyzed more fully before any decision is made. studied and There being no further comments, Trustee Alter moved, second by Trustee Hayes to close the public comment section, carried. Old Business-None New Business-None Mayor•s Report Discussions with General Motors is moving along. We have the first draft of the contract with regard to the closure of the plant and hope to have the final draft for the future of that building in a few weeks. We are looking forward to some positive things happening with that site. The State has commissioned a study for future uses of the plant; the preliminary study has been done. There are very interesting ideas for the use of the site. The study should be completed in April. On the reassessment of the plant, the agreement states that the village will be held harmless for two years as far as taxes; the second draft should be ready in the near future. Mayor Treacy commented that due to inclement weather on December 14th, the village had to cancel the Municipal Village Officials dinner that we were to host. We donated the food to the Community Opportunity Center who were appreciative. Mayor Treacy commented with regard to a water issue back in May of 1995. The private investigator that the Board hired found no intent to steal water but found other possible problems in the Court, therefore the Mayor read a letter which he wrote to the County District Attorney asking them to investigate further. Trustee Reports Trustee sweet reported that he attended the Planning Board meeting on December 21st where discussion took place on property on Kendall Avenue to have the two buildings currently standing on one building lot, become one building on its own individual lot, also a site plan application by Chuck Pateman to demolish some houses on Barnhart Avenue and rebuild affordable apartments. He is researching to see if this will fit in with the LWRP. Trustee Sweet read the attached memo from Sergeant Morrison to Chief Brophy commending Officers Greg Camp and Paul Cappello for their quick action when a fire broke out at 15 Webb Road. The 3 �I memo also commended two neighbors, William Bouton Freidner. (Letter placed in officer's personnel files) and Ed Trustee Sweet commented that he received the police overtime usage report for December. Trustee Alter reported that TNT baseball registration will take place on February 3 from 10-12, February 6 and February 8 from 7-9 PM, February 10 from 10-12. All registration will take place in the Sleepy Hollow gym. Kiddie Corner will start on January 5 from 9:30-10:20 AM at the Warner Library for ages 12-24 months. Ten sessions will cost $40. for residents and $45. for non-residents. Aerobics will start on January 8th from 6-7 PM in Morse gym. Trustee Alter commented that the Westchester County Office of the Aging is putting together a Cookbook for Healthy Eating. Anyone having a healthy recipe -to share should submit it to Henry Atterbury in the Recreation Department. If your recipe is included in the cookbook, you will receive a cookbook free, otherwise there will be a nominal fee. Trustee Alter read the attached public works report. Trustee Blanco commented regarding the referendum that he would like a report on exactly what is needed and when it's needed. Linda David commented that the information the Board of Elections sent us was not helpful but she will follow up on some of their suggestions. Trustee Blanco asked the Mayor for his appointments to the Cultural Council. Mayor Treacy then appointed Henrietta Brand and Sal Donzella. Trustee Blanco commented that he is the public official the Mayor was referring to in his letter to the District Attorney and that he also wants the District Attorney's office to investigate this fully. With regard to the water meter incident, no wrong doing was found and the Mayor told him that he would apologize to Trustee Blanco and his family if this were the case and he waiting to see if he will. Trustee Horecky started to comment about public integrity when Donal Walsh called a point of order stating that this cannot be discussed at an open meeting, it must be discussed in executive session, this is an employee issue and an employee can request that it not be brought up in public. Trustee Horecky asked for a copy of this law. Trustee Horecky commented that the Fire Department needs shovels. Trustee Horecky commented that there are a few employees that have not received raises. Trustee Horecky moved that the Parking Enforcement Officers receive a 4% raise for December 1-June 1, 1996 and 5% raise for June 1, 1996-May 31, 1997, motion was seconded by Mayor Treacy ancl carried 6-0. 4 �i Trustee Hyland commented that he is waiting for a report showing the revenue, other than taxes, that we have received and how much we have collected in littering fines. We need enforcement and we had this when Marc Broadway was working for us. He commented that our integrity is at an all time low when we degrade our own trustee. Trustee Hayes read the attached Fire Wardens report, Trustee Horecky moved, second by Trustee Alter to approve these appointments, carried. Trustee Hayes would like to have a meeting with the Chiefs and asked the Administrator to set up one. The Senior Coalition luncheon for December 19 was canceled due to the weather. The Library Board met on December 2 0th and he reported at that meeting what took place at our regular meeting; the resolution which was passed regarding the contract with the Library. There had been a meeting between our Administrator and Tarrytown's Administrator regarding input on Library union negotiation discussions. The next meeting will be held on January 25, 1996. Administrator's Report Linda David commented that she will have littering fines for Trustee Hyland shortly. the report on the She reported that we are working on sailing the old fire truck and should have good news soon. A notice regarding lead and copper was sent out to all residents. There will be a meeting on January 29, 1996 at 8 PM at the Warner Library regarding the Hudson Recycling Facility final environmental statement. The Administrator commented that there is an expanded list of recycable items and urged residents to read their newsletters. There will be a meeting on January 25th at Village Hall regarding recycling for multi-family dwellings. Linda David read the agendas for Fire Prevention Board, January 10th, Zoning Board, January 17, Planning Board, January 18th and the ARB on January 2 4th. She commented that parking at the Philipse Manor train stations is limited, but parking is allowed on Palmer Avenue during construction. Fiber optic wiring of cable television is being done throughout the village. Plumbing licenses are no longer being issued by the village, the County has taken over. 5 �Linda David commented that Sergeant Jimmy Warren was #1 on the local Civil Service Lieutenant's list and #7 on the county list. Also, Richard Gross was #1 on' the Water Maintenance Foreman's list and Larry Verdi was #2. She congratulated all of these employees. Linda David commented that we will discuss getting on the Hitachi internet at the next work session. Communications, Petitions and Requests Mayor Treacy reported that Westchester County is having their 12th Annual Westchester Women's Hall of Fame award and they are asking if anyone knows of someone deserving of this award to let us know. The County Executive Office has five scholarships available to commenerate this year's Weschester County Women's Hall of Fame; each one is $3 000. through the generosity of Avon, Nynex and Tambrands. Applications are available at village hall. Mayor Treacy received correspondence from the Tarrytown schools asking the village to provide funds in our budget for summer recreational programs for children in grades 6,7 and 8. Correspondence was received from Isla Penya thanking the Mayor and Georgiana Mariano for all the work that is being done for all the Latin people of this community. Mayor Treacy received correspondence from the Commissioner of Empire State Development Corporation, Charles Gargano stating that NY State has no specific preference with respect to the redevelopment of the General Motors site. There being no further business, Trustee Sweet moved, second by Trustee Alter to adjourn the meeting, carried.
