Present: Mayor Sean Treacy Richard C. Sweet Jose Blanco Scott P. Horecky Michael Hyland John T. Hayes, Jr. Trustees Also Present: Donal M. Walsh, Jr. Village Attorney Linda E. David, Village Administrator Absent: Trustee Morris Alter Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearing Trustee Hayes moved, second by Trustee Horecky to open the public hearing, carried. Mayor Treacy read the attached public hearing notice. Several residents of the Manor were present to speak in favor of the no left turn onto Palmer Avenue. Jim Carlin, David Perlmutter and Roberta Strauss asked the Board to give the same consideration to Palmer Avenue as they did for Devries and Merlin. There being no further comments, Trustee Hayes moved, second by Trustee Sweet to close the hearing, motion carried. Mayor Treacy commented that the State has finally approved our request to have a left turn light at Bellwood Avenue into Philipse Manor. Trustee Sweet commented that we have received permission from the State Department of Transportation for the no left hand turn on Devries and Merlin. He hoped that we can enforce the speed limit on the other streets like Pierson and Bellwood into Palmer going to the railraod station. Attached resolution #02/19/96 was then passed. Approval of Minutes Trustee Sweet moved, second by Trustee Horecky to approve the minutes of February 6, 1996 with minor additions/corrections. Trustee Sweet commented on page 3, para 6 regarding the concrete recycling plant, he added" A prepared statement was not read because of the preponderance of speakers but was given to the Secretary for inclusion in the minutes of the proceedings." Page 3 para 7, "This is unfortunate because that office was the one which provided us with the draft form for our wetlands watercourse ordinance." Page 4, 1st para, " that one or even all of the Trustees should be invited to future meetings 1 �with GM." Trustee Hayes commented on page 5, para 4, "the Senior Coalition will hold five more sessions, para 5, Trustee Hayes commented he was unable to attend the January 25th Library Board meeting but met with Diane Boersma. Motion carried 5-0. Approval of Warrants Trustee Hayes moved, second by Trustee Horecky to approve the warrants and authorize the Treasurer to pay the bills. Discussion ensued on a couple of bills such as Hitzman, Hoffman and O'Reilly, and the Contingency fund. Motion then carried 4-1 with Trustee Hyland voting no. Total of General Fund is $182,519.78, Water fund total is $1,011.28 and the Capital fund total is $1,068.75. Public Comments-Agenda Items Trustee Blanco moved, second by Trustee Horecky to open the public comment section, motion carried. There being no comments, Trustee Hayes moved, second by Trustee Horecky to close the public comment section, carried. Resolutions-Attached Much discussion ensued on resolution #02-18-96. Mayor Treacy commented that he felt this was a personal vendetta against the Mayor's office by the Republican trustees. The law was changed in 1993 for all municipalities not just our village. Trustee Sweet commented that since he was the one who primarily initiated this, he wanted to insure the public that under no conditions does he impune the integrity of the village or in any way detract from the capability of the Planning Board, it was simply an attempt by him to create the conditions under which Planning Board members had been chosen in the village since 1946. We tried to get this referendum on the ballot in November and we didn't succeed, then we tried again for our March election and we didn't make it again. More discussion ensued. Trustee Horecky then brought forward resolution #02-21-96 which is attached. Donal Walsh, our attorney, stated that we need a valid list before an appointment is made. He stated that we can't make an appointment contingent on the list. Discussion ensued. Public Comments Trustee Hayes moved, second by Trustee Sweet to open the public comment section, carried. Marc Arduino, 52 Pocantico street, Publisher of the Tarry News, asked the Mayor if he met with GM alone. The Mayor responded no, the Administrator is present as is our attorney Stephen Kass. Mr. Arduino commented that the Police Chief accused the Mayor of ticket fixing. Discussion ensued between the Mayor and Mr. Arduino. The Mayor took exception to Mr. Arduino's remarks and commented that he does not fix tickets. When residents complain about receiving unwarranted tickets, he checks into these matters. More discussion ensued. 2 �There being no further comments, Trustee Horecky moved, second byTrustee Hayes to close the public comment section, carried. Old Business- None New Business Mayor Treacy commented that March is Hudson Valley Art and Antigues month. Kykuit, Sunnyside, Philipse Manor Restoration and Lynhurst are all taking part in this new venture. For further information and tickets to take a tour, contact Historic Hudson Valley. On February 24th at 2 PM music, poetry and stories will take place at the Warner Library in honor of African American History Month. Mayor's Report Mayor Treacy commented that we have received correspondence from the State DOT approving our request for a left turn green arrow northbound from Route 9 into Pierson Avenue. Mayor Treacy commented that last Friday, he called emergency at 2 PM and the police were notified. At 7 evening the cars were still parked on both sides of Avenue; the police did not have them removed. There cooperation between the police department and the department. a snow PM that Beekman was no highway The Mayor met with veterans group and they have requested improvements to the corner that hold the Veteran's Monument in Patriots' Park. We will be working with them on having this done. Mayor Treacy commented that we have gone over our snow budget this year due to the tremendous amount of snow that has fallen. We have found that the State owes us approximately $3 8,23 0. for the past few years for the removal of snow from Route 9. This will help a little. Also, the cost of salt has increased by $10. per ton. The Administrator commented that we have applied for funds from the State due to the snow emergency. '•'/ Mayor Treacy commented on vagrancy in our village. During the snowstorm last week he saw the homeless man in front of the Open Door drinking, scratching, etc. He reported this to the police and they said nothing could be done unless they actually saw him doing these things. The next day he was in front of White Front Market, the police were called and commented they did not see him do these things. He was arrested for trespassing but released the next day. Something must be done to stop this. The Mayor reported that last week he met with GM attorney and Art Hestor, plant manager regarding settling the problems with the GM contract; there are a variety of incentives. Trustee Hyland asked the Mayor if he was in favor of rescinding the Reclamation Law. The Mayor responded that he is in favor of amending the law, not rescinding it. 3 �The Mayor commented that Donal Stever, the author of the local law, has bee consulted throughout all these meetings. The Mayor commented that he attended a dinner dance last Sunday where Sgt. Jimmy Warren received the Guardian of the Year Award. Trustee Reports Trustee Hayes reported that the Senior Coalition will hold five more meetings on Italian Culture. He does not have any dates as yet. Trustee Hayes commented that he has received the minutes of the last Library board meeting. A few items of interest were that the civil service list for Library Clerk was canvassed but most candidates said the salary was too low. On January 27th tiles fell in the north stairwell due to leaking of the roof and $22,000. or more is needed for roof repairs. He commented that he missed the February 15th Library Board meeting but will give a report at the next village board meeting. Trustee Hayes read the November fire report. He read the attached letters from the Fire Council. He will refer these to the Administrator and suggested they discuss some of these problems with the Fire Chiefs at the next meeting with the Fire Council. Trustee Hayes read a recent newspaper article regarding the fact that most people do need a refresher course on fire safety. Trustee Hyland commented on the Mayor's remark that the Police Department did not cooperate with the Highway Department last Friday during the snow emergency. He commented that we never had a communication gap between these two departments before during the past snowstorms. Trustee Hyland commented on the snow tickets incident; that the police are doing their job and why are they being questioned on how they gave prior notification before issuing these tickets. The last time tickets were given out for snow removal, the Parking Enforcement Officer was dismissed; is this going to happen to the Police Officers. As a result of his dismissal, only ten littering tickets have been issued since last year. The Mayor commented that complaints were received from residents regarding the issuance of these tickets, so he checked into it. Trustee Horecky commented that he will be meeting with Joe DeFeo and Henry Atterbury at Barnhart Park to get the new parkland in shape. Trustee Horecky commended the Highway Department for their tremendous efforts during this winter commenting that they have done a superb job. Trustee Horecky would like to set up a m e e t i n g with representatives of College Arms, Margotta Courts and the Van Tassel Apartments regarding multi-family recycling since they did 4 �not attend the other meeting that was held. He would like to have Union Hose representatives at the regular meeting with the Board regarding the congestion on Cortlandt Street. Linda David commented that John Celante has been contacted. Trustee Blanco read a letter to Art Hestor from the majority of the Board members requesting full disclosure of all meetings and negotiations between GM. ( Part of the official minutes.) Trustee Blanco congratulated several boys who are from North Tarrytown and attend Transfiguration School for winning the WCAA title for boys basketball tournament; this was quite an accomplishment. Trustee Blanco commented in the absence of Trustee Alter that boys baseball registration is still open; the next date is February 29th and girls Softball registration will take place on April 15th. Trustee Horecky called a point of order regarding the Mayor's statement that he only received correspondence from Trustee Sweet, when it fact he gave the Mayor correspondence two weeks ago. The Administrator commented it was given to her and she gave it to the appropriate parties and she will see that the Mayor receives a copy. Trustee Sweet reported that he attended the Planning Board meeting on February 15th and reported on the items on the agenda. Trustee Sweet commented there will be a continuation of the public hearing regarding the proposed concrete recycling plant at the Warner Library on February 2 6th. At the last hearing both of the consultants felt that the Final Environmental Impact Statement (FEIS) was incomplete and did not properly address all of the concerns that had been put in the draft environmental impact statement. Administrator's Report Linda David read the attached Public Works report in the absence of Trustee Alter and also commented that tot camp registration for 3-4 year olds will take place on April 20 at 9 AM, the Easter egg hunt will take place at Douglas Park on Saturday, April 6 at 11 AM for 2-7 year olds. She commented that the Mt. Pleasant Town Board will hold a public hearing on March 26th to discuss a proposal to amend the Mt. Pleasant zoning code to allow child day care centers as permitted uses. Linda David read the Zoning Board agenda for February 21st at 8 PM and the Architectural Review Board agenda for February 28th at 8 PM. Trustee Sweet asked the Administrator if she had a chance to set up a hearing for the LWRP. 5 �Linda David commented that Ms. Gandolfo told her she is working on it with Jeff Beech and its in the process but that she hasn't heard yet. Trustee Sweet commented that Mr. Beech is on vacation right now. The Administrator commented she will contact him next week. Communications, Petitions & Requests Trustee Sweet read attached correspondence from Jim Occhiogrosso regarding the happenings at village board meetings.(part of official minutes) Trustee Sweet commented that he will reply to this letter, but not at this time. Deputy Clerk read correspondence from the Eagles informing the village of their intent to renew their liquor license. (Referred to Police Chief) Trustee Hyland read a copy of a letter from Police Chief Brophy to the Assistant District Attorney regarding the snow removal summonses and why they left the Court Clerk's office. There being no further business, Trustee Hayes moved, second by Trustee Horecky to adjourn the meeting, motion carried. PLEASE NOTE: Residents are urged not to put leaves, twigs or brush out on the curb until April 1st. At that time make sure leaves are bagged and twigs are tied in bundles. Tarrytown, NY 10591 Re: Sprinkler System in Rock of Salvation Church Gentlemen, We have received a copy of the letter from Union Hose that, was sent to the Village Administrator on January 19, 1996. It concerns the Building Inspector and the Sprinkler Review Board. The Fire Council agrees with Union Hose that the Building Inspector should enforce the rules and codes of the Village, not to interpret and revise them. It is our understanding that no Building Permits are to be issued until Sprinkler plans are submitted. We were never shown any plans for a Sprinkler System when they were asked to be seen, and wonder if there are any plans available? We understand the Church is considering putting in a Detection System after the fact. This is not acceptable to the Council as a Dectection System is not a replacement for a Suppresion System. Can the Mayor and Board of Trustees contact the Building Inspector and look into this matter further? When the Sprinkler Review Board was organized in 1991, there were 7 members on the Board. Over the years the number of Board members has been reduced, and no one is sure of the actual number of members on the present Board, nor who they are. OCCHIOGROSSO 49 Merlin Avenue North Tarrytown,'NY 10591 914-631-3504 February 13, 1996 Mayor Sean Treacy Mrs. Linda David Board of Trustees Village Hall - Beekman Avenue North Tarrytown, NY 10591 Dear Mayor Treacy, Mrs. David and the Board: When I first started attending some of the Tuesday evening Board meetings I was initially surprised at the level of malice directed towards the Mayor by certain Board members. It was soon apparent that this malice was the result of misguided partisan politics; politics which have no place in a small Village such as ours. I tended to ignore it after that and viewed it as a necessary evil in the business of the Village. The last meeting I attended, February 6, 1 9 9 6 was different. Dr. Sweet's personal attack on the Village Administrator, Linda David, was unconscionable and uncalled for, especially in a public forum. Mrs. David is a paid public official and should not be subjected to this sort of offensive behavior. Prior to this outburst I had viewed Dr. Sweet as a concerned Trustee who didn't just disagree along party lines but put thought into his opinions. His public attack of Mrs. David has caused me to question my prior view. I would hope that Dr. Sweet would publicly apologize to Mrs. David and not follow the path other Trustees have taken after wrongfully defaming other individuals in public. This incident brings up a larger question. When will certain Board members realize that running this Village is a business and not politics? Delivering services such as police protection, garbage removal, etc. involve business decisions and do not depend on political affiliation. Larger issues, such as those concerning the proposed concrete recycling facility or the GM plant, which will impact this Village for years to come, are also business decisions and should not be trivialized by injecting partisan politics into the process. At this same meeting Dr. Sweet questioned w h y no Trustees are asked to �attend the Village's negotiating sessions w i j h General Motors. I think Dr. Sweet's o w n offensive behavior .that night provides the best answer to his ** question. As the Village election for three Board seats is approximately one month away, I would urge the residents of the Village to look past their o w n political affiliations when they vote. The goal in any voting process is to elect officials who can accomplish the specific objectives of the Village. The goal in this election is to elect people to the Board who can work w i t h the incumbent officials to address the issues that impact North Tarrytown. We really don't have any more time to waste on the Tuesday night buffoonery that currently infects the Board and prohibits progress from being made on important Village issues.
