Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Jose Chevere, Jr. Patricia P. Ramsey John T. Hayes, Jr. Trustees Also Present: Linda E. David, Village Administrator Absent: Trustee Mario DiFelice Mayor Treacy called the meeting to order with a pledge to the flag. He welcomed the new trustees and they were sworn into office by Linda David, Village Administrator\Village Clerk. Trustees Ramsey and Chevere thanked everyone who voted for them and commented that they are looking forward to working with everyone. Trustee Alter 'moved, second by Trustee Hayes to open the meeting, motion carried. Public Hearing-None Mayor Treacy made appointments to the trustee committees. (Copy attached) Mayor Treacy appointed Janet Gandolfo as Village Attorney, second by Trustee Ramsey and motion carried 5-0-1 with Trustee Sweet abstaining. Mayor Treacy reappointed John Lewis as Acting Village Justice for a term of one year, second by Trustee Alter an motion carried 5-0. Mayor Treacy reappointed Elvira Aloia to the Archictectural Review Board for a term of four years, second by Trustee Alter and motion carried 5-0. Mayor Treacy reappointed James Nazemetz to the Architectural Review Board as Chairman for a term of four years, second by Trustee Hayes and carried 5-0. Mayor Treacy reappointed Sean McCarthy to the Archictectural Review Board for a term of four years, second by Trustee Alter and motion carried 5-0. Mayor Treacy reappointed Chris Skelly, Harrison Moore, Joan Rose, and Andres Valdespino and appointed Rosaria Piomelli to the Economic Development Advisory Committee, all for a term of three years. The Mayor reappointed Ida Mae Smith to the North Tarrytown Housing Authority for a term of five years and appointed Jimmy Warren to fill the unexpired term of Joseph Ortiz which will expire in 1997. Mayor Treacy designated the Sleepy Hollow National Bank as our Depository of Funds for one year, second by Trustee Ramsey and motion carried 5-0. The Mayor designated Westchester Gannett newspaper as our official newspaper, second by Trustee Hayes and carried 5-0. Trustee Alter moved, second by Trustee Hayes to designate Roberts Rules of Order as the Official Parliamentary Procedure for the village, motion carried 5-0. Mayor Treacy reappointed Frank Gallagher and appointed Hugh Casey to the Parking Authority for a term of three years each, second by Trustee Alter, motion carried 5-0. Mayor Treacy reappointed Ed McCarthy to the Planning Board for a term of five years. Mayor Treacy put forth the names of Gus Donovan and Peter Gasperini as Journeymen to the Plumbing Board, Trustee Alter moved, second by Trustee Hayes to approve these appointments, motion carried 5-0. The Mayor put forth the names of Adrian Domingues and Bill Herlihy as Master Plumbers to the Plumbing Board; Trustee Sweet moved, second by Trustee Alter to approve these appointments, motion carried 5-0. Mayor Treacy appointed Gary McLean as Plumbing Inspector, second by Trustee Chevere, motion carried 5-0. Mayor Treacy put forth the name of Dr. Elio Ippolito as Police Surgeon for a term of one year; Trustee Hayes moved to approve this appointment, second by Trustee Alter and carried 5-0. Mayor Treacy appointed Peter Hildick Smith to the Recreation Commission to fill the unexpired term of Marion Palmer which expires in 2002 and appointed Ron Kessler to the Commission to fill the unexpired term of Jose Chevere which expires in 1999. 2 �Mayor Treacy reappointed Angelo Verdi and Ed McCarthy to the Electrical Board for a term of three years; Trustee Hayes moved, second by Trustee Alter and carried 5-0. Mayor Treacy reappointed Donald Stever, Diane Hegarty, Richard Weiss, Alberto DeCarvalho and Ron Greene to the Environmental Council for a term of two years and he appointed Angelo LoMascola to fill the unexpired term of Mario DiFelice which expires in 1997. The Mayor appointed Angelo LoMascola to the Environmental Review Board to fill the unexpired term of Jose Chevere which will expire in 1998. Trustee Sweet moved, second by Mayor Treacy that Donald Stever, Walter Ceconi, Nicholas Cicchetti, James Donovan, Richard Weiss and Ralph Gunderman be reappointed to the Conservation Advisory Council, motion carried 5-0. Mayor Treacy reappointed Sam Gittens to the Ethics Committee and appointed Art Brady, both for a term of two years; Trustee Alter moved, second by Trustee Hayes to accept these appointments, motion carried 5-0. Mayor Treacy reappointed Stanley Pulaski to the Fire Board of Appeals for a term of five years; Trustee Alter moved, second by Trustee Chevere to accept this appointment, motion carried 5-0. Mayor Treacy reappointed Adrian Kringas to the Handicapped Committee for a term of two years. Mayor Treacy reappointed Trustee Hayes as Liaison to the Library Board. Mayor Treacy reappointed Filomena Fallacaro as Registrar of Vital Statistics for a term of two years, second by Trustee Alter and carried 5-0. Mayor Treacy reappointed Robert Balog as Village Assessor for a term of one year, second by Trustee Alter and carried 5-0. Mayor Treacy reappointed Joseph DeMilia, Jr. as Village Auditor for a term of one year, second by Trustee Sweet and carried 5-0. Mayor Treacy reappointed Linda David as Village Clerk for a term of two years, second by Trustee Hayes and carried 5-0. Mayor Treacy reappointed Mr. & Mrs. Theodore Hutchinson as Village Historians for a term of one year; Trustee Alter moved, second by Trustee Hayes to accept this appointment, carried 5-0. Mayor Treacy appointed Sanjay Shah as Village Treasurer effective April 22, 1996 for a term of two years, second by Trustee Alter and motion carried 5-0-1 with Trustee Sweet abstaining. Mayor Treacy reappointed John Morabito to the Zoning Board of Appeals and appointed Miguel Jimenez, both for a term of three years. 3 �Mayor Treacy appointed the following people to the Tourism Committee: Margaret O'Brien, Hugh Casey, Mark Arduino, Emily Herman, Henry Steiner, Tom Staudter, Jose Blanco, Peter Hildick Smith, Rosaria Piomellia, Marcia Fuzer, Mary Grace DiClemente, Yolanda Mallery and a representative from Historic Hudson Valley, and the Hudson Valley Writers Center. Approval of Minutes Trustee Hayes moved, second by Trustee Alter to approve the minutes of February 27,1996 as written, motion carried 4-0-2 with Trustees Chevere and Ramsey abstaining. Trustee Hayes moved, second by Trustee Hayes to approve the minutes of March 5, 1996 as written, motion carried 4-0-2 with Trustees Chevere and Ramsey abstaining. Trustee Alter moved, second by Trustee Hayes to approve the minutes of March 20, 1996 with a minor addition by Trustee Sweet. On page one, Trustee Sweet commented that the total number of votes exceeded the total number of ballots indicated on the sheet having voted on that night and he felt that this could not be possible. With that addition, motion carried 4-0-2 with Trustees Chevere and Ramsey abstaining. Trustee Sweet commented that it turned out that the total number of ballots listed was incorrect but the total number of votes was correct. A resolution correcting this is on tonight's agenda. Approval of Warrants Trustee Alter moved, second by Trustee Hayes to approve the warrants of the General Fund and authorize the Treasurer to pay the bills.Brief discussion ensued on payment to Donal Walsh, motion carried 5-1 with Trustee Sweet voting.no. Total of the General fund is $141,592.22. Trustee Hayes moved, second by Trustee Alter to approve the warrants of the Capital fund and authorize the Treasurer to pay the bills, motion carried 5-0. Total of the Capital fund is $8,494.94. Trustee Ramsey moved, second by Trustee Alter to approve the warrants of the Water Department fund and authorize the Treasurer to pay the bills. Brief discussion ensued on the tax bills for Mt. Pleasant and they were removed from the warrant. Motion carried 5-0. Total of the Water fund is $384,603.46. Public Comments-Agenda Items Trustee Hayes moved,second by Trustee Chevere to open the public comment section, motion carried. Mark Arduino asked the annual salary of the Village Attorney, the Mayor commented that it has not been set yet. Miguel Jimenez congratulated the new board. Gary McLean commented that the Village Attorney should be paid. The Mayor commented that he is being paid. Resolutions-Attached On resolution #04-27-96 regarding the referendum, Trustee Sweet commented that sometimes the State of New York will pass laws which in many instances those laws may be contrary to what the villages would like to have for themselves.In case a village wishes to get relief from a state law, they can do it by supersession and the Municipal Home Rule. Communications/ Petitions and Requests The Deputy Clerk read correspondence from Leonard Galante requesting permission to hold its annual Memorial Day parade and services on Monday May 27, 1996 starting at 9 AM. Trustee Ramsey moved, second by Trustee Sweet to approve this request. Deputy Clerk read attached correspondence from the Fire Council. Trustee Alter moved, second by Trustee Ramsey to approve their action and requests, motion carried. The Mayor read correspondence from Lenny Rutligan and the Board of Fire Wardens thanking the Mayor, Board of Trustees and Administrator for their generosity towards their 1996-97 f iremens' budget. There being no further business, Trustee Hayes moved,second by Trustee Alteif to adjourn to executive session to discuss a personnel matter and litigation. Executive Session Discussion ensued regarding the conditional nomination of Jose Quinoy as Police Officer and his legal residency. Discussion ensued on the termination of the legal services of the law firm of Maroney, Ponzini and Spencer with regard to certain outstanding litigation. Attached resolution #04-47-96 was passed. MOVED: Trustee Sweet SECONDED: Trustee Alter VOTE: 5-0 �04-01-96 04-28-96 Meeting Date: Resolution #: VILLAGE OF NORTH TARRYTOWN TITLE: LOCAL LAW # 3 1996 PLANNING BOARD APPOINTMENT POWER Be it enacted by the Board of Trustees of the Village of North Tarrytown, A LOCAL LAW TO AMEND the Code of the Village of North Tarrytown, Chapter 62, thereof, to add a new section providing for the supersession of New York State Village Law Section 7-718(1) regarding the manner in which members are appointed to the Planning Board of the Village of North Tarrytown. Chapter 62 shall be amended as follows: Section 28-1 Planning Board Appointments. A. Legislative Findings of Fact. Effective July 1, 1993, the New York State Legislature amended Village Law Section7-718, providing "in subsection (1) thereof that the power to make appointments of members to a village's planning board is vested in the mayor of the village. This amendment changed the law concerning the power and manner in which planning board appointments were made, since prior to that time the law had stated that planning board appointments were to be made by a village's board of trustees. In fact, prior to the effective date of that amendment, planning board appointments in the Village of North Tarrytown had been made by the Board of Trustees. Although the state law concerning planning board appointments has been changed, pursuant to the authority of Municipal Home Rule Law Section 10(1) (ii) (e) (3), a village may by local law amend or supersede any provision f the Village Law, as long as the state legislature shall not have expressly prohibited the adoption of such a local law. The Board of Trustees of the Village of North Tarrytown considers it important that the various working boards and groups of the Village be as representative and responsive as possible to the nueds, desires and demands of the community, and recognizes that by virtue of its size and varied composition the Board of Trustees represents six-fold the elected delineation of the voters. The Board of Trustees therefore believes that a more democratic selection process will result if Planning board appointments are made by the Board of Trustees. Accordingly, it is the specific intention of the Board of Trustees to supersede Village Lav/. V �I Section 7-718(1) to require that appointments of members to the Planning Board of the Village of North Tarrytown be made by the Board of Trustees. B I Manner of Appointment Members of the Planning Board of the Village of North Tarrytown shall be appointed by the Board of Trustees of the Village. C. Effective Date.
