The meeting was called to order by Richard Weiss, Chair at 8:06 p.m. The Chair noted that a
quorum was present.

Dolph Rotfeld is representing this application.
Dolph Rotfeld stated that this application started back in 1999. He gave a brief history of the
project. He stated that the original plan included building a road parallel to the existing road
between the stream and the ball field. He stated that the Village DPW decided to use the
existing road on the southern portion of the property. He stated that the revised proposal will
install 3 additional drainage crossings tubes across the road to connect into the southern basin.
He stated that in order to not disturb any additional wetlands, the additional work will drain
underneath the road and leave everything else in its natural state.
Doug Maass asked who initiated this project.
Dolph Rotfeld presented a letter dated 2008 from the former Village Administrator, Dwight
Douglas to the Planning Board Chairman.
Doug Maass questioned why a silt trap was installed within a silt trap.
Dolph Rotfeld responded that wetlands are a silt trap. He stated that during heavy rains, silt is
put back into the stream and into the pond.
Carol Manca asked what was done before this project.
Dolph Rotfeld responded that he did not know.

�Doug Maass asked about the vortex dome.
Dolph Rotfeld spoke about the vortex dome. He stated that the vortex dome needs to be
cleaned out several times a year.
Doug Maass asked about communications with the DEC, Parks Department, US Army Corps of
Engineers, etc.
Dolph Rotfeld responded that the only required permit was from the US Army Corps of
Engineers. He could not locate a copy of the permit.
Doug Maass questioned that the project area noted on the revised application is not ½ acre. He
stated that the project area should be 4-5 acres. He stated that the raised road is about 1-acre
alone.
Dolph Rotfeld disagreed.
Doug Maass stated that there is a history of projects being done in the Village without being
reviewed by the Committee.
The Chair asked about the consequences if the project does not move forward.
Dolph Rotfeld responded that the area would not be re-seeded and replanted. He stated that the
stumps would not be removed and would remain visually unappealing.
Doug Maass stated that the road use should be limited to pedestrians and to vehicles servicing
the pond. The Committee stated that this recommendation should be sent to the Planning Board.
Doug Maass asked if Dolph Rotfeld was concerned that the wetlands would be drained.
Dolph Rotfeld responded no.
The Chair stated that policy 7(a) is applicable to this application.
Ralph Gunderman stated that the wetlands are not being restored but mitigated. He stated that
he feels that the application is consistent with Policy 7(a).
Doug Maass agreed with the condition that the road is used for pedestrians and vehicles used to
support the basins and associated culverts. Also, dredged spoils are not to be deposited in the
wetlands. The Committee unanimously agreed that the application is consistent with Policy 7(a).
The Chair stated that Policy 44 is also applicable to this application.
The Committee unanimously agreed that the application is consistent with Policy 44.
Doug Maass asked if Dolph Rotfeld is involved in any other projects in the Village.
Dolph Rotfeld discussed his other projects in the Village. They included the new water tank
and other water supply projects in the Village.

�Paul Janos gave an overview of the proposed project. He stated that the Castle Oil site will be
renovated to accommodate a 60 unit development. He stated that there is a 200-foot pier for
recreational purposes. He submitted a letter from Westchester County on the proposed project.
The Chair stated that the amount of residential units does not work with the LWRP and waterdependent uses.
Paul Janos responded that Castle Oil site will connect the waterfront paths from Tarrytown to
the Washington Irving Boat Club. He stated that currently the site is closed to the public.
Doug Maass stated that Castle Oil is a water-dependent use. He is concerned with the large
amounts of residential units proposed. He stated that the water-dependent uses include a
floating dock, etc. He asked if the area could also be dredged.
The Chair stated that there should be other water-dependent uses other than fishing piers.
Paul Janos responded that Horan’s Park would be expanded to accommodate the public. He
also stated that the GM site will also have some water-dependent uses. He stated that there is a
price involved with removing Castle Oil.
Ralph Gunderman stated that the scale is too massive. He stated that the Committee needs
some consistency.
The Chair stated that this project will need some time to properly review.
Paul Janos asked about possible uses on the site.
Doug Maass responded that a marina or boat repair shop would meet the water-dependent uses
requirement.
Paul Janos stated that the tax revenue to the Village would be substantially increased. He also
stated that the many of the people inquiring about the project are concerned with the proximity
to the train station.
Ralph Gunderman asked if the Lead Agency could be provided with an economic analysis of
the project.
Ralph Gunderman asked if a decision needed to be made tonight.
Sean McCarthy responded no. He stated that some advice to the Village Trustees should be
provided. He stated that it would ultimately return to the Committee.
Ralph Gunderman stated that he is concerned with the density. He stated that it is not
consistent with the LWRP. He stated that the zoning regulations should not be exceeded.
Sean McCarthy stated that there is also a proposed zoning amendment to this area.
Ralph Gunderman responded that he is opposed to the proposed zoning amendment.
Ralph Gunderman stated that the proposed density would create a dangerous precedent for the
density of the GM site. He asked about the density of the Hudson Harbor site.
Paul Janos responded 238 units over 30 acres.

�Doug Maass stated that access to the waterfront is very important. He stated that an individual
should be able to get their feet wet. He stated that the structure is enormous. He stated that
Ichabod’s Landing was constructed at an increased height from the proposed plans. He stated
that the proposed structure is 7 stories tall.
Paul Janos stated that the Castle Oil site will connect the walkway and will allow access to the
waterfront where is currently does not exist.
The Chair stated that the current design is too dense. He stated that the Village does not need
another solid apartment building.
The Chair stated that the Committee is not opposed to the development of the site but they
would like to see a more creative use.
Paul Janos invited the Committee to visit the Hudson Harbor site to get a better understanding
of the entire plan.
Doug Maass stated that the proposed structure should not exceed the existing height of the
Castle Oil tanks.
This matter was adjourned.

3) Approval of minutes –
The minutes from the November 2008 meeting will be reviewed at the next meeting.

4) Other The Chair asked about the work at the Grotto property. He stated that the application did not
appear before the Committee.
Doug Maass stated that the new gazebo was not presented to the Committee.
Sean McCarthy responded that the gazebo was not referred to the Committee by the Village
Trustees.
Doug Maass also stated that the staircase at the train station was replaced without coming
before the Committee.
Doug Maass stated that the Village does not have a Conservation Committee. He asked if there
are any rules or standards on energy conservation.
Sean McCarthy responded no.
Ralph Gunderman made a motion to adjourn. Carol Manca seconded. It was unanimous (4-0).
