David, Village Administrator Janet Gandolfo, Village Attorney Absent: Trustee Morris Alter Discussion ensued with Stephen Kass, Attorney, on the amendment to the Abandoned Industrial Property Law. proposed Mayor Treacy opened the meeting with a pledge to the flag. Trustee Hayes moved, second by Trustee Ramsey to open the public meeting. Mayor Treacy presented Certificates of Merit to Frank Rizzi and Emil Imhof for fifty years of dedicated service to the fire department and thanked them for all their years of service. Mayor Treacy read the attached public hearing regarding the amendments to the Abandoned Industrial Property Law. Trustee DiFelice moved, second by Trustee hearing for comments, carried. Ramsey to open the public Stephen Kass, Attorney representing the Village, gave a brief explanation of the proposed amendment to the Law. Frank Rey read a letter he had written to the Board of Trustees which he wanted made part of the official minutes. Mayor Treacy read letter from Assemblyman Richard Brodsky offering to facilitate any communications between the Village of North Tarrytown, �General Motors and the Department of Environmental Conservation to help execute and expedite the environmental remediation of the site. Several residents, Angelo LaMascola, George Hritz, Pat Munroe and Hugh Jones were all in favor of the agreement that was signed and felt it was a good one. Other residents, Mark Arduino, and Scott Horecky opposed this agreement. There being no further comments, Trustee Ramsey moved, second by Trustee Sweet to close the public hearing, motion carried. Mayor Treacy answered questions that the residents had regarding the cleanup. Trustee Ramsey also answered some questions. Mayor Treacy thanked Stephen Kass for the work he did in reaching this agreement, thanked representatives of General Motors and thanked the members of the GM Advisory Council, Eliot Martone, George Hritz, Patricia Ramsey, Jose Ch3vere, Bob Anello, John Becker, Bill Jarr, Angelo LaMascolo, David Maloy, Don Stever, Scott Horecky and Jim Occhiogrosso for all their work on the agreement. Mayor Treacy read attached public hearing Chapter 9 entitled "Bicycles". notice regarding amending Trustee Chevere moved, second by Trustee Sweet to open the public hearing, carried. There being no comments from the public, Trustee Ramsey moved, second by Trustee Sweet to close the public hearing., carried. Mayor Treacy read the attached public hearing regarding amending the Sprinkler code to add another member to the Bureau of Fire Prevention. Trustee DiFelice moved, second by Trustee Ramsey to open the public hearing, carried. John Jadus and John Cellante had questions regarding this amendment which our attorney addressed. There being no further comments, Trustee Sweet moved, second by Trustee Ramsey to close the public hearing, carried. Trustee Hayes moved, second by Trustee Sweet to open the public hearing, carried. \\.i �Mayor Treacy explained that we no longer needed this space since the person requesting it has moved. Trustee Ramsey moved, second by Trustee Sweet to close the hearing, carried. Mayor Treacy read attached public hearing notice regarding the increase of »-33 cents to cable bills for government access and explained the reason for this. • * / Trustee DiFelice moved, second by Trustee hearing, carried. Ramsey to open the public Sunny McLean and Carmen Mariano had questions regarding this increase. Ms. Mariano felt the Spanish community was not being informed. Trustee Chevere commented that he is around the village every day to speak to the residents of the Spanish community. Trustee Ramsey commented that she should let the trustees know if they feel they are not being informed. Trustee Chevere commented that he could give a report in Spanish if that would help. There being no further comments, Trustee DiFelice moved, second by Trustee Sweet to close the public hearing, carried. Trustee Sweet moved, second by Trustee Ramsey to reopen the public hearing regarding the amendments to the Tree Ordinance. Trustee Sweet gave a brief explanation of the proposed amendments. Angelo LaMascolo asked that the Board suspend the four minute limit so that he could read his suggestions. Trustee Ramsey moved, second by Trustee Chevere to suspend the four minute limit, earned. Mr. LaMascolo presented his suggestions to the Board., (copy part of official minutes) Pat Munroe asked that the trees with wires around them be checked to make sure that they are not choking the trees. Mayor Treacy moved, second by Trustee Sweet that we continue this public hearing on September 17,1996, motion earned. Trustee Sweet commented that the CAC will be meeting at the end of the month and will discuss Mr. LaMascolo's suggestions and invited him to attend this meeting. Trustee Sweet commented that the trees that were removed on Teresa Street have been replaced with other trees. �Trustee Hayes moved, second by Trustee Ramsey to approve the minutes of July 23,1996 as written, motion carried, 5-0. Trustees Ramsey moved, second by Trustee Chevere, to approve the minutes of August 6, 1996 as written, motion carried,5-0. Trustee DiFelice moved, second by Trustee Chevere to approve the General Fund warrant for a total of $240,315.76 and authorize the Treasurer to pay the bills, motion earned 4-0-1 with Trustee Ramsey abstaining. Trustee DiFelice moved, second by Trustee Hayes to approve the warrant of the Capital fund for a total of $67,273.83 and authorize the Treasurer to pay the bills, motion earned 4-0-1 with Trustee Ramsey abstaining. Trustee DiFelice moved, second by Trustee Hayes to approve the Water & Sewer fund for a total $29,512.23 and authorize the Treasurer to pay the bills; motion earned 4-0-1 with Trustee Ramsey abstaining.. Trustee Hayes moved, second by Trustee Ramsey to open the public comment section, carried. Mark Arduino, Clay Tiffany , Costas Boomis, Frank Rey, Jim Galgano and Lydia Michaelides had comments and questions regarding certain resolutions and public hearing items. There being no further comments, Trustee Chevere moved, second by Trustee Ramsey to close the public comment section, carried. On resolution #08-134-96, Trustee Ramsey moved, second by Trustee Chevere to exclude motorized wheelchairs and equipment for the handicapped from being prohibited, motion earned. �l?o The Mayor commented that Trustee Alter could not be here tonight due to , ;the fact that he will be going to the hospital tomorrow for surgery and he wanted the Mayor commented that the Recreation Commission had written a letter with regard.to the proposal of the Ferry Sloop Organization which we will discuss at the next work session. Recycling has increased in the village by 18% since last year. The Mayor commented that he and Chief Brophy have signed off on an application for a Law Enforcement Creditation Program in North Tarrytown which will be administered by Lt. Warren. On Monday August 26th the Seniors will be taking a tour at Kykuit. The Mayor reported that since Lt. Warren has been supervising the 4-12 shift, the quality of life in the village is improving. This is called Operation Zero Tolerance program. Mayor Treacy appointed Gary McLean as Officer at a salary of Provisional Code Enforcement $15,000.00 a year which includes the $1500.00 he receives as Plumbing Inspector, seconded by Trustee Hayes, motion carried 4-2 with Trustee s DiFelice and Sweet voting no. Trustee Sweet read a memo from Chief Brophy commending Police Officers Robert Nevelus, Paul Cappello and Fire Chief Lenny Rutigliano and the members of the Ambulance Corp. for their exceptional performance of duty during a call of a possible suicide. (Placed in their personnel files) In the absence of Trustee Alter, Mayor Treacy reported on the clean-up schedule of our parks by the Recreation Department. He read the attached Public Works report. Trustees DiFelice and Chevere had no report. Trustee Ramsey reported that the Tourism Committee will be meeting this Thursday. �She commented that she has received numerous complaints regarding old signs that are still up on telephone poles throughout the village. The Mayor commented that we do have a sign ordinance and we will have the Building Inspector send a letter to those people whose signs are still up. Trustee Hayes reported that the Library Board will meet on September 19, 1996. The seniors will take a trip to Kykuit next Monday. There has been no fire report for the summer. The Fire Council will resume their meetings in September. Administrator's Report Linda David reported that there will be no meeting of the Planning Board or Architectural Review Board this month. She reported on the Zoning Board agenda for August 21s* at 8 PM. The Westchester County Planning Board brochure had an article in it regarding the Cortlandt Street sidewalk project. She reported that the Department of Transportation will be replacing the grates on the catch basins along Route 9 northward. She received correspondence from the Immaculate Conception Church regarding a possible handicapped ramp in front of the church. The lights in Reverend Sykes Park have been repaired. Communications, Petitions & Requests Deputy Clerk read correspondence from Tarry Inn informing the village of their intent to renew their liquor license. The Mayor responded that paving was very badly needed. Mario Belanich had comments regarding the name change. Lydia Michaelides asked about the paving of the Kendall Avenue extension. The Mayor commented that we will have the General Foreman look at this > .section. •' # Mr. Kavicky asked about the hydrants being painted green. The Mayor commented that reflectors are being placed on the hydrants so that they can be seen. MOVED: T r u s t e e Hayes SECONDED: Trustee DiFelice VOTE: 5-0 '• ,.'.:" -v.-"-.'/ v ; �Meeting Date: 08-20-96 08-138-96 Whereas, the Board of Trustees has determined it is in the best interests of the Village of North Tarrytown to amend the local law entitled "Environmental Protection and Abandoned Industrial Property Reclamation Law" in such a manner that is consistent with the goals and intent of said law; and Whereas, the Board of Trustees has determined that a special condition exemption for any person thereon subject to the provision of this law should be applicable wherein such person has entered into a binding written agreement with the Village which the Mayor and Trustees determine is substantially equivalent to the requests and commitments mandated under said local law; and Whereas, the Mayor and Board of Trustees have determined that the agreement dated August 5, 1996 executed between the Village of North Tarrytown and the General Motors Corporation is substantively equivalent to the requests and commitments mandated by said local law; Now Therefore, Be It Resolved that the Environmental Protection and Abandoned Industrial Property Law is hereby amended as follows: AMENDMENT The North Tarrytown Abandoned Industrial Property Law, chapter 17A of the Village of North Tarrytown Laws, is hereby amended by inserting the following new Section 17A-11. Section 17A-11. Special Condition Exemption. Av Any person otherwise subject to the provisions of this law on account of the permanent closure of an'industnal facility scheduled to occur during the calendar year 1996, and who prior to September 1, 1996 has entered into a binding written agreement with the Village of North Tarrytown which the Mayor and Trustees of the Village of North Tarrytown determine is substantively equivalent to the requirements and commitments mandated under this local law, shall be conditionally exempt from the procedural and substantive requirements hereof. B. For the purposes of subsection (A) hereof, an agreement shall be considered to be "substantially equivalent" to the requirements and commitments mandated under this local law if it: 1. Requires the owner, lessee or operator of the industrial facility to perform a complete environmental site assessment of the industrial facility in accordance with generally established standards and practices followed by competent environmental site assessment professionals;' �\ , 2. Requires the owner, lessee or operator to remediate (clean up) any environmental contamination discovered at, under or emanating from the industrial facility within a reasonable period of time, and to a levelof clean-up that is consistent with applicable or relevant and appropriate federal or state clean-up standards or remediation trigger levels for specific compounds and applicable soil or ground water quality criteria; and 3. Requires the owner, lessee or operator to demolish the industrial structures, fixtures and appurtenances on the site within a period of time that is equal to or less than the longest time period within which such activity would be required under the provisions of this local law. C. Nothing contained in this Amendment or any agreement entered into pursuant to this Amendment shall constitute a waiver of or otherwise limit the powers of the Village of North Tarrytown to take such other reasonable actions as it shall believe necessary or appropriate to protect the public health and welfare against any unremediated or continuing contamination of an industrial facility subject to such an agreement, any failure to demolish such an industrial facility within the time provided in such agreement, or any other condition resulting from the failure of an owner, lessee or operator to comply with its obligations under such agreement. D. This amendment shall take effect immediately. The record should now include a fact-based response to her negative opinion. She voices concern about the cost of the change and says the tax money "could be used to upgrade the quality of life" in North Tarrytown. Well, a study done on the question shows that that figure would be, in total, about $5109. And, according to a recent master plan submitted to the village board, that amount would pay for one new parking space at the south end of the village. The single "quality of life" suggestion in her letter is the chilling invitation for residents at the north end of the village to "move if they don't like the name." Mr. Mayor and Members of the Board, that's not the spirit of the village I've grown up in, served in elective office, and grown to love over the past 52 years. She sees the pennies the change would cost and ignores the real costs involved here: the thousands of dollars (some say tens or hundreds of thousands) in business and tax revenue that North Tarrytown has not seen because we've been hidden for so long in the shadow of our big sister to the south. Let's look at specifics. Changes to village stationery are not required at all. North Tarrytown just uses up current letterhead stock, envelopes and summonses, then reorders with the 2-word change when we run out. Local printers charge a few bucks a thousand for that. Re-doing vehicle markings is also optional. The village board could simply decide to change them, for example, when it's time to replace an ambulance or a police car. Or, the board could go for the $100 or so to re-do a door on this or that vehicle. Any way you look at it, gontlemon, we're not talking thousands here. The New York State Vehicle and Traffic Law, as summarized in our driver's manuals, requires license holders to notify Albany of a change in residence. No one would be changing residence if the village simple changed its name. And, we have it in writing from the Department of State in Albany that "the inhabitants would not have to obtain new driver's licenses if the village changed its name." Furthermore, no one would have to spend a penny to amend a deed, lease or incorporation document because that's not required by law, either. Lastly, residents twice this lady's age favor the change, and not because they're "old-timers". Age and address are worse than red herrings in this �\ r) \ ' discussion. Said amendment calls for the exemption of any person otherwise subject to the provisions of said law on account of the permanent closure of an industrial facility scheduled to occur during the calendar year 199 6 and who prior to September 1, 1996 has entered into a binding written agreement with the Village of North Tarrytown which the Mayor and Trustees of the Village determine is substantively equivalent to the requirements and commitments mandated under the law. An agreement shall be considered to be "substantially equivalent" to the requirements and commitments mandated under the law if it (1) requires the owner or operator of the industrial facility to perform a complete environmental site assessment of the industrial facility in accordance with generally established standards and practice followed by competent environmental site assessment professionals; (2) requires the owner or operator to remediate any environmental contamination discovered at, under or emanating from the industrial facility within a reasonable period of time, and to a level of clean-up that is consistent with applicable or relevant and appropriate federal or state clean-up standards or remediation trigger levels for specific compounds and applicable soil or ground water quality criteria; and (3) requires the owner or operator to demolish the industrial structures, fixtures and appurtenances on the site within a period of time that is equal to or less than the longest time period within which such activity would be required under the provision of the law. A copy of said amendment to the local law is available in the office of the Village Clerk, together with a full environmental Assessment Form and Negative Declaration Amendment to Chapter 17A.
