Present: Mayor Sean Treacy Richard C. Sweet Morris Alter Mario DiFelice Jose Chevere Patricia Ramsey John T. Hayes, Jr. Also Present. Trustees Linda E. David, Village Administrator Janet Gandolfo, Village Attorney Executive Session- 7 PM Discussion ensued on a personnel and litigation matter but no formal action was taken. Public Hearings Mayor Treacy commented that this is a continuation of the public hearing regarding amendments to the Tree Conservation ordinance. Trustee Sweet moved, second by Trustee Alter to reopen the hearing, carried. Mario Belanich asked for an explanation of the changes. Trustee Sweet commented that they are quite extensive and had been explained at the previous hearings. He gave a brief explanation. There being no further comments, Trustee Alter moved, second by Trustee Ramsey to close the public hearing, carried. Mayor Treacy read the attached public hearing notice regarding rooming/boarding houses. He read portions of the Legislative intent chapter 34. Trustee Alter moved, second by Trustee Hayes to open the public hearing, carried. Mayor Treacy read letter from Second Assistant Fire Chief Lenny Vogt asking that the Board hold over the public hearing until October because they need more time to review the code. Brief discussion ensued. Trustee DiFelice moved to continue this hearing on October 15th until we meet with the Fire Chiefs, second by Trustee Chevere, carried. i �Mayor Treacy read the attached public hearing notice regarding amending Chapter 57 "Vehicle and Traffic" and gave a brief explanation for this hearing. Trustee Sweet moved, second by Trustee Chevere to open the public hearing, carried. There were no comments from the public,. Trustee Ramsey moved, second by Trustee Alter to close the hearing, carried. Mayor Treacy read the attached public hearing notice regarding the adoption of the Local Waterfront Revitalization Project. Trustee Sweet moved, second by Trustee Alter to open the public hearing, carried. Jim Galgano had a few questions on the background of the LWRP. Trustee Sweet gave a brief explanation and how it came about and all the work that the Conservation Advisory Council did on drafting it. Mayor Treacy gave a brief overview of the highlights of the completed LWRP. Village Attorney commented that written comments will be accepted until October 3rd. There being no further comments, Trustee Ramsey moved, second by Trustee Sweet to close the public hearing, carried. Mayor Treacy thanked all those who worked so hard on the LWRP. Trustee Ramsey wanted to especially thank Trustee Sweet for all his hard work on the LWRP. Mayor Treacy read the attached public hearing notice regarding the Draft Generic Environmental Impact Statement. Trustee Sweet moved, second by Trustee Ramsey to open the public hearing, carried. There being no comments from the public, Trustee Chevere moved, second by Trustee Ramsey to close the public hearing, carried. Approval of Minutes Trustee Ramsey moved, second by Trustee Hayes to approve the minutes of September 3, 1996 as written, motion carried 6-0. Approval of Warrants Trustee Alter moved, second by Trustee Sweet to approve the warrants of the General fund and authorize the Treasurer to pay the bills for a total of $1,347,457.45, which includes $1,250,000. in CDs, motion carried 6-0; Trustee Ramsey moved, second by Trustee Alter to approve the warrants of the Water & Sewer fund and authorize the Treasurer to pay the bills for a total of $15,936.73 , motion carried 6-0; Trustee Ramsey moved, second by Trustee Alter to approve the Capital fund warrants for a total of $46,790.00, motion carried 6-0. �% * $ Public Comments-Agenda Items Trustee Hayes moved, second by Trustee Ramsey to open the public comment section, motion carried. Mario Belanich commented on the resolution regarding the proposed retaining wall in the employees parking lot. There being no further comments, Trustee Alter moved, second by Trustee Hayes to close the public comment section, carried. Resolutions- Attached Old Business- None New Business Trustee Chevere commented that we might consider contacting the NY Rangers to see if they might be interested in using a portion of the General Motors property for their hockey practice. Trustee Ramsey commented that residents have informed her that they are very upset with Continental Cablevision. We will be meeting with Diane Rainey to discuss some of their concerns. Mayor's Report Mayor Treacy reported that the Recreation Commission is very enthusiastic about the proposed new building at Devries field. Bingo will be starting on Saturday evening, November 2 in Central Fire Headquarters and continue every Saturday. The Mayor reported that PBA negotiations were held last week and we settled two grievances. The Mayor read a proclamation to be presented to the School Board designating October 28-November 1, 1996 as School Board Recognition Week in the Village of North Tarrytown. Mayor Treacy commented that Joanne Pritchard has sent him a summary report of the ongoing activities regarding the GM assembly plant. The Mayor reported on the progress of the ADA project. 3 �He commented that North Tarrytown has the second lowest crime rate in the County. Buchanan has the first but they are a small village. Mayor Treacy complimented the Police Department, especially on the 4-12 shift, for the numerous amount of tickets related to the quality of life that were issued in August. Trustee's Reports Trustee Sweet reported that the civil service exam for Police Officer will be held on December 7, 1996. Information is available in Village Hall or the Police Department. Trustee Sweet attended a very informative meeting of the Environmental Management Council meeting on Monday in White Plains . Topic was how land developers are looking for open space. A EMC member from Larchmont presented an article wherein that village passed a law banning gas powered leaf blowers in their village from June 15-September 15. Trustee Alter reported on the recreational activities such as baseball, softball and after school activities. Trustee Alter reported on the October activities regarding Halloween events. The Recreation Commission will be meeting on September 25th at 7 PM. Trustee Alter read the attached public works report. Trustee DiFelice commented on a letter received from Mrs. Vydarney regarding eliminating the no right on red in certain areas of the village, especially Washington Street and Beekman Avenue. Will discuss at the next work session. Trustee Chevere had no report. Trustee Ramsey commented that she and Trustees Sweet and DiFelice attended the opening of the GM Training Center. The Tourism Committee will be meeting on September 19th at 7 PM in Village Hall. Trustee Ramsey gave an update on certain events. Trustee Ramsey commented that she met with Tarrytown's Village Administrator about tourism plans and events for October. She commented that the GM parking lot will be available for parking for those attending any Halloween events. 4 �Trustee Hayes commented that the Library Board will meet on September 19' . The annual book fair will be held on October 12,h and 13,h. Trustee Hayes reported that North Tarrytown has won the AAA Pedestrian Safety Award for ten years without a pedestrian accident. He attended the Senior Coalition luncheon at the Van Tassel. Trustee Hayes read the attached fire department correspondence. Mayor Treaty moved, second by Trustee Ramsey to accept the Fire Council appointments, carried. He gave a brief summary of the Chief Engineer's Fire report for the months of June, July and August. Administrator's Report Linda David gave an update on the Cortlandt Street project. She read the Zoning Board and the Architectural Review Board agendas for September, there is no Planning Board meeting in September. Linda David commented that the NYS Department of Transportation's work along Route 9 of repairing storm water catch basins is almost completed. Communications, Petitions & Requests Mayor Treacy read Mrs. Vydarney's letter regarding the right turn on red. Will discuss at the next work session. Deputy Clerk read correspondence from Bettman and Bettman informing the village that Maria Brea is applying for a liquor license at the premises formerly known as Courtney's Pub. Referred to Police Chief. Public Comments Trustee Hayes moved, second by Trustee Chevere to open the public comment section, carried. Steve Maceyak, owner of property on lower Beekman Avenue, had questions regarding the LWRP and its effect on surrounding properties. Mark Arduino asked about the demolition of the GM property starting in April. He also asked about the opening of the Writers Center and if the Village will have any responsibility if they would default on any financial responsibility. The Mayor replied the opening is on September 28th and the Village has no financial responsibility. 5 �Mario Bclanich commented about store signs in a foreign language, the fire truck at the village garage and Pat Munroc's letter regarding the name change. There being no further comments, Trustee Hayes moved, second by Trustee Alter to close the public comment section, carried. Jim Galgano commented that the Board closed the section before he could speak. Trustee Chcverc moved, second by Trustee Ramsey to reopen the public comment section. carried. Mr. Galgano had comments regarding the old marshland at the GM property. There being no further comments, Trustee Ramsey moved, second by Trustee Alter to close the public comment section, carried. Sewer system rehabilitation program is in progress. The removal of the slates along Beekman Avenue and replacement with cement is ongoing. Lighting on Riverside Drive is being upgraded. The rest of Riverside Drive will be repaved shortly. Devries Avenue is scheduled for repaving, also. New hydrants and new water main valves should be installed next week on Route 9. Linda David, This is in reference to the painting of the Fire Hydrants. We would like to recommend for the fire hydrants to be painted in accordance with the NFPA 291. Recommended practice for fire flow testing and marking of hydrants. Color coding or other means of marking fire hydrants can be of immense value to fire departments. The NFPA recommends the following color-coding system: light blue for hydrants with flows of 1500 gpm or greater; green for hydrants with flows between 1000 and 1499 gpm; orange for hydrants with flows between 500 and 999 gpm; and red for hydrants with flows of less than 500 gpm (NFPA 291). All of these flows are at the recommended fire flow residual pressure of 20 psi, and the color code is applied to the caps and bonnets of the hydrants.. A high visibility color, such as NFPA's recommendation of chrome yellow, should be utilized for the remainder of the hydrant. i We would like to thank you in advance for your consideration. We wrote to you about the color coding of the fire hydrants. I Being they were painted green, we the 13 member of the Board of Fire Warden do not want to be responsible for the present color of the Fire Hydrants and want to be exempt from any possible law suites this may cause because of the low visibility. If a mutual aid company should come in to N. Tarrytown to back us up in case of a fire they will not be able to locate the hydrant, which is to dark to notice. We would also like the Maltese cross painted in the roads near the hydrants, so the drivers may notice them from the roadway and have a basic idea where the hydrants are located. We would like to be added into any decision that is being made that would involve us the fire department.
