Trustee Alter made a motion to open the public meeting seconded by Trustee Ramsey. Motion carried. EXECUTIVE SESSION Mayor Treacy stated that there are two executive session matters that need to be discussed regarding litigation and personnel, therefore Mayor Treacy moved that the Board of Trustees go into executive session seconded by Trustee Alter, motion carried. No formal action was taken. PUBLIC HEARING Mayor Treacy read the public hearing notice regarding an exemption from Village taxes within the control of said Board of Trustees for Senior Citizens within certain income guidelines. Trustee Ramsey made a motion to open the Public Hearing, seconded by Trustee DiFelice, motion carried. Mayor Treacy stated that this is an annual exemption set by the State of New York which allows a set income at a certain rate. Trustee Sweet stated that for a point of information the Village picks up the exemption that is provided to the seniors. The Village is not crippled by giving this exemption. Trustee Ramsey stated that the Village is just sharing the burden. There were no comments from the public. Trustee Ramsey made a motion to close the public hearing, seconded by Trustee Alter, motion carried. 1 �Attached resolution # 10-158-96 was then passed. APPROVAL OF WARRANTS Trustee Ramsey moved, seconded by Trustee Alter to approve the warrants of the General Fund and authorize the Treasurer to pay the bills for a total of 69,845.45. Discussion ensued on warrants. Motion carried 5-0. Trustee Alter moved, seconded by Trustee Ramsey to approve the warrant of the Water and Sewer fund and authorize the Treasurer to pay the bills for a total of 45,991.76. Discussion ensued regarding the New York City water bill. Motion carried 5-0. Trustee Ramsey moved, seconded by Trustee Alter to approve the warrant of the Capital Fund and authorize the Treasurer to pay the bills for a total of 48,010.21. i Discussion ensued regarding County Asphalt and Hudson Canyon bills. Motion carried 5-0. Mayor Treacy stated that everyone is extremely concerned and not happy with the Cortlandt Street project, but there is a check list of areas regarding safety concerns and the Mayor hopes they will get to work on it soon. The Village has been keeping a check on the project as well. Mr. Belanich stated that public comments should come before number 12. Trustee Ramsey moved, seconded by Trustee Alter to close the Public comment section, motion carried. i RESOLUTIONS: Attached OLD BUSINESS Trustee Sweet stated that the slates on Beekman Avenue are in the process of being replaced with cement I �Trustee Sweet also stated that there are two dates for voter registration, October 3, 1996 from 1-4 PM and October 12, 1996 from 2-9 PM. Mayor Treacy stated that anyone who cannot make the dates can stop into Village Hall for a voter registration application. NEW BUSINESS Trustee DiFelice asked if volunteers are covered under the Villages insurance. Ms. David stated that under an umbrella plan all volunteers are covered. MAYOR REPORT Mayor Treacy stated that the Village's 11th Annual Street Festival will be held on Saturday, October 5, 1996. The race begins at 9:00 AM.. Also there will be a life saving project at Sleepy Hollow High School called CPR 2000 throughout the day. The goal is to have one person in every household to know CPR. Mayor Treacy has received notice of a proposal from Con Edison which involves seeking support to become a bulk provider to consumers in New York State. It offers a five year freeze on electric rates. Mayor Treacy met with Diane Rainey of Continental Cablevison to discuss fees. Basically, nothing can be done concerning the box.. The Mayor suggested residents look into satellite dishes since they have gone down in price it may be worth it because you can receive more channels. Mayor Treacy met with Herman Keith of the Westchester County Economic Development. He is looking at each of the communities future and suggesting how the County can help Villages. There are lots of good things about North Tarrytown. Also the Mayor met with Lynn Oliva, Larry Salley and Karen Kennedy of the Westchester County Planning Dept. Discussion ensued regarding Cortlandt Street and supporting North Tarrytown to develop and beautify the Village. The facade improvement program will be starting again for property owners on Valley and Cortlandt Street if they wish to participate. There is also another 50/50 program called Property Improvement Program. Mayor Treacy stated that the work at the Writers Center has been completed. They had their grand opening last weekend. The Village has been helping through the process. The ADA Elevator Project is moving along. 3 �TRUSTEES REPORTS Trustee Ramsey stated that the Fire Committee met with the Fire Chiefs and discussed paint and tape on the fire hydrants and repainting of the crosses in front of each fire hydrant, this is a good safety feature. There will be an annual Fire Department reception on October 19, 1996. Trustee Ramsey reported on the upcoming Halloween events for the month of October. This will bring in a lot of tourism. Trustee Ramsey mentioned that there are web site listings in several locations that refer to North Tarrytown. Trustee DiFelice asked the Village Administrator to check on Con Ed's natural gas vehicle. The "ARE YOU Okay" program is on line and working. i Trustee Alter also mentioned that the fall festival is Saturday and the Village expects to have 130 runners. There is a new menu of events which include different bands. Trustee Alter thanked Jamie Pendergast and Salley Dente for their help. On October 12, 1996 a fishing contest will be held for children up to 15 years of age from 1-4 PM at the Pocantico River. Children can register at the park entrance. Public Works Report- Attached Trustee Sweet received reports from the Police Department. Also Trustee Sweet has received information from the Environmental conservation Remedial Action report of Hazardous wastes in 1996. Also the Sleepy Hollow Society will have a table at the fair. The Village would also like to aim for November 7th to adopt the L.W.R.P. ADMINISTRATORS REPORT Ms. David stated that there was no Planning Board meeting scheduled in the month of October. The Zoning Board has three items on the agenda which will be held on October 16, 1996 at 8:00PM. i As per Westchester County the Village has to comply with a sewer mandate program with regards to sewer caps and roof leaders. Discussion ensued regarding setting up a committee concerning sewer mandate. Ms. David also thanked Angela Everett and Christine Zambrano for their help with the Street Festival. 4 i �I COMMUNICATIONS, PETITONS, REQUESTS Mayor Treacy received a thank you letterfromHelen DeMilia, President of the Senior Citizen group with regard to Kykuit tickets. The group enjoyed the trip very much. The Mayor also received a letter from Sherri Lain regarding an unsafe tree infrontof 304 North Washington Street. The Treasurer of the Village is hereby directed to file with the Board of Trustees of the Village of North Tarrytown certificates reporting the date of the Notes, the date the Notes mature, the rate of interest of the Notes, the purchaser of the Notes and a statement to the. effect that the power of the Treasurer of the Village to sell, issue and deliver the Notes is in full force and effect and has not been modified, amended or revoked prior to the delivery of and payment for the Notes, and such other certificates as may be delivered to the purchaser or purchasers of the Notes. Section 7. In the absence of the Treasurer of the Village, the Deputy Treasurer of the Village is hereby authorized to exercise the powers referred to in Section 4 and 6 of this resolution. Section 8. The Village covenants for the benefit of the holders of the obligations authorized herein that it will not make any use of the proceeds of such obligations, any funds reasonably excepted to be used to pay the principal of or interest on such obligations or any other funds of the Village, and will not make any use of the facilities financed with the proceeds of such obligations which would cause the interest on such obligations to become subiect to Federal income taxation under the Internal Revenue Code of 1986, as amended (the • • v.-V/.'/.V-"- • « �"Code") (except for the alternative minimum tax imposed on corporations by section 55 of ihc Code and except for.the environmental tax imposed on corporations by section 59A of the Code) or subject to the Village to any penalties under section 148 of the Code, and that it will not take any action or omit to lake any action with respect to such obligations, the proceeds thereof or any facilities financed thereby if such action or omission would cause the interest on such obligations to become subject to Federal income taxation under the Code (except for the R mative minimum tax imposed on corporations by section 55 of the Code and except for the ironmental tax imposed on corporations by section 59A of the Code) or subject the Village to any penalties under section 148 of the Code. The foregoing covenants shall remain in full force and effect notwithstanding the defeasance of such obligations or any other provision hereof until the date which is sixty (60) days after the final maturity date or earlier prior redemption date thereof. The proceeds of such obligations may be applied to reimburse expenditures or commitments made for such purpose on or after a date which is not more than one year prior to the adoption date of this budget note resolution by the Village. Section 9. For the benefit of the holders and beneficial owners from time to time of the budget notes authorized pursuant to this resolution (the "obligations"), the Village I ees, in accordance with and as an obligated person with respect to die obligations, under Rule 2-12 promulgated by the Securities Exchange Commission pursuant to the Securities Exchange Act of 1934 (the "Rule"), to provide or cause to be provided such financial information and operating data, financial statements and notices, in such manner, as may be required for purposes of die Rule. Devrics Avenue was paved today. 415 tons of blacktop was used. Kendall Avenue Extension will be paved next. The remainder of Riverside Drive will be paved sometime during the week of October 21-25. The removal of the slates along Beekman Avenue and replacement with cement is ongoing. The pruning of trees and the removal of dead trees is ongoing. We are asking that residents start bagging their leaves. The vacuum will not be going out until around the end of October or beginning of November. Seven new light fixtures and poles and all new wiring were installed on Riverside Drive at the train station and around the end of Kelbourne Avenue by the island. A new light fixture has been installed on Maple Street, Palmer Avenue, and Gordon Avenue. Two new light poles were installed on Cortlandt Street. REMINDER!!!!!!! ANYONE WHO HAS AN APPLIANCE THAT CONTAINS FREON MUST PURCHASE A GREEN STICKER FROM VILLAGE HALL FOR $20. IN ORDER FOR THE PUBLIC WORKS DEPARTMENT TO PICK IT UP.
