                  <text>A regular meeting of the Board of Trustees of the Village of North Tarrytown was held on
Tuesday, November 19, 1996 at 8:00 PM in Village Hall, 28 Beekman Avenue, North
Tarrytown, New York.

EXECUTIVE SESSION-7 PM
Discussion ensued on the Local Waterfront Revitalization Program.
Mayor Treacy called the regular meeting to order with a pledge to the flag.
Before starting the regular order of business, Mayor Treacy presented a proclamation to
Peter Conrad proclaiming November 19lh as Peter Conrad Day in the Village of North
Tarrytown honoring him as a war veteran.
Mayor Treacy stated that he would like to deviate a bit from the agenda and bring forth
the LWRP resolutions at this time. He commented that he would like to read a few words
about what this Local Waterfront Revitalization Program signals are read the following:
This Local Waterfront Revitalization Program signals a new step in a positive direction for
North Tarrytown.
After years of planning, we have a well thought out document that addresses the needs of
our community at this important time of change and rebirth for our village. The LWRP
shows a new strong commitment by our village government to accept the challenges of
our future with pro active planning that calls for a sound approach to economic
development.
Our LWRP has a" new vision for our under utilized waterfront. A vision that would
expand our community by making our southwestern Hudson riverfront a vibrant new part
of North Tarrytown both enhancing economic opportunities and improving our natural
and cultural resources.

Recognized land use planning considerations have been used in drafting this LWRP, it
follows a consistent direction allowing multi-uses that improve public access to the
riverfront, new businesses and housing.
This LWRP will result in substantial economic benefits, preserve our environment and
empower our community.
This is a historic event, one that will be remembered in posterity.
Tonight this Board can proudly say that we have insured that our children and families will
live in a community that truly has a great future.
He thanked the many people who worked on the LWRP through the years; Richard
Sweet, Mario DeFelice, Donal Stever, Catherine Wolfe, Alberto DeCarvalho, Walter
Ceconi, James Donovan, Ralph Gunderman, Diane Hegarty, Richard Weiss, Nicholas
Cicchetti, Haig Bohigan, Sean Dugan, George O'Hanlon, Phil Keimig, Edmund Stocklein,
Stephen Kenny, Patricia Tornello and Ron Greene.

Trustee Sweet wanted to thank Jeff Beach of the Department of State for all his time and
effort in helping us to get this Local Waterfront Revitalization Program to itsfinalstage.
Also, he wanted to thank Jeff Beach's boss, Loretta Simon,
who came to our village several years ago to suggest to us that we might want to put this
master plan in place.
Jeff Beach gave a brief report on what this LWRP is going to do for North Tarrytown .
Attached resolutions #11-180-96 and 11-181-96 were unanimously passed.
The Mayor asked if anyone would like to speak on this.
Robert Fedder of Cuddy, Fedder &amp; Worby, lawfirmrepresenting General Motors
commented that they totally support the adoption of the LWRP. He commented that for
the record General Motors would like to express their hope and concern that the local
laws that are proposed to implement the LWRP, will before they are adopted, have the
benefit of further impact statement review, so that matters such as constraints on
development, economic concerns, etc. will be considered before it is implemented.

Jim Galgano asked if the adoption of the LWRP changed the zoning of the waterfront
property. The Mayor responded not until the board has a rezoning hearing in the new
year will zoning be changed.
George Hritz commended the Mayor and Board for adopting the LWRP and thanked Jeff
Beach and Don Stever for all their work on this project..

APPROVAL OF MINUTES
Trustee Sweet moved, second by Trustee Alter to approve the minutes of the Special
meeting of October 29, 1996, motion carried 5-0-1 with Trustee Chevere abstaining.
Trustee DiFelice moved, second by Trustee Sweet to approve the minutes of November
7, 1996 meeting with minor corrections, motion carried 6-0.
APPROVAL OF WARRANTS
Trustee Chevere moved, second by Trustee Alter to approve the warrants of the General
fund for a total of $121,100.29 and authorize the Treasurer to pay the bills, motion
carried 6-0; Trustee Alter moved, second by Trustee DiFelice to approve the warrant of
the Water &amp; Sewer fund for a total of $ 4773.07 and authorize the Treasurer to pay the
bills, motion carried 6-0; Trustee Alter moved, second by Trustee Chevere to approve the
warrants of the Capital fund for a total of $ 96,376.50 and authorize the Treasurer to pay
the bills, motion carried 6-0.

Trustee DiFelice commented that we should look into the possibility of secession from the
Town of Mt. Pleasant. BriarclifTis looking into this and perhaps we could get together
with them. Brief discussion ensued. Discuss at work session.
MAYOR'S REPORT
Mayor Treacy commented that he went on a trip to New Jersey with the Wolfpack
football team and cheerleaders this past weekend and had a great time.
On Sunday he was part of a group that gave a presentation at a symposium called Signs of
Life, Sounds of Action and Reviving our Hudson Riverfront, discussing plans for the
future of our communities
The Environmental Quality Bond Act has passed. We may be able to obtain funds for
correction of the infiltration into the sewer system , parks and environmental restoration
projects.

�TRUSTEE REPORTS
Trustee Hayes reported the Library Board will meet on November 25th. Letters requesting
contributions were mailed out.
The November 13th meeting of the Fire Committee was canceled and has been
rescheduled for January 3rd at 2 PM.
He has not received the October Fire Chiefs report.
Trustee Hayes read the attached Fire Council correspondence. Trustee DiFelice moved,
second by Trustee Chevere to approve their action, carried.
The Senior Coalition will meet on December 10th. At the last meeting Dr. Frazer from
the Office of the Aging spoke and gave out pamphlets regarding Aim flam. Anyone having
problems can call Westchester County Department of Consumer Protection at 285-2155.
Trustee Ramsey commented that she is still waiting for the breakdown on the cost of the
Halloween events before she can give herfinalreport.
Trustee Chevere reported that they met with the owner of 100 College Avenue to discuss
the illegal activities taking place in their lot, such as drugs and the congregation of youths.
Detective Caixiero was also in attendance.There will be another meeting on Wednesday
for further discussion on the situation.
Mayor Treacy commented that at the meeting it was brought up to have College Arms
amend their leases so that if someone is arrested and convicted, they can be evicted from
their apartment.
Trustee DiFelice commented that he attended the Senior Citizens' annual services at Holy
Cross Church this Monday which was followed by lunch.
Trustee Alter reported on upcoming Youth Outing trips for grades 4-12.
He read the attached Public Works report.
The Mayor commented that we will have a resolution on our next agenda to cover the
parking meters for the holidays.
Trustee Sweet read correspondence from Fran and Don Murray addressed to the Police
Chief commending Officer Lombardi for his help recently directing traffic and assisting
people when their daughter's wedding was taking place right after another wedding party
was coming out of St. Teresa's church. (Placed in personnel file)

Trustee Sweet read correspondence from Joe and Lynn Guardino addressed to the Police
Chief commending Officer Pellegrino for all his help when their daughter and boyfriend
were stranded when their car broke down. (Placed in personnel file)
ADMINISTRATOR'S REPORT
Linda David reported on the agenda for the Architectural Review Board meeting to be
held on November 25th at 8 PM. She commented that there is no Planning Board or
Zoning Board meetings for the month of November.
The elevator project is moving along. Trees will be planted on Cortlandt Street this week.
General Motors has informed us that in the next two weeks they will be using drill rigs to
install wells around the perimeter of their property and the marshland for their
environmental study.
Mayor Treacy asked the Administrator to add the challenge grants from the Westchester
County Arts Council to our work session agenda.
COMMUNICATIONS, PETITIONS &amp; REQUESTS
Mayor Treacy read correspondence from the Gramonte/Perez family commending Officer
Cappello and police department for their help when lightning struck their home at 34
Kendall Avenue causing a fire. They thanked the fire department for their quick response
and help during this stressful time. They contributed $100. to the fire department.

Correspondence from John Tucci of 21 Pine Street was received regarding a tree.
Forwarded to Tree Commission.
The Mayor received correspondence from Westchester Jewish Conference of Mayors
regarding the wave of anti-Semitic graffiti that has been occurring recently in
Mamaroneck and Rye and efforts to pass legislation to make bias related graffiti a felony.
PUBLIC COMMENTS
Trustee Ramsey moved, second by Trustee Sweet to open the public comment section,
carried.
Martin Kavicky of Kendall Avenue asked that the "Do Not Enter" sign be replaced now
that paving is done, also to fill in the corners with more blacktop.
Mayor Treacy read a letter from John Edwards asking that the Board consider having our
zip code (10593) reinstated no matter what the outcome of the election is in December.
Will discuss at work session in January.
Jim Tierney asked about the cost of the special election.

�Jim Galgano asked about the Ferry Sloop agreement.
Marc Arduino asked about the fee schedule for the ferry sloop.
Vic Albanese asked whether the Ferry Sloop was a profit organization, Mayor responded
it is not for profit.
Chris Skelly commented that the passage of the LWRP was a great accomplishment for
the village.
Mario Bclanich objected to the four minute time limit.
Don Caetano asked the Mayor to explain the reason for the four minute time limit.

Henry Steiner and Pat Munroe commented that they would like to invite the opponents
the name change to a debate. Discussion ensued on whether or not the opponents would
be interested.
A resident in the audience complimented the Mayor and the Board on passage of the
LWRP.
Jim Tierney was not in favor of the name change.
There being no further comments, Trustee Sweet moved, second by Trustee DiFelice to
close the public comment section, carried.

adjourn the meeting, carried.

STATE ENVIRONMENTAL QUALITY REVIEW
FINDINGS STATEMENT
Pursuant to Article 8 (State Environmental Quality Review Act - SEQRA of
t h e Environmental Conservation and 6 NYCRR Park 6 1 7 , the North Tarrytown
Village Board of Trustees as lead agency, makes the following findings:
N a m e of Action:
Adoption of a Local Waterfront Revitalization Program (LWRP) pursuant to
the NYS Waterfront Revitalization of Coastal Areas and Inland Waterways Act
(Article 4 2 of the NYS Executive Law); adoption of RF-Riverfront Development
Zoning District, adoption of the R-4A One and Two-Family and Neighborhood
Commercial Zoning District; adoption of a local law amending the Village's
existing Architectural Review law by adding provisions for review and
protection of historic structures on the State and National Registers of
Historic Places; adoption of amendments to the Village's Zoning Regulations to
give the Village Planning Board authority for issuance of Special Use Permits;
various other related amendments to the Village's Zoning Regulations; and
adoption of the Village of North Tarrytown Local Waterfront Revitalization
Program Consistency Review Law.
Description of Action:
The North Tarrytown Village Board of Trustees and Mayor intend to adopt a
Local Waterfront Revitalization Program (LWRP) for the entire area within the
Village of North T a r r y t o w n . The Draft LWRP has been prepared under
guidelines established by the ^ e w York State Department of State and
includes: (1) policies for use, protection, and development of the waterfront
a r e a and actions and projects proposed to implement the LWRP and achieve
its objectives. Upon subsequent approval by the NYS Secretary of State and
w i t h concurrence by the U.S. Office of Ocean and Coastal Resources
M a n a g e m e n t (OCRM), the adopted LWRP establishes applicable State and
Local policies, proposed land uses and proposed projects for the entire area
within Village.

�The proposed RF-Riverfront Development Zoning District would replace;
existing zoning districts along the Hudson River. The new zoning district would
afford priority to water dependent uses, achieve public access to the
waterfront, control development, provide opportunities for permanent public
views to the Hudson River, would provide standards for development in such a
fashion so as to create a distinct waterfront district which would replicate an
old Hudson River waterfront community image, and would implement the
policies and purposes of the North Tarrytown LWRP.
The proposed R-4A One-and Two-Family and Neighborhood Commercial
Zoning District would replace the current M-Manufacturing Zoning District for
the small area between Beekman Avenue, the Railroad Right-of Way, and east
of Hudson Street. The Zoning District will make the existing uses in this area
of the Village conforming uses and promote their continued existence into the
future.
The proposed amendment of the Village's Architectural Review Law will
add provisions for review and protection of historic structures on the State and
National Registers of Historic Places and will provide for the identification and
designation by the Village Board of Trustees of historic structures and
resources of local significance.
The Village Zoning Regulations will also be amended to give the Village
Planning Board specific authority for the issuance of Special Use Permits for
specific uses in certain zoning districts.
The proposed LWRP Consistency Review Law would establish procedures
for determining the consistency of proposed actions with the North Tarrytown
LWRP, would require a consistency determination for all Type I and unlisted
actions in the Village's Waterfront Area, and provides for prosecution of
violations of these requirements.

Facts and Conclusions in the EIS Relied Upon to Support the Decision:
WHEREAS, the Village of North Tarrytown entered into a voluntary,
cooperative agreement with the State of New York (Department of State) for
the preparation of a Local Waterfront Revitalization Program pursuant to the
provisions of the New York State Waterfront Revitalization of Coastal Areas
and Inland Waterways Act and the U.S. Coastal Zone Management Act, for the
land and waters within the coastal area of the Village of North Tarrytown; and

WHEREAS, the Village of North Tarrytown Conservation Advisory Council and
Environmental Advisory Committee prepared and submitted to the North
Tarrytown Village Board of Trustees a Draft Local Waterfront Revitalization
Program and a Draft Programmatic Environmental Impact Statement; and
WHEREAS, in compliance with the New York State Environmental Conservation
Law, Article 8 and these rules and regulations promulaged thereunder (6
NYCRR 617) hereinafter referred to as "SEQRA" the North Tarrytown Village
Board adopted a Lead Agency Designation and issued a Positive Declaration
and circulated the same to appropriate agencies and interested parties; and
WHEREAS, the North Tarrytown Village Board as lead agency (hereinafter
referred to as "Lead Agency") filed a notice of intent to prepare a Draft
Programmatic Environmental Impact Statement (DPEIS) for the Draft Local
Waterfront Revitalization Program. Such action is considered to be a Type I
Action under SEQRA since it is a comprehensive resource management plan
which proposes (places) policies* to guide future actions affecting the coastal
area of the Village of North Tarrytown and specific actions to implement those
policies, including adoption of a local consistency review law to govern Village
actions in the waterfront area, municipal park improvements, provisions of
additional waterfront related recreational opportunities, and various
infrastructure improvements, rezoning actions, amendments to the Village's
zoning regulations; and
WHEREAS, the North Tarrytown Village as Lead Agency accepted the DPEIS as
complete and Notice of Completion was filed and made to appropriate
agencies and interested parties; and
WHEREAS, three public hearings on the DLWRP and DPEIS were held on
September 19,1995, July 23,1996, and September 17, 1996 by the Village of
North Tarrytown Board of Trustees pursuant to legal notice, providing an
opportunity for the general public to comment on the DLWRP and DPEIS; and

�WHEREAS, the Lead Agency did consider the following items and issues,
among others:
- the inventory and analysis data identified in the DLWRP document;
- The New York State Management Program Policies;
- The current and proposed zoning of the land within-the coastal area of
the Village;
- The current and historic uses of the coastal area and the land adjacent
thereto, and the relationship of such uses to the vitality and future of the
Village;
- The importance and significance for the Village's scenic resources and
important view sheds, historic resources, fish and wildlife habitat
resources, agriculture resources, and the desirable economic, social and
aesthetic benefits produced for the Village by these resources;
- The importance of natural and scenic resources protection for the
continuing vitality of the Village and waterfront environment;
- Initiation of various capital projects and regulatory measures associated
with adoption and implementation of the LWRP, including rezoning
portions of the Village's coastal area;
- The coastal area boundary for the Village; and
WHEREAS, the Lead Agency has identified possible environmental impacts of
LWRP implementing upon local natural, institutional, economic, developmental,
energy and social resources; and
WHEREAS, the Lead Agency prepared a Final Programmatic Environmental
Impact Statement (FPEIS) to fully address any concerns raised throughout the
DPEIS review process;
WHEREAS, the Lead Agency determined the FPEIS to be complete and thereby
filed a Notice of Completion on October 2,1996 and caused the Notice of
Completion and FPEIS to be properly circulated; and
WHEREAS, the Lead Agency held three public hearings on September 19,1995,
July 23,1996 and September 17, 1996 concerning the matter of the Village
Board's intent to adopt a Local Waterfront Revitalization Program (LWRP) and
ail of the related proposed local laws associated with the LWRP, as described
herein; and

WHEREAS, the adoption of the LWRP, in itself, will not result in any immediate
physical changes to any site within the Village; and
WHEREAS, the LWRP is largely a policy document t h a t has no immediate
impact on any site within the Village; and
WHEREAS , the Village of North Tarrytown received responses and/or
comments from the following federal agencies: U.S. Department of Commerce,
Office of Ocean and Coastal Resources Management; U.S. Department of
Interior, Office of Environmental Policy and Compliance; U.S. Department of
Transportation, Federal Highway Administration, Region I: U. S. Department of
Transportation, Federal Transit Administration, Region I I ; the following state
agencies; NYS Office of Alcoholism and Substance Abuse Services; NYS
Department of Correctional Services; NYS Disaster Preparedness Commission;
Dormitory Authority of the S t a t e of N e w York; NYS Education Department;
Empire S t a t e Development Corporation; NYS Department of Environmental
Conservation; NYS Executive Department, Office of General Services; NYS
Department of Health; NYS Division of Housing and Community R e n e w a l ; NYS
Office of Mental Retardation and Developmental Disabilities; NYS Metropolitan
Transportation Authority, Metro-North Railroad; NYS Office of Parks,
Recreation, and Historic Preservation, NYS Office of Parks, Recreation and
Historic Preservation, Taconic Region; NYS Department of Social Services;
NYS'Department of Transportation; NYS Division of Y o u t h ; Hon. Suzi
Oppenheimer, NYS Senate and from the following other agencies and
interested parties: Westchester County Department of Planning; John Cooney;
General Motors Corporation, North American Operations; and General Motors
Corporation, Worldwide Facilities Group, and
WHEREAS, the aforementioned responses and/or c o m m e n t s have been made
available to the public throughout the process for review, inspection and
copying.
NOW, THEREFORE, BE IT RESOLVED, that the Lead Agency finds that the North
T a r r y t o w n Local Waterfront Revitalization Program would have beneficial
impacts on the natural and man-made environment, and social and economic
conditions in the Village of North Tarrytown; and

BE IT FURTHER RESOLVED, that the Lead Agency finds and determines, based
on the entire record of the environmental review process, including all relevant
State and Village Laws and records of Village bodies, as well as all
correspondence received regarding the local coastal management planning
process, that the North Tarrytown Local Waterfront Revitalization Program,
and all of the related proposed local laws associated with the LWRP, are
necessary to:
•

ensure that comprehensive local coastal program and consistent set of
policies is adopted to guide use and development in the coastal area
and to protect the quality of the Villages' coastal environment;

•

ensure the existing character of the Village and the economic vitality of
the Village are maintained and enhanced as appropriate;

•

provide a comprehensive planning vision and sound basis for waterfront
revitalization, development, promotion of certain uses, and protection of
social, economic, natural, and scenic resources;

•

establish the basis to obtain funding for further coastal planning from
Federal, State, and other sources and to assure these Federal, State,
and other resources that the North Tarrytown LWRP is consistent with
State and Federal programs; and

•

guarantee that local residents through local government, will continue
to have control over actions in their community; and

BE IT FURTHER RESOLVED, that the Village Board of the Village of North
Tarrytown, serving as Lead Agency of SEQRA (purposes) proposes*.
determines and decides that the adoption of the Local Waterfront
Revitalization Program, and all of the related proposed local laws associated
with the LWRP, as described herein, will have a significantly beneficial impact
upon the coastal environmental and generally upon the Village of North
Tarrytown and will enhance and protect the health and welfare of the
residents of the Village and thus should be adopted; and

�BE IT FURTHER RESOLVED, that the Lead Agency, having considered the Draft
and Final programmatic EIS, and having considered the preceding written facts
and conclusions rely upon to meet the requirements of 6 NYCRR 617.11,
makes the following certification of findings:

Consistent with the social, economic, and other essential considerations
from among the reasonable alternatives thereto , the action approved is
one which minimizes or avoids adverse environmental effects to the

Consistent with social and economic, and other essential considerations,
to the maximum extent practicable, adverse environmental effects
revealed in the environmental impact statement process will be minimized
or avoided by incorporating as conditions to the decision those mitigating

as implemented by 19 NYCR 600.5, this action will achieve a balance

WHEREAS, in 1988 the Village of North Tarrytown determined that it
would be in the best interests of our community to prepare a Local
Waterfront Revitalization Program; and
WHEREAS, this Board of Trustees, as well as previous Boards, realize
that there exists within the Village of North Tarrytown natural
resources, property and unique historical riches which must be
preserved, protected and developed for our own and future generations
to enjoy and appreciate; and
WHEREAS, we are proud to live in the Hudson Valley and share in the
wonderful benefits the region has to offer, including the magnificence of
the Hudson River; and
WHEREAS, the Village of North Tarrytown established a Memorandum of
Understanding with the New York State Department of State for
preparation of a Local Waterfront Revitalization Program under the
provisions of article 42 of the NYS Executive Law and its implementing
regulations; and
WHEREAS, a Draft Local Waterfront Revitalization Program (DLWRP) and
related local laws and zoning amendments were prepared under the
guidance of the Village's Conservation Advisory Council and
Environmental Advisory Committee; and
WHEREAS, a Draft Programmatic Environmental Impact Statement
(DPEIS) was prepared for the Draft Local Waterfront Revitalization
program in accordance with the requirements of Part 617 of the
implementing regulations for Article 8 of the Environmental
Conservation Law; and
WHEREAS, a DLWRP, including all proposed local laws and zoning
amendments, and the DPEIS were referred to appropriate local, county,
state and federal agencies in accordance with State and Federal
requirements; and
WHEREAS, all meetings of the Village's Conservation Advisory Council
and Environmental Advisory Committee were open to the public, and

Trustees on September 19, 1995, July 23, 1996, and September 17, 1996
to receive and consider comments on the DLWRP, all proposed local
laws and zoning amendments, and the DPSEIS; and

�WHEREAS, a Final Programmatic Environmental Impact Statement
(FPEIS) was prepared, accepted and properly filed and distributed by the
North Tarrytown Village Board of Trustees on October 1,1996; and
WHEREAS, modifications were made to the Draft Local Waterfront
Revitalfzatfon Program as called for In the FPEIS in response to
comments received; and
WHEREAS, all documents pertaining to the Local Waterfront
Revitalization Program have been In the custody of the Village of North
Tarrytown throughout the foregoing process and have* always been
available to members of the public for review, Inspection and copying.
NOW,THEREFORE, BE IT RESOLVED, that the Village of North Tarrytown
Board of Trustees hereby adopts the SEQRA
Findings Statement
attached hereto and directs the Mayor of the Village to execute the
Findings Certification thereon; and

Proposal to Prepare and Implement LWRP-Proposed Zoning Changes

Dear Linda:
As per our discussion, we are pleased to submit this proposal to assist the Village in the
preparation and implementation of new zoning regulations consistent with the
recommendations of the Village's Local Waterfront Revitalization Program (LWRP). The
proposed zoning changes will initiate a turning-point in the Village's development history
which will permit the transformation of its waterfront Manufacturing District into a
appropriate mixture of commercial, residential and recreational uses.
SCOPE OF SERVICES
Preparation of Zoning Amendments
The scope of our zoning work will be limited to revising the zoning text and map
amendments already proposed in Appendices A, D, E and F of the LWRP. More
specifically, these zoning amendments are the following:
Creation of a new RF-Riverfront Development Zoning District.
Creation of a new R-4A One- and Two-Family Residence/Neighborhood
Commercial Zoning District.
Amendments to the Village's Zoning Code to create and/or amend regulations
regarding Special Permit Approval by the Village Planning Board.

Amendments to the Village's Zoning Code to authorize the issuance of demolition
permits.
Amendments to the Definitions section of the Village's Zoning Code to include the
terms "Demolition," "Demolition Permit" and "Building Permit."
The zoning amendments recommended in the LWRP are fairly complete. It is not our
intent to duplicate previous efforts; therefore we do not anticipate substantial revisions to
these other than minor changes to improve organization, to eliminate inconsistencies with
existing provisions in the Village Code, and to clarify or strengthen the proposed language.
Most of our work will focus on the proposed RF-Riverfront Development Zoning District
which is roughly 30 pages long in the LWRP and includes a number of permitted uses,
review procedures and design standards which must be carefully reviewed. The cost
estimate below is, however, based upon the assumption that the zoning districts which we
will write will be closely based upon the recommendations in the LWRP without substantial
divergence.
State Environmental Quality Review (SEQR)
Pursuant to the requirements of SEQR, the Village prepared a Generic Environmental
Impact Statement (GEIS) to assess the potential environmental impacts of the adoption of
the LWRP. The extent of analysis in the GEIS appears sufficient for the adoption of the
LWRP given that the LWRP is largely a policy document that has little immediate impact
on the value of property.
Under the requirements of SEQR, subsequent actions carried out in conformance with the
conditions and thresholds established in a GEIS are not subject to additional SEQR
compliance. If the environmental analysts in the GEIS had been more extensive, the zoning
amendments proposed in the LWRP could have perhaps met that standard. Unfortunately,
however, the 12-page Draft Generic Environmental Impact Statement (DGEIS) is limited
with respect to its analysis of the potential environmental impacts of the proposed zoning
amendments.
It is our recommendation that a more complete environmental analysis be conducted at this
time for the proposed zoning amendments. The potential for litigation is much greater for
the proposed zoning changes than for the adoption of the LWRP, given the financial
implications which the proposed zoning changes could have for the owners of the General
Motors site and other waterfront properties. In order to better withstand potential legal

challenges, we believe that it is imperative that the Village establish a firm foundation of
environmental analysis prior to its adoption of the proposed zoning changes.
We propose to prepare a Supplement to the Final Generic Environmental Impact Statement
(FGEIS). The Supplement will include more comparison o\ the proposed zoning changes
versus the existing zoning and more specifics regarding the potential environmental impacts
of the proposed zoning changes. This analysis was not adequately addressed in the GEIS
and should be performed prior to the adoption of the proposed zoning changes.
We will also prepare a revised Findings Statement which incorporates the analysis «&gt;i the
Supplement to the FGEIS.
Public Hearing
We will also attend the public hearing on the proposed zoning amendments and Supplement
to the FGEIS and will assist the Village Board in whatever way(s) it deems appropriate at
the hearing.
TIMING AND FEE
Timing
We are prepared to begin work on this project immediately upon receipt of your
authorization to proceed. We estimate that we will be able to complete our preparation of
the proposed zoning amendments and Supplement to the FGEIS within approximately 5 to
7 weeks.
Fees
We estimate that our total fees in connection with the scope of services described above will
be approximately $7,500, plus expenses. If, however, the Village believes that the zoning
amendments can be successfully adopted with a reduced level of environmental analysis than
we are proposing, we would of course be happy to modify our cost estimate downward.

This work will be invoiced on the basis of our hourly charges plus expenses; in this manner,
the Village will only be charged for the time and materials which we actually expend. The
hourly charges which we will use will be the same as those for all of our other work in the
Village.

The fee estimate above includes our attendance at a maximum of two meetings or hearings
with the Village. Any work which the Village may ask us to perform which is outside of the
scope of services mentioned above, such as our attendance at additional meetings or the
revision of our originally submitted documents, would be in addition to the fee estimate
above and would also be invoiced on the basis of our hourly charges plus expenses.

Cortlandt Street was paved last Tuesday.
Parking meters have been replaced on Cortlandt Street.
The replacement of the slate with cement along Beekman Avenue has been completed.
Tree work is continuing.
The 50/50 sidewalk program has stopped for this season and will continue next spring.
Leaf season is in full swing. We are picking up leaves everyday when possible.
Halloween flags have been taken down. Christmas lights will be put up in a couple of
weeks.

REMINDER!!! DO NOT PUT BRUSH AND TWIGS IN WITH THE LEAVES. THEY
MUST BE TIED IN BUNDLES BEFORE PLACING AT THE CURB.
IF A TREE IS CUT DOWN ON YOUR PROPERTY, THE COMPANY WHO CUT
THE TREE IS RESPONSIBLE FOR REMOVING IT. THE VILLAGE WILL NOT
PICK UP THESE STUMPS AND BRANCHES.
