Present: Mayor Sean Treacy Morris Alter Mario DiFelice Jose Chevere Patricia Ramsey Trustees Absent: Trustee Richard Sweet Trustee John T. Hayes, Jr. Also Present: Linda E. David, Village Administrator Janet Gandolfo, Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Alter moved, second by Trustee Ramsey to open the meeting. Mayor Treacy read a letter of resignation from Trustee John Hayes. He accepted his resignation with regrets. Mayor Treacy then appointed Donal Stever of 157 Millard Avenue to fill the unexpired term of John Hayes. Mr. Stever was sworn into office by Linda David, Village Administrator/Village Clerk. Public Hearings Mayor Treacy read the attached public hearing notice to consider amending Chapter 57, Section 57-22.1 Snow Zones. He read the attached letter from Allan Williams into the record. Trustee Ramsey moved, second by Trustee Alter to open the public hearing, motion carried. Archie McLarty of Spruce Street commented that he was in favor of the snow ordinance on both sides of the street and people do have driveways to park in when a snow emergency is called. There being no further comments, Trustee Alter moved, second by Trustee DiFelice to close the public hearing, carried. Mayor Treacy commented that he would like more research done before adopting it. 1 �This will be discussed at the next work session. Trustee Ramsey commented that we should check with the Department of Public Works. Mayor Treacy suggested that wc receive comments from Fire Department and Ambulance Corp. Mayor Treacy read the attached public hearing notice regarding a fire zone and gave sonic reasons why this fire zone would be a good idea. Trustee Alter moved, second by Trustee Ramsey to open the hearing, carried. Mr. Foley, a resident of 126 Valley Street, commented that he felt there should be a better way to resolve the problems in the area surrounding College Arms other than erecting a fire zone. Trustee Chcvcre commented that many things were taken into consideration before considering this fire zone. Trustee DiFclicc asked how many parking spaces will be lost. The Mayor responded that there arc ten or eleven visitor parking spaces available. Reverend McCrac of College Arms commented that the parking for the residents is adequate. Fat Munroc commented that surveillance is important and perhaps a camera could be installed in the lot. Mayor Treacy agreed and informed the public that GM is donating cameras and perhaps wc can use them there. There being no further comments, Trustee Chcverc moved, second by Trustee Ramsey to close the hearing, carried. Executive Session Mayor Treacy commented that there are two items that needed to be discussed in executive session before continuing with the meeting. Trustee Alter moved, second by Trustee Ramsey to move into executive session to discuss personnel and litigation, motion carried. Discussion ensued on a personnel matter but no formal action was taken. Discussion ensued on a litigation matter. Trustee Chevere moved, second by Trustee Alter to authorize the Village Attorney to approve payment of up to $10,000.00 in the Bclanich case, motion carried 5-0. Trustee Alter moved, second by Trustee Chcvcre to go back to regular session, carried. �Approval of Minutes Trustee Alter moved, second by Trustee Ramsey to approve the minutes of January 7, 1997. Trustee Ramsey moved, second by Trustee Alter to add a letter written by Richard Gross into the official minutes, motion carried 4-1 with Trustee DiFelice voting no. Approval of Warrants Trustee Alter moved, second by Trustee DiFelice to approve the warrants and authorize the Treasurer to pay the bills in the General fund for a total of $489,260.48, motion carried 5-0; Trustee Ramsey moved, second by Trustee Stevcr to approve the warrants and authorize the Treasurer to pay the bills in the Water and Sewer fund for a total of $20,198.92, motion carried 5-0; Trustee Ramsey moved, second by Trustee Alter to approve the warrant of the Capital fund and authorize the Treasurer to pay the bills for a total of $933.94, motion carried 5-0. Public Comments-Agenda Items Trustee Alter moved, second by Trustee DiFelice to open the public comment section, carried. Frank Rey had comments on the resolution regarding the Assistant Sanitation Foreman position. The Mayor commented that Joe DeFeo is the General Foreman for Public Works which is all departments, therefore we are creating assistant's positions. He also asked about the resolution regarding the budgeted amount for tourism. Trustee Ramsey commented that she received an estimate from the printer for 10,000 copies of the maps and brochures but she had suggested that wc get another 10,000 for only $1000.00 extra . Our village has received so much attention from the media because of the name change and there has been many requests for copies of the maps and brochures. Chick Galella asked why Douglas Park was left out of the list for the grant monies; and why was the route 9 corridor added to the list. The Mayor explained that Douglas Park does not fit into the guidelines that the federal government sets up. Route 9 was rezoned a few years ago and we need to add new sidewalks, curbs, trees, etc. and it is within the areas set by the guidelines. Mr. Kavicky asked about the building that was closed down on route 9 after the fire; the Mayor responded that the owner has exciting plans for that building. Frank Rey recommended that the Board apply for funding for all existing parks and suggested that they hire Jose Quinoy as a police officer with the grant they received. Chick Galella asked about the additional $500.00 for the Writers' Center on resolution #1/10/97. �The Mayor commented that this is for an art program which is being held at the Writers' Center, not for the Writers' Center. Trustee Ramsey commented that the Writers' Center is donating the use of their facility for this program. There being no further comments, Trustee DiFclice moved, second by Trustee Chcvcre to close the public comment section, carried. Resolutions-Attached Old Busincss-None New Business-None Mayor's Report Mayor Trcacy commented that Trustee Sweet is still ill and wished him a speedy recovery. The Mayor reported that we have received the COPS FAST grant award of $75,000.00 for each new officer we recently hired. This will pay for half of their salary for three years. Total of $150,000.00 in grant monies Ferry Sloop has arrived at Sleepy Hollow Landing and he read a letter from them which stated that they signed the lease on January 15th and a dedication ceremony will be held on Sunday, March 9lh at 3:30 PM in the village board room, all arc welcome. The Mayor reported that we will be receiving $72,394.00 in federal monies for the cost of the snow removal last winter, also we will be receiving reimbursement from the state of $30,000.00 to $40,000.00. The LWRP is moving forward. Many meetings have been held towards its adoption for the great future of our community. The Mayor gave a brief overview of some of the proposed uses. The final document should be available for the public to review on Friday. Trustee Reports Trustee Ramsey reported that the Tourism Committee met last Monday. The meeting was very productive. They have started planning for a St. Patrick's Day parade; Hugh Casey has offered his help in organizing this parade. They arc also looking into the possibility of a Columbus Day parade, Memorial Day parade and an Octobcrfcst. �Trustee Alter informed Trustee Ramsey that the village already has a Memorial Day Parade. Henry Steiner has suggested that we contact the County with regard to Kidd's Rock which belongs to our village but can only be accessed through Kingsland Point Park. It has become covered with silt and he would like it to be marked and a sign to be erected for the purposes of identifying it. He would like some of the earth and silt that has accumulated around it dug out. We would like to form a Council on the Arts in order to promote the arts in our village. The Old Dutch Church will be celebrating their 300,h anniversary and the Restoration will be planning some activities for this event. The Mystery at Spook Rock which gets funding from the Council on the Arts will probably take place the last weekend in June or the first weekend in July. Trustee Ramsey commented that we are looking into the possibility of having Art in the Park once again. Trustee Ramsey commented that John Edwards is checking into the costs of a 4th of July celebration for our village. Trustee Chevere thanked the Board for their approval of the fire zone. It will help with some of the problems. Meetings with the tenants will still be taking place to discuss problems and get ideas. The approval of a fire zone is a start. Trustee Chevere commented that in response to the Fire Departments inquiry regarding a sprinkler system at the Rock of Salvation Church, they have contacted an engineer to install a sprinkler system in the church. Trustee DiFclicc commented that every time there is a holiday during the week there is garbage all over. The police do not have any contact numbers for the owners of the properties. He asked that we try to get a computer printout for the police to have available when this occurs. The Mayor commented that he was surprised that the police do not have that type of information system and inquired as to what is done in an emergency. Trustee DiFclice asked if we have received any feedback from the Police Chief regarding the yellow zone at the bottom of VanRipper Avenue and Gordon Avenue. The Administrator commented that we have not, but she will send him a reminder. �He asked if the Board can take any action against the tenants after there is a drug bust at College Arms. The Mayor commented that they have an agreement with the managing agent at College Arms that anytime anyone is convicted of drug use, etc., they will take steps to have them evicted from their apartment. One such individual was evicted already. Trustee DiFcIicc commented that he did a study of village hall and it is in dire need of repairs. Mayor Trcacy commented that we need to start a capital program for improvements. Trustee Alter reported on several recreation activities. TNT baseball applications have been mailed for ages 6 to 15, April ll ( h is kick off night at the McKecl Avenue parking lot, line dancing takes place every Tuesday night at the GM Training Center from 7-8 pm and a ski trip will take place this Saturday. Trustee Alter read the attached public works report. Administrator 1 Report Linda David reported there was a water main break on Amos Street which has been repaired. She read the Architectural Review Board agenda for January 22nd. Communications, Petitions & Requests Deputy Clerk read letter from Richard Maki, Commander of the VFW thanking Joe DeFco for all his work in furnishing the rope and installing it on the flagpole on the roof of their quarters, (placed in personnel file) Mayor Treacy read the Chief Engineers report for December. He read the attached correspondence from the Fire Council. Trustee Alter moved, second by Trustee Ramsey to accept correspondence and approve action taken at the Fire Wardens meeting, carried. Mayor Trcacy read correspondence from Mrs. Pulsoni regarding a large water bill for her property at 178-180 Cortlandt Street. Will discuss at next work session. The Mayor read correspondence from "My Sister's Place" regarding the prevention of violence in the home. We will adopt a resolution at the next meeting in support of this program. �3 S3 I Correspondence from Sleepy Hollow Chamber of Commerce commenting that their new show on cable is off to a very good start and the Chamber is in support of the Public TV Center. The Hudson River Museum will be presenting many programs on Sundays in February, such as concerts, etc.. The Mayor read a letter from Mrs. Scheinwald commenting that she had donated a microwave to the police department but never received a thank you from them. Senator Spano has sent us applications for the Clean Air and Water Bond Ait grant. I The Westchester Business Institute has offered discounts for any local employee who is interested in attending. The Mayor received a letter from the Westchester Arts Council thanking him for all his support on the NYS Council on the Arts which made possible essential funding for Westchester Arts organization of the decentralization program. There will be a breakfast on January 30,h from 8:30AM-10AM. Mayor Treacy read correspondence regarding the name change from a former resident who now lives in Tennessee. Public Comments Trustee DiFelice moved, second by Trustee Alter to open the public comment section, carried. Mario Belanich suggested that the number of board members be changed from seven to five and how to get this on a referendum. Mr. Kavicky commented that the cable rates keep going up and can't we change companies. I The Mayor commented that the federal law requires that we negotiate with them and there is no competition. Lenny Vogt addressed the Mayor commenting that he was upset over an incident that occurred after the last board meeting. Chick Galella asked when the proposed budget would be ready , how long the lease with Ferry Sloop is, if we received an answer from the Attorney General regarding the special referendum on the name change and the hiring of Terry O'Neill for police negotiations. �The Mayor commented that a memo is being sent to department heads for their requests this week; this is the first step; the Ferry Sloop lease is for five years, and that Terry O'Neill has a retainer for $15,000.00 a year which is for all labor related issues; this is less expensive than payment by the hour. Village Attorney commented that she will provide Mr. Galella with a copy of the Attorney General's answer. Frank Rizzi asked if the date of the LWRP public hearing could be changed since that is the same date as the Republican caucus. i Village Attorney commented that it has already been published in the newspaper. Mario Belanich commented that the decals on the trucks should not read 1874. Trustee Ramsey commented that the village was incorporated in 1874 so that date should remain. Village Attorney would check into it. Marc Arduino asked Trustee Stever a few questions regarding the rezoning of the GM property. Trustee Stever gave a brief overview and commented that single use district is not wanted there, mixed use is needed. Jim Galgano asked if any other properties are involved in the rezoning; also if GM was going to be the main developer. The Mayor responded that Hudson Street at the top of the hill and Cooney's property to the Tarrytown line will be involved, also all properties in the "M" zone. • Donal Stever commented that there are many options such as selling pieces for development, we're not sure what GM is going to do. A draft of the riverftont requires draft infrastructure, single type use is not wanted. Mario Belanich commented that we should concentrate on the Duracell property. Chick Galella commented that other trustees should attend GM meetings with the Mayor. I would like to suggest, at this time, a new survey be taken as to what the homeowners on Spruce truly want for their street, not outsiders from other areas in the village. I have spoken to a few of my neighbors who say they did not sign a paper with all the restrictions such as what has already been submitted before the board. Apparently, someone has changed the original petition to further include restrictions upon residents. Petitioners recall only the "15 feet from intersection parking" and the "left side to curb parking restriction," being written out in the original petition proposed to the board. We are very confused as to where all these further restrictions came from. As to the "sweeper restrictions," I, my family of nine children and their children, who frequently visit, will be the most effected of any resident on Spruce. This talk of "alternate side of the street parking for both sides" is unnecessary and will be a burden to every resident here on Spruce. Further, New Broadway and surrounding streets will be asked to carry the burden of parking for Spruce. It could not be the intent of your administration to further congest New Broadway and other streets. In the thirty years I have resided here, I have never observed any street-cleaning problems. Residents of Spruce agree that this is one of the cleaner streets in all of Sleepy Hollow all year round. The end result, regardless of what some might feel, this street does not need a constant manicure. Because of the incline of spruce, rainfall does a very good job in keeping the street well maintained. When leaves do fall, spruce primarily needs attention upon the bottom of the street, where it intersects with New Broadway, as the leaves tend to congregate there due to the utilization of a commercial leaf blower on the part of a New Broadway resident. As to the snow removal, Spruce street has always been properly maintained, after the village plow departs, by my sons and I. We have adequately maintained the width and length of Spruce street for years. I have been told that Spruce is always one of the clearest streets by village employees. We don't mind performing this task because it is in our best interest to make Spruce passable for residents. We realize the older residents of Spruce are somewhat limited when it comes to snow removal, this is what makes our task important and their thanks is reward enough. �In closing, I would ask you and the board to re-examine this matter of restrictions for Spruce. After speaking with some of the residents of Spruce, they agree that the petition before you does not appear to be the original. The fact that the proposal before you contains no date is enough for some of us to question its authenticity. Words and restrictions wore added after the fact by someone to manipulate you and the board. If there is anything else I can do for you and the board please don't hesitate to alert me. Please feel free to read this to all concerned regarding this matter at the next public hearing for Spruce. I extend my sincere thanks for your time and your consideration. Pot holes arc being filled throughout the village. Recycling will take place tomorrow along with Tuesday's regular garbage pickup. Christmas trees will still be picked up when place at the curb on any day'before 7 AM. We helped several residents this past weekend with frozen water lines. We will be cleaning up Sleepy Hollow road of dead brush and trees shortly. This statement of Trustee Chevere contradicts an article which appeared in the September 16,1996 Gannett addition of The Tarrytown Daily News. This article states " A SPRINKLER SYSTEM HAS BEEN INSTALLED AND IS BEING TESTED SO THE BUILDING INSPECTOR JAMES MARGOTTA CAN APPROVE IT." This department on it's routine inspection of NEW or RENOVATED BUILDINGS requiring a Sprinkler System, is unable to locate the Fire Department Siamese Connection for the Sprinklers. We request a response, at this meeting, from Trustee Chevere, who is also a Board member of the Church, as to the correct status of the Sprinkler System. If the Sprinkler System has been installed according to The Daily News Article of September 16,1996, we request a copy of the test results be placed in Chief Rutiglianos Mail Box as of Wednesday January 22nd. Chief Lenny Vogt 2nd Asst Chief fee To.Mayor and Board of Trustees From: Fire Council Date: January 17,1997 Re: Ambulance State Certification Honorable Mayor and Trustees At our regular monthly meeting held on Tuesday January 14,1997, it has been brought to the attention of this Council, by the Captain of the Ambulance Corps., that the NYS Department'of Healths regulations requiring all ambulances to be certified by January 1, 1998 is fast approching. There has been no commitment made by this Board to the ambulance corps Captain or Chief of this department for the purchase of necessary needed life saving equipment.
