A Public Hearing on the Local Waterfront Revitalization Project was held on
Tuesday, January 28, 1997 at 8 PM in village hall at 28 Beekman Avenue, Sleepy
Hollow, New York.

Mayor Treacy read the following into the official minutes:
Tonight is a historic night for Sleepy Hollow. The actions taken by this Board of
Trustees will have beneficial impacts well into the next millennium.
We are taking a major step in changing our village's riverfront front industrial use
of the past to a new traditional neighborhood with new and beautiful riverfront
access for our community.
Our Local Waterfront Revitalization Plan is one of the best of its type in New York
State. It is far reaching and visionary.
When the site is redeveloped, our community will have a new traditional
neighborhood that in many ways will resemble the turn of the century communities
that hugged our beautiful Hudson River.

It will be well-designed, waterfront compatible and will open up new vistas that
have for decades been cut off by the large 132 foot tall manufacturing plant.
Our new local law will insure permanent public view sheds. New activities will
enhance our riverfront and protect sensitive environmental areas.
The new district will substantially reduce impacts of previous uses; height, traffic
and pollution.

�Our new uses with the various controls created in the new LWRP zoning
amendments and the enabling legislation that accompanies the law will ensure that
our community will be enhanced environmentally and also financially.
The creation of the Riverfront Trust Fund will allow our village to improve various
parks, historic places, rehabilitate the old pedestrian bridge connecting Kingsland
Point Park and Dcvrics Field (Horsemen's Trail), landscape improvements, street
scape improvements, possible construction of a museum or similar facility, erosion
controls and improvements to the inner village.
New architectural design standards must be adhered to and the creation of a new
Sleepy Hollow Waterfront Advisory Committee to insure the proper implementation
of the new village's Local Waterfront Rcvitalization Plan.
In short, tonight we are ensuring that our village will have a new and brighter
future. There is life after General Motors.
David Stolman gave a brief overview of what the adoption of this LWRP will mean
for the village and some of the permitted uses.
Slides were shown and Trustee Stcver gave a brief explanation of height restrictions,
etc.
Public Hearing Comments
Trustee Alter moved, second by Trustee Ramsey to open the public hearing, motion
carried. 5-0.
Mayor Trcacy read the attached public hearing notice.
Trustee Stever commented that Trustee Sweet is very ill and could not be here this
evening. He worked very hard towards this adoption and we owe him a debt of
gratitude.
Steve Scrina commented that the creation of the new 4-A district does not have a
provision for commercial zone in this plan.
David Stolman responded that there are provisions in the whole packet for this.
Mr. Kavicky asked that we concentrate on the Duraccll property instead of General
Motors.
Lou Ann Smith of Hudson Street had concerns of the effect the demolition
of General Motors would have on their area and where docs the village stand as far
as waste removal, etc. She felt more meetings should be held.

Mayor Treacy explained that the old law would require 15 years for them to
demolish the plant but now demolition will start in the summer of 1997. We have a
legal binding agreement with GM as far as the clean up and there have been a series
of meetings held. Future meetings will be held to inform them on the demolition.
Trustee Ramsey commented that the current zoning is now manufacturing. The law
being considered tonight changes the designation to riverfront development which
includes residential and commercial. Changing the zoning is added protection for
us. If this new law is not passed, GM could leave more contaminants at the sight
than they would under the new zoning restrictions.
Trustee Stever commented that there were many informational hearings held
previously whereby residents were given the opportunity to speak and ask
questions.
Phyllis Riina of General Motors commented that there are still some concerns with
the documents such as some of the uses, restricted uses, height, etc. General Motors
would like a less restrictive code.
Gary McLean commented that the sooner this project is completed the better for all
concerned; it will help our tax base. Don Caetano and John VVhalen also
commented we should move ahead.
Richard Weiss, member of the CAC, commented that this is a good blueprint for the
village and was supportive of these changes.
Dennis McDaniel of Hudson Street had concerns about the restrictions of one and
two family houses.
The Mayor commented that a survey of that street was done and there were mostly
two family homes, but any three or four family home in existence can remain even
when sold as "grandfathered-non-conforming uses".
Mark Arduino asked about the availability of the document to the public,
and whether there were any demolition fees and recreation fees.
Don Stever commented that the final document must be fine tuned and changes
could even be made tonight.
Janet Gandolfo commented that the working document was available to the public
in November and January . There are demolition fees which the Board can amend
from time to time, but recreation fees continue as they are.
Trustee DiFclice made a motion to hold off adopting these resolutions until the next
meeting. There was no second, motion died.

�Mario Bclanich commented that more input was needed.
Ms. Dickey of Hudson Street had concerns about the demolition of GM
as far as the blasting.
Ms. Riina gave a brief overview of the process involved with the demolition but
commented that no explosives will be used.
Mayor Trcacy commented that we will be meeting with the residents during the
process to discuss their concerns.
John Jadus wanted to know what kind of tax base this new zoning redevelopment
will produce.
The Mayor responded that this redevelopment will produce a very large tax base.
Trustee Ramsey read a portion of the document regarding the net tax gain, whereby
a net tax gain is anticipated.
Frank Rcy felt that the Board should seek out businesses instead of residential and
the document needs more review.
Trustee Ramsey commented that she must leave the meeting and if she should not
be back in time for the vote, she urged her fellow trustees to adopt these zoning
amendments.
Jim Galgano commented that at the last meeting he was told that the properties to
be rczoned would be south to the Tarry town village line but didn't see it listed.
He commented more residents would put an added strain on all departments and
felt there should be more commercial than residential. He wanted to know what
difference between the special use provision and the zoning variance.
The Mayor commented that the entire "M" zone is included in the document.
Trustee Stcver commented that the special use permit is a use that is permitted
subject to certain criteria that the local law sets forth; there are two types of
variances a use variance and an area variance and an applicant must go before the
Zoning Board and gave further explanation .
Vic Albancse wanted to know the businesses on Beckman Avenue have been given
any consideration.
Trustee Stever commented that there are provisions in the riverfront district that
provide incentives in return for providing benefits given by the developer at the
riverfront, some of which will reach up to Bcekman Avenue .

Frank Rey commented that a regional office was created years ago; is the any
continued use by GM.
Ms. Riina stated that the planning process has not started.
There being no further comments, Trustee alter moved, second by Trustee Stever to
close the hearing, carried.

�LEGAL NOTICE
PLEASE TAKE NOTICE that the Village of Sleepy Hollow will hold a public
hearing on Tuesday, January 28, 1997 at Sleepy Hollow Village Hall at 8 P.M. or as soon
thereafter as possible, to hear and consider public comments regarding the following.
1) Supplement to Generic Environmental Impact Statement Regarding Local
Waterfront Revitalization Program (LWRP);
2) Adoption of local law amending the Village Zoning Code to create a new RFRivcrfront Development zoning district. The proposed local law would create a new RFRivei front Development zoning district to be applied to portions of the Village along the
Hudson River including lands associated with the General Motors Assembly Plan and
lands west of Hudson Street. The proposed local law would replace the existing Mmanufacturing and PP-Public Parking Area Districts with the RF District.
3) Adoption of local law amending the Village Zoning Code to create a new R-4A
One-ancl Two-Family Residence/Neighborhood zoning district. The proposed local law
would replace the existing M-manufacturing zoning with a new R-4A District which
would be applied to an area located east of Hudson Street, west of the Metro-North rightof-way, south of Beekman Avenue and north of Sleepy Hollow/Tarrytown Village
boundary.
4) Adoption of local law amending the Village Zoning Code pertaining to the
regulation and authority of the Village Architectural Review Board (ARB). The proposed
amendments will authorize the seven member Architectural Review Board, using their
existing review procedure, to review actions involving historic sites which are listed on or
nominated for inclusion on the State or National Registers of Historic Places. It also
establishes a procedure whereby a newly created "Historic Resource Evaluation
Committee" can recommend to the Village Board of Trustees, the designation of
properties, areas, or structures having special historic, cultural, architectural, or
archaeological value to the Village of Sleepy Hollow, as landmarks, historic sites, or
historic districts of local significance. The historic resource amendments also provide a
review procedure for the ARB to consider applications for demolition permits involving
historic properties, and provide a mandatory waiting period before authorizing the
issuance of a demolition permit in order to allow a party that would save the historic
property to come forward.
5) Adoption of local law amending the Village Zoning Code to define and
authorize the issuance of Demolition Permits. The proposed local law would amend
Section 62-34, Building Permits, of the Village's Zoning code to provide such permit
authority and definitions.
6) Adoption of local law amending the Village Code to create a new Village of
Sleepy Hollow Waterfront Consistency Review Law. The proposed local law establishes
consistency review procedures for Village actions in order to implement the LWRP. this
local law will require of each board, department, office, officer or other body of the
Village of Sleepy Hollow, that its actions to directly undertake or to permit, fund or
otherwise approve any project, use or activity with the Village be consistent to the

maximum extent practicable with the State and local policies set forth in the Village's
LWRP More specifically, the proposed local law would establish procedures for: (1)
Initial review of proposed actions in accordance with the State SEQRA; (2) Advisement
and assistance to applicants (if involved) and/or to the boards, departments, offices,
officers, or other bodies of the Village involved regarding forms, procedures, etc.; and (3)
LWRP consistency and SEQRA review through advisement from a newly created
Waterfront Advisory Committee and the local lead agency, respectively.
7) Adoption of local law amending the Village Zoning Code to authorize the
Village Planning Board to issue Special Use Permits. The proposed local law would
provide authorization to the Village Planning Board to issue special use permits as a part
of the proposed RF-Riverfront Development zoning district. Currently, the Village's
Zoning code only authorizes the Zoning Board of Appeals to issue special permits for "an
off-site parking area or joint use of parking facilities subject to the provisions of Section
62-21 as to the location and design and of Section 62-29 as the site plan review by the
Planning Board . . ." It is not proposed that the current authorization for issuance of a
special permit for off-site parking or joint use parking facilities be changed from that
currently administered by the ZBA.
8) Adoption of a local law amending the Village code to establish a Village of
Sleepy Hollow Waterfront Advisory Committee. The Committee will provide general
oversight for the administration of the Village's LWRP and technical assistance in the form
of advice. Such Committee will function as the Village entity that is primarily responsible,
in an advisory capacity, for implementing the policies, purposes, and projects contained
within the Village's LWRP. The Committee will also function as the Village agency that
makes recommendations for consistency of actions with the Village's LWRP as prescribed
by the Village's Waterfront Consistency Review Law.
All interested parties are invited to attend and be heard at said hearing.
Copies of all proposed local laws, together with supporting documentation are
available for inspection, review and copying at Village Hall, 28 Beekman Avenue, Sleepy
Hollow, NY at the Village Clerk's Office between the hours of 8:30 a.m. and 4:30 p.m.,
Monday-Friday.
Written comments may be submitted to the Village Clerk's Office up to the time of
the hearing
