Present: Mayor Sean Treacy Morris Alter Mario DiFelice Jose Chevere Donald Stever Also Present; Absent: Trustees Linda E. David, Village Administrator Janet Gandolfo, Village Attorney Trustee Richard C. Sweet Trustee Patricia Ramsey Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Alter moved, second by Trustee Chevere to open the meeting, carried. Public Hearine-None Approval of Minutes Trustee Alter moved, second by Trustee Chevere to approve the minutes of January 21, 1997, motion carried 4-0. Approval of Warrants Trustee Alter moved, second by Trustee Chevere to approve the warrants of the General Fund and authorize the Treasurer to pay the bills for a total of $75,842.52 motion carried 4-0; Trustee Alter moved, second by Trustee Chevere to approve the warrants of the Water and Sewer fund and authorize the Treasurer to pay the bills for a total of $20,802.83 motion carried 4-0; Trustee Chevere moved, second by Trustee Alter to approve the warrant of the Capital fund and authorize the Treasurer to pay the bills for a total of $933.94, motion carried 4-0. Public Comments-Agenda Items Trustee Alter moved, second by Trustee Chevere to open the public comment section, carried. Mario Belanich commented on having the public comments earlier in the meeting. Trustee Stever explained why public comments were put at the end. There being no further comments, Trustee DiFelice moved, second by Trustee Chevere to close the public comment section, carried. �Resolutions-Attached Trustee Stcvcr moved, second by Trustee Alter to table resolution #2/24/97 for further discussion at the work session, motion carried 4-0. Old Business- None New Business Mayor Treacy read a letter from the Parade Committee requesting permission to hold a St. Patrick's Day parade on Sunday, March 16,1997 from 11 AM-12 Noon. Trustee Alter asked what the parade would consist of. Hugh Casey commented that it would be small with a few fire departments and a few bands. He asked if they could put banners across the street. Trustee Alter moved, second by Trustee Chcvere to approve this request, motion carried 4-0. Trustee Chevcre moved, second by Trustee Alter to approve request to put banners across the street, motion carried. Mayor Treacy commented that the banners arc not to be put within 200 feet of a school. Mayor* s Report Mayor Treacy commented that since Trustee Hayes had resigned, we need a liaison to the Fire Committee and he appointed Trustee Ramsey as Chair of that committee. He read a letter that GM had sent to all residents in the village regarding the ongoing activities at their plant. Meetings will be scheduled with the residents in that area. Westchester County has a web site on which there is interesting information about County government. The Mayor met with a group called Paddles who have a 200 foot saddle river boat and would like to purchase property in the area for a tourist destination. Mayor Treacy commented that the budget process has begun. Budget proposals are due by March Ist from deparment heads. Mayor Treacy commented that the design work for Sleepy Hollow Landing is commuting and we will be meeting again on Monday. Chris Skelly, President of the Sleepy Hollow Society has written a letter to the Board requesting that the village take steps to have our own zip code. Trustee Stcvcr asked what process needed to be taken. �Mayor Treacy commented that we need a committee to research this. He then appointed Trustees Ramsey, DiFelice, Chcvere to a committee to research this matter. Trustee's Reports Trustee Stever reported that with regard to the asbestos removal from General Motors, the companies hired to do the work will be subject to the regulations by the Environmental Bond Act. Trustee Chevere commented that he has spoken to a few residents with regard to the fire zone at College Arms to try and alleviate their concerns. A positive effort has been made to improve the quality of life in that area. Mayor Treacy commented that the County Department of Planning is scheduled to give us grant approval of $150,000.00 for storefronts in that area. Trustee DiFelice asked if we could send a letter to HUD regarding improvements. The mayor responded that it has already been done. Trustee DiFelice commented that he met with a firm last week regarding the repairs that are needed in village hall. Mayor Treacy commented that we should have local contractors walk through village hall and give us an estimate. (Discuss at work session) Trustee Alter reported that there will be ski trips on February 14th and March V\ a fishing derby will take place on April 12,h at the Pocantico River for ages 4-15. TNT baseball association had over 100 registrants; the next registration day will be held on February 8,h; April 1 l,h kick off will take place at the McKeel Avenue parking lot. After school program at Morse School for grades 1-6 is held Monday through Friday from 2:30PM-5:30PM. Trustee Alter read the attached public works report. Administrator's Report Linda David read the Planning Board agenda to be held on February 20"' at 8 PM and the Architectural Review Board agenda to be held on February 26th at 8 PM, there is no Zoning Board meeting this month. Grievance Day will be held on February 18,h from 4PM-8 PM. The Administrator reported that the Cortlandt Street project is coming to a close, some minor items need to be addressed. �The elevator project is ncaring completion; should be completed by mid to end of February. Linda David attended the Westchester Council of the Arts meeting last week and she attended an election seminar last week. Linda David commented that she met with school officials regarding the construction that will be taking place there this summer. Communications, Petitions & Requests Mayor Trcacy read correspondence from the Sleepy Hollow Chamber of Commerce stating that Cynthia Ferguson is the new president and the Village looks forward to working with her. There will be a Chamber of Commerce breakfast on February 20* . The Mayor received a letter fromn Kent, England regarding our name change. Public Comments Trustee Alter moved, second by Trustee DiFclice to open the public comment section, motion carried. John Edwards thanked the Mayor for forming a committee to research a new zip code. He asked that they consult with Trustee Sweet on the zip code issue and also Philip Zcgarelli. Mr. Kavicky had a complaint about the cable company because channel 26 was not in service for quite awhile. Frank Rey commented that he was not running for Mayor. He commented that there was no representative from our village at the Chamber dinner. He commented about reducing spending and asked about the cost of the parking lot across the street. He wanted to know about the outcome of the hearings on the Police Chief since John Hayes is no longer a trustee. Mayor Trcacy commented that the budget depends on labor negotiations and whether we will need to cut services. He would like a zero tax increase. Over the past four years the average tax increase has been 1.9%. Trustee Alter commented that with regard to the outcome of the hearings, we are waiting for a response and this will be addressed. Trustee DiFclice asked if the vote had to be a majority or unanimous. �"'• ' . :i,W.>{j'i,ftrfJ '>., Janet Gnndolfo replied a majority. Jim Tierney commented that changing the zip code will cost the village more money and that we should have public comments earlier. Clay Tiffany had comments with regard to the letter written by Lenny Vogt about the Mayor. Robert Kearns read attached letter into official minutes. A question was asked by a resident on why the village paved the lot. The Mayor responded that we lease the property and it was in need of repairs; it is an insurance liability. Trustee Stever commented that the lessee of a property is responsible for taking care of that property. There being no further comments, Trustee Alter moved, second by Trustee Chevere to close the public comment section, carried. There being no further business, Trustee DiFelice moved, second by Trustee Chevere to adjourn the meeting, carried. Be it Further Resolved, that the pay for Election Inspectors shall be $130 and an additional $10. 00 for the Chairman. MOVED: Trustee Alter SECONDED: Trustee Stever VOTE: 4-0 �Meeting Date: 02-04-97 Resolution #: 02*24-97 W h e r e a s , it is of substantial benefit to local residents and organizations to have continued use of a local 3-camera fully-equipped operating live c a b l e studio and area-wide cable channel to 4 6 , 0 0 0 residents of the Hudson Valley; and W h e r e a s , the use of a local non-profit cable station is a valuable community a m e n i t y for municipal, educational and resident c o m m u n i c a t i o n . S i n c e these facilities have been made voluntarily available since 1 9 8 3 and t h e facility has been m a d e available since 1 9 8 8 , it should be protected and preserved like park land by the Villages and Town and be grandfathered into our telecommunications future; and W h e r e a s , the cable operator, Continental/US West will stop providing their studio for community use in 1 9 9 7 and, as a result the community will be left w i t h o u t the benefit of a 3 c a m e r a live operating cable station to serve residents, unless the Center continues its operations; and W h e r e a s , the Center w a s the first television organization to initiate voluntary video c o v e r a g e and regular scheduling of your municipal board meetings and local community events since the early 1 9 8 0 ' s ; and W h e r e a s the present "volunteer" access T V station for the the Public Television Center-on-Hudson has demonstrated t r a c k record of providing community television services to T o w n and, is willing to continue these services & facilities c o n t r a c t u a l basis; and Villages and T o w n , since 1 9 8 3 , a worth the Villages and on volunteer & W h e r e a s the Center's studio is a self-supporting non -profit organization and continues to provide the necessary voluntary services to Village and T o w n residents since 1 9 8 8 . In order to maintain operations, the Center needs the ability to transmit your programs. The loss of transmission will result in the Center having to deliver more than 4 3 hours of w e e k l y programs to the cable company. This task would have to be completed e a c h day and w o u l d be u n c o m p e n s a t e d ; and �ni^ Whereas, it is incumbent on the part of the Village and T o w n Boards, to support he voluntary station for resident use, by continuing to offer a local studio for the purpose of broadening community communications through administration, scheduling, resident training & the production of talk s h o w s , d e b a t e s , fraternal, religious, r e c r e a t i o n , public works, educational, environmental and senior programs; and W h e r e a s , the Villages, T o w n , four school Districts, Rotary and Exchange Clubs, Senior Citizens groups, churches, Boy/Girl Scouts, Hispanic A d v a n c e m e n t programs, Family Services of Westchester, Open Door, Phelps Hospital, Tourism C o m m i t t e e s , Marymount College, Pace University the local Medical Groups, four A m b u l a n c e Corps, Fire and Police Departments, Historic Hudson Valley, United Way, AYSO Soccer, TNT Baseball, Dads Clubs, Ken Fisher Baseball, DARE, Recreation Departments, Youth Officers, area School Foundation groups, School boards, Merchants Associations, Chambers of C o m m e r c e , T h e Harbormaster, the Mental Health Association, the Audubon Society, local and s t a t e legislator, Hudson Valley Writers Center, The Democratic and Republican Parties, the Libraries, Westchester Library Systems, Jenny Clarkson H o m e , Abbott House, Local Judges, the Historical Societies, the Air Force National Guard, the NY Guard, Army Reserve Challenge Youth Program, County Y o u t h Bureau and Criminal Justice Department, My Sisters' Place, T h e Arthritis Foundation, American Red Cross, Hitachi Community Services, T h e School Business partnership, BOCES, Blythdale, T h e Junior L e a g u e of W e s t c h e s t e r , the Hudson River Foundation, NAACP, National Resources Defense Council, and the public at large are all recipients of the Centers' volunteer services. It is i n c u m b e n t on the part of local Municipalities to ensure t h e s e local organizations and rare service agencies have the continued ability to use the Center's facilities for the purpose of providing valuable public information to your focal residents. i i THEREFORE HEREBY BE IT RESOLVED, that the Village of Sleepy Hollow designates the Public Television Center on Hudson to administer the Village's public a c c e s s facilities and services for resident benefit, as provided for in Part 5 7 5 of the rules and regulations of the NYSCCT. THEREFORE HEREBY BE IT RESOLVED, that the Village of Sleepy Hollow requests Continental US-West "take a good will action" to preserve its a c c e s s provider - T h e Public Television Center's shared use of the a r e a - w i d e public a c c e s s c h a n n e l for resident benefit and community use. i �3*7 THEREFORE HEREBY BE IT RESOLVED, that the Village of Sleepy Hollow requested Continental US West to make technical resources available to the aforementioned entity for the purposes of transmission, play-back and t e x t generation. THEREFORE HEREBY BE IT RESOLVED that the Village of Sleepy Hollow requires the (entity), the Public Television Center on Hudson to develop and enforce access policies and procedures consistent with federal and state law and regulations. THEREFORE HEREBY BE IT RESOLVED, that the Village of Sleepy Hollow further decides that upon a joint decision with the municipalities of Tarry town, Briarcliff Manor and Mount Pleasant that the Village of Sleepy Hollow has the desire to take up their option of participating in the joint ownership of their designated area-wide public access channel. Monday, February 17th is a legal holiday. Therefore, Monday's garbage will be picked up on Tuesday and Tuesday's garbage will be picked up on Wednesday along with recycling. Please put any leftover Christmas trees at the curb. Next week will be the last week they will be picked up. This Spring and Summer the Department of Public Works will be putting in new fire hydrants and water main distribution valves. A computer has been ordered for the DPW to keep track of the road system, water and sewer system, street lighting and to keep track of trees that were either destroyed by storm damage or decay. We plan on replacing these trees in the future. Any resident who notices a street light that is out, notify the police department and it will be put on a list for us to replace. We are changing the parking meters on Beekman Avenue. AH the dime meters are being eliminated on the Avenue because pennies are being used instead of dimes. These new meters will be 5 cents for 15 minutes and 25 cents for 1 hour. �I February 4,1997 Mayor Sean Treacy and Board of Trustees We the undersigned, request that this statement become part of the offical minutes of this evenings meeting. I At the January 21,1997 Village of Sleepy Hollow Board Meeting, Second Assistant Fire Chief Leonard Vogt Jr. , accused Mayer Sean Treacy of making threatening accusations towards Chief Vogts livelihood. We the undersigned were witness to the event on Tuesday January 7,1997 following the Village Board meeting. The accounts of that evening as> presented by Chief Vogt were true and accuate. WE can attest to every^' threatening comment made by Mayor Treacy and to his vulgarity. You Mr. Mayor categorically denied making any threatening comments, we the undersigned categorically call you a tier, and the residents of Sleepy Hollow should know your true colors. Chief Vogt is a hard working family man who volunteers his time to the residents of Sleepy Hollow. A formal public apology should be made to Chief Vogt by you.
