The regular board meeting was held at 8 PM. Present: Mayor Sean Treacy Morris Alter Mario DiFelice Patricia P. Ramsey Michael Collins Trustees Patrick J. Munroe (Arrived late) Also Present: Linda E. David, Village Administrator Janet Gandolfo, Village Attorney Absent: Trustee Jose Chevere Mayor Treacy called the public hearing to order with a pledge to the flag. Trustee Alter moved, second by Trustee Collins to open the meeting, carried. Mayor Treacy read the attached public hearing notice. Trustee Alter moved, second by Trustee Ramsey to open the public hearing, carried. There were no comments from the public. The Village Attorney commented that on page 3 of 8 under appropriations, budget code A31204284 should read fire arms training equipment. There were no further comments; Trustee Alter moved, second by Trustee Collins to close the public hearing, motion carried. Trustee Collins moved, second by Trustee Alter to adopt the budget is submitted, motion carried unanimously. Budget Resolutions-Attached There being no further business on the budget, Trustee Alter moved, second by Trustee Collins to adjourn this meeting, carried. Executive Session Trustee Alter moved, second by Trustee Collins to go into executive session to discuss litigation and a personnel item, carried. Discussion ensued on the Belanich lawsuit. Discussion ensued on a personnel item in the police department. �Trustee Alter moved, second by Trustee Ramsey to adjourn the executive session until the end of the regular meeting , carried. Regular Meeting Trustee Alter moved, second by Trustee Ra nsey to open the regular portion of the meeting, carried. Mayor Trcacy called the meeting to order v ith a pledge to the flag. Morris Alter was sworn in as re-elected trmtce by Linda David, Village Clerk. Before starting the meeting, Mayor Trcacy read a proclamation for Donald Stever who has served our village numerous times (his past year, proclaiming April 15, 1997 as Donald Stever Day in the Village of Sleepy Hollow. Donald Stever thanked the Mayor for this honor. Mayor Trcacy commented that no votes were taken in executive session. Public Hearings Mayor Treacy read the attached public hearing notice regarding amending Chapter SOB entitled "Taxation" and gave a brief explanation. Trustee Alter moved, second by Trustee Ramsey to open the public hearing, motion carried. There being no comments from the public, Trustee DiFelice moved, second by Trustee Collins, to close the public hearing, carried. Mayor Treacy read the attached public hearing notice regarding amending Chapter 57 of the Vehicle & Traffic code and gave a brief explanation. Trustee Alter moved, second by Trustee Ramsey to open the public hearing, motion carried. There being no comments from the public, Trustee Alter moved, second by Trustee Collins to close the hearing, carried. Approval of Minutes Trustee Alter moved to approve the minutes of March 4,1997 with a minor corrections, second by Trustee Collins and carried 4-0. Trustee Alter moved to approve the minutes of March 19, 1997, second by Trustee Collins and carried 4-0-1 with Trustee Ramsey abstaining. Trustee Alter moved, second by Trustee Ramsey to approve the minutes of March 25, 1997 with several additions, carried 4-0. �Approval of Warrants Trustee Alter moved, second by Trustee Collins to approve the warrants of the General fund for a total of $153,219.06 and authorize the Treasurer to pay the bills; discussion ensued. Trustee Ramsey felt that the expenditure for the jackets for the Ambulance Corp. was inappropriate and should be removed, the money should be spent on equipment instead, motion carried 4-1 with Trustee Ramsey voting no; Trustee Alter moved, second by Trustee Collins to approve the warrants of the Water & Sewer fund for a total of $35,606.60 and authorize the Treasurer to pay the bills, motion carried 5-0; Trustee Alter moved, second by Trustee Collins to approve the warrants of the Capital fund for a total of $17,834.86 and authorize the Treasurer to pay the bills, motion carried 5-0. Public Comments-Agenda Items- None Resolutions-Attached Old Business-None New Business-None Mayor's Report Mayor Treacy reported that the budget was adopted this evening and commented that no members of the public were in attendance. He stated that there will be no increase in the budget for homestead properties and non-homestead will have a 0.72% increase. He then gave an overview of the new budget. The Historic River Towns met to discuss their summer agenda. The trolley will be back this summer. The village will be working on a web site this year so that we can promote our local events and allow our residents access to various Tiles in village hall. Mayor Treacy re-appointed Janet Gandolfo as Village Attorney, second by Trustee Munroe and motion carried 5-0. Mayor Treacy put forth the name of Robert Audio as a re-appointment to the Zoning Board as Chairman; Trustee Munroe moved, second by Trustee Alter to accept this nomination and motion carried 5-0. Trustee Reports Trustee Collins had no report. Trustee Ramsey read the attached Fire Wardens correspondence. Trustee Alter moved, second by Trustee Ramsey to accept their actions, carried. Trustee Ramsey commented that she and a few other trustees attended the Chiefs' swearing in ceremony on April 3rd. �>. The Mayor commented that he was unable to attend due to a family commitment. The Warner Library will be closed on April 29th due to library terminals being shut down in the system and limited service will he available on that day. It will also be closed on May 26,h in observance of Memorial Day. Trustee Ramsey commented that she is declining the position of Chair of the Police Overtime Committee because she needs cooperation to hold the position. She commented that she had volunteered her services pro-bono in the past but now she would need to get paid for her services. Discussion ensued between Mayor Trcacy and Trustee Ramsey with regard to her serving on other committees. Trustee DiFelice had no report. He commented that the Metro-North commuters arc parking at the meters on lower Cortlandt Street and Valley Street and asked that one hour parking signs be posted on the meters. The Mayor commented the police must enforce this one hour parking. Trustee DiFclice made a motion to call for a public hearing to restrict no right turn on Depcystcr and route 9 during school hours only, second by Trustee Ramsey and carried. The Village Attorney commented that we should check the code first so see if there was ever an ordinance for this restriction. Trustee Alter reported that the recreation brochures have been mailed out. He gave a brief overview of some of the activities such as trout fishing derby on April 19th to be held at Douglas Park, sure shot basketball contest will be held on April 26th at 10 AM, ten spaces are left in tot camp registration, etc. He then read the attached public works report. Trustee Ramsey commented that Joe DeFco and his men deserve a special commendation for the great job they did the night of the storm of April 1st. Trustee Munroe reported that a volunteer organization has begun making the Pocantico River a much friendlier place for the trout that we are stocking it with. This clean-up will be continuing during the next couple of months. The potential for the Pocantico River as something to be beautiful and proud of is beginning to become a reality. Administrator's Report Linda David read the agendas for the Zoning Board which will be held on Wednesday, April 16 th , the Planning Board agenda to be held on Thursday, April 17'", and the ARB agenda to be held on April 23rd. On April 17,h at 8 PM the �Warner Library is holding their meeting. The Public Schools of the Tarrytowns is meeting this evening. The New York Public Interest Research group which comes around the village every summer has applied to come back from May l" through August 31s1 and this will be set up with the Police Department. (Discuss at work session) The Chamber of Commerce will meet this Thursday morning at 8:30 AM at Lyndhurst. Linda David commented the work session will be held next Wednesday at 8 PM. Trustee Ramsey reported that the Historical Society will be meeting on Thursday evening at 7 PM at the Restoration. Mayor Treacy reported that there will be a meeting at the Warner Library at 1 PM on April 19<h with regard to the proposed changes to the Emergency Tenants Protection Act. He and Trustee Chevere will be in attendance from our village. Communications, Petitions & Requests Mayor Treacy received communication from Pace University inviting the Mayor to be guest at a conference on Tobacco and Public Health , Social Policy and Legal Issues which will be held on April 18,h and April 19th. The Mayor received communication from Andrew O'Rourke regarding a series of meetings that were to be held April 8lh, 9lh and 15th for the public to share their views and ideas regarding Department of Parks and Recreation and Conservation's work for the past year to establish a master plan to serve as a guide for the preservation, management and development of almost 16,000 acres of parkland administered by Westchester County. He received a letter from Ken Gentile, Executive Director of Margotta Courts that there was an article in the Tarry town Daily News regarding the HUD rating for various housing authorities in the Westchester area. The North Tarrytown Housing Authority has received a high performance rating. This building is a credit to our village. Andrew O'Rourke sent a letter of congratulations to the Mayor and commented that he is looking forward to working with him. Public Comments Jim Tierney commented that he is glad that the Board is trying to keep the ETPA in effect. There being no further comments, Trustee Collins moved, second by Trustee Alter to go back into executive session to continue discussion on a personnel item. �Executive Session Discussion ensued on a personnel item in the police department. The following resolutions were then passed with regard to a memo to be given to the Police Chief: The Board of Police Commissioners hereby delegates authorization to the Village Administrator to provide you with written directives concerning situations relating to your job functions. You are to follow any written directive of the Village Administrator. If you disagree with any of her directives, you arc to follow them nevertheless, unless they affect your safety or violate any law. Failure on your part to follow any directive may result in the consideration of disciplinary charges for insubordination. MOVED: Trustee Collins SECOND: Trustee Munroc VOTE: 5M) i The Board of Trustees does hereby direct the Police Chief to report to Dr. Lawrence Panitz for a full and complete physical. MOVED: Trustee Alter SECOND: Trustee Munroe VOTE: M) The Board of Trustees unanimously agreed that issues confronting the Village with General Motors are very serious and it is important for the Board to remain united in its approach to these issues. Last week General Motors contacted several trustees to meet with them separately. It was also discussed that a quorum of the Board could not be in attendance at any meetings unless public notice was given. The Mayor stated that he would be having meetings and would invite at least two trustees to these meetings. It was agreed that trustees would not hold separate meetings with General Motors without the Mayor under any conditions. Trustee Collins made the motion, seconded by Trustee Alter and carried unanimously. There being no further business, Trustee Alter moved, second by Trustee DiFelice to adjourn the meeting, carried.
