Present: Mayor Sean Treaty Mario DiFelicc Michael Collins Patricia Ramsey Jose Chevere Morris Alter Patrick J. Munroe Also Present: Trustees Linda £. David, Village Administrator Janet Gandolfo, Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Trustee Munroe moved, second by Trustee Ramsey to open the meeting, motion carried. Mayor Treacy reported that discussion ensued during Executive Session on a litigation matter but no votes were taken. Public Hearing Mayor Treacy read the attached Public Hearing notice with regard to senior citizen tax exemption and explained that this will only affect us by less than $20,000. Trustee Alter moved, second by Trustee Ramsey to open the public hearing, motion carried. Chick Galella asked what the deadline for filing was. The Mayor responded, December 31,1997. There being no further comments, Trustee Ramsey moved, second by Trustee Collins to close the hearing, carried. Approval of Minutes Trustee Alter moved, second by Trustee Munroe to approve the minutes of September 23,1997 with minor corrections, motion carried 6-0-1 with Trustee Chevere abstaining. Approval of Warrants Trustee Alter moved, second by Trustee Munroe to approve the warrant of General Fund and authorize the Treasurer to pay the bills for a total of $109,646.74, motion carried 6-0; Trustee Collins moved, second by Trustee Alter to approve the warrant 1 �of the Water and Sewer fund for a total of $56,919.33 and authorize the Treasurer to pay the bills, motion carried 5-0-1 with Trustee Chevere abstaining; Trustee Alter moved, second by Trustee Collins to approve the warrant of the Capital fund for a total of $1900.00 and authorize the Treasurer to pay the bills, motion carried 6-0. Public Comments-Agenda Items Frank Rey commented on the $150,000.00 projected revenue for the water fund from GM since the plant is closed. Resolutions- Attached On resolution #10-119-97 regarding the change in health insurance, Trustee Collins moved, second by Trustee Munroe. Discussion ensued and Trustee DiFelice made a motion to withdraw this resolution. There was no second. Trustee Collins moved, second by Trustee Munroe to adopt this resolution, motion carried 6-1 with Mayor Treacy and Trustees Collins, Munroe, Chevere, Ramsey, and Alter voting yes, and Trustee DiFelice voting no. The Mayor noted that Trustee DiFelice was a recipient of medical insurance as a retired Police Officer. Old Business Trustee DiFelice wanted to know who owns Patriots Park. The Mayor responded Tarrytown does. Trustee DiFelice asked if there was any further information regarding our Post Office becoming a historic site. Discussion ensued among the trustees on this matter. The Administrator commented that she will get information from the Postmaster regarding the status of the renovations. Trustee DiFelice asked when the "No Turn on Red'* sign will be installed at Depeyster Street and Route 9. The Administrator commented that two signs are on order and one is up. He also commented that the walk signal on route 9 and New Broadway does not work. (DOT will be contacted) He also wanted to know when a copy of the court report from the State will be available. Trustee DiFelice made a motion to restore the Chiefs pay while he is on suspension, there was no second to the motion. Trustee DiFelice commented on the article in the newspaper regarding the Chief where his name was mentioned. He wanted to know when the decision to suspend the Chief was reported to the public. �Our Village Attorney advised Trustee DiFelice that this is a personnel matter and he should not discuss this in public. Trustee DiFelice commented that he only discussed it because it was already in the newspaper. New Business-None Mavor* s Report Mayor Treacy reported that GM gave a presentation at the high school on Monday night where they showed three different concepts for the GM site. He gave a brief overview of their concept plans. More informational hearings will be held. The Mayor commented that Universal Studios and the village spent a week drafting a contract and Universal was willing to sign the contract with the village, but there was one property owner near where the movie was to take place who prevented the movie from taking place by not giving his permission for the film crew to go onto his property. The street festival was a huge success. The Mayor commented that there will be a public hearing at the next meeting regarding the proposed increase in the water rates using a revised tier system. Phelps Memorial Hospital is interested in developing a continuing care facility for senior citizens with 200 units. This will be good for the village; the residential portion will be on the tax rolls. Anyone who is interested can call the Kendall Corporation at 1-800-517-8962. Trustee's Reports Trustee Collins reported that the Facade Improvement Program is about ready to begin. We will receive federal dollars through the County. Three businesses have already been approved. This is a 50/50 program between the village and businesses. Trustee Ramsey reported that this is Fire Prevention Week. The Fire Department is having its annual fund drive and have dropped off appeal letters to all residents. Trustee Ramsey reported that there seems to be a concern about the need for expanded fire protection with regard to the development of the GM site. There was no fire report or library report. Trustee Ramsey commented that in an issue of Worth magazine, our village ranks 203rd richest community in the Country based on median single family home sales for the years 1995 and 1996. �Trustee Chevere read the attached public works report. Trustee Chevere reported that October 15-November 15 is Hispanic month and he would like to present a certificate to them. He attended a meeting at Christ Church last week where discussion took place regarding it becoming a historic landmark. He will give a detailed report at the next board meeting. Trustee DiFelice reported that the zip code packet is ready. John Edwards then presented the packet to the board for delivery to the Postmaster once it is completed. Trustee Alter reported that there were approximately 80 vendors at the street festival which was very successful. He thanked Henry Haas and Jim Laird for their help in obtaining and designing the T-shirts. The hayride will take place on October 24* and 25th from 6PM-11PM and will leave from the high school. Trustee Alter reported that the Old Dutch Church will hold a reading of Washington Irving's Legend of Sleepy Hollow on October 24th and 25th at 8:00 PM. Trustee Munroe reported that we have asked the President to pass a resolution designating the Hudson River as an United States American Heritage river. He will draft the resolution. Administrator's Report Linda David reported that the Tarrytown Public Schools will hold their meeting on October 9th at 8 PM. She read the Zoning Board agenda for October 15th, the Planning Board agenda for October 16th and the ARB agenda for October 22wi. There is a meeting with representatives of Con Ed to discuss plans when emergency occurs and a Wetlands Workshop this month which will be attended by two of our staff. Communications. Petitions & Requests Mayor Treacy commented that we have received an invitation to attend a celebration on November 16th at 3PM for the 300th anniversary of the Reformed Church in Tarrytown. �Deputy Clerk read correspondence from the Central Veterans' of the Tarrytown requesting permission to hold their annual memorial service at Patriot's Park on November 11th at 10:30 AM. Trustee Alter moved, second by Trustee Ramsey to approve this request, motion carried. The Mayor received correspondence from John Nolan, Director of Pace University Law & Land Use Center inviting local leaders to attend a training program on land use disputes. The Mayor will attend. Correspondence from David Glickhouse was received regarding the creation of youth basketball. Discuss at work session. The Mayor read correspondence from Media One that customers may experience some outages from October 3-14. Correspondence from Uni Star Federal Credit Union was received thanking the village for supporting them in opening up a credit union for our employees. Mayor Treacy read a letter from Tony Rodrigues commending several members of the Police Department, Lt. Warren, Sgt. Hayward, Detective Corona and Officers Nevelus, Cotarello and Lombardi for their quick response to the recent fire on Beekman Avenue. (Placed in personnel files) We received correspondence from County Executive O'Rourke regarding the annual financial report showing that Westchester County has received a triple A bond rating. Public Comments Jim Tierney wanted to know why the United Nations celebration didn't take place. The Mayor responded that there wasn't enough time to coordinate with everyone involved. It takes a lot of planning to put this altogether and the village worked very hard in trying to bring it all together. Chick Galella commented that there was never a referendum on Patriot's Park and asked who was representing the village in the Brophy case and what is the cost of the PBA arbitration. The Village Attorney commented that we cannot comment on this issue. The Mayor commented that we pay our labor attorney a yearly retainer of $15,000. Maryann Connolly asked if we were paying for our Acting Chief to go to college. �The Mayor commented that their contract states that the village reimburses for the members of the police department for tuition of courses pertaining to criminal justice. She also commented that her garbage has been missed over the past few months and would like to know why. The Mayor stated that we will look into this matter. Frank Rey commented on the water fund transfer in light of the closure of GM, and he wanted to know about the status of the GM parking lot; he may be interested in putting in a bid. Mrs. Michalides asked if the village could contact the Restoration about the parking situation on Howard Street especially when a special event takes place and perhaps when we have a parade, they could change Howard Street to two ways for those few hours. i The Mayor will speak to the Police Chief on these matters. There being no further comments, Trustee DiFelice moved, second by Trustee Alter to close the public comment section, carried. There being no further business, Trustee Collins moved, second by Trustee DiFelice to adjourn the meeting, carried.
