The Chair noted that a quorum was present. Present: Sean McCarthy, Chairman John Korzelius, Fire Department Chief Frank Morabito, Code Enforcement Officer Richard Green Jim Timmings Absent : None Also Present: Anthony DelVecchio (Recording Secretary) Agenda: 1) Sleepy Hollow Cemetery 2) Approval of the minutes from October 3, 2007 Announcements: None. Sean McCarthy started the meeting with a pledge to the flag. He also requested a moment of silence for former Fire Chief, Thomas F. Square. 1) Sleepy Hollow Cemetery This is a continuation from previous meetings. Sean McCarthy stated that this application is requesting an exemption from Village Code section 48b (8) which would requires that a sprinkler system be installed in the mausoleum. Sean McCarthy summarized the options discussed from the last meeting. Kyle McGovern stated that the applicant has evaluated several of the options discussed from the last meeting. He deferred the discussion on the technical details of the proposals to Ed Napoleon. Ed Napoleon stated that he met with Ken Franco (NYSDOT). He stated that NYSDOT will not allow an open road cut on Route 9. He stated that Route 9 would have to be jacked to install the sewer line. He described the jacking process. It involved running a 6” sewer line about 5-feet under Route 9 with a connection pit on Bellwood Avenue. He stated that making a connection into the existing water main on Route 9 would be difficult since it is located under the passing lanes on Route 9. He stated that since NYSDOT will not permit Route 9 to be saw cut, there is �no way to access this water line unless the Village contacts the NYSDOT and requests assistance. Sean McCarthy asked if there is anything in writing from NYSDOT to support these statements. Ed Napoleon responded that some paperwork was provided to their consulting engineer, Charles Manganaro Consulting Engineers. Kyle McGovern asked about the location of the nearest fire hydrant. Richard Green responded that the nearest fire hydrant is located between ½ to ¾ blocks away on Bellwood Avenue. There was an open discussion on the location of the closest water line. Ed Napoleon stated that he can only run one 18” sleeve under Route 9. He stated that since the water line must cross Route 9, it must be placed in the same sleeve as the 6” sewer line. Sean McCarthy responded that since the water line is for a fire hydrant, it can be placed in the same sleeve as the sewer line. Steve Byelick (Sleepy Hollow Cemetery) stated that the Cemetery needs to get this project completed. He stated that the bathroom is added to the project as a customer amenity. He stated that the Cemetery needs to get a Certificate of Occupancy quickly in order to pay for the actual mausoleum construction. Kyle McGovern stated that the mausoleum needs to get this project completed. He stated that the applicant wants to install the proposed dry-type fire suppression system to provide the required fire protection. He stated that the dry-type system will also be supplemented with the proposed stand-pipe so that the Village Fire Department can make a connection into a fire hydrant for additional fire protection. Richard Green asked how much it would cost to bring the water line across Route 9. Ed Napoleon responded that the dry-type system is around $40,000. He stated that bringing the 6” sewer line across Route 9 cost around $130,000. John Korzelius stated that the applicant needs to provide some financial data to support the hardship. Sean McCarthy stated that the applicant needs to properly document the economic hardship to support the request for the waiver. Ed Napoleon stated that the hardship should include the $40,000 for the dry-type system. He stated that the water line would involve about 250-feet of new pipe. He estimated that the water line itself would cost about $10,000. He also stated that the cemetery is looking to postpone the construction of the bathroom until they can generate some revenue by selling some of the crypts. He stated that a Temporary Certificate of Occupancy is needed so the cemetery can sell some of the crypts. He stated that the Cemetery might decide to eliminate the bathroom if it becomes financially prohibitive. He stated that if the building is structurally safe, those crypts can be sold. Kyle McGovern responded that the potential customers want to see the completed building. Sean McCarthy stated that the building needs fire protection based on its construction type and limited occupancy. He stated that the issue is how the fire department will put out a fire in the building. Kyle McGovern responded that there will be a full fire alarm system in the building. He stated that the pumping system will also be installed. He stated that the fire department does not have to enter the building until the pumping system is operational on site. He stated that the cemetery believes that the proposed system will be an adequate plan. Sean McCarthy stated that the applicant is committed to installing the dry-type system and the stand-pipe. Kyle McGovern responded yes. Steve Byelick stated that the mausoleum has three very large doors that could help ventilate the building in case of a fire. Sean McCarthy opened the public hearing. Since nobody from the public was present at the meeting, the Chair closed the public hearing. There was a 10-minute recess so that the Board could discuss the project. The meeting was temporarily adjourned at 7:48pm. The meeting was resumed at 8:01pm. Jim Timmings arrived at the meeting. Sean McCarthy stated that the Board wanted the dry-type system installed with a prime connection located at the building. An additional water line will be run down to a location near the cemetery entrance. The location will be determined by the Village Fire Chief. He stated that the installation of the water line and fire hydrant could be postponed until either the Cemetery sells 500 crypts or the applicant gets the NYSDOT permit for the purpose of installing the sewer line under Route 9. Ed Napoleon asked if the bathroom was temporarily mothballed but not deleted, would that impact the Cemetery’s ability to get a Certificate of Occupancy. He stated that the connection could be provided on Sylvan Road instead. Sean McCarthy asked if the domestic line was installed in the building yet. APPROVED - Fire Prevention Board Meeting, November 29, 2007 3 �Ed Napoleon responded that the line is installed already. He stated that it is a 1” line coming from Sylvan Road. Frank Moribito expressed concerns about the ability of the Fire Department to access the connection on Sylvan Road during a snow storm. Kyle McGovern responded that the cemetery could make plowing Sylvan Road a priority during a snow storm. Frank Moribito made a motion to install a dry-type system with a Siamese connection at the building with an additional hydrant on Sylvan Road with the location to be determined in the field by the Fire Chief. Once the 500th unit is sold, the water line will be installed on Route 9 with a fire hydrant being installed on Route 9. The hydrant will also be required if the sewer line is installed prior to the 500th unit being sold. Sean McCarthy stated that the Board finds that there is a financial hardship present. He stated that the Board can grant a waiver based on these items. Kyle McGovern stated that the Cemetery will give priority to plowing the area on Sylvan Road to keep the fire hydrant area cleared. John Korzelius seconded. The waiver was unanimously granted (5-0). 2) Approval of the minutes from October 3, 2007 The minutes from the October 3, 2007 meeting were reviewed. Jim Timmings made a motion to approve the minutes as amended. Frank Morabito seconded. It was unanimous (5-0). Adjourned 8:16pm.
