Present: Morris Alter, Deputy Mayor Michael Collins Mario DiFelice Patrick J. Munroe Donald W. Stever Trustees Absent: Mayor Sean Treacy Craig A. Laub, Trustee Also Present: Janet Gandolfo, Village Attorney Sanjay Shah, Treasurer Deputy Mayor Alter called the meeting to order with a pledge to the flag. Deputy Mayor Alter introduced the three new police officers: Jose Quinoy, Brent Gamble, and Nancy Fahey. He then presented public service certificates to Floyd Rhein (25 years) and John Johnson (30 years) of the Department of Public Works. Three police officers also received certificates but did not attend the meeting: Lt. Gabriel Hayes, Jr., Sgt. William Booth and Sgt Gordon Ferguson. Next two recently elected volunteerfirefighterswere introduced: Michael Hayes and Michael Tavano. Public Hearings: (1) Wireless Telecommunications Tower and Antenna Ordinance - Representatives from Snyder & Snyder (attorneys) presented their views on the proposed ordinance as it relates to their clients' (Bell Atlantic Mobile and Sprint) needs for sites in the Village. (2) Stop Sign at Amos Street and North Street (Northbound) - no comments (3) Stop Sign at Sleepy Hollow Road and Webber Avenue (Northbound) - Questions were asked about the exact location of the proposed sign. A suggestion was made to put up a Yield sign instead of a Stop sign. The hearing was adjourned and will be continued in September and accident reports will be gathered for the site. Approval of Minutes A motion was made and seconded to approve the minutes of the July 6,1998 meeting. The motion to approve the minutes was carried 5-0. A motion was made and seconded to approve the minutes of the July 20,1998 meeting, with one minor correction. The motion to approve the minutes was carried 4-0-1 (Trustee Collins abstained). 1 �/3V Approval of Warrants It was moved and seconded to approve the warrants of the General Fund for a total of $173,643.00 and authorize the Treasurer to pay the bills, motion carried 5-0. It was moved and seconded to approve the warrants of the Water Department for a total of $45,089.81 and authorize the Treasurer to pay the bills, motion carried 5-0 and to approve the warrants of the Capital Projects Fund for a total of $22,877.17 and authorize the Treasurer to pay the bills, motion carried 5-0. Public Comments: Agenda Items Only A question was asked about Resolution 08-106-98, regarding the reserve fund. Two questions were asked about Resolution 08-109-98, regarding the proposed contract with Larry Cassidy and the resolution which was passed regarding his hiring. Resolutions - Attached Old Business - None New Business - None Mayor's Report- None Trustee Reports Trustee Munroe noted that a recent newspaper article reported that tourism in Westchester County is up 25%. He also pointed out the article in the Half Moon Press for August about the Historic Rivertowns Trolley. Trustee Munroe will be chairing a meeting on Route 9 beautification activities on August 20th. Trustee Munroe and Trustee Collins met with a representative of the NYS Department of Transportation to discuss possible revisions to the intersection of Route 9, Route 448 and New Broadway to provide better pedestrian crossings and better signs to direct traffic. Trustee DiFelice reported that the ZIP Code Committee is working with Rep. Kelly's office to set up a meeting with the Postal Service regarding the denial of the new ZIP Code. In addition, he asked that the Board consider reversing the parking restrictions in the area of Beekman Avenue and Clinton Street to allow parking now that the GM plant is closed. He noted that the GM property was overgrown with weeds. Trustee DiFelice then asked for an update on purchasing a senior van, since he felt that a decision should be made as soon as possible. Deputy Mayor Alter suggested that these items be put on the agenda of the next worksession. Trustee Stever added to the ZIP Code Committee report recognition of the work of John Edwards. Regarding the loading zone request for Alter's Bakery, Trustee Stever stated that this situation pointed out a problem with site plan reviews in the Village in that the Planning Board does not look at the impact of new construction on sites across the street but only at adjacent sites. 2 �\2S Trustee Collins stated that he and the Village Treasurer would be meeting with the Westchester County Department of Planning regarding the Facade Program to discuss the $120,000 in improvements for Phase I and additional money for Phase II. He will be giving the Police Report at the next Board meeting. Communications, Petitions and Requests Deputy Mayor Alter received a notice from the Tarrytown Fire Department regarding the parade scheduled for August 23rd and inviting the Sleepy Hollow Fire Department to participate. Public Comments Trustee Munroe moved and Trustee Collins seconded a motion to open the meeting for public comment. Chick Gallela commented on the practicality of buying a used van instead of a new one for the seniors. He also asked for a clarification of the sweeper bids from the August 10th meeting. Don Caetano made suggestions about signs at Phelps Hospital and Route 9. He also suggested that someone check with GM about donating a van at cost. Ugo Checchi agreed with the suggestion about trying to get a van from GM. Pat Scova, the Town Clerk for the Town of Mount Pleasant, requested that the Village pay the technician who repaired the voting machine after the Village election. Some discussion ensued regarding this issue. Trustee DiFelice moved to pay the bill. Trustee Stever moved to ask the Mayor to call the Town Supervisor to discuss the matter. Neither was seconded. Mario Belanich said he walked by the GM site and it was clear of weeds. He noted that there were trees on Beekman Avenue that needed trimming and that crosswalks had not been painted on the streets where they were faded. Don Caetano asked about Village sanitation trucks picking up garbage at non-profit sites such as Phillipsburg Manor. There being no other business, Trustee Collins moved and Trustee DiFelice seconded to adjourn the meeting, motion carried. MOVED: Trustee Stever SECONDED: Trustee Munroe VOTE: 5-0 �An executive session of the Board of Trustees of the Village of Sleepy Hollow was convened on Monday, August 17,1998 at 8:00 P.M. in Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York. Motion to go into executive session to discuss a personnel matter was made by Trustee Alter, seconded by Trustee Collins and carried unanimously. Laub, Trustee Also Present: Janet Gandolfo, Village Attorney Sanjay Shah, Treasurer The Board of Trustees was presented with copies of sworn Affidavits submitted by three women, two of whom are employees of the Village, regarding inappropriate conduct by Recreation Supervisor Manuel Sanguily (Signed and sworn Affidavits are attached hereto and made part of the official minutes; names have been deleted). After a discussion regarding the contents of the Affidavits and a discussion regarding the interviews of the employees who submitted the Affidavits a motion was made and seconded to terminate the employment of Manuel Sanguily. During the discussion on the motion the issue was raised that the Westchester County Department of Personnel, Civil Service, advised the Village Treasurer that the Village might have to pay the employee for the full twelve week probationary period. The probationary period extends to September 1,1998. The Board directed the Village Treasurer to follow-up with Civil Service and pay whatever salary was due to the employee but the termination date of employment would be immediate. After the discussion, a motion was made by Trustee Stever and seconded by Trustee DiFelice to terminate the employ of Manuel Sanguily immediately and to direct the Village Treasurer to pay whatever monies were due and owing to the employee. Motion carried unanimously. This incident happened on August 13, 1998 around 9:00 am in the Recreation office on the 3rd floor of the Village Hall. I was sitting at my desk with my back to Manuel Sanguily, Recreation Supervisor. He said to me to turn around and see how he was dressed. He said he was going to work in the field today. So I turned around and he stood up from his chair and his sweat pants were cut off and fly was open. Not expecting such a sight, I quickly turned my eyes away and turned back. I heard him say "Oops" and covered up his fly. He also made lewd remarks about a camp girl in the first week of the day camp. He said how well endowed her breasts were. When I told him that it was not funny and that the girl will have back problems when she gets older. He said he would hold her breasts. 1 once told him that some parents were concerned that we were leaving the side door of the gym open. There were lot of 5 and 6 years old boys in the camp. He brushed it off, saying that, "What are they afraid of? That their boys would be fucked in the ass?" There were kids of age between 5 & 6 in the camp. He responded, "We wouldn't want pedophile to come to the gym and dick the children in the ass". If a female parent left the office after signing up for camp, he would remark about their anatomy. He also would say "whore" or "slut" after talking to a female on the phone.
