                  <text>A regular meeting of the Board of Trustees of the Village of Sleepy Hollow was held
on Monday, December 7,1998 at 8 PM in Village Hall, 28 Beekman Avenue, Sleepy
Hollow, New York.

Mayor Treacy called the meeting to order with a pledge to the flag.
Mayor Treacy asked that everyone remain standing for a moment of silence for all
those who died in Pearl Harbor. Trustee DiFelice asked that we remain standing for
one of our seniors, Lucy Tumino who passed away.
Trustee Stever moved, seconded by Trustee Alter to open the meeting, carried.
Public Hearing
Mayor Treacy read the attached public hearing notice and gave a brief explanation.
Trustee Collins moved, seconded by Trustee Alter to open the public hearing,
carried.
There were no comments from the public. Trustee Munroe moved, seconded by
Trustee Alter to adjourn the public hearing, carried.
Approval of Minutes
Trustee Alter moved, seconded by Trustee Munroe to approve the minutes of the
November 16,1998 meeting, carried 6-0.
Approval of Warrants
Trustee Munroe moved, seconded by Trustee Alter to approve the warrant of the
General Fund for a total of $134,099.34 and authorize the treasurer to pay the bills,
motion carried 5-1 with Trustee DiFelice voting no; Trustee Collins moved,
seconded by Trustee Alter to approve the warrant of the Water &amp; Sewer fund for a
total of $41,478.07 and authorize the treasurer to pay the bills, motion carried 6-0;
Trustee Collins moved, seconded by Trustee Alter to approve the warrant of the
Capital fund for a total of $16,615.73 and authorize the treasurer to pay the bills,
motion carried 6-0.

Mayor's Report
Mayor Treacy reported that they have been in touch with DOT regarding changing
their signs to Sleepy Hollow. DOT told us they would eventually get around to it,
but with the help of Hugh Jones, the erection of the new signs should start in May
1999.
We have received our certificate of completion from the Department of Health
regarding corrosion control.
Mayor Treacy reported that the ground breaking ceremony took place today at the
new Sleepy Hollow Landing Park. Representatives of the state and county were
present. A portion of the park will be dedicated to Dr. Richard Sweet who was very
instrumental in getting this park started.
Mayor Treacy read the fourth quarter summary report from General Motors
regarding the demolition which is moving along right on schedule.
Mayor Treacy commented that Westchester County is holding an informational
hearing for seniors on December 9th from 10AM-4PM at the County Center to help
those seniors whose current HMO is dropping them.
Mayor Treacy invited everyone to our December 21st meeting which will be a short
meeting and we will have refreshments.
Trustee Reports
Trustee Collins reported that the Facade Improvement Program has started up
again and the stationary store across from village hall is the first store to be
improved.
Trustee Collins commented that the Sleepy Hollow Society asked him to announce
that on December 10th at 9 PM ,the bells in Sleepy Hollow Cemetery will be rung for
our villages second anniversary and all are invited to attend.
Trustee Laub had no fire report.
Trustee Laub commented that several residents of the manors have complained
about the extremely loud noise that the landscapers make with their leaf blowers
and wanted to know if something could be done about it. (Will be discussed at a
work session)
Trustee Stever reported that there is no Planning Board meeting this month. He
reported on the Architectural Review Board agenda for December 15th and the
Zoning Board agenda for December 16lk.

Trustee DiFelice reported that the Sleepy Hollow Society is helping the Zip Code
Code Committee mail out letters to residents asking them to mail out the enclosed
postcard to Sue Kelly in support of changing the zip code. He also asked that the
Board of Trustees write to Sue Kelly in support of the zip code change.
Trustee DiFelice commented that the seniors asked him when the tax rebate checks
will be mailed.
Mayor Treacy commented that the treasurer is working on it.
Trustee Alter reported on some recreation programs; breakfast with Santa will be
held on December 19th from 9AM-12PM in Columbia Hose fire house and Santa's
mailbox is in village hall and the post office. There will be upcoming programs in
January.
Trustee Alter reminded the seniors that they must file the STAR application again
this year.
Trustee Alter read the attached public works report.
Trustee Munroe thanked the members of the Route 9 Beautification Committee that
worked on the selection of the planters.
Trustee Munroe commented that the Historic Hudson Valley has sent out a flyer
informing people that there is a lot for people to see and do if they come and visit
our area, especially now during the holiday season.
Communications, Petitions, &amp; Requests
Mayor Treacy read a letter to Carl Tomanelli, a court employee, from Bernadette
Engmann thanking him for always being so pleasant as well as helpful. (Placed in
personnel file)
Village Clerk read correspondence from Francisco Mejias of 180 Valley Street
informing the village of they are applying for a liquor license, (copy to Police Chief)
The Mayor read a letter from John Foglia asking if the village could erect a sign on
Sleepy Hollow Road requesting two signs be erected north and south where people
cross on horseback.
Mayor Treacy read letter from Maggie Vincent Gara, Executive Director of
Greenway congratulating the village on the groundbreaking of the new Sleepy
Hollow Landing park.
Public Comments !
Cynthia Ferguson, President of the Chamber of Commerce, addressed the Board
regarding their request for $500. towards the web site.
Mr. Kavicky wants to know if the sign at the Philipse Manor station could be
changed to read Sleepy Hollow.

�The Mayor commented that he has written letters to Metro North regarding this
request.
Trustee DiFelice commented that Metro North has informed them that when they
change the timetable, the sign will be changed.
John Edwards showed the postcard that is being sent to 600 people. He urged
everyone to sign and return these postcards.
He also commented that the village will be celebrating their 125th anniversary next
year and wanted to know if the village will be planning any celebration.
Maryann Connolly asked about the tax rebate and asked that something be done
regarding the noise coming from car radios.
Mario Belanich commented about having local elections in November and reducing
the number of trustees to four.
There being no further business, Trustee DiFelice moved, seconded by Trustee Alter
to close the meeting, carried.

POLICY REGARDING HARASSMENT
IN THE WORKPLACE
FOR

THE VILLAGE OF SLEEPY HOLLOW

A.

PURPOSE
It is the purpose of this policy to do the following:
1.
Establish a policy that all employees have the right to work in an environment free of all
forms of harassment and maintain "zero tolerance" in the workplace for all forms of
harassment, including sexual harassment and retaliation for complaining of harassment;
2.
Provide employees with convenient and reliable mechanisms for reporting incidents of
sexual harassment and other forms of harassment and retaliation, and for participating in
related investigations;
3.
Provide for the posting of the name, work location and telephone number of the
employer representatives~both male and female~to whom employees may make
complaints of harassment and retaliations; ensuring that at least one employer
representative is at the employer's facility whenever it is in operation;
4.
Encourage employees to report incidents promptly either verbally or in writing;
5.
Provide a timetable for reporting harassment, beginning and completing an
investigation, and responding to the complainant;
6.
Inform employees of the potential consequences of failing to take advantage of this
policy's preventative and corrective opportunities;
7.
Inform employees-supervisors and non-supervisors alike-of disciplinary action that
may be taken if they are found to have violated the employer's policy;
8.
Identity all supervisors and make them accountable for compliance with the Village's
harassment and anti-retaliation policy.

PROHIBITED ACTIVITY
1.
No employee shall either explicitly or implicitly, directly or indirectly, verbally or by the
putting of cartoons, caricatures, pictures, poems or stories, ridicule, mock, deride or
belittle any person.
2.
Employees shall not make offensive or derogatory comments based on race, color, sex,
religion, national origin or sexual orientation either directly or indirectly to another
person. Such harassment is a prohibited form of discrimination under state and federal
employment law and is also considered misconduct subject to disciplinary action by this
Village.
3.
Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors,
and other verbal or physical conduct of a sexual nature when:
a)
Submission to such conduct is made either explicitly or implicitly a term or
condition of employment; or
b)
Submission to or rejection of such conduct by an employee is used as the basis
for employment decisions affecting the employee; or
c)
Such conduct has the purpose or effect of unreasonably interfering with an
employee's work performance or creating an intimidating, hostile, or offensive
working environment.
EMPLOYER'S RESPONSIBILITIES
1.
The following is a list of supervisors in the Village of Sleepy Hollow (subject to
wheiher position is filled):

Chief of Police
e)
Department of Public Works Foreman
f)
Recreation Director
g)
Court Clerk
2.
Each supervisor shall be responsible for preventing acts of harassment. This
responsibility includes:
a)
Monitoring the unit work environment on a daily basis for signs that harassment
may be occurring;
b)
Counseling all employees on the types of behavior prohibited and the Village
procedures for reporting and resolving complaints of harassment;
c)
Stopping any observed acts that may be considered harassment and taking
appropriate steps to intervene, whether or not the involved employees are within
his line of supervision; and
d)
Taking immediate action to limit the work contact between two employees
where there has been a complaint of harassment, pending investigation.
3.
Each supervisor has the responsibility to assist any employee of this Village, who comes
to that supervisor with a complaint of harassment, documenting and filing a complaint
with the internal investigations authority.

Each employee of this Village is responsible for assisting in the prevention of
harassment through the following acts:
a)
Refraining from participation in, or encouragement of, actions that could be
perceived as harassment;
b)
Reporting acts of harassment to a supervisor; and
c)
Encouraging any employee who confides that he or she is being harassed to
report these acts to a supervisor.
Failure to take action to stop known harassment shall be grounds for discipline.
Each supervisor shall be trained on harassment prevention and the appropriate manner
in which to respond to a complaint of harassment.
Each supervisor shall distribute a copy of the policy herein to each employee and obtain
a signed receipt for same.
Each supervisor shall explain the policy herein to each employee and ensure that the
employee understands same.
Each supervisor shall redistribute periodically (at least annually) the policy herein and
obtain updated receipts.
Each supervisor shall incorporate the harassment policy into new employee orientation
and maintain records documenting same.

COMPLAINT PROCEDURES
1.
Employees encountering harassment shall tell the person that his/her actions are
unwelcome and offensive.
2.
Employees encountering harassment shall immediately report the unwelcome and
offensive behavior to his/her immediate supervisor so that steps may be taken to protect
the employeefromfurther harassment, and appropriate investigative and disciplinary
measures may be initiated.
3.
In the event it is not practical for the employee to report the incident to his/her
immediate supervisor the employee shall report the incident to any one of the following
persons:
a)
Mayor
b)
Any Trustee
c)
Village Clerk
d)
Village Administrator
e)
Village Treasurer
4.
The employee shall document all incidents of harassment in order to provide the fullest
basis for investigation.
5.
The supervisor or other person to whom the complaint is given shall meet with the
employee and document the incidents complained of within 48 hours of the complaint.
The documentation shall be as complete as possible setting forth the person(s)
performing or participating in the harassment, the date(s) on which it occurred, and the
names of any witnesses to said incident(s).
6.
The person taking the complaint shall expeditiously deliver the complaint to the Village
Administrator.

The Village Administrator shall immediately notify the Mayor and Board of Trustees
and the prosecutor's office if the complaint contains evidence of criminal activity,
including but not necessarily limited to, battery, rape or attempted rape.
The investigation shall include a determination whether other employees are being
harassed by the person(s), and whether other Village employees participated in or
encouraged the harassment.
The Administrator shall inform the parties involved of the outcome of the investigation
as soon as practically possible.
A file of harassment complaints shall be maintained in a secure location at Village Hall
imder the custody of the Village Clerk. The Mayor and Board of Trustees shall be
provided with an annual summary of these complaints.
There shall be no retaliation against any employee for filing a harassment complaint, or
assisting, testifying, or participating in the investigation of such a complaint.
Complainants may file a grievance/appeal by placing their disagreement with the
investigation or disposition in writing and directing it to the Mayor and Board of
Trustees. The Mayor and Board of Trustees shall respond to the grievance/appeal within
three weeks of receipt of same
This policy does not preclude any employee from filing a complaint or grievance with
an appropriate outside agency.
On March 19,1998, a policy regarding "Hostile Work Environment" was distributed to
members of the Police Department. It is intended that members of the Police
Department comply with the conditions of said policy dated March 19,1998, regarding
forms of harassment other than sexual harassment and to comply with the conditions of
the policy herein regarding sexual harassment.

Public Hearing Notice
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Sleepy Hollow
will hold a public hearing on Monday, December 7,1998 at 8:00 PM or soon
thereafter in Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York to hear
and consider comments regarding amending Chapter 57 entitled Vehicle &amp; Traffic
code to designate a No Parking Zone in front of the entrance to the Van Tassel
apartments located on Pocantico Street and to designate a handicapped parking
space directly to the south of said No Parking Zone.
All residents and parties in interest are invited to attend and be heard at said
hearing.
Hearing is accessible to the handicapped.

Leaves are still being picked up throughout the village and will continue until all
leaves are picked up.
New holiday flags have been put up on the lightpoles on Beekman, Valley and
Cortland Street and two Victorian candle wreaths have been put across Beekman
Avenue.
Pot holes are being patched throughout the village as needed.
Tree trimming/removal is ongoing.
Planters have been placed along route 9.
REMINDER!!!!!
FRIDAY, DECEMBER 25 TH IS CHRISTMAS DAY, VILLAGE OFFICES WILL
BE CLOSED. THURSDAY'S GARBAGE WELL BE PICKED UP ON
WEDNESDAY, ALONG WITH RECYCLING AND FRIDAY'S GARBAGE WELL
BE PICKED UP ON THURSDAY. THE SAME SCHEDULE WILL APPLY FOR
THE FOLLOWING WEEK, FRIDAY, JANUARY 1ST WHICH IS NEW YEARS'

COMPLAINT PROCEDURES

Employees encountering harassment shall tell the alleged harasser that his/her actions
are unwelcome and offensive.
2.
Employees encountering harassment shall immediately report the unwelcome and
offensive behavior to his/her immediate supervisor so that steps may be taken to stop
the harassment and to protect the employee from further harassment, and appropriate
investigative and disciplinary measures may be initiated.
3.
In the event it is not practical for the employee to report the incident to his/her
immediate supervisor the employee shall report the incident to any one of the following
persons:
a)
Mayor
b)
Any Trustee
c)
Village Clerk
d)
Village Administrator
e)
Village Treasurer

The employee sliall document, as described in D-5 below, all incidents of harassment in
order to provide the fullest basis for investigation.

The supervisor or other person to whom the complaint is given shall meet with the
complainant and document the incidents complained of within 48 hours of the
complaint. The documentation shall be as complete as possible. It must include:
a)
the name or names of alleged harasser(s);
b)
name or names of possible witnesses;
c)
date(s) of the incident or incidents alleged;
d)
approximate time(s) of the day when the incident(s) occurred; and
e)
description of the exact behavior and/or words that constituted the alleged
harassment.

The person taking the complaint shall expeditiously deliver the complaint to die Village
Administrator.
The Village Administrator shall immediately notify the Mayor and Board of Trustees
and the prosecutor's office if the complaint contains evidence of criminal activity,
including but not necessarily limited to, battery, rape or attempted rape.
The investigation shall include a determination whether other employees are being
harassed by the person(s), and whether other Village employees participated in or
encouraged the harassment.
The Administrator shall inform the parties involved of the outcome of the investigation
as soon as practically possible.
A file of harassment complaints shall be maintained in a secure location at Village Hall
under the custody of the Village Clerk. The Mayor and Board of Trustees shall be
provided with an annual summary of these complaints.
There shall be no retaliation against any employee for filing a harassment complaint, or
assisting, testifying, or participating in the investigation of such a complaint.
Complainants may file a grievance/appeal by placing their disagreement with the
investigation or disposition in writing and directing it to the Mayor and Board of
Trustees. The Mayor and Board of Trustees shall respond to the grievance/appeal within
three weeks of receipt of same
This policy does not preclude any employeefromfiling a complaint or grievance with
an appropriate outside agency.
On March 19,1998, a policy regarding "Hostile Work Environment" was distributed to
members of the Police Department. It is intended that members of the Police
Department comply with the conditions of said policy dated March 19,1998, regarding
forms of harassment other than sexual harassment and to comply with the conditions of
the policy herein regarding sexual harassment.
