Present: Mayor Philip Zegarelli Craig Laub Mario DiFelice Donald Stever James Hart Patricia Rodriguez Robert Higle Trustees Also Present: Sanjay Shah, Village Treasurer Robert Ponzini, Village Attorney Mayor Zegarelli opened the meeting with a prayer. He asked that everyone remain standing for a moment of silence for Robert Powers who passed away last week and for all those who are suffering in mind and spirit as a result of the events in Colorado. The Mayor called the meeting to order with a pledge to the flag. Before starting the regular order of business, Fire Chief Cellante and Elmer Kenyon, President of Pocantico Hook and Ladder presented Chick Galella a certificate for fifty years of service to the fire department. Chick Galella thanked them and urged people to join the Fire Department and Ambulance Corp. Public Hearings-None Approval of Minutes Trustee DiFelice moved, seconded by Trustee Hart to approve the minutes of April 5, 1999 as written, motion carried 6-0. Trustee Hart moved, seconded by Trustee Higle to approve the minutes of April 13, 1999 with minor corrections/additions, motion carried 6-0. On the minutes for March 29,1999, Trustee Stever commented although the majority of the previous board is no longer here, he would just like to add one addition to the paragraph regarding the comment made by the Treasurer regarding the surplus fund. With that addition, Trustee Hart moved, seconded by Trustee Higle that these minutes become part of the official minutes, carried. Public Comments Scott Horecky commented on the possibility of full time employees in the Parks Department. The Mayor commented that we are working on our budget and considering that possibility but there is so much that is needed in the village that it is impossible to accomplish everything overnight, but we will try to meet the needs of the Recreation Department halfway. �Mr. Horecky commented that the village should look into the possibility of having a volunteer game warden to police the Pocantico River for the catch and release program. The Mayor stated that this is a good idea not only for those fishing but for deer hunters also. Ugo Checchi offered the board his services pro bono to check on repairs that need to be done in this building and the fire houses. Mayor Zegarelli thanked Mr. Checchi for his offer but explained that right now the building needs major repairs, such as windows, heating, air-conditioning, etc. and we are putting money aside in the budget for this . Thereafter, we might have someone check the buildings periodically to *ee what needs to be done. Joe DeFeo explained that we are in the process of getting estimates from cleaning firms and a proposal for an overhaul of the entire building over a five year span. The priority items that need to be done first are the roof, windows, doors and airconditioning. Scott Horecky commented on money spent on the research done on the Duracell property and the Assessor's bills. Trustees Stever and Hart stated that the old invoices can be reviewed. Trustee Hart then gave a report on his review of the previous administration's bills for March. Trustee DiFelice wanted it noted for the record that he had voted no on paying those bills. Chick Galella asked why the Treasurer approved some of these bills. Sanjay Shah explained how the vouchers are approved. Charles Curi raised a concern over safety at the new Riverfront Park. The Mayor stated that he has discussed some of these issues with Joe DeFeo and Chief Warren. There is no money in the budget for increased surveillance, but we may be able to put a camera on site. The road is a public thoroughfare so we cannot stop cars and trucks from going through that road. He met with GM representatives regarding the possibility of our public works employees parking their vehicles at the lower end of their employees' parking lot which would alleviate some of the congestion. Mayor's Report Mayor Zegarelli reported that the village will be hiring a consulting engineering firm tonight and read the attached resolution regarding the hiring of Jerry Fine of Robert Folchetti and Associates. Mayor Zegarelli commented that the burden of the tax increase will be on the one and two family home owners (homestead properties) due to the increase in the value of these homes. Mayor Zegarelli reported that he met with Paul Janos, Mayor of Tarry town, and Nick Robinson, Chairman of the Planning Board, to discuss the possibility of creating an advisory board between the two villages to deal with issues that affect �both villages. Representatives from Cooney Brothers have approached the Mayor on a proposal on their piece of property. The Mayor gave an update on General Motors. He reported that the fire that occurred there recently was the first one since the demolition began. He commented that General Motors has agreed to pay for a portion of the bicycle patrol and communications with their representatives has been very good. The Hudson River Towns of Westchester has asked that we have representatives attend their events and the Mayor asked that Trustees DiFelice and Rodriguez attend an upcoming one. Joe DeFeo, Trustees DiFelice and Rodriguez will be meeting with Anthony Zaino of the County tomorrow regarding CDBG grants for the parks, sidewalks and parking improvements in the village. The Mayor met with Ken Gentile of North Tarrytown Housing Authority to discuss the concept of them being our agency sponsor for senior citizen housing. Mayor Zegarelli received correspondence from C.J. Henderson regarding a police matter which cannot be discussed, but he will answer Mr. Henderson's letter. Mayor Zegarelli received a letter from the Portuguese Community requesting permission to hold their annual procession in honor of Our Lady of Fatima on Sunday, May 9th at 8 PM and moved that we approve their request, seconded by Trustee Rodriguez and carried. Trustee Reports Trustee Rodriguez had no report. Trustee DiFelice read the attached public works report. He read the attached police report. Trustee Stever had no report. Trustee Laub read the attached annual Fire Chiefs report. Trustee Higle had no report. Joe DeFeo gave an update on what is being done in the parks and we have ordered a water fountain for Devries Park which is handicapped accessible. He will be meeting with a sales representative on May 3,1999 to discuss the installation of a new pavilion at Devries Park. He presented a rough sketch of ways to increase the parking spaces near the Duracell property, Elm Street and Andrews Lane. He and Chief Gross agreed that with the diagonal parking spaces , it would not affect the fire trucks getting through. 3 �35 Mayor Zegarelli reported that the Spanish Coalition of Westchester held a meeting to discuss several topics and concerns and their desire to be more pro-active. The Mayor met with Trustees from Tarrytown to discuss recruiting more Hispanics into the fire department. Mayor Zegarelli commented the upcoming census will have an impact on grants. Resolutions-Attached Old Business Trustee DiFelice reported that the torn flag that was at the island at the top of Beekman Avenue has been repaired by Lorraine Annichiarico and put back up. He thanked her for her quick response. Mayor Zegarelli has in his possession a flag given to him many years ago by Peter Peyser and would like it to be kept in village hall for a spare flag when needed. Trustee Laub asked about the upcoming PMIA meeting. Trustee Hart commented the board will be receiving an invitation shortly. Mayor Zegarelli has written a letter to the County regarding the status of Kingsland Point Park with regard to parking availability. He would like to discuss the reconfiguration of the Parking Authority at the next work session. Approval of Warrants Mayor Zegarelli moved, seconded by Trustee Hart to approve the warrants of April 27,1999 and authorize the treasurer to pay the bills, motion carried 6-0. The total of the General fund is $75,236.97, the Water & Sewer fund total is $3,400.06 and the Capital fund total is $1,507.66. Mayor Zegarelli commented that the board has been invited to the new Hollywood Pizza Restaurant before the meeting on May 11th. Columbia Hose has invited the Mayor and the Board to Friendship Night on May 22nd for their 100th celebration. Public Comments Chick Galella asked that the board consider pursuing HUD to sell the property at 79 College Avenue which the village still owns. There being no further comments, Trustee Laub moved, seconded by Trustee Higle to adjourn the meeting, carried. Respectfully submitted, Angela Everett-Village Clerk �3(D PUBLIC WORKS REPORT April 27,1999 Joe DeFco met with Trustees Rodriguez and DiFelice andAnthony Zaino of the C ounty Planning Department to discuss sidewalks, parks and parking improvements in the inner village with regard to the CDBG grants. Joe DeFeo and the two trustees toured the village to try and determine priority items. Anthony Zaino will be touring the same areas with them tomorrow morning. Line painting will start within the next week or so. The plant supplying us with blacktop has had a delay in opening due to mechanical difficulties, but should open within the next week or so. Several lights throughout the village are in the process of being repaired/replaced; Margotta Courts parking lot, 10 Farrington Avenue, 33 Gory Brook Road, Cortlandt St.(opposite Alter's Bakery), across from 75 College Avenue and the corner of Hemlock and Birch Close. The following is a list of the streets left in the village that need to be repaved. Lakeshore Close, Center of Millard Avenue, all of Palmer Avenue, Bellwood Avenue from Devries to route 9, Pierson Avenue, Dell Street, Van Ripper Avenue, Andrews Lane, Kendall Avenue, Elm Street, Howard Street, Washington Street from Chestnut Street to College Avenue. The streets in the inner village are done once school is closed for the summer. We will be receiving 40 trees for planting throughout the village which is a matching grant from the NYS Power Authority. THE SEARCH WARRANT RESULTED IN THE ARREST OF SIX INDIVIDUALS FOR THEIR INVOLVEMENT IN SEVERAL COCAINE SALES TO AN UNDERCOVER POLICE OFFICER, OVER A THREE MONTH PERIOD. AT THE TIME OF THE SEARCH WARRANT, SEVERAL GRAMS OF COCAINE ALONG WITH DRUG PARAPHERNALIA WERE FOUND INSIDE OF THE APARTMENT. CASE # 98-0140 A FIVE MONTH JOINT INVESTIGATION WITH THE NEW YORK STATE POLICE C.N.E.T. UNIT, FOR STREET LEVEL NARCOTICS SALE, RESULTED IN THE ARREST OF FOUR INDIVIDUALS FOR THEIR INVOLVEMENT IN THE SALE OF COCAINE TO UNDERCOVER POLICE OFFICERS. THIS INVESTIGATION WAS PRESENTED TO A WESTCHESTER COUNTY GRAND JURY, WHERE FOUR INDIVIDUALS WERE INDICTED AND WARRANTS WERE ISSUED FOR THEIR ARREST. ROBERT FOLCHETTI & ASSOCIATES, L.L.C., Civil/Environmental Engineers whose address is 247 Route 100, Pinewood Business Center, Somers, NY (hereinafter called "FOLCHETTr). WITNESSETH: WHEREAS, the VILLAGE is desirous of securing full-time consulting engineering services; and WHEREAS, FOLCHETTI is experienced in civil and environmental engineering and has previously rendered services to municipalities, is properly licensed by the State of New York and desires to provide the VILLAGE with the engineering services it requires, as contemplated by this agreement; NOW THEREFORE, IT IS HEREBY AGREED: SECTION I-EMPLOYMENT FOLCHETTI Hereby agrees to provide and the VILLAGE agrees to engage FOLCHETTI to provide the following consulting professional engineering services: A. B. Village Board Services: Provide such engineering services as are requested by an official designated by the Village Board; including, but not limited to: 1. Conduct interviews, investigations, provide reports, engineering plans and specifications for all potable water, wastewater and storm water systems, facilities and appurtenances owned by the VILLAGE. 2. Review reports and advise die VILLAGE regarding the operations of the potable water, storm water wastewater and wastewater systems. 3. Serve as liaison between the VILLAGE and other agencies, including the United States Army Corps of Engineers, the Department of Environmental Conservation, Environmental Protection Agency and County Departments of Health and Planning and their respective boards. 4. Observe construction work performed by or for the VILLAGE. 5. Perform those engineering services required to be performed by the Village Engineer as specified by the VILLAGE Code. 6. Perform other engineering services requested by an official designated by the Village Board. Planning Board Services: As may be r e q u e s t e d by t h e Village 1. Review subdivision and site development plans and specifications for conformance with the applicable regulations. Submit written reports on said plans and specifications together with comments upon the foreseeable impact to the proposed projects with respect to the VILLAGE'S growth and development. 2. Set performance bonds in accordance with the applicable codes. 3. Submit written reports with respect to reducing and/or releasing of bonds. 4. Inspect improvements during and after construction for compliance with approved plans. �C D. 5. Attend monthly meetings. 6. Perform those other engineering services for the Planning Board as requested by an official designated by the Planning Board. Zoning Board of Appeal?: As May be requested by the Village 1. Review and report on applications. 2. Attend meetings. Highway Department and Building Inspector Services: 1. Provide such engineering services as are requested by the Highway Superintendent and Building Inspector. It is understood that other engineering services to be performed hereunder by FOLCHETTI may be performed by any employees or associates of FOLCHETTI who are professionally qualified by education and/or work experience to do the specific item of work in question. SECTION II-TERMINATION This agreement can be terminated by either party without cause upon six months written notice. If terminated, FOLCHETTI shall be paid for all work and expenses performed up to the date of termination. SECTION III - OWNERSHIP OF DOCUMENTS With regard to all services performed by FOLCHETTI pursuant to this agreement that result in an end product of maps, surveys, drawings, reports, etc., such maps, surveys, drawings, reports, etc. become the property of the Clerk of the VILLAGE, except that FOLCHETTI may retain separate copies for file purposes known as 'RECORD COPIES." Furthermore, during the pendency of this agreement, all copies of map, surveys, drawings, reports, etc. shall be furnished to the Village Board or its designee at its request. Other expenses shall be reimbursed as authorized by the Village Board. FOLCHETTI will upon execution of this agreement and during the term of this agreement, file and keep filed with VILLAGE certificates evidencing the existence of a general liability policy and professional liability policy covering his firm in amounts reasonably satisfactory to VILLAGE and naming VILLAGE as an additional insured.
