Present: Mayor Philip Zegarelli Mario DiFelice Donald Stever Craig Laub Robeit Higlc James Hart Trustees Also Present: Robert Ponzini, Village Attorney Sanjay Shah, Village Treasurer Absent: Trustee Patricia Rodriguez Mayor Zegarelli opened the meeting with a prayer and a pledge to the flag. Public Hearings Mayor Zegarelli read the attached public hearing notice regarding revisions to the Sprinkler Code, gave a brief explanation and opened the hearing. There being no comments from the public, Trustee DiFelice moved, seconded by Trustee Laub to close the hearing, carried 5*0. Mayor Zegarelli read the attached public hearing notice regarding the proposed increase in the water rates, explained why we need to consider raising the water rates and opened the hearing. Mario Belanich commented that money from the water fund should not be transferred. The Mayor commented that the water fund has been depleted and we need to raise our rates because New York City has increased their rates to us. Trustee Stever explained that New York City Aqueduct system is our source of water and we must purchase our water from thern. Their rates have increased substantially recently. Trustee DiFelice asked how fast are our water meters being replaced. Sanjay Shah explained that all meters will be replaced by next year; meters are being tested on a priority basis. There being no further comments, Trustee Hart moved, seconded by Trustee Higle to close the hearing, carried 5-0. �Approval of Minutes Trustee DiFelice moved, seconded by Trustee Hart to approve the minutes of April 14,1999 as written, motion carried 5-0; Trustee Higle moved, seconded by Trustee Laub to approve the minutes of the April 27,1999 as written, motion carried 5-0; Trustee DiFelice moved, seconded by Trustee Hart to approve the minutes of April 29,1999 adopting the budget as written, motion carried 5-0. The Mayor commented that we will move into executive session to discuss litigation and a police matter; Trustee DiFelice so moved, seconded by Trustee Stever and carried 5-0. Back in regular session, the Mayor commented that no action was taken in executive session. Public Comments Joan Ferrara of 95 Beekman Avenue complained about the noise at the Hollywood Nites bar on the corner by the Van Tassel. Police Chief Warren will have his officers check out the situation. Don Caetano complained about the double parking on the corner of Lawrence and Beekman Avenue. The Police Chief will look into it. * Trustee Hart thanked the Police Department for having a car removed from his parking space on Elm Street. Maryann Connolly thanked Robin Pell for cleaning up the islands and planting flowers. She also asked if the handicapped parking space in front of the Van Tassel could be moved to the corner by the bicycle shop. Joe DeFeo commented that he would have it taken care of. Mayor's Report Mayor Zegarelli was in receipt of a request from the Chamber of Commerce for a donation of $2000.00 towards the fireworks. Trustee DiFelice moved, seconded by Trustee Higle to approve their request, carried 4-0. The Mayor commented that the Board will hold a worksession at 7 PM before every meeting. Trustee Reports Trustee Higle commented' that he was in receipt of a check for $5000.00 from the John M. Olin Foundation to go towards the purchase of bicycles for our Police Department. A thank you note will be sent to them. Trustee Higle read the attached Recreation Department report. �Trustee DiFelice commented that since Trustee Laub had to leave early, he read the attached Fire Department reports and Fire Chiefs report. Trustee DiFelice moved to approve the appointments to the Ambulance Corp., seconded by Trustee Stever and carried 4-0; Trustee DiFelice moved, seconded by Trustee Hart to approve the request to take the Fire Chiefs1 cars and Engine 85 to the Fire Chiefs* Convention in June, motion carried 4-0. Trustee Stever reported that he has spoken to Nicholas Robinson, the Chairman of the Planning Board to schedule a meeting of the three boards to have an in-house seminar to discuss their powers and responsibilities. Trustee Stever commented that he had discussions with the current owners of the Rockefeller property. He suggested that the village take formal steps to change the zoning in that area. Attached resolutions were then passed. Trustee DiFelice read the attached Public Works Report and commented that this is National Police Week. He also commented that there is room for small boats at the Sleepy Hollow Landing Park. Trustee DiFelice commented that there has been complaints regarding parking on both sides of the street on Tappan Avenue. After brief discussion, Trustee DiFelice moved, seconded by Trustee Hart to call for a public hearing on June 15,1999 to consider a No Parking zone in the proposed area, carried 4-0. In the absence of Trustee Rodriguez, Mayor Zegarelli commented that committees will be set up to help with the census. Discussion ensued on the upcoming meetings and worksessions for the summer. The worksession schedule is June 10(k, July 8th and August 5lh. The regular board meetings will be June 15th, July 13th and August 10th with a worksession starting at 7PM before each regular board meeting. Mayor Zegarelli commented that some of the topics to be discussed at the next worksession are the proposed reduction of the escalated fines and a moratorium whereby people can come in and clear up their back tickets, the proposed binding arbitration award in the Police Department and the yearly contract with the SPCA. Trustee Hart reported that he is currently reviewing bills on prior plumbing bills on work that was done in this building and other buildings and is asking Trustee Higle to review some of those bills with him. Trustee Hart is working with Sanjay Shah on the status on his response on the recent state audit report. Resolutions-Attached Old Business-None �New Business-None Communications, Petitions & Requests Mayor Zegarelli read a petition from residents objecting to the opening of the former Sophie's bar. A copy has been given to the Police Chief. The Mayor read a letter from Jerry Fine of Folchetti and Associates thanking the Mayor and Board for the approval of his contract with the village. Communication from Allan Block Insurance Company was read by the Mayor. Mayor Zegarelli read a petition presented by Judy Hefferon of 9 Fremont Road signed by several residents requesting a speed bump between Evergreen and Hemlock. Chief Warren commented that a survey was conducted in that area and it showed that cars are not speeding; they are driving at or below the current limit. Mayor Zegarelli received a thank you letter from the Hispanic Advisory Board. Mayor Zegarelli commented that an executive session will be held with outside counsel this Thursday at 7 PM dealing with General Motors litigation. Mayor Zegarelli made appointments to several committees, (list is attached) Trustee DiFelice moved, seconded by Trustee Stever to approve the appointments to the Recreation Advisory Board, motion carried 4-0. Trustee DiFelice moved, seconded by Trustee Hart to approve the appointments to the Tree Commission, motion carried 4-0. On the Public Safety Committee, Trustee Higle seconded the Mayor's motion, carried 4-0. On the Tourism and Celebrations Committee, Trustee DiFelice seconded the Mayor's motion, carried 4-0. On the Mayor's Advisory Board, Trustee Stever seconded the Mayor's motion, carried 4-0. Approval of Warrants Trustee Stever moved, seconded by Trustee DiFelice to approve the warrant of the General fund for a total of $108,845.17 and authorize the Treasurer to pay the bills, motion carried 4-0; Trustee Stever moved, seconded by Trustee Higle to approve the warrant of the Water and Sewer fund for a total of $4,608.01 and authorize the treasurer to pay the bills, motion carried 4-0; Trustee Stever moved, seconded by Trustee Higle to approve the warrant of the Capital fund for a total of $124,315.89 and authorize the treasurer to pay the bills, motion carried 4-0. 4 �Public Comments John Edwards commented on a light that was out on Pine Street. He commented that he is still working on getting us our own zip code. The Mayor commented that he spoke with Sue Kelly and she is trying to help us. Joe DeFeo commented that the light will be taken care of by our electrician, Larry Verdi. We have a list of lights that need to be repaired. Chick Galella complained about our phone system. The Mayor commented that it is on our agenda to be changed. There being no further comments, Mayor Zegarelli moved to go into executive session to discuss personnel matters, seconded by Trustee DiFelice and carried. Discussion ensued on personnel matters in the Public Works Department. Back in regular session, the Mayor commented that no formal action was taken in executive session. There being no further business, Trustee DiFelice moved, seconded by Trustee Higle to adjourn the meeting, motion carried. Street paving and the 50/50 sidewalk program will resume once the plant is reopened. The County sidewalk project along Beekman Avenue is nearing completion. Water meter reading is taking place now. Hydrant flushing will start on May 17 through May 28, Monday through Friday from 9 AM-2 PM.
