Present: Mayor Philip Zegarelli Mario DiFelice Patricia Rodriguez Donald Stever James Hart Also Present: Absent: Trustees Brian Murphy, Village Attorney Sanjay Shah, Village Treasurer Trustee Robert Higle Trustee Craig Laub Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag. Public Hearing Mayor Zegarelli read the attached public hearing notice with regard to the proposed re-zoning of County House Road. Dave Smith of Saccardi and Schiff gave a brief overview of the proposed rezoning. Henry Hockerman, attorney representing the applicant, commented that they had no objection to the rezoning but asked that the board not file with the Secretary of State until further review. Mario Belanich asked about the difference between R-3 and R-l zoning. Trustee Stever explained. There being no further comments, Trustee DiFelice moved, seconded by Trustee Rodriguez to close the hearing, motion carried. Mayor Zegarelli presented Lorraine Annichiarico with a Certificate of Appreciation for all her skills and the time she has devoted to the village. She has repaired torn flags, made aphgans and has various other sewing skills. John Butler of Bell Atlantic addressed the board regarding the proposed AT&T and Media-One merger. He commented that the citizens should be alerted about this proposed merger and that Bell Atlantic has a lot to offer. Bell Atlantic is against this merger. Mayor Zegarelli reported that overall, Tropical Storm Floyd's damage to the village was light in comparison to other areas. 1 �Mayor Zegarelli praised Joe DcFeo and his crew for a great job the night of the storm and praised the members of the Fire Department for all their help in pumping out basements for our residents. The Mayor commented on the ongoing issue of encephalitis. Anyonefindinga dead bird should contact the Police Department and they will pick it up and send it to the Health Department. Chief Warren explained the procedure that is followed when a dead bird is found. We will be notified by the Health Department 48 hours before spraying takes place in our village. Approval of Minutes Trustee DiFelice moved, seconded by Trustee Hart to approve the minutes of September 14,1999 as written, motion carried 5-0. Public Comments Don Caetano commented that the sanitation men should be careful when picking up garbage if there is any standing water in lids of the garbage cans. He also asked if anything was done about the fire department situation on Lawrence Avenue. The Mayor commented that we are trying to resolve the situation and have been discussing the matter with the Fire Chiefs. Charles Curi commented that there were many rumors regarding the Mayor's bank and GM. They are not true. Mayor Zegarelli commented that because of the size of his bank, they are precluded from doing any business with the village and that we would not do any business with the village because of his position. Joe DeFeo commented that the Mayor spent most of the night of the storm with the public works crew. Mayor Belanich commented again on the parking on the streets in the Manors and there is no sign about no parking more than 48 hours on the streets. The Mayor responded thgt.he met with the Board of Directors of the PMIA to try and resolve this issue. He commented that we don't need signs on every street for the 48 hour ordinance. Jeanette Morrison commented on a problem she is having with the sand that is going into her yard from the yard above hers. James Margotta explained that he spoke to the owner of the other property on this matter. Trustee Stever asked that he look into it further and report back to him. Mayor's Report 2 �173 Mayor Zegarelli was in receipt of a letter from Maria Cellante of 34 Hudson Terrace regarding a drainage problem. (Referred to Public Works) The Mayor asked that a motion be made authorizing him to sign the contract with Legion Fireworks for fireworks to be held on December 17th and December 31"*, Trustee DiFelice so moved, seconded by Trustee Stever and carried 5-0. The Mayor received a letter from the North Tarrytown Reunion Committee requesting that the Riverfront Park be named in honor of the late John J. Horan. Chick Galella also asked that this park be named after John J. Horan. The Mayor explained that the board is discussing this matter. The North Tarrytown Committee has requested permission to put up a reunion sign at the top of Beekman Avenue; Trustee DiFelice moved, seconded by Trustee Hart to grant this permission, carried 5-0. Mayor Zegarelli reminded everyone that a scoping session on the Kendal project will be held on Thursday, October 7,1999 at 8 PM in village hall. Mayor Zegarelli commented that Union Hose had requested permission to take their truck to South Amboy. Trustee Rodriguez moved, seconded by Trustee Hart to approve their request, motion carried 4-0-1 with Mayor Zegarelli, Trustees Hart, Stever and Rodriguez voting yes and Trustee DiFelice abstaining. The Mayor was in receipt of a letter from Mayor Janos advising us that he has appointed John Nolan, Nancy Checchi, William Cerbone and Susan Sincero to his side of the Villages' Advisory Board. Mayor Zegarelli commented that the Parks department will no longer be under Public Works and that the three Parks employees, Robert Pell, Jerry Navin and Daniel Gallagher will be reporting to Robin Pell except for such Department of Public Works needs such as Wednesdays when they will report to Joe DeFeo. The Mayor commented that we have discussed several options on to separate 79 College Avenue from the village. Trustee DiFelice commented that the board has discussed the issue regarding the time that garbage can be put out for pickup. More discussion ensued and the Mayor commented that the board needs to look into this further. The Mayor was in receipt of a letter of resignation from Betsy Sawyer-Gaylin from the Planning Board and a letter of resignation from George Tanner from the Zoning Board. ». Mayor Zegarelli appointed George Tanner to the Planning Board to fill the unexpired term of Ms:. Gaylin. Trustee Rodriguez moved, seconded by Trustee Hart to approve this appointment, carried 5-0. 3 �The Mayor appointed Thomas Capossela to the Architectural Review Board to fill fill a vacancy; Trustee DiFelice moved, seconded by Trustee Hart to approve this appointment, carried 5-0. Mayor Zegarelli appointed Terrence McGlynn to the Waterfront Advisory Board to fill a vacancy; Trustee Stever moved, seconded by Trustee Rodriguez to approve this appointment, motion carried 5-0. The Mayor appointed Jim Timmings, Jr. to the Ethics Board to fill a vacancy; Trustee DiFelice moved, seconded by Trustee Hart and carried 5-0. The Mayor asked that a motion be made to set the snow removal reserve at $72,089.02 and according to Section 6-E of the General Municipal Law, total reserve for snow removal may be brought up to $100,000.00; Trustee Hart so moved, seconded by Trustee DiFelice and motion carried 5-0. Mayor Zegarelli asked for a motion setting up the tax stabilization reserve of $200,000.00 which can only be used for tax stabilization and will require a super majority vote; Trustee DiFelice so moved, seconded by Trustee Hart and carried 50. Trustee Reports Trustee Hart reported that the year end audit is almost completed sjid will be in Albany by September 30,1999. Trustee Rodriguez commented that the signs directing people to Devries Field should be changed and one should be erected directing people to the Writers' Center. Brief discussion ensued. Trustee DiFelice read the attached Public Works report and Fire Council correspondence and Fire Chiefs reports. Trustee DiFelice moved, seconded by Trustee Stever to approve the Fire Council appointments, motion carried 5-0. Trustee DiFelice moved, seconded by Trustee Rodriguez to approve all other actions, motion carried. •• Trustee DiFelice read the attached Police Chiefs report. Trustee DiFelice reminded everyone that Saturday night, October 2nd at Losee Park at 7 PM, the Sleepy Hollow Police challenges the Tarrytown Police in a softball game. Trustee Stever reported that the Architectural Review Board will meet this Wednesday. The Planning Board will be holding a series of worksessions and be holding informal meetings with developers. He, Planning Board Chair, and planning and engineering consultants had had a very productive meeting with Inter-development Corporations with respect to development on the waterfront. Resolutions-None �» Old Business Trustee Stever moved, seconded by Trustee Rodriguez that the Board of Trustees call for a public hearing on Tuesday, October 12,1999 at 8 PM regarding the adoption of a Local Law which would authorize a cluster development simultaneously with the approval of a plat or plats pursuant to the provisions of Article 7 of the Village Law, section 7-738 and said proposed Local Law, motion carried 5-0. Mayor Zegarelli asked that a motion be made to award the appraisal of the GM site to McGrath, Basciani & Associates for $8,900.00; Trustee DiFelice moved, seconded by Trustee Hart and carried 5-0. New Business-None Communications. Petitions & Requests Village Clerk read letter from Lilawatee Balgobin of 180 Valley Street informing the village that they are renewing a liquor license for their liquor store and the Horseman Diner has applied for a liquor license. (Referred to Police Chief) Mayor Zegarelli was in receipt of correspondence from Con Ed with regard to trying to find out how many meters are in each building. A letter was received from Doug Maas regarding the time that leaf blowers can be operated. We received correspondence from FEMA regarding funding from the damage of the storm Floyd. A letter was received from Elizabeth Gareis regarding the litter at the end of Gory Brook Road. (Referred to the Public Works Department and Police Department) Dave Smith commented that he has prepared a memo outlining some of the issues with respect to the Kendal proposal for the scoping session on Thursday. Mayor Zegarelli received correspondence from Assemblyman Richard Brodsky offering to help us with the GM development. Approval of Warrants Trustee DiFelice moved, seconded by Trustee Stever to approve the warrants with minor exceptions and authorize the Treasurer to pay the bills, motion carried 5-0. The total of the General fund is $90,970.43, the Water & Sewer fund total is $3,659.57 and the Capital fund total is $65,982.48. Public Comments John Edwards reported on a list of upcoming events that the Celebrations Committee is planning. Don Caetano asked about a Youth Officer. Sidewalk replacement should resume sometime next week. Street paving will resume on Thursday, October 7th starting with Howard Street from Pocantico to Washington Street to the bank, raindate is Friday, October 8th. Irving Place is on the street paving list. We received a check for $40,460.35 from the CHIPS program for reimbursement of the paving of the last three streets in the Manors. We are collecting data for storm related expenses. Tree work is ongoing.
