Present: Mayor Philip Zegarclli Mario DiFclicc James Hart Patricia Rodriguez Robert Ilip.lc Also Present: Absent: Trustees Brian Murphy, Village Attorney Sanjay Shah, Village Treasurer Trustee Craig Laub Trustee Donald Stcvcr Mayor Zegarclli called tlic meeting to order with a prayer and pledge to the flag. Before starting the meeting, Trustee DiFclicc asked that a moment of silence be taken for Edward Koval who passed away. Public Hearings Mayor Zegarclli read the attached public hearing notice regarding the senior citizen exemptions. Miguel Jimenez asked what measures the village had taken to compensate for this loss of revenue and Don Cactano asked if this is regulated by the state. The Mayor responded that the rest of the taxpayers pick up the difference. The state regulates it and the village opts into it. This has been a practice for many years. Sanjay Shah commented that tliis is built into the tax rate and there arc only 42 seniors who qualify for this. There being no further comments, Trustee DiFclicc moved, seconded by Trustee Hart to close the hearing, motion carried 5-0. Mayor Zegarclli read the next attached public hearing notice regarding repealing section 57-7A (10) of the village code. Trustee DiFclicc gave a brief explanation of the reason for this proposed change stating that the new business at that location docs not need all that space for a loading zone and residents on Kendall Avenue need more parking spaces. There being no comments, Trustee DiFclicc moved, seconded by Trustee Hart to close the hearing, motion carried 5-0. �Trustee DiFelice moved, seconded by Trustee Hart to approve the minutes of October 12,1999 as written, motion carried 4-0-1 with Trustee Rodriguez abstaining. Public Comments Miguel Jimenez commented that the fees for parking permits in the village arc not all the same and that is unfair. He also commented about the parking in the streets of Philips* Manor. Mayor Zcgarclli explained that the Board is looking into increasing the permit fees at the station and looking'at all the parking fees. He stated that he has been speaking to the PMIA and trying to come up with a solution such as parking permits, and alternate sides. Miguel Jimenez questioned the large gas tank that is going to be installed at the corner of Pocantico Street and route 9, The Building Inspector stated that the owners have a permit to install new holding tanlcs to hold the contaminated ground water and that it is not a gas tank. The holding tank meets today's state code. George Samaras addressed the hoard regarding a situation when his son was wrongly stopped and handcuffed by the Tarrytowii Police Department when i:hcy were looking for a stolen car. Mr. Samaras was upset that our local Police Department did not show up for over forty minutes. Chief Warren gave an explanation of the events that took place. Trustee llodrigucz commented that Mr. Samaras should be complaining to the Tarry town Police Chief about the way his son was treated, not us. Much discussion took place among a couple of members of the audience and the Trustees and the Police Chief. Trustee DiFelice asked for n point of order stating that this is a personnel master and should not be discussed in public. After more discussion, Trustee DiFelice moved, seconded by Trustee fliglc to order the Police Chief to prepare a full investigation and give this to the Mayor and Board of Trustees, motion carried. Mario Belanich also commented on the parking situation in the Manors and that parking regulations .diould be the same throughout the whole village. lie commented on the possibility of elections being held iu November instead of March, the possible elimination of two trustees, increasing the salaries of board members and eliminating some stop signs in the village. After more discussion on the parking situation in the Manors, Trustee Rodriguez, moved, seconded by Trustee DiFelice to direct the Police Chief to enforce all regulations in the village.. More discussion ensued. Mayor Zegarclli moved to ttablc this resolution, seconded by Trustee Hart, motion failed 2-3. 2 �On the first motion to enforce nil regulations, Trustees Rodriguez, DiFclicc and Hart voted yes and Mayor Ze^arclli and Trustee Hart voted no. Discussion ensued on whether or not a 3-2 vote was counted as a majority. The Board adjourned info executive session to discuss this with the attorney. The Village Attorney will have to check further into this matter. Don Cactano commented that residents should be given a warning first before issuing a ticket. He also commented that the hairdo was a great success. John Edward's gave an update on the upcoming celebrations for the village. The Celebrations Committee is seeking donations for theirfireworksdisplays in December. Mogul Jimenez and George Samaras donated $200.00 each for the fireworks. Marco Passion commented that he had applied for the position of Assistant Court Clerk. Mayor's Report Mayor Zcgarclli commented that 1998-1999 audit is available and he will be meeting with our accountant, Joe DeMilia next week to discuss it. The Mayor reported that the village has received six out of six grants, such as sidewalks, parking on Bcckman Avenue, rehab of lighting in Sakcs Park, a new senior van and added off-street parking. Mayor Zcgarclli asked for a motion authorizing him to sign contracts for the purchase of two parcels across from village hall to be used for parking; on e for $188,500.00 and one for $135,000.00; Trustee DiFclicc moved, seconded by Trustee Higlc and carried 5-0. Trustee Higlc moved, seconded by Trustee Rodriguez to authorize the Mayor to complete and execute the Economic Development Block Grant, motion carried 5-0. The Mayor stated that meetings were held with FEMA and we feel confident that we will receive what we requested for damage and remediation. Trustee's Reports Trustee Hart had no report. Trustee Rodriguez had no rcpQrt. Trustee DiFclice gave thu attached police report. Discussion ensued with regard to alternate side parking on Valley and Cortlandt Streets. Trustee DiFclice moved, seconded by Trustee Rodriguez to call for a public hearing on November 23,1999 at 8 PM to consider a proposal to designate alternate side parking in those areas, motion carried 5-0. 3 �used ami perhaps we could ask them if we could utilize it for parking. The Mayor asked for a motion to approve a one time only 15 year longevity bonus of $300.00 for the three Public Works employees, Assistant Highway Foreman, Water & Sewer Maintenance Worker I and Auto Mechanic; Trustee DiFclice so moved, seconded by Trustee Hart and carried 5-0. The Mayor received correspondence from GM approving our request for the use of their lower lot on December 17* for our fireworks display. Correspondence was received from Elizabeth Rune regarding the moving of the handicap parking space from in front of the entrance to the Van Tassel to the end of licekm.'in Avenue. IJc received comments from Scenic Hudson with regard to the scoping of Kendal on Hudson. The Mayor received a letter from the Ladies Auxiliary thanking us for the certificates we presented Ihcm. Mayor Zegarclli received a request from the Hudson Valley Writers' Center for matching grant monies. Tic received correspondence from the Public Schools stating that they will be sharing 1/3 of the cost of the reappraisal of General Motors. The Mayor received a letter from the Mayor of Philadelphia requesting that the Board designate the week of November 21st as National Bible Week; Trustee DiFelice so moved, seconded by Trustee Higle and carried 5-0. He received a note from the Student Advisory Council thanking us for our help. The Mayor commented that notices have gone out to the Planning and Zoning Boards regarding the hiring of a new recording secretary. Mayor Zegarclli received a letter from Joseph Caimi regarding the placement of a handicap spot in front of llris mother's home. (Discuss at work session.) The Mayor received correspondence from Henry Stciner the need for volunteers and $600.00 for the restocking of the Pocantico River. Mayor Zegarclli was in receipt of the attached letter from Fire Chief, John Ccllantc, regarding the need for a full time Fire Inspector. Mayor Zegarclli commented that there will be an inspection of the firchouscs on Thursday at 7:30 PM. Approval of Warrants Trustee DiFelice moved, seconded by Trustee Rodriguez to approve the warrants of of October 26,1999, and authorize the Treasurer to pay the bills, motion carried 50. The total of the General fund is $77,345.89, the total of the Water & Sewer fund is $3,574.82 and the Capital fund total is $8,158.07. The Building Inspector has been on site and inspected the premise, I have been on site and have communicated the public safety concerns, that may arise based on the proposed usage which includes three (3) barber stations, three (3) video amusement games and one (1) coin operated pool table. The proprietor of the establishment has or will be applying for the necessary permits. The Village Code Chapter 4, §4-2 A License Required; Application; number of devices restricted and §4-6 Minors, addresses most of the concerns that would arise out of this proposed usage However, the village code does not permit video amusement devices in any premises other than a bar or tavern. Considering the Village's long term goals, it may want to revisit this local law, with the proper safeguards and limitation. Please note, that no hazardous materials are being stored at that location. There is currently a No Parking Zone in front of 8 Kendall Ave which was designated in the Village Code, §57-7A A (10), in July of 1974. §57-7AA(10) For a distances of forty (40) feet on the east side of Kendall Avenue at the bend, as posted. We had numerous concerns as to the safety of the residents and the buildings within the village. We never received an answer despite the numerous requests. We also asked the former administration to assist us with our requests, but this also fell on deaf ears. I During this period we had several major fires within the village, including a fire at 106 Depeyster Street that led to a loss of a civilian life. It was demonstrated that this building was converted from a six family apartment house into a single room occupancy/rooming house WITHOUT THE BENEFIT OF ANY BUILDING PERMITS! As you are well aware, our membership, like most volunteer organizations is suffering from a decrease in the amount of active volunteers. In addition, the amount of ambulance calls that we handle are steadily increasing. As our membership enter buildings on an emergency call, we notice numerous violations, but we cannot do anything to correct them.The building inspector is only a part-time position, and in no way does he have the time or the resources to handle these violations. Over the past three to four years, when this department would bring suspected building or fire code violations to the attention of the former administration, we were met with i c^>/? �political bureaucracy.Politics and political favors have no place in the safety of the village residents and of the membership of your fully volunteer fire department. The structures in the southern part of this village are mostly of older construction. We find many that are not properly maintained. In addition,they are built closely upon each other which can contribute to the spread of fire. Also, many of these units may be overcrowded. A full time fire inspector would uncover any overcrowding before a catastrophe occurs. Now the Village is facing major contruction over the next several years which would lead to rapid growth and insurmountable work load for a part-time building inspector and part-time fire inspector. Therefore, on behalf of the membership of the Sleepy Hollow Fire Department I respectfully request that you the Mayor and the members of the board of Trustees strongly consider the appointment of a FULL-TIME CERTIFIED AND EXPERIENCED FIRE INSPECTOR to help alleviate our concerns and to insure the safety of the residents in our Village. The creation of this position would allow the fire inspector to concentrate on the fire/life safety inspections throughout the village on an orderly and productive basis. Finding the violations is one thing, enforcing correction is another matter. Please also note that our village has a fire sprinkler ordinance on the books that was approved by New York State, and is part of our building code. A FULL-TIME fire inspector would be able to review installation plans as well as test for compliance. Consider the amount of proposed construction before the Village, and you can readily agree that we need a qualified inspector. Please consider our request and appoint a FULL-TIME FIRE INSPECTOR as soon as possible. The safety and lives of our residents and depatment members depend on your actions. Paved Gory Brook Road from Ridge Street to the dead end. Completed two sidewalks on Gordon Avenue. Sidewalk replacement is Continuing. Replaced sidewalk in front of village hall. In the process of replacing ramp in front of Central Fire Department. Added new security lites outside of village hall. Four new street lites have been installed in Sleepy Hollow Manor. Repaired fifteen street lites throughout the village. Contractor for County sidewalk improvement program has finished repairing the road after installing storm drains on Barnhart Avenue. Leaf pick-up has started and will continue until the end of December. Please do not put brush in with the leaves. Hydrant flushing is almost completed throughout the village. Repaired a water main break on Amos Street. PLEASE NOTE!!!! THURSDAY NOVEMEBER 11™ IS VETERANS' DAY. VILLAGE OFFIC ES WILL BE CLOSED!!!! THURSDAY'S GARBAGE WILL BE PICKED UP ON WEDNESDAY ALONG WITH RECYCLING.
