                  <text>A regular meeting of the Board of Trustees of the Village of Sleepy Hollow was held
on Tuesday, April 25, 2000 at 8 PM in Village Hall, 28 Beekman Avenue, Sleepy
Hollow, New York.

Mayor Zegarelli called the meeting to order with a prayer, and pledge to the flag.
Before starting the regular order of business, the Mayor introduced Diane Maas
who is organizing the clean up of Peabody Field on Saturday, April 29th starting at
9AM. She commented that everyone is fnvited to participate and will receive a
T-shirt. This is in coordination with Earth Day which took place last week but due
to the holidays last weekend, it was postponed to this weekend.
Public Comments
John Edwards reported on the Tourism Committee activities. They are going to
create different characters to march in all parades starting with the Memorial Day
parade. He would like to be able to use the senior van to transport people back and
forth. He thanked Joe DeFeo for the signs on Pine Street. He asked if lines could be
painted on Pine Street so that cars don't park over a space. The Mayor commented
that this is not usually a good idea on a residential street, but will look into the
matter.
David Smith, Planner Consultant, gave a brief overview of the DEIS of where we are
and gave a brief summary of the environmental review process regarding Kendal*
on-Hudson. (Part of official minutes)
Jerry Fine, Village Engineer gave a brief report on the water and sewer situation
with regard to the Kendal project.
David Smith stated that the applicant is to take all comments from everyone into
consideration and re-submit documents for approval.
Joel Sachs, Special Counsel, stated that we need a resolution for this. Attached
resolution #35 was then passed.
Andrew Tung, Planner of Divney, Tung and Schwab, representing the applicant
for Kendal on Hudson stated that it is their intention to provide the Village with the
documents that address all the issues outlined in the scope.

�Susan Fisher of Birch Close asked when the residents could speak on this matter.
Joel Sachs commented that when the DEIS is completed it will be made available to
the public and written comments can be made and public hearings will be held.
Mr. Sachs commented that the Board is aware that the present zoning there does
not permit this use. A public hearing must be held to change this zoning. We can
have a public hearing on the DEIS and zoning amendments together.
Mayor's Report
Mayor Zegarelli commented that we received correspondence from our insurance
carrier regarding the Samaras case.
We received a shut off notice from Con Edison for 7 Hudson Street.
A letter was received from Mr. Santos regarding the sidewalk and tree on Katrina
Avenue. (Refer to Public Works)
Mayor Zegarelli thanked Joe DeFeo and his men for the work that they did on the
demolition of the two properties across from Village Hall. He commented that the
village saved a lot of money by the Public Works Department doing this job. He
commented that we should-be closing on the 21 Beekman Avenue parking lot
shortly.
We have received a franchise payment from Media-One.
Because of the threat of the West Nile Virus, the Mayor commented that holes have
been drilled at the old GM site so that the water drains properly.
He received correspondence from Mr. Casares regarding sidewalk on 8 Francis
Street. (Referred to Public Works)
Mayor Zegarelli commented that we need to call for public hearings regarding the
re-establishment of the Code Enforcement Officer position and to establish a
Department of Fire and Life Safety ; Trustee Hart moved, seconded by Trustee
Zieja to call for a public hearing on these two items on Tuesday, May 23, 2000 at 8
PM, motion carried.
The Mayor commented that we received the monies from the movies that were made
in the village.
Trustee Reports
Trustee Hart reported that we will be adopting the budget this Thursday, April 27th.
Trustee Hart read the attached correspondence from the Fire Wardens. Trustee
I)iFelice moved, seconded by Trustee Stever to approve their actions, carried.
Trustee DiFelice read the attached the Public Works Report.

�Trustee DiFelice asked that we send letters of thanks to the other Police
Departments who helped us during the day of the shootings.
Trustees Stever and Higle had no report.
Trustee Zieja reported with regard to ambulance services, Phelps Hospital's
proposal gives us the most ALS coverage; 24 hours a day at an equal cost, and the
first six months would be free for the village.
Mayor Zegarclli commented that there may be a resolution through the Town of
Mt. Pleasant taxes to pay for the ambulance. A minimal cost would be added to
those taxes.
Mayor Zegarelli commented that he had a couple of appointments left to do.
The Mayor re-appointed Elliot Martone to the Zoning Board for a term of five
years; Trustee Stever moved, seconded by Trustee Hart to confirm the Mayor's
action, motion carried 5-1 with Trustee DiFelice voting no.
The Mayor re-appointed the same members as last year to the Mayor's Advisory
Board and the Recreation Committee; Trustee Hart moved, seconded by Trustee
Higle to confirm the Mayor's action, carried.

The Mayor gave a quick update on where we are with Briarcliff Water and New
Rochelle Water in with regard to the Northern Loop.

Communications, Petitions &amp; Requests
Village Clerk read correspondence from Michael Gasparre, President of the Central
Veterans' of Tarry town and Sleepy Hollow requesting permission to hold their
annual "Memorial Day" parade on Monday, May 29th; Trustee DiFelice moved,
seconded by Trustee Higle to approve their request, carried.
There being no further business, Trustee Higle moved, seconded by Trustee Stever
to adjourn to executive session to discuss personnel items but no formal action will
be taken.
Back to regular session, Trustee DiFelice moved, seconded by Trustee Zieja to
adjourn the meeting, carried.

Whereas, The Hudson River Estuary Management Action Plan was approved and
released by Governor Pataki in May 1996, in furtherance of the requirements of the
Hudson River Estuary Management Act adopted by the state Legislature in 1967;
and
Whereas, The Hudson River Estuary Management Action Plan identifies 20 priority
actions that the Department of Environmental Conservation has committed to
implementing for the purposes of:
Conserving natural resources,
Promoting use and enjoyment of the river,
Cleaning up pollution; and
Whereas, in the 2000-01 State Executive Budget, Governor Pataki has proposed
making the Estuary Program a permanent category in the Environmental
Protection Fund (EPF) budget, eligible for annual funding to support
implementation of the Estuary Fund; and
Whereas, a $6 million EPF appropriation is now proposed in the 2000-01 Executive
budget for the Estuary Management Program; and
Whereas, these funds will be used to:
Assure that shad, striped bass, sturgeon and other important species are
sustained in the Estuary,
Provide grants to municipalities and non-profit organizations for river
access, interpretive centers, habitat conservation, and other purposes,
Improve water quality of the Estuary and the tributaries, among other
things.
Whereas, the Village of Sleepy Hollow considers the Pocantico River as part of the
Estuary;
Now, therefore be it resolved that the Village of Sleepy Hollow, New York urges the
New York State Legislature to support the Estuary Management Program as a
permanent category line kern in the Environmental Management Protection Fund
and the $6 million appropriation for 2000-01 be approved in full.

�Public Works Report
April 25, 2000

The two buildings across from village hall have been demolished and are in the
process of being hauled away.
The Dept. of Public Works is building a new retention basin at the Shaft 10 pump
house by the Tarry town Lakes for chemical deliveries.

Hydrant flushing will start at the end of May.
We are meeting with the County next Tuesday at the Riverfront Park to finalize any
of the problems that still exist.
903 new water meters have been installed as of today. The meter company needs
the cooperation of those homeowners that they have been unable to gain access to
their homes to install the meters. We urge these residents to please contact the
meter company so that they may finish their job.
Sleepy Hollow is among the top ten recycling Westchester County municipalities.
Storm drain cleaning is now moving into the inner village.

DEIS scoping document. Notwithstanding the above, initial comments on the

Saccardi and Schiff, Inc. has reviewed the Kendal on Hudson (KOH) Draft
Environmental Impact Statement (DEIS) prepared by Divney Tung Schwalbe, LLP,
and dated March 23,2000, for consistency with the DEIS scoping document adopted
by the Village on November 9, 1999. The comments provided herein supplement
those contained in our April 11, 2000 memorandum.

" If vibration is expected to result in the operating areas, blasting will not be permitted
between the normal construction hours of 7:00 AM and 4:00 PM on weekdays." Indicate
when blasting will be permitted to occur.

Page III.C.9. Accidents were analyzed for the period beginning in January 1997 through
October 1999, which is less than three years. The analyses should be a three-year period;
either include the last quarter of 1999, or, if that information is not yet available, include the
accident data for the last quarter (October through December) of 1996.
Accident rates for intersections are typically calculated on the basis of Million Entering
Vehicles (MEV), not per Million Vehicle Miles (MVM). The accident rates should be
recalculated using the appropriate MEV values. (The Manual of Traffic Engineers Studies.
prepared by the Institute of Transportation Engineers, indicates that the total entering

terms one through five of the Accident Rate Analyses (Table 2 in the Traffic Appendix)
should be completed for all intersections, to document that the accident rate for an
intersection does not exceed the statewide accident rate.
The accident analyses do not include the accidents for roadway sections, typically calculated
on the basis of MVM. Accidents along the roadway sections should be identified and

revised to indicate that this is the Applicant's opinion. It is suggested that photographs of
other Hudson River hillside villages and residential structures which support the Applicant's
